GEORGIA PEACE OFFICER STANDARDS AND TRAINING COUNCIL Threadmill Complex August, Georgia December 6, 2011 11:00 AM MINUTES The regular meeting of the Georgia Peace Officer Standards and Training Council was held at the Threadmill Complex, in Austell, Georgia on December 6, 2011. Chairman Mike Yeager called the meeting to order at 11:00 AM. ROLL CALL OF COUNCIL MEMBERS: A calling of the roll by Vice-Chair, Bryan Golden indicated a quorum was present. Barry Woodward Opening Remarks of the Chairman: Chairman Mike Yeager welcomed everyone and thanked them for being present. Chairman Yeager, at this time called Chaplain Della Leyssius to perform the invocation. Chairman Yeager introduced the newest Council member, Tim Bearden with the Georgia Public Safety Training Center, and welcomed him to the board. Approval of the Minutes Chairman Mike Yeager entertained a motion to approve the minutes for the September 7, 2011 Full Council meeting and the called Council meeting on November 1, 2011. Sheriff Scott Berry made a motion to approve the minutes. Sgt. Dolly Johnson seconded the motion. All were in favor, and the motion carried. ANNOUNCEMENTS Executive Director Ken Vance greeted the Council members and guests. Director Vance discussed the budget situation and the work ethic of the POST staff. Director Vance stated that the new database is going well and there is a lot of positive feedback regarding the new system. At this time, Director Vance called forward Bill Kicklighter who is a former Council Member, to say a few words. Colonel Bill Hitchens was then called forward to receive a plaque for all of his years of service. Colonel Hitchens spoke about POST Council and the importance of the work POST does. Director Vance spoke about the job that POST does and the quality of the people employed at POST. P.O.S.T. OPERATIONS DIVISION Director Ryan Powell stated that he was presenting two issues to the Council and one update. Annual Academy Recertification Director Ryan Powell stated that this issue was presented at the Training Standards Committee and it was the recommendation to approve this request. Commissioner Bubba Williams made a motion to accept the recommendation of the Training Standards Committee and approve the request for the annual academy recertification. Sheriff Scott Berry seconded the motion. All were in favor, and the motion carried. Equivalency of Training Update Director Ryan Powell discussed the statistics of out of state officers and the certification exam to basic mandate students. The discussion in the Training Standards Committee lead to a decision to gather more data before consideration of a modification is made. 2

Harry C. McCann Application for Academy Director of the Georgia Piedmont Technical College Police Academy Director Ryan Powell stated that this issue was presented at the Training Standards Committee and it was the recommendation to approve this request. Sheriff Scott Berry made a motion to accept the recommendation of the Training Standards Committee and approve the request of Harry C. McCann s application for certification as academy director of the Georgia Piedmont Technical College Police Academy. Sgt. Dolly Johnson seconded the motion. All were in favor, and the motion carried. CERTIFICATION DIVISION AND TRAINING STANDARDS DIVISION 20 Hour Annual Training Requirement Waivers: Director Mitch Jones stated that this issue was presented to the Training Standards Committee and it was the recommendation to approve the following training waivers: Charles F. Hill- First Waiver 3 years or more Bob M. Graham-First Waiver 3 years or more Byron K. Kinder Second Waiver Wesley H. Cannon- Second Waiver Akeia R. Keith- First Waiver 3 years or more Sheriff Scott Berry made a motion to accept the recommendation of the Training Standards Committee and approve the waivers of Charles F. Hill; Bob M. Graham; Byron K. Kinder; Wesley H. Cannon and Akeia R. Keith. Sheriff Mike Jolley seconded the motion. All were in favor, and the motion carried. INVESTIGATIONS DIVISION Probable Cause Committee Recommendations For cases with the recommendation of: No Action Approve Probation Deny Certification Revoke Certification Revoke/Deny Certification Sgt. Dolly Johnson made the motion to accept the recommendations of the Probable Cause Committee. Director Michael Nail seconded the motion. All were in favor, and the motion carried. Probable Cause Committee Cases December 6, 2011 Director Pope stated that the Probable Cause Committee had reviewed the following cases. Case #0002341110 3

Sheriff Mike Jolley seconded the motion. All were in favor, and the motion carried. Case # 0007980411 Recommendation: Approve Certification Director Michael Nail made a motion to approve the recommendation of the Probable Cause Case # 0021510811 Sheriff Scott Berry made a motion to approve the recommendation of the Probable Cause Committee. Commissioner Bubba Williams seconded the motion. All were in favor, and the motion carried. Case # 0021720811 Recommendation: Deny & Revoke Certification Sgt. Dolly Johnson made a motion to approve the recommendation of the Probable Cause Committee. Commissioner Bubba Williams seconded the motion. All were in favor, and the motion carried. Case # 0068860208 Recommendation: Revoke Certification Chief Bryan Golden made a motion to approve the recommendation of the Probable Cause Case # 0089400810 Recommendation: Revoke Certification Sheriff Scott Berry made a motion to approve the recommendation of the Probable Cause Committee. Commissioner Bubba Williams seconded the motion. All were in favor, and the motion carried. PETITIONS FOR REINSTATEMENT/RECONSIDERATION Richard Lankford s petition will be tabled and discussed at a later date due to new information. Chief Bryan Golden made a recommendation to table the recommendation to deny the petition of Richard D. Lankford. Commissioner Bubba Williams seconded the motion. All were in favor and the motion carried. Recommendation to Deny Certification Anita Atwater Sedric D. Carithers Marcus Robinson Sheriff Scott Berry made a motion to accept the recommendation of the Certification Committee and deny the following petitioners: Anita Atwater; Sedric D. Carithers; and Marcus R. Robinson. Director Stan York seconded the motion. All were in favor, and the motion carried. 5

Recommendation to Approve Certification Marie C. Jensen Constantine Kassars. Jr. Robin A. Lupo Jamie E. Ricks Mr. Don Banks made a motion to accept the recommendation of the Certification Committee to approve the Certification of Marie C. Jensen; Constantine Kassars, Jr.; Robin A. Lupo and Jamie E. Ricks. Director Stan Cooper seconded the motion. All were in favor, and the motion carried. Recommendation to Approve with Conditions Jamena C. Brown Approve Certification with DHR approved anger management course. Director Stan York made a motion to accept the recommendation of the Certification Committee to approve with conditions for Jamena C. Brown. Mr. Don Banks seconded the motion. All were in favor, and the motion carried. ADMINISTRATIVE AND/OR EMERGENCY MATTERS Chairman Mike Yeager thanked everyone that was present and discussed how fast POST gets through the cases on the day of Council but stressed the importance of the Committees. Chairman Yeager discussed how much time and effort is spent by all involved and it would not be possible if it were not for the Committee process. Chairman Yeager announced the 2012 Council dates as being March 7, June 6, September 12 and December 5, 2012. Chairman Mike Yeager entertained a motion to adjourn. Sheriff Scott Berry made a motion to adjourn the meeting of the Georgia Peace Officer Standards and Training Council. Sgt. Dolly Johnson seconded the motion.
