STATEMENT OF MOST APPROPRIATE AUTHORITY This issue is governed by Local Criminal Rule 83.31(e). BACKGROUND The re-trial of the above-captioned matter is set for July 21, 2014. As it did during the original trial in this matter, the government intends to display exhibits to the jury by means of electronic evidence presentation software. The government 2

ARGUMENT Local Rule 83.31(e) provides: Laptop computers are permitted in federal court facilities, but may not be used in any courtroom without the written permission of the appropriate judicial officer. The government seeks permission to use laptop computers during trial for two reasons. First, the government s trial exhibits consist largely of court filings and other documents. The most effective manner of presenting these exhibits is by utilizing electronic courtroom presentation software, which, in turn, requires use of a laptop computer. Second, access to laptop computers will permit counsel to conduct legal research and bring relevant legal authority to the Court s attention if and when issues arise during trial. 3
