CONTRACT FOR DIRECTOR OF INSTRUCTION AND HUMAN RESOURCES Contract provisions as agreed upon by and between THE BOARD OF EDUCATION OF THE BRIARCLIFF MANOR UNION FREE SCHOOL DISTRICT, with offices located in Briarcliff Manor, New York, hereinafter referred to as the "District", and DUNCAN WILSON residing 21 Ridgecrest West, Scarsdale, New York 105 83 hereinafter referred to as the "Director" or "Mr. Wilson", made this 18 th day of June 2018. 1. The Board appoints Duncan Wilson as the Director of Instruction and Hurrian Resources of the Briarcliff Manor Union Free School District (the "District"), to serve as a probationary administrator in the tenure area of Director of Instruction and Human Resources, pursuant to the terms and conditions of employment as set forth in this Contract. 2. This Contract shall be effective the period of July 1, 2018 through June 30, 2022. During the term of this agreement or during the extension year hereof, if any, the Director may only be terminated from his employment upon his being provided due process consistent with the federal due process standards applicable to the employment of probationary public-school administrators who serve New York School Districts pursuant to a durational employment contract. Notwithstanding the above, the District may discontinue employment for cause or for no cause at the conclusion of each anniversary date of employment by a resolution acted upon by the Board, as recommended by the Superintendent of Schools during the thirty (30) day period preceding the anniversary date of employment. 3. By accepting employment pursuant to the terms set forth above, the Director acknowledges that any rights otherwise available to him pursuant to Sections 3012, 3019-a and 3031 of the New York State Education Law shall not apply with respect to service pursuant to this Agreement and the same are expressly waived.
4. Effective July 1, 2018, the Director shall be paid at the annual salary of Two Hundred Twenty-Five Thousand ($225,000) Dollars through June 30, 2019; if employment is continued from year to year within the time of probationary service, the Director's annual salary shall be increased by 2.0% for each such subsequent year of employment. 5. The Director shall be paid in equal installments in accordance with the rules of the Board governing payment of other professional staff members of the District. 6. The Director agrees that prior to terminating employment with the District he shall give the District at least ninety (90) calendar days' notice. 7. The Director shall be entitled to twenty-two (22) work days of vacation annually, subject to the prior approval of such use by the Superintendent of Schools. Each school year the Director may roll-over up to five (5) vacation days at the end of each school year that may be used in the following year or be extinguished. 8. Effective July 1, 2018, the Director shall be credited with a bank of thirty (30) accumulated sick leave days. The Director shall also be entitled to fifteen (15) sick leave days each year and may accumulate unused sick leave from year to year, to a maximum of two hundred (200) days, for use only. Up to five (5) days sick leave may be used in case of the illness of a member of the Director's imm ediate family, defined as parent, child, spouse, and such other person as approved by the Superintendent. 9. The Director shall be entitled to five (5) personal days per year for urgent personal business matters which cannot be attended to during other than work hours, upon notification to the Superintendent. Unused personal days shall not be cumulative. 2
10. The Director shall be granted up to five (5) days of bereavement leave due to the death of a member of the Director's immediate family, defined as parent, child, spouse, and such other person as approved by the Superintendent. Such leave shall not be cumulative. 11. The Director shall be entitled to 80% of District funded individual or family health insurance, at the Director's option, in the District's plan, with the Director contributing 20% towards the cost of such health insurance premiums. 12. The Director shall be vested for the purposes of eligibility for retiree health insurance (individual or family coverage as needed) through the District after five ( 5) years of District administrative service. District funding of premium costs shall be at the same percentage that was in effect during the final year of employment in the District. Retiree health insurance shall only be available upon the Director retiring from the District to receive benefits from the New York State Teachers' Retirement System. 13. The Director shall be entitled to 100% District funded individual or family dental msurance. 14. The District will provide the Director with term life insurance in the face amount of $100,000. 15. The District will provide the Director with long-term disability insurance in the District's Group Long-Term Disability Plan, providing a two-thirds salary benefit with a 60-day waiting period.: 16. The Director shall be entitled to participate in the District's Section 125 Internal Revenue Code Flexible Benefits Plan. 17. The Director may have monies withheld for the purpose of participating in a tax deferred annuity program of his choosing, as provided for by State law. 3
18. The District shall contribute the sum of Five Thousand ($5,000) Dollars per year to the Section 403(b) Internal Revenue Code Tax Sheltered Annuity Account of the Director a non-elective direct employer contribution, without cash option. 19. The Director may attend appropriate professional meetings at the local, state and national levels as approved by the Superintendent. Expenses of said attendance shall be incurred by the District within budgetary appropriations. The Director shall file an itemized expense statement regarding all conference expenses which shall be subject to audit. 20. During the term of this Agreement, the District will make available annually, the sum of Five Thousand Dollars ($5,000) to be applied for advanced graduate course work conducted by the Director as approved in advance by the Superintendent of Schools. 21. Upon successful defense of his doctoral dissertation and completion of his doctoral program at Columbia University's Teacher's College, Mr. Wilson's title will be elevated from Director of Instruction and Human Resourses to that of Assistant Superintendent for Instruction and Human Resources. The elevation of Mr. Wilson's title shall take place on July l8 1 of the year following conferral of the doctoral degree. All other provisions of this agreement will remain in force. It is understood by the parties that service as Assistant Superintendent for Instruction and Human Resources would be in the orginal tenure area of employment designated by the Board of Education and will not require any change in the length of the probationery period. 22. The Board shall pay the annual dues of membership of the Director in four ( 4) professional organizations selected by the Director. 23. The Director shall furnish throughout the life of this Contract, a valid and appropriate certificate to serve as a Director of Instruction and Human Resources. The Director hereby agrees to devote his time, skill, labor and attention to said employment during the term of this appointment. 4
24. In the event any portion of this Contract shall be declared illegal and unenforceable, the balance of this contract shall remain viable and binding upon the parties. 25. This Contract shall be construed in accordance with the laws of the State of New York. 26. The Director shall be entitled to the rights afforded by Public Officers Law Section 18 for indemnification and a legal defense when named as a defendant or respondent in a lawsuit or other legal proceeding.
