Purpose: To provide Council with information regarding the legislated and District of Squamish process with respect to Bylaw No. 1984, 2007 for the Public Hearing on January 15, 2008. 2. Background: On December 18 th, 2007 Council gave first two readings to Bylaw No. 1984, 2007 and scheduled a Public Hearing for January 15 th, 2008. Third reading for the bylaw is also on the January 15 th, 2008 Council agenda for consideration. 3. Project Information: The District of Squamish policy and process, as well as the requirements of provincial legislation have been met with respect to this rezoning application. Bylaw No. 1984, 2007 is included as Attachment 1. Notice of Public Hearing was published in two consecutive issues of the Squamish Chief newspaper, namely January 4, 2008 and January 11 th, 2008, pursuant to section 892 of the Local Government Act. Four (4) Notices of Public Hearing were also sent to all owners/tenants in occupation of property within 100 metres of the subject site for the proposed rezoning. The Technical Planning Committee discussed the rezoning application and staff has addressed issues related to the application. The applicant held a Public Information Meeting regarding the application on March 12 th, 2007. No written comments have been received. 4. Written Comments received: No written comments to date. DISTRICT OF SQUAMISH BYLAW NO. 1984, 2007. A bylaw to amend the District of Squamish Zoning Bylaw No. 1342,1995. WHEREAS the District of Squamish deems it necessary and appropriate to amend Zoning Bylaw No. 1342, 1995; NOW THEREFORE the Council of the District of Squamish, in open meeting assembled, enacts as follows: 1. This bylaw may be cited as "District of Squamish Zoning Bylaw No. 1342, 1995, Amendment Bylaw (Comprehensive Development No. 51 1150 Bailey Street) No. 1984, 2007" 2. District of Squamish Zoning Bylaw No. 1342, 1995 is amended as follows: Lot 3, Block R, District Lot 4261, Plan 12458 and located at 1150 Bailey Street, be rezoned from Industrial General (I-3) to Comprehensive Development Zone Fifty One (CD- 51). 3. That the following be added after Section 14TT: SECTION 14TT COMPREHENSIVE DEVELOPMENT ZONE FIFTY ONE (CD-51) 14TT.1 Permitted Uses (a) (b) 65 apartment style residential dwelling units Accessory uses; 14TT.2 Height of Principal Buildings No principal building shall exceed a height of 15.25 meters (50 ft). 14TT.3 Lot Coverage The lot coverage shall not exceed 37% of the total lot area. 14TT.4 Lot Area The minimum lot area of parcels in the CD-51 zone is 0.42 hectares (1.05 acres).
14TT.5 Buildings per Parcel There may be only one principal building per lot. 14TT.6 Siting requirements of Principal Building (a) Front (North) Lot Line Setback: The front lot line setback is 6.10 metres (20 feet); (b) Side (East ) Lot Line Setback: The east side Lot line setback is 4.57 metres (15 feet); (c) West Side Lot Line Setback: The west side Lot line setback is 3.0 metres (10 feet); (d) Rear (South) Lot Line Setback: The south rear line setback is 3.0 metres (10 feet). 14TT.6.1 Projections into Setbacks (a) Canopies, decks, and roof overhangs, are permitted to project into the setback areas, subject to Section 4.11. 14TT.7 Fencing Fencing shall be provided in accordance with Section 4.6 of District of Squamish Zoning Bylaw No. 1342, 1995. 14TT.8 Off-Street Parking 1.5 off-street parking stalls per residential unit are required (including visitor and accessible stalls). 14TT.9 Accessory Buildings All accessory buildings shall comply with the requirements of Section 4.4 of District of Squamish Zoning Bylaw No. 1342, 1995. 14TT.10 Screening and Landscaping Screening and Landscaping shall be provided in accordance with Section 4.7 of District of Squamish Zoning Bylaw No. 1342, 1995; 4. By amending the zoning map, being Schedule "A" to the District of Squamish Zoning Bylaw No. 1342, 1995 to reflect the rezoning.
