RESOLUTION NO. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PLANT CITY, FLORIDA CALLING FOR A COMMUNITY MEETING AND PUBLIC HEARINGS ON THE PROPOSED DESIGNATION OF A BROWNFIELD AREA FOR REHABILITATION AND ECONOMIC REDEVELOPMENT PURSUANT TO CHAPTER 376 FLORIDA STATUTES. WHEREAS, Section 376.80, Florida Statutes, sets forth specific public hearing and publication requirements for the adoption of resolutions designating a brownfield area for rehabilitation; and Whereas, the City Commission for the City of Plant City, is considering the designation of the property generally located North of Merrick Street, East of Walker Street, South of CSX Railroad and West of Canal running North and South of Alsobrook Street to/and inclusive of CSX railroad, consisting of 83.59 acres as depicted by the map attached hereto, as a Brownfield area for site rehabilitation for the purposes of Sections 376.77 376.85, Florida Statutes. Whereas, at the City Commission meeting on this date, the City Commission has announced the following community meeting and public hearings; now, therefore BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF PLANT CITY, FLORIDA, THAT: Section 1. The City Commission proposes to adopt the following resolution designating a Brownfield area pursuant to Chapter 376, Florida Statutes, the Brownfields Redevelopment Act: A RESOLUTION OF THE CITY COMMISSION OF THE ClTY OF PLANT CITY, FLORIDA DESIGNATING A BROWNFIELD AREA TO BE CALLED MIDTOWN BROWNFIELD AREA WITHIN THE CITY FOR PROPERTY GENERALLY LOCATED NORTH OF MERRICK STREET, EAST OF WALKER STREET, SOUTH OF CSX RAILROAD, AND WEST OF CANAL RUNNING NORTH AND SOUTH OF ALSOBROOK STREET TO/AND INCLUSIVE OF CSX RAILROAD, CONSISTING OF APPROXIMATELY 83.59 ACRES FOR THE PURPOSE OF ENVIRONMENTAL SITE REHABILITATION AND ECONOMIC REDEVELOPMENT; AND PROVIDING FOR AN EFFECTIVE DATE. Section 2. The City will hold an advertised community meeting in order to provide an opportunity for public input on the size of the brownfield area, the objectives for rehabilitation, job opportunities and economic developments anticipated, neighborhood residents considerations, other relevant local concerns and any and all matters pertinent to the

proposed resolution. The community meeting shall be held in the Mary Noel Moody Community Room at the Bruton Memorial Library, 302 West McLendon Street, Plant City, Florida, on October 26, 2010 at 6:00 p.m. Section 3. The City Commission will hold two advertised public hearings on the proposed resolution. At the public hearings, interested parties and citizens may appear and be heard as to any and all matters pertinent to a proposed resolution designating a brownfield area for rehabilitation and redevelopment. Section 4. The first public hearing shall be held in the Sadye Gibbs Martin Auditorium of the Nettie Berry Draughon Municipal Building (City Hall), 302 West Reynolds Street, Plant City, Florida, on November 8, 2010 at 7:30 p.m., or as soon thereafter as the matter may be heard, in order to provide an opportunity for public input on the size of the area, the objectives for rehabilitation, job opportunities and economic developments anticipated, neighborhood residents considerations, other relevant local concerns and any and all matters pertinent to the proposed resolution. Section 5. The second public hearing will be held in the Sadye Gibbs Martin Auditorium of the Nettie Berry Draughon Municipal Building (City Hall), 302 West Reynolds Street, Plant City, Florida, on November 22, 2010 at 7:30 p.m., or as soon thereafter as the matter may be heard, in order to provide an opportunity for public input on the size of the area, the objectives for rehabilitation, job opportunities and economic developments anticipated, neighborhood residents considerations, other relevant local concerns and any and all matters pertinent to the proposed resolution. Section 6. All persons are advised that if a person decides to appeal any decision made by the City Commission with respect to any matter considered at such meeting, he will need a record of the proceedings, and for such purpose he may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

Section 7. In accordance with the Americans with Disabilities Act, any person with a disability requiring reasonable accommodation in order to participate in this meeting should call the City Clerk at (813) 659-4200 at least 48 hours prior to the public hearing. Section 8. The proposed resolution may be inspected by the public at the offices of the City Clerk at the Nettie Berry Draughon Municipal Building, 302 West Reynolds Street, Plant City, Florida. Section 9. The City Clerk is hereby directed to publish notice regarding said community meeting and public hearings in the Tampa Tribune. The required advertisements shall be at least 16 square inches in size, no less than 2 columns wide by 10 inches long with a headline in the advertisements no smaller than 18 point and shall be in accordance with Section 166.041(3)(c)(2), Florida Statutes. The advertisement shall not be placed in that portion of the newspaper where legal notices and classified advertisements appear. The advertisement for the community meeting shall be published at least seven (7) days prior to said community meeting. The advertisement for the first public hearing shall be published at least seven (7) days prior to said hearing. The advertisement for the second public hearing shall be published at least five (5) days prior to the second hearing. Section 10. In accordance with Section 376.80, Florida Statutes, the notice shall further be published in the Florida Sentinel Bulletin and La Gaceta at least seven (7) days prior to the community meeting. Such notice shall be at least 16 square inches in size. Section 11. The City Manager, or his designee, shall post a sign or signs in the area proposed for designation as a brownfield area informing the public of the proposed action, indicating the date, time and place of the community meeting and public hearings and informing the public where additional information may be obtained. Said signs shall be posted no later than seven (7) days prior to the community meeting. Section 12. This resolution shall be effective immediately upon passage.
