Appropriation. Notwithstanding any other provision oflaw, the 3 sum of Two Million Three Hundred Thousand Dollars ($2,300,000) from the Fiscal
1 Year 2015 Hotel Occupancy Tax Surplus Fund is appropriated to the Guam Visitors 2 Bureau for safety related capital improvement projects in Tumon and the hosting of 3 the Festival of Pacific Arts. This appropriation shall not lapse and shall remain 4 available for the purposes identified herein until fully expended follows: 5 (1) The programming and hosting of the Festival of Pacific Arts, for 6 a sum of up to One Million Three Hundred Thousand Dollars ($1,300,000); 7 (2) Safety related capital improvements projects in Tumon, not to 8 exceed the amount of One Million Dollars ($1,000,000) for the following: 9 a. Improvement of crosswalk safety at the Marine Corps 10 Drive and JFK Hill Intersection; 11 b. The improvement of the streetlight system from JFK Hill 12 Intersection to Pale San Vitores Road; 13 c. The improvement of the streetlight system along Pale San 14 Vitores Road; 15 d. Upgrade of crosswalk signs along Pale San Vitores Road, 16 17 JFK Hill, Chalan San Antonio, and Governor Carlos Camacho Road; and 18 e. Improvement of sidewalk safety on Pale San Vitores Road 19 to include, but not limited to, the replacement of dilapidated handrails 20 and the installation of bollards along San Vi tores Road. 21 Section 2. Appropriation. Notwithstanding any other provision oflaw, the 22 amount not to exceed One Million Three Hundred Thirty-Seven Thousand Dollars 23 ($1,337,000) is hereby appropriated from revenues collected in excess of the FY16 24 Tourist Attraction Fund (TAF) adopted revenues to the Guam Police Department, 25 the Department of Public Works, and the Guam Fire Department to provide 26 increased security measures for the welfare of the community and visitors during the 27 12th Festival of the Pacific Arts as follows: 2
1 (1) The sum of Five Hundred Forty-Two Thousand ($542,000) to 2 the Guam Police Department; 3 (2) The sum of Six Hundred Five Thousand Dollars ($605,000) to 4 the Department of Public Works; and 5 (3) The sum of One Hundred Ninety Thousand Dollars ($190,000) 6 to the Guam Fire Department. 7 These departments are authorized to use any of its FY16 appropriations for 8 such purposes and such appropriations shall be reimbursed upon collection of the 9 excess T AF revenues. 10 Section 3. Severability. If any provisions of this Act or its application 11 thereof to any person or circumstance, is held invalid, invalidity shall not affect any 12 other provision or application of this Act that can be given effect without the invalid 13 provision or application, and to this end the provisions of this Act are severable. 3
