Medical certificate not older than 90 days, indicating that the alien does not suffer from a disease presenting a threat to BiH public health (original or certified copy). Authorized health institutions for medical examinations: Preventiva Medical health institution, Dr Marjanović health house, Mediccare health institution, Institute of Occupational and Sports Medicine, Health Center, Euromedic, Deamedica, Intermedic and other health institutions able to perform the required examinations, 10. Certificate that there are no ongoing criminal proceedings against the alien, and certificate that the alien has not been convicted of a crime, issued by the competent body of the country of alien s usual place of residence (original or certified copy), not older than six months. This evidence need not be filed for minors under 14 years of age, 11. Evidence of no ongoing criminal proceedings issued by the competent court of BiH at the latest six months before filing of the application, and certificate of no conviction issued by the RS MoI (Banja Luka or Prijedor Public Security Center), not older than six months (this evidence is only required if the alien is applying for temporary residence renewal), 12. Excerpt from court register on company registration (original or certified copy), 13. Certificate issued by the Tax Administration on settled tax liabilities in BiH, not older than 90 days, for a company founded or cofounded by an alien applying for temporary residence approval, 14. Certificate issued by the Indirect Taxation Authority on settled indirect tax liabilities, not older than 90 days, for a company founded or cofounded by an alien applying for temporary residence approval. All foreign documents must be translated to one of the languages in official use in BiH. IMPORTANT NOTES concerning the Law on Aliens (Official Gazette of BiH 88/15) and Rulebook on Entry and Stay of Aliens Article 36 of the Rulebook - Work on the Grounds of Work Permit - An alien requesting approval of temporary residence in BiH for the purpose of work may exercise the right to temporary residence if, in addition to fulfilling the general requirements for entry set forth by the Law and this Rulebook, they entered BiH with a previously issued work permit or other equivalent. An alien not holding a work permit when entering BiH from a country with visa-free regime for BiH, must obtain work permit, leave the territory of Bosnia and Herzegovina, reenter BiH with the work permit, register residence within 48 hours and attach to the application all documentation set forth by Article 64 of the above Rulebook. Article 67 of the Law - Link between Temporary Residence Approval and Work Permit (1) An alien may not start working in BiH on the grounds of a work permit before being approved temporary residence, unless otherwise provided under this Law. (2) An alien may work in BiH only on the grounds of the work permit used for the approval of their temporary residence. An alien with the work permit may work in BiH only on the specific post or specific tasks for which they were issued the work permit that subsequently served as grounds for the approval of their temporary residence in BiH. (3) Temporary residence on the grounds of a work permit shall be approved for the period covering validity of the work permit plus 30 additional days, but not longer than a year, and may be renewed under the same conditions as those applied to residence approval. Temporary residence approval shall cease to be valid 30 days upon expiry of the work permit. (4) Alien s temporary residence in BiH approved on the grounds of the issued work permit shall not cease if, in the course of the approved temporary residence in BiH, they change position within the same legal entity and file a new work permit with the Service within the deadline provided under paragraph (3) of this Article. (5) Alien s temporary residence in BiH approved on the grounds of the issued work permit shall not cease if, in the course of the approved temporary residence in BiH, they change employer and file a new work permit or evidence of initiated procedure for new permit issuance with the Service within the deadline provided under paragraph (3) of this Article. (6) An alien who entered BiH without prior obtaining of a work permit may not be approved temporary residence on the grounds of work permit during their stay in BiH. I - DEADLINES FOR APPLICATION FILING FOR: 1. Temporary residence approval: Article 82, paragraph 4 of the Law: Application for temporary residence approval shall be filed at the latest 15 days prior to expiry of a long-term stay visa (D Visa) or visa-free stay. 2. Renewal of temporary residence approval: Article 82, paragraph 5 of the Law: Application for temporary residence renewal shall be filed within BiH, directly with the competent organizational unit of the Service, or abroad, through BiH DCR. The application shall be filed at the earliest 60 days and at the latest 15 days prior to expiry of the period of approved residence. II - CONDITIONS FOR RENEWAL OF TEMPORARY RESIDENCE APPROVAL: Article 48, paragraph 5 of the Law: Renewal of temporary residence may be approved upon alien s request, but solely on the grounds applied to approval of the temporary residence the renewal of which is now requested. For a company or enterprise headquartered in BiH, founded or cofounded by an alien applying for temporary residence approval, evidence/certificate issued by the Tax Administration on settled tax liabilities and by the Indirect Taxation Authority on settled indirect tax liabilities for the company or enterprise, not older than 90 days, 14. Decision on entry of legal entity into court register. All foreign documents must be translated to one of the languages in official use in BiH. Evidence of possession of means of subsistence in accordance with Article 23 of the Law on Aliens (original or certified copy of the certificate) as follows: a) Possession of cash in the national or a foreign convertible currency to be proved by: certificate or another document issued by a bank on bank account balance, cheque or another evidence of the level of pension, work permit, certificate issued by the employer of the level of personal income generated by employment, work contract which indicates the level of income, evidence of receipt and level of scholarship, or another evidence, b) Possession of any form of non-cash payment means recognized by the banking system of BiH or means enabling withdrawal of money in BiH, or a guarantee of a bank from BiH which accepts the non-cash payment means possessed by the alien, c) Invitation letter referred to in Article 32 (Letter of Invitation) of this Law, d) Possession of other assets, such as real estate in BiH based on which it is possible to secure the means of subsistence during the stay in BiH, funds generated by direct foreign investments, manufacturing technical cooperation and collaboration, etc., e) Certificate that there are no ongoing criminal proceedings against the alien, and certificate that the alien has not been convicted of a crime, issued by the competent body of the country of alien s usual place of residence (original or certified copy), not older than six months. This evidence need not be filed for minors under 14 years of age, f) Evidence of no ongoing criminal proceedings issued by the competent court of BiH at the latest six months before filing of the application, and certificate of no conviction issued by the RS MoI (Banja Luka or Prijedor Public Security Center), not older than six months (this evidence is only required if the alien is applying for temporary residence renewal), g) Evidence of provided health insurance in BiH (health insurance policy, copy of health card, evidence of registration with the Health Fund, evidence of paid individual or collective travel health insurance), h) Evidence of higher education qualification, i) Evidence of at least five years of professional experience acquired after completing the formal higher education, j) Work contract or another relevant contract on highly qualified employment during at least one year, provided that the contract must indicate the gross annual income not lesser than 1.5 the average gross annual income in BiH as published in the official data by the authority responsible for statistics in BiH, k) Temporary residence for the purpose of highly qualified employment may be granted to an alien if: a) employer intending to employ the alien had advertised the vacancy before the alien filed the application for residence for the purpose of highly qualified employment, b) employer has advertised the vacancy in at least three daily newspapers available on the entire territory of BiH with the application deadline of 30 days, and simultaneously submitted it to the BiH Agency for Labour and Employment, which made this vacancy available to all employment institutions in BiH,

c) no BiH citizen applying for the advertised vacancy met the requirements for the post, d) vacant post requires higher education qualification and at least five years of professional experience acquired after completing the formal higher education. The Blue Card allows the alien to enter and stay in BiH during the period of its validity. Temporary residence referred to in paragraph (1) of this Article shall be approved by the issued BiH residence permit called the Blue Card. Issued Blue Card shall be valid for a period of two years. If the work contract or other relevant contract is concluded for a period shorter than two years, the Blue Card shall be issued for the period of duration of that contract plus additional three months, though its validity may not exceed two years. The Blue Card may be renewed under the same conditions as those applied to its initial issuance. Employer shall file the application for Blue Card issuance with the Service. If abroad, the application shall be filed with the Service through BiH DCR, and if in BiH territory, it shall be filed with the organizational unit of the Service territorially competent for the seat of the employer. IMPORTANT NOTES concerning the Law on Aliens (Official Gazette of BiH 88/15) (Blue Card Employment and Change of Employer) (1) An alien issued a BiH Blue Card may be engaged only on those tasks for which the card was issued, and only with the employer with whom they had concluded work contract or other relevant contract. (2) In the event of termination of the work contract or other relevant contract or termination of conditions under which the Blue Card was issued, both employer and the alien shall notify the Service thereof within eight days from the occurrence of such circumstances. (3) Upon expiry of two years, a Blue Card holder may change their employer though they must inform the Service thereof within eight days and file a new work contract or other relevant contract signed with the new employer. The new Blue Card shall be issued under the conditions referred to in Article 72 (Temporary Residence for the Purpose of Highly Qualified Employment) and Article 73 (Issuance of the Blue Card) of this Law. (4) Notwithstanding paragraph (3) of this Article, an alien may change employer under the conditions referred to in Article 72 (Temporary Residence for the Purpose of Highly Qualified Employment), paragraph (1) of this Article even before the expiration of Blue Card validity and must notify the Service thereof within eight days from the day of such change and file a new work contract or other relevant contract with the new employer. (5) In the event that the work contract or other relevant contract is terminated prior to expiry of the contracted period, the Blue Card shall be valid for three months following the termination of the contract or shorter if the Blue Card is valid for less than three months. Medical certificate not older than 90 days, indicating that the alien does not suffer from a disease presenting a threat to BiH public health (original or certified copy). For managers and experts, certificate issued by the employer of employment within the same legal entity or group of legal entities for an uninterrupted period of at least 12 months immediately preceding the date of redeployment within the legal entity, 11. For interns, certificate issued by the employer of employment within the same legal entity or group of legal entities for an uninterrupted period of at least six months immediately preceding the date of redeployment within the legal entity, 12. Work contract, 13. Certificate issued by the employer indicating the address of the legal entity, duration of the deployment, alien s future position of a manager, expert or intern, salary and other terms of employment, possibility for the alien to be transferred back to the legal entity that belongs to the same legal entity or group of legal entities in a foreign country upon completion of their deployment, 14.
