18-13. Front Set-Back for Parking. Application #18-02 Chairwoman Corbett opened the public hearing at 7:32 p.m. to hear comment, if any, on application #18-02 Motion by Ms. Holder, Seconded by Ms. Kehoe WHEREAS, an application has been filed by A. William Golling III, the Petitioner, 2405 S. Telegraph Road, Bloomfield Hills, MI 48302 is requesting a variance from Section 10.401(i) Schedule of District Regulations of the Madison Heights Zoning Ordinance to allow a new parking lot to be built within the required front yard setback in the M-1 District. A 22 variance is requested to allow said parking lot to come within 10 of the north front property line where a 32 parking setback is required; and WHEREAS, a notice of public hearing was published in the Madison Park News on May 23, 2018 and 59 notices were mailed to property owners within 500 feet of the aforementioned property; and WHEREAS, a report has been received from the Community Development Department stating that: RELEVANT INFORMATION 1. The applicant is the prospective property owner. 2. The existing use of the property is a parking lot associated with the Shannon Precision facility. The parking area that is being utilized for the proposed KIA dealership is in excess of the required parking for Shannon Precision and is therefore available for re-use. 3. Applicant proposes to split the subject parcel from Shannon Precision and create a separate parcel for the KIA dealership in accordance with the attached site plan. 4. City Council approved a special approval request for this project at their May 14, 2018 meeting subject to: ZBA approval of this variance request; administrative land division; reciprocal cross access easement agreement for the proposed access drive between the two properties; and that there be no bump & paint repair work performed on the site. 5. The existing parking lot is non-conforming, with parking spaces coming to within 5 of the front (north) property line. Normally, a 50 setback is required in the M-1 District and parking is prohibited within that setback area. However, the Zoning 2 06-07-18 ZBA Minutes
Ordinance does allow an averaging of front setbacks where existing buildings are closer to the road. Using this method, the required setback is 32. Applicant proposes a new parking lot to come within 10 of the front property line. This is twice the current 5 greenbelt area, but does require a variance as it is new development, and therefore must conform to current setback standards unless a variance is granted. Applicant seeks such relief through this variance request. PREVIOUS ACTIONS None. SITE PLAN COMMITTEE ACTION The Site Plan Committee has reviewed this request. The Committee has no objection to the request, noting that the proposed greenbelt is twice the width of the existing greenbelt and contains all of the required plantings per the landscaping section of the Zoning Ordinance. WHEREAS, a public hearing was held this date and A. William Golling, III, 2991 Voorheis Lake Ct, Lake Orion, MI, the Petitioner, was present and stated that this variance will allow the property to be consistent with the neighboring business and also allows for better operating procedure and a maximize the visibility of the vehicles. There being no further comments, the public hearing was closed. NOW, THEREFORE, BE IT RESOLVED, that the Madison Heights Zoning Board of Appeals approves a variance from Section 10.401(i) Schedule of District Regulations of the Madison Heights Zoning Ordinance to allow a new parking lot to be built within the required front yard setback in the M-1 District. A 22 variance is requested to allow said parking lot to come within 10 of the north front property line where a 32 parking setback is required, as this will allow the property to be consistent with area and adjacent business as well, the economic viability of the business, maximize visibility of the vehicles and subject to a condition that the service bays be utilized to park vehicles awaiting service overnight.
