CALL TO ORDER Mayor Drew called the meeting to order at 7:30 pm. 2. APPROVAL OF THE AGENDA 2.1 Regular Council Meeting, September 19, 2016 That the Agenda for the September 19, 2016 Regular Council Meeting, be amended by adding: Item 8.26 Don Reid, 154 Turtlehead Road, dated September 19, 2016, regarding Belcarra Zoning Bylaws. 4. 4.1 DELEGATIONS AND PRESENTATIONS Kim Alfreds, 4593 Belcarra Bay Road, regarding Zoning Bylaw Amendment No. 502. Kim Alfreds spoke regarding the limitations of Proposed Bylaw 502, 2016 and the creation of non-conforming residences. He noted that, better understanding is needed of the size of current residences. It was suggested that Council consider establishing a committee to discuss floor area ratio. Considerable discussion ensued regarding the proposed floor area ratio. That the correspondence from Kim Alfreds, 4593 Belcarra Bay Road, dated September 13, 2016, be received, and That Mr. Alfreds be thanked for the information provided. 4.2 Dale Bellavance, Consultant for Brian Kask Jr., regarding Building Permit Application #607-16. Dale Bellavance advised that he is a consultant acting on behalf of Brian Kask, Jr. He spoke regarding the building permit application process and noted that his client was unaware of proposed Bylaw 502, 2016 until June, 2016. He requested that Council consider the building permit application. Considerable discussion ensued. That the information dated September 14, 2016, from Dale Bellavance, Consultant, regarding Building Permit Application 607-16 be received, and That Mr. Bellavance be thanked for his presentation. 5. REPORTS 5.1 Lorna Dysart, Chief Administrative Officer, verbal report dated September 19, 2016, regarding reschedule Regular Council Meeting from October 11, 2016 to October 12, 2016. That Council reschedule the Regular Council Meeting from October 11, 2016 to October 12, 2016. 5.2 Lorna Dysart, Chief Administrative Officer, report dated September 19, 2016 regarding, Waste and Recycle Depot (WARD) Refundables Revenue. Lorna Dysart outlined the report and noted refundables revenue received from the Waste and Recycle Depot for the first 8 months of 2016 is $3,623.90. REGULAR COUNCIL MINUTES September 19 1 2016 Considerable discussion ensued regarding various aspects of the Ward and Recycling Depot refundables revenue. Dave Warren, 4925 Robson Road, President of CRAB, outlined the history of CRAB receiving the Waster and Recycle Depot refundable revenues. He noted that CRAB received $4,000 in 2015 from refundables. Larry Scott, Superintendent of Public Works/Building Inspector, advised of the transition and operation of Waste and Recycle Depot since January, 2016. That Council allocate the Waste and Recycle Depot (WARD) refundables revenue for the first 8 months of 2016 in the amount of $3,623.90 to the Community Recreation Association of Belcarra (CRAB) in support of community events; and That Council and CRAB meet to discuss refundable revenues. 5.3 Larry G. Scott, Superintendent Public Works/ Building Official, report dated September 19, 2016, Building Permit Application 609/16 - Hamber Island Floor Area Ratio exceeding Zoning Amendment Bylaw 502, 2016 - First Reading Whereas: (a) Section 463 of the Local Government Act authorizes a local government to withhold a building permit application if it identifies what it considers to be a conflict between a development proposed in the application and a zoning bylaw that is under preparation; and (b) The Council of the Village of Belcarra (the "Council") has identified what it considers to be a conflict between the development proposed in Building Permit Application No. 609/16, made on August 23, 2016 (the "Application"), and Zoning Amendment Bylaw No. 502, given first reading on June 27, 2016 (the "Bylaw"); and (c) The conflict Council has identified is that the size of the house proposed in the Application is 948.10 square meters, and the Maximum Floor Area Cap of a house allowed on the property under the Bylaw is 697 square meters a difference of 251.0 square meters greater than what is proposed in the Zoning Bylaw Amendment. Therefore Council consider the following resolutions: (a) That the building permit that is the subject of Building Permit Application 609/16 be withheld for a period of 30 days, beginning on August 23, 2016, the date of acceptance of Building Permit Application 609/16. Following the resolution to withhold Building Permit Application 609/16 for 30 days, the applicant was invited to comment on the resolution to withhold Building Permit Application 609/16 for a further 60 days. (b) That, after due consideration of the conflict between First Reading of the Zoning Amendment Bylaw 502 and the Building Permit Application that is the subject of Application 609/16, the Building Official is directed to withhold Building Permit 609/16 for a further 60 days beginning 30 days after August 23, 2016, the date of acceptance of the Building Permit Application. 6. REPORTS FROM MAYOR AND PROJECT LEADS 6.1 Mayor's Report - New Spill Response Base Planned for Burrard Inlet Mayor Drew presented his report regarding Construction of the New Spill Response Base, essential to spills. 7. Suggested forming a team to assist Jo Ledingham with roadway clean up. RESOLUTION TO CLOSE MEETING That the September 19, 2016 Regular meeting of Council be closed pursuant to the Community Charter Section 90 (1 )(c) "a part of a Council meeting may be closed to the public if the subject matter being considered relates to or is one or more of the following:" (g) litigation or potential litigation affecting the municipality; (k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the council, could reasonably be expected to harm the interests of the municipality if they were to be held in public. 12. ADJOURNMENT That the September 19, 2016 Regular Council Meeting be adjourned at 8:57 pm.
