Taxicab Parking Area ACTION REQUIRED: Modify ordinance to increase the number of taxicabs allowed in the airport loading area from 9 to 11 and add a provision that enables the airport management to provide will call spaces. RECOMMENDATION: Staff recommends Council adopt the proposed changes to the ordinance as proposed to increase the number of taxicabs allowed in the airport loading area from 9 to 11 and add a provision that enables the airport management to provide will call spaces. FISCAL IMPACT/BUDGET IMPLICATIONS: None. BACKGROUND: The current language in the ordinance restricts the number of taxicabs in the airport ground transportation lane to a maximum of 9. This is a carryover from when we were in the old terminal facility as the taxi lane only had 9 spaces. The current lane has adequate space for 11 taxis in the designated area plus we have added 2 will-call spaces to accommodate travelers who have made advance reservations with a cab company. The modifications requested will make the number of spaces physically available and the City ordinance which governs airport taxi operations so they are consistent. ATTACHMENTS: None

BY THE COUNCIL: BISTERFELDT, CLEGG, EBERLE, JORDAN, SHEALY AND TIBBS AN ORDINANCE AMENDING TITLE 12, CHAPTER 19, SECTION 10, BOISE CITY CODE TO: ADD TWO SPACES TO THE EXISTING TAXICAB PARKING AREA OPERATION AT THE BOISE AIRPORT (DEPARTMENT OF AVIATION); PROVIDE THE AIRPORT DIRECTOR WITH FLEXIBILITY TO DESIGNATE OR REMOVE PASSENGER LOADING AREAS, BY DESIGNATION OR BY AIRPORT RULES AND REGULATIONS; PROVIDE THAT TAXI WILL-CALL SPACES MAY BE PROVIDED AT THE SOLE DISCRETION OF THE AIRPORT DIRECTOR; APPROVING A SUMMARY OF THE ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO: Section 1. That Title 12, Chapter 19, Section 10, Boise City Code, be, and the same is hereby amended to read as follows:. Section 12-19-10 TAXICAB OPERATION A. Quality of Service: Taxicab companies shall at a minimum operate their taxicabs, while on the Boise Air Terminal, in a manner consistent with Boise City Code Title 5, Chapter 24. The Airport Director shall have the right to call to the attention of a company or a driver any violation of the rules and regulations required to be observed under Section 12-19-8. B. Right to Accept Passengers: No taxicab shall accept passengers at the Boise Air Terminal unless it shall: 1. Proceed to the taxicab loading area. 2. Pay the fee for use of the taxicab loading area established under Section 12-19-05. 3. Be in the proper position in the taxicab loading area according to the rotation of taxicabs based upon the order of arrival, except that passengers may be accepted other than in the proper rotation if by passenger direction or choice. C. Taxicab Parking Area Operation: A maximum of nine (9) eleven (11) taxicabs will be permitted in the taxicab loading area. When the taxicab loading area is full, any taxicab arriving at the Boise Air Terminal must wait in the taxicab

loading holding area until a vacancy is created in the taxicab loading area. The order of taxicabs in the holding area will be in the order of arrival. D. There shall be no loading except in the taxicab loading zone, other areas designated for loading in the Airport Rules and Regulations, or areas specified by the Airport Director or his or her designee. Taxi will-call spaces (for pre-arranged trips), may be provided at the sole discretion of the Airport Director or his/her designee. Taxi will-call spaces, if provided, shall be excluded from the 11 spaces designated in C. above. E. It shall be unlawful for a taxicab driver or company to charge a passenger a fare that is excessive or otherwise in violation of Section 5-24-13 of the Boise City Code, as modified by Section 12-19-7. Section 2. That the summary of this Ordinance, attached hereto as Exhibit A, is approved as to both form and content. Section 3. That this Ordinance shall be in full force and effect from and after its passage, approval and publication. 2008. June, 2008. Specifically, it provides for two additional queued waiting spaces for taxicabs inside the Airport s taxicab gate, in the taxicab parking area. The ordinance also amends the ordinance to provide that the Airport s Rules and Regulations

may add or remove taxicab loading zone areas, and the Airport Director, or the Director s designee, may add or remove additional taxicab loading areas. Finally, the ordinance amendment provides that taxi will-call spaces at the Airport (for pre-arranged trips), may be provided, in the discretion of the Airport Director or the Director s designee, and that those will-call spaces, if provided, are not included in the 11 spaces in the taxicab parking area. The effective date of the Ordinance is the date of its passage, approval and publication.
