Information & Registration Form Dear Potential Exhibitor: On March 2 & 3, 2017, The Builders Association will be holding the 8 th Annual Midwest Construction Safety Conference at Adams Pointe Conference Center located in Blue Springs, Missouri. The conference planning committee would like to invite your organization to be part of this exciting event by becoming an exhibitor at the conference. By your organization becoming an exhibitor it will be recognized for its contributions to improving construction safety in the Midwest. Attached is a Conference Exhibitor Form for your information. Please take a moment to review the exhibitor information. If you are interested in becoming an exhibitor simply complete the Exhibitor Registration Form included in this document and submit with your payment. A layout of the exhibitor booths is included on the last page of this document. Please indicate your booth preference first choice, second choice and third choice. (If first choice is not available we will then refer to second & third choices.) The booths will be assigned on a first-come, first-paid basis and will be confirmed either by telephone or email after payment is received and the booth has been assigned. Information EXHIBITOR BOOTHS: The price for one regular exhibitor booth is $425.00; with a discount given for additional booths. If your company registers by Friday, October 21, 2016 you will receive a discounted rate of $375.00 per booth. Each booth includes meals for two workers per booth, a 10' by 10' exhibit space with a 10' back drop, two 8 side drops, one 8 long skirted table, two chairs, waste basket, Personalized ID sign, Free Wi-Fi, access to 110 volt electricity at the additional cost of $10.00 per booth (electricity must be requested in advance), Company Name, Logo and Contact information in brochure (if provided before October 21, 2016), & Company Logo listed in PowerPoint Presentation during breaks. The booths will be assigned on a first-come, first-paid basis and will be confirmed either by telephone or email after payment is received and booth has been assigned. Exhibit space cannot be sublet without the approval of The Builders Association. 2. No exhibit shall block or interfere with the direct visibility of an adjoining exhibit. 3. Lewd, immoral or offensive material is prohibited. 4. Solicitation or the distribution of literature is permitted only in exhibitors leased area. 5. No exhibitor may interfere with the orderly procedure of another exhibitor. 6. Exhibits may not be erected without full payment of space rental. 7. Exhibitors must comply with all State of Missouri and City of Blue Springs fire codes and exercise care to prevent property loss. 8. Exhibitor shall not encourage attendance by those who are not connected with the 2017 Midwest Construction Safety Conference activities, or are there by way of invitation or approved by The Builders Association in their research to open to the public. 9. Exhibit booth personnel shall wear their identifying badges at all times when on the exhibit floor. 10. Admission: All visitors shall be registered and wear appropriate badge at all times. The Builders Association reserves unto themselves the right to deny admission to any person or firm and to set terms of policies for admissions. Exhibitor badges will be available on Thursday, March 2, 2017, at the Midwest Construction Safety Conference registration table. 11. Property Loss: Although Adams Point Conference Center will provide protections during closed hours, neither The Builders Association, nor Landlords shall be held responsible for property loss from any cause of any sort. Information 12. Installation and Removal: Exhibitor will be able to access exhibitor area at 4:00 P.M., on Wednesday, March 1, 2017, for the installation of exhibits prior to the convention opening. The installation of all exhibits must be fully completed at least two (2) hours prior to the opening time of the exposition. Exhibits shall be removed after the conclusion of the convention. 13. Storage: The Builders Association cannot store displays. If storage of display material is needed, contact Adams Point Conference Center Exhibitor Staff. 14. Property Damage: Neither The Builders Association, nor Exhibitor shall be responsible for any loss or damage to property of the other party hereto including but not limited to, loss or damage occasioned by theft, fire, smoke, acts of god, Public enemy, not, civil commotion or other insurable casualty, and The Builders Association and Exhibitor expressly waive any claim for liability against the other party hereto with respect to any such loss of damage. Accordingly, it shall be the responsibility of the Exhibitor to secure its own insurance or otherwise protect it and its property against such loss or damage. 15. Applicable Law: This Agreement shall be delivered and shall be deemed to be performed in the State of Missouri and shall be construed and enforced in accordance with the laws of said State, and abide by local sales tax code. 16. Attorney's Fees and Exposes: Should any dispute or litigation arise out of this agreement, the prevailing party shall be entitled to reasonable attorney's fees and courts costs, in addition to any other relief the Court may allow. 17. Hold Harmless: Exhibitor agrees that it will indemnify and hold and save The Builders Association harmless of, from and against any and all claims, demands, actions, damages, loss, cost, liabilities, expenses and judgments recovered from or asserted against The Builders Association on account of injury to person or property to the extent that any such damage or injury may be incident to, arise out of, or be caused, either proximately or remotely, wholly or in part, by an act, omission, negligence or misconduct on the part of Exhibitor or any of its agents, servants, employees, contractors, patrons, guests, licensees or invitees or any other person entering upon the Premises leased hereunder with the express or implied invitation or permission of Exhibitor, or when any such injury or damage is the result, proximate or remote, of the violation by Exhibitor or any of its agents, servants, employees, contractors, patrons, guests, licensees or invitees of any law, ordinance or governmental order of any kind, or when any such injury or damage may in any other way arise from or out of the occupancy or use by Exhibitor, its agents, servants, employees, contractors, patrons, guests, licensees or invitees of the Premises leased hereunder. Exhibitor covenants' and agrees that in case The Builders Association or committee members shall be made a party to any litigation commenced by or against Exhibitor or relating to this lease or the Premises leased hereunder, then Exhibitor shall and will pay all costs and expenses, including reasonable attorney's fees and court costs, incurred by or imposed upon The Builders Association by virtue of any such litigation. 18. Other Regulations: Any and all matters not specifically covered by the preceding rules and regulations shall be subject solely to the decisions of The Builders Association SHALL HAVE FULL POWER TO INTERPRET, AMEND, AND ENFORCE THESE RULES AND REGULATIONS, PROVIDED ANY AMENDMENTS, WHEN MADE ARE BROUGHT TO THE NOTICE OF ALL EXHIBITORS. EACH EXHIBITOR, FOR HIMSELF AND HIS EMPLOYEES, AGREES TO ABIDE BY THE FOREGOING RULES AND REGULATIONS AND BY ANY AMENDMENTS OR ADDITIONS THERETO IN CONFORMANCE WITH THE PROCEEDING SENTENCE. 19. Receipt of an "Exhibitor Form for Exhibit Space" is a commitment to exhibit at the MCSC. As such, MCSC begins assigning booth space upon receipt of the executed application agreement and begins compilation and distribution of printed and electronic program materials. Subsequent cancellation of assigned booth space poses a burden and hardship on those exhibitors who must choose from available exhibit space. A refund of the total amount paid less a $150 processing fee per Exhibit space will be made if cancellation is received before December 2, 2016. No refunds will be made for cancellations received after December 2, 2016. Page 3
