LOCAL AGENCY FORMATION COMMISSION SPECIAL DISTRICTS ADVISORY COMMITTEE MINUTES OF THE FEBRUARY 17,2006 MEETING There being a quorum present, the meeting was convened at 9:30 a.m., by Chairwoman Jo Mackenzie (Vista ID). Attending were: Committee Members - James Alkire (South Bay ID), Ron Fuller (Alpine FPD) (who entered the meeting at 9:35 a.m.), Trish Hannan (Vallecitos WD), Judy Hanson (Leucadia WD), Dr. Hanno E.G. Ix (Rincon del Diablo MWD), Vice Chairman Darrell Jobes (East County FPD), Keith Lewinger (Fallbrook PUD), John Pastore (Rancho Santa Fe CSD), Tom Pocklington (Bonita-Sunnyside FPD), and Augie Scalzitti (Padre Dam MWD). LAFCO Staff - Executive Officer Michael D. Ott; Chief, Governmental Services Ingrid Hansen; and Administrative Assistant Claire Riley. Absent were: Committee Members - Gary Arant (Valley Center MWD), Harry Ehrlich (Olivenhain MWD), Daniel Goldberg (Fallbrook HCD), and Dennis Shepard (North County CD). Also present were: James F. Ix, Vice Chairman Darrell Jobes, and Chairwoman Jo MacKenzie abstaining, ON MOTION OF Judy Hanson, seconded by Trish Hannan, and carried unanimously by the remaining committee members present, the committee dispensed with reading the minutes of the November 18, 2005 meeting, and approved said minutes. ltem 2 Executive Officer's Recommended Agenda Revisions Mr. Ott indicated that there were no revisions to the agenda. ltem 3 Committee MemberlExecutive Officer Announcements Michael Ott announced that Councilman Ron Morrison, City of National City, has been appointed by the City Selection Corrlrr~ittee to the Local Agency Formation Corrlmission to replace Commissioner Patty Davis. Mr. Ott said that at their February 6, 2006 meeting, the Local Agency Formation Commission authorized the preparation of a micro analytical report, which is a detailed study to be used to implement the reorganization of fire agencies. Ron Fuller entered the meeting at 9:35 a.m. Mr. Ott said that efforts to examine and mitigate the impacts to fire districts caused by district detachments are on-going and that Darrell Jobes and other fire chiefs have been involved in the discussions. Mr. Ott said that the Local Agency Formation Commission will hear their recommendations, which only affects fire districts, at the March 6, 2006 meeting. Mr. Ott said that the report will be available on the LAFCO website.

Tom Pocklington said that not only are fire districts affected by district detachments, but the whole county is affected as well. ltem 4 Public Comment No members of the public requested to speak. ltem 5 Selection of Chair and Vice Chair for 2006 ON MOTION OF Trish Hannan, seconded by Augie Scalzitti, and carried unanimously by the committee members present, the committee reelected Jo MacKenzie as the 2006 Chair. ON MOTION OF Judy Hanson, seconded by Tom Pocklington, and carried unanimously by the committee members present, the committee reelected Darrell Jobes as the 2006 Vice Chair. ltem 6 Final Discussion of Selected Excerpts of the Draft LAFCO Publication, Profiles of Special ~istricts in San Diego County Mr. Ott introduced Admir~istrative Assistant Claire Riley, who provided a brief staff report. Ms. Riley indicated that the format for the publication has been simplified so that it can be easily updated by the districts. Ms. Riley said that LAFCO staff is looking at distributing the final format to the special districts for their input by mid-march. Paul Bushee commented that the word "Information" has been misspelled on the template for some of the districts and should be corrected. Mr. Bushee also indicated that he has concerns regarding the request for the "No. of Regional Water Quality Control violations within the past three years," under the heading Sewer Service. He asked if this is a requirement of the Cortese-Knox-Hertzberg Act. In response, Mr. Ott said that it is not a requirement, but the information will be used to make conclusions that will help satisfy the requirements of the Cortese-Knox-Hertzberg Act. Keith Lewinger said if LAFCO needs a measure of how the districts are managing their treatment plants, a better way of requesting this information would be, "Have you been fined by the regional board? If so, how much?" John Pastore said that another way to request this information is, "Have you been fined for permit violations? If so, how many and how much?" He said this question would cover all perrrrits. Mr. Pastore said that a contact name, for instance the General Manager, should be added under the heading "Contact Information." Chairwoman MacKenzie suggested an e- mail address also be added. Mr. Pastore suggested adding an item under the category "Reclaimed Water Distribution" regarding the annual amount of reclaimed water, expressed in acre feet, that is sold or delivered. Paul Bushee suggested requesting information regarding "Miles of Collection" or "Miles of Sewer Line1' and "Number of Pump Stations."

Keith Lewinger commented that under the category "Governance," the "Monthly aniount of per diem or stipend paid to each board member" does not make sense and should be changed to read "Amount of per diem or stipend paid to each board member per meeting." Chairwoman MacKenzie suggested adding an example under the category "Governance," to explain specific information LAFCO is requesting under "No, of board vacancies over the past five years." Vice Chairman Jobes said there is a disparity in board member compensation throughout the fire districts and asked if LAFCO needs information.from the districts regarding benefits the elected officials may be receiving, such as health insurance, life insurance, and retirement. He said the question could be phrased, "Are other benefits provided to elected officials?" He said a dollar amount is not as important as whether the elected officials receive these benefits. In response to a question from Keith Lewinger, Mr. Ott said that this information has been collected by LAFCO for some municipal service reviews where there have been public concerns regarding excessive benefits for elected officials. Chairwoman MacKenzie said that information about whether or not districts offer benefits could be a line item "yes" or "no." Vice Chairman Jobes said that a simple "yes1' or "no" would be sufficient. He said this is a big factor when you are looking at the level of service and the overall cost of service. Keith Lewinger questioned why this information is important with respect to municipal service reviews. He said these issues are local issues that should be dealt with by the local voters. Mr. Lewinger made a motion that under the category "Governance," the wording "Monthly amount of per diem or stipend paid to each board member" be amended to read, "Amount of per diem or stipend paid to each board member per meeting." The motion was seconded by Augie Scalzitti. Dr. Hanno E.G. Ix suggested this information would be more useful if it was included under the Finance Section - District Budget, and not under Governance. ON MOTION OF Keith Lewinger, seconded by Augie Scalzitti, and carried by the following vote of the committee members present, the Special Districts Advisory Committee requested staff to amend the wording under the Governance Section, "Monthly amount of per diem or stipend paid to each board member" to read "Amount of per diem or stipend paid to each board member per meeting." ON MOTION of Darrell Jobes, seconded by Ron Fuller, and failed by the following vote of the committee members present, the Special Districts Advisory Corr~mittee declined to include the line item request, "Are benefits provided to Board members, "yes" or "no." Chairwoman MacKenzie asked that on the first page, under the heading Management, "Ratio of management/executive employees to non-executivelmanagement" be clarified. Keith Lewinger said that the line item should read "Ratio of management/executive employees to non-executivelnon-management." Chairwomarl MacKenzie suggested adding parameters under the heading "Miscellaneous," otherwise it is possible the districts will include too much information. In response to a question from Mr. Bushee, Mr. Ott said that the Miscellaneous section should be included because there are agencies that do not fit into a specific category, for example, Sweetwater Authority and South Bay Irrigation District, and these districts will need this space for explanations. Regarding parameters for the Miscellaneous section, Chief, Governmental Services Ingrid Hansen said that there is language in the request for information for the municipal service reviews that can be incorporated into this document. Item 6 Adiournment There being no further business to come before the Special Districts Advisory Committee, the meeting was adjourned at 10:30 a.m. to the scheduled meeting on March 17, 2006.
