STAFF REPORT: TREE REMOVAL PERMIT APPLICATION Date: June 18, 2014 To: City of Dunnellon Tree Board Request: Application No.: Removal of 3 Cypress Trees and 1 Unidentified Tree for a Garage Addition PZ1314-67 Applicant: Robert Ripple on behalf of Patricia Farris Property Address: 12181 Palmetto Way Parcel Number: 3383-001-004 Applicable Code: Code of Ordinances, Subpart A, General Ordinances, chapter 74, Vegetation, Article III, Trees; Review Requirement: In accordance with Section 74-63(d)(3) "Applications for tree removal permits for all waterfront land...shall require consideration by the tree board and the city council. The city manager, or his designee, shall prepare a staff report regarding the application for tree removal with the requirements of this article. Notice shall be provided as set forth in subsection 74-63(d)(5). The application and staff report shall be forwarded to the tree board at the next regular meeting following notice. The tree board shall make recommendation to approve, deny, or approve with conditions to the city council. The application, staff report, and written recommendation from the tree board shall be forwarded to the city council at the next regular meeting following notice. The city council may approve, deny, or approve with conditions." STAFF EVALUATION AND FINDINGS Applicable Code: Sec. 74-70, Standards for tree removal in special circumstances. Parcel number 3383-001-004 is an occupied waterfront lot and subject to Sec. 74-70. Three of the trees requested for removal are trees of "Special Circumstances" and must comply with Sec. 74-70(a) and one unidentified tree is subject to Sec74-70(b) unless identified as a prohibited tree. Trees to be Removed: Cypress Tree 14" DBH Cypress Tree 14" DBH Cypress Tree 16" DBH Unidentified Tree 12" DBH Measurements were confirmed by Code Enforcement Officer Larry Straus Status of Trees: Live Determination as Diseased or Dangerous All trees appear to be healthy and disease free. Additional Information No certified arborist or other expert report was submitted. Code Enforcement Officer Straus observed no obvious signs of disease. Recommendation: 1) Staff recommends denial of the application for the three (3) Cypress Trees in accordance with Sec. 74-70(c) (2) unless evidence of disease or death is submitted by the applicant. 2) Staff recommends denial of the application for the unidentified tree in accordance with Sec. 74-70(c) (2) unless the unidentified tree is determined to be a "prohibited" tree in accordance with Sec. 74-66(c). 3) Staff recommends the applicant be advised to follow Sec. 74-67, Standards for protecting trees during development and construction activities.

I also understand that if I do not plant appropriate replacement trees within 60 days of removal I may be in violation of the City of Dunnellon's minimum 1 6 trees per acre requirement and subject to enforcement action. NOTE: Failure to secure a permit will result in a $25.00 per inch DBH. However the fine for unauthorized removal of a champion or heritage tree shall be $100.00 per inch DBH, in addition to a requirement to pay the current tree permit fee. When the size of a champion or heritage tree cannot be determined, the minimum penalty shall be $3,600.00.
