'.\ T~ THE COUNCIL OF THE CITY OF LOS ANGELES File No. 12-0229 Your reports as follows: PUBLIC WORKS Committee CATEGORICAL EXEMPTION, PUBLIC WORKS COMMITTEE REPORT and RESOLUTION relative to rejecting the future street as public street lying on Norris Avenue between Paddock Street and Astoria Street (Right of Way No. 36000-1886). Recommendations for Council action: 1. FIND that the rejecting the future street as public street lying on Norris Avenue between Paddock Street and Astoria Street is exempt from the California Environmental Quality Act of 1970, pursuant to Article Ill, Class 5(22) of the City's Environmental Guidelines. 2. FIND that the Resolution rejecting the future street as public street lying on Norris Avenue between Paddock Street and Astoria Street, as shown colored red on Exhibit "A" be adopted subject to the following condition: That petitioner make satisfactory arrangement with the Real Estate Group of the Bureau of Engineering with respect to the payment of document recording fee. 3. FIND that pursuant to Section 556 of the City Charter, the City Council finds that this rejection of future street as public street is in substantial conformance with the purpose intent and provisions of the General Plan. 4. ADOPT the accompanying City Engineer report dated February 16, 2012 to approve the rejection. Fiscal Impact Statement: The City Engineer reports that a fee of $6,869.40 was paid for processing this request pursuant to Section 7.40 of the Administrative Code. Community Impact Statement: None submitted. SUMMARY At its regular meeting held on Apri125, 2012, the Public Works Committee considered the recommendations of the City Engineer as contained in its February 16, 2012 report. The City Engineer reports that the area sought to be rejected as the future street as public street is a portion of Norris Avenue between Paddock Street and Astoria Street (a map of the area is included as Exhibit A in the February 16, 2012 City Engineer report and is attached to the Council file). The petitioners, Relyt Developers LLC, is requesting the City to reject the 27 -foot wide future street. The petitioners stated this easement is no longer needed by the city and to allow development consistent with existing entitlements. The future street easement was offered for dedication by that certain "Irrevocable Offer to Dedicate" recorded as Document No. 2840, in Book D4895, page 69, of Official Records, in the Office of the County Recorder of Los Angeles County. "This Irrevocable Offer to Dedicate" document includes a provision that if the offer is rejected by the City Council, the Real Estate Group of the Bureau of Engineering shall issue a release from such offer which shall be recorded in the Office of the County Recorder of Los Angeles County.

The petitioner's request can be granted since the area is being developed in a "RD" Restricted Density Multiple Dwelling Zone instead of single family zone. After having provided an opportunity for public comment, the Committee moved to recommend approval of the recommendations as contained in said City Engineer report and detailed above in Recommendation Nos. 1-4. This matter is now submitted to Council for its consideration. R E S 0 L U T I 0 N WHEREAS, a portion of Lot 99, Tract No. 5909, as per map recorded in Book 77, pages 16 and 17, of Maps, in the Office of the County Recorder of Los Angeles County, was offered for dedication for public street purposes by that certain "Irrevocable Offer to Dedicate," recorded on November 20, 1970, as Instrument No. 2840, in Book D4895, Page 69, of Official Records, in the office of said County Recorder, the dedication to be completed at such time as the City Council shall accept the same for public street purposes; and WHEREAS, the rejection of said portion of said property as public street at this time is necessary.to the public interest and convenience; NOW THEREFORE BE IT RESOLVED, that the Council of the City of Los Angeles hereby rejects that portion of said Lot 99 offered for dedication by said "Irrevocable Offer to Dedicate," described as follows: That certain future street, 27 feet wide, lying within Lots 10 and 11, Tract No. 63263, as per map filed in Book 1363, pages 57 through 60, inclusive, of Maps and within Parcel B, Parcel Map L.A. No. 2046, as per map filed in Book 29, page 81, of Parcel Maps, in the Office of the County Recorder of Los Angeles County, described in that certain "Irrevocable Offer to Dedicate" recorded on November 20, 1970 in Book D4895, Page 69, of Official Records, in the office of said County Recorder.
