2. The Overview of the e-tender: The Directorate of Commercial Taxes, West Bengal procures various computer consumables and accessories for its offices throughout the year. The present e-tender is floated to invite item-wise rates of computer consumables for official use as per specification of the same appended in Annexure - A of this document. 3. Scope of Work: The selected agency(s) shall remain responsible for supply of computer consumables as may be directed by the Office of the Commissioner, Commercial Taxes, West Bengal. Order may be placed from time to time in phased manner. Supply of materials/ articles shall have to be made within 72 (Seventy Two) working hours from the receipt of Supply Order from the Office of the Commissioner, Commercial Taxes, West Bengal. 4. Eligibility Criteria: Sl. No. Criterion 1. Be an HP authorised dealer operating in India for at least 03(three)years. 2. The bidder must be an entity that has at least 03 (three) work experiences of having executed similar nature ofsupply duringthe last 03 (three) years in any Government Departments/ Organizations / Undertakings/ PSU. 3. The bidder must have an annual turnover abovers.20,00,000/- (Rupees Twenty Lakhs) only in Indian Rupees for each of the past 03 (three) audited Accounting years. 4. Should not hold any black-listing by any Government Departments / Organizations / Undertakings/ PSUpersisting on the last due date of receipt of RFP/ tender. 5. Bidder should have valid P.Tax, PAN, GST Registration, Bank A/c. Supporting Documents to be submitted Copy of valid Trade License, authorisation letter issued by HP andself-attested by authorized signatory of the bidder. Payment Certificate / Sanction Order/Credential Certificate of thosegovernment Departments / Organizations / Undertakings/ PSU. Annual Profit & Loss A/c and Balance Sheet of last 03 (three) financial years. AND IT Return for last 03 (three) assessment years. Bidder should submit duly notarized affidavit in this regard. Copy of P.Tax Registration / Enrolment Certificate along with up to date P. Tax payment challan, PAN, GST Registration Certificate, Bank A/c details self-attested by authorized signatory of the bidder. 2

6. The bidder should submit details of any pending litigation in Hon ble High Court, Supreme Court of India or any other statutory legal forum. Details to be provided in a duly notarized affidavit. 7. Authorized Signatory of the Bidder. Power of Attorney in the name of person signing the Bid, authorizing him to submit/ execute this agreement as a binding document. 8. Joint Venture/ consortium of companies are not allowed for bidding in this RFP/ tender. Even though the bidders meet the above qualifying criteria, they are subject to be disqualified if they have: (i) Made misleading or false representations of any nature in any documents submitted as proof of the qualification/ requirements; (ii) Record of poor performance such as abandoning the works, not properly abiding by the contract, inordinate delays in completion, litigation history, financial failures, etc. 5. Technical Bid consideration and Evaluation: 1. Technical Bid should contain self-attested copies of all the documents in support of the eligibility criteria spelt out at Point No. 4 above along with a Top-sheet mentioning the documents submitted. 2. The Tender Committee constituted by the Commissioner, Commercial Taxes, West Bengal shall evaluate the responses to the NIT and supporting documents/ documentary evidences. In case of inability to submit requisite supporting documents/ documentary evidences, the Bid shall not be considered for evaluation and will be summarily rejected. 3. Only one set of tender document duly signed & stamped on each page by authorized representative of tenderer shall be electronically submitted. Bidders should note specifically that all pages of tender document are to be electronically submitted by them as a part of their offer. Price should not be mentioned by them anywhere in the Technical Bid portion of offer. 4. On the date of opening of tender, Technical Bid shall be opened first to select the eligible Bidders. Financial Bid will be opened on the scheduled date only in respect of those Bidders, whose bids are found technically acceptable. 5. Each of the responses shall be evaluated as per the criteria and requirements specified in this NIT. 6. The Tender Committee reserves the right to reject any or all proposals on the basis of any deviation and the decision of the Committee in the matter of evaluation of the bids shall be final and abiding. 6. Financial Bid Evaluation: 1. Item-wise price should be mentioned only in the "Bill of Quantities (BOQ)" by quoting the rates online as specified in the Price Schedule format. 3

2. The Financial Offer of the prospective bidder will be considered only if the Technical Bid of the bidder is found qualified by the Tender Committee constituted by the Commissioner, Commercial Taxes, West Bengal. The decision of the Tender Committee will be final and absolute in this respect. 3. The bidder should quote only one rate for one item as per specification. 4. If any bidder does not deal in any item(s) no rate for the same is to be mentioned. The space for providing rate for such item(s) should be left blank. In no situation, it is to be filled with zero (0). 5. The rates tendered shall remain valid for the period of 01 (one) year. 7. Taxes and Duties: 1. All payments will be subjected to tax deduction at source as applicable/required as per existing provisions of law. All prices quoted should be exclusive of GST. 2. The Bidder shall be solely responsible for payment of delivery/carrying charges, if required, and all other taxes, duties, license fees etc. as per existing Government norms. 8. Earnest Money: The Bidder shall be required to deposit Earnest Money of Rs.25,000.00 (RupeesTwenty Five Thousand only) in Online Mode only (as per Finance Department Memo No: 3975 F(Y) dated 28 th July 2016). By selecting ICICI Bank Mode bidder have to pay the EMD amount through net banking and in case of ICICI NEFT/RTGS a challan will generate online in that case Bidder have to pay the EMD at their concerned bank branch through NEFT or RTGS mode. The Earnest Money may be converted to Security Deposit in case of successful Bidder. 9. Mode of submission of Bids: All documents and corresponding information are to be obtained, shared and submitted only through e-tender process. No manual submission of documents, etc. will be entertained. Canvassing in any form by any bidder will be treated as disqualification and may result into rejection of the Bid. 10. Terms and Conditions: a. There will be no sub-letting of the Contract. b. Under no circumstances escalation in prices will be entertained. c. The rates tendered shall remain valid for the period of 01 (one) year. d. After selection, ordered articles should be delivered within 72 (Seventy Two) working hours of receipt of order. Supply of items should be made as per specification of the same appended in Annexure -A of this document. No deviation in specification during supply will be accepted. 4

e. Items may be procured from time to timein phased manner. The Directorate reserves the right not to procure any of the items as mentioned in Annexure-A even after selection of the successful bidder for those items. f. Quantity mentioned in Annexure -A may vary. g. The selected agency should give warranty against each item supplied and replace the items found defective subsequently at its own cost. h. In the event of breach /violation or contravention of any terms and conditions contained herein by the selected agency, the firm/agency will be blacklisted in addition to termination of contract. i. Payment will be made after successful supply of the articles/materials to the satisfaction of the Office of the Commissioner, Commercial Taxes, West Bengal. No advance payment will be made. 11. Instruction To Bidders: a. Registration of Contractor: Any agency/firm/entity etc. and or its authorized representative willing to take part in the process of E-Tendering will have to be enrolled & registered with the Government e-procurement system, through logging on to https://wbtenders.gov.in. b. Digital Signature Certificate (DSC): Each agency/firm/entity etc. and or its authorized representative is required to obtain a Class-II or Class-III Digital Signature Certificate (DSC) for submission of tenders from the approved service provider of the National Informatics Centre (NIC) on payment of requisite amount. Details are available at the web site https://wbtenders.gov.in. DSC is given as a USB e-token. c. Each agency/firm/entity etc. and or its authorized representative can search and download the NIT and Tender Document(s) electronically from computer once he logs on to the website https://wbtenders.gov.in using the Digital Signature Certificate. This is the only mode of collection of Tender Documents. d. Submission of Tenders: Tenders are to be submitted through online to the web site https://wbtenders.gov.in in two folders at a time for each work, one in Technical Proposal & the other is Financial Proposal before the prescribed date & time using the Digital Signature Certificate (DSC). Virus scanned and digitally signed copies of the documents are to be uploaded. The documents will get encrypted (transformed into non readable formats). e. Technical Proposal: The Technical Proposal should contain scanned copies of the following two covers: i. Statutory Cover Containing the following documents NIT ii. Non-Statutory Cover Containing the following documents All documents as stated in the Eligibility Criteria in Point No. 4. 5

f. Financial Proposal: 1. BOQ: The Financial Proposal should contain Bill of Quantities (BOQ) in one cover (folder). The agency/firm/entity etc. and or its authorized representatives is to quote the rate online through computer in the space marked for quoting rate in the BOQ after downloading the prescribed format from the web site. 2. The rates shall be quoted by the bidder entirely in Indian Rupees. 3. In case of non- participation by any bidder in any item, the specified space for quoting the rate must be kept Blank and in no situation, it is to be filled with zero (0). g. Opening & Evaluation of Tender: i. A Tender Evaluation Committee comprising of selected officers will open the bids of the Tender. ii. The online tenders will be received up to the time and date mentioned in the Bid Schedule and will be opened on the date and time mentioned therein. In the event of the specified date of Bid opening being declared holiday, the Bid shall be opened at the specified time and location on the next working day. iii. Cover (folder) for Statutory Documents will be opened first and if found in order, cover (folder) for Non-Statutory Documents will be opened. If there is any deficiency in the Statutory/Non-statutory Documents the tender will summarily be rejected. iv. Decrypted (transformed into readable formats) documents of the Non- Statutory cover will be downloaded and handed over to the Tender Evaluation Committee. v. Summary list of technically qualified tenderers will be uploaded online. vi. During evaluation the committee may summon the tenderers and seek clarification / information or additional documents or original hard copy of any of the documents already submitted and if these are not produced within the stipulated time frame, their proposals will be liable for rejection. h. Rejection of Bid: Tenders with incomplete/incorrect information, subjective and conditional offers as well as partial offers will be liable for rejection. Tenders with variance/ contradiction between Technical Bid and Financial Bid will also be liable for rejection. Further, Tenders submitted without any of the mandatory statements/ documents of the bidders are liable for rejection. The Tender Committee formed by the Commissioner Commercial Taxes, West Bengal reserves the right to reject any / or all the tendered rates without assigning any reason and / or not to place any orders even after selection and is not liable for any cost that might have been incurred by any bidder at the stage of bidding and also reserves the right to divide the contract amongst any number of tenderers, if required so. The said committee does not bind himself to accept the lowest rate. 6
