In case of any unscheduled holiday or on days of Bandh or natural calamity on the aforesaid dates, the next working day will be treated as scheduled / prescribed date for the same purpose. 2). The Tender Inviting Authority may change the venue of opening the Technical or Financial Bids in case of exigent circumstances like breakdown of communications link or conditions of force majeure. 3). The Tender Inviting Authority reserves the right to defer the date of opening of either Technical or Financial Proposal or both, if required. TERMS & CONDITIONS 1. The Rate(s) should be quoted per Kg both in figures & words clearly; any correction made there should be initialled by the tenderer. The rate should be inclusive of all Taxes. 2. All rates quoted inclusive of cost of transportations to the delivery point. 3. Copies of latest P.Tax, Service Tax, GST, Trade License for the year 2015-16, 2016-17&2017-18 and PAN Card to be attached with tender. 4. Earnest Money Deposit and Tender Fees a)tender Fees should be deposited in the form of Challan to be originated from GRIPS Portalof Finance Department, West Bengal and remitted in favour of Divisional Forest Officer, Bankura (North) Division. b) Tender Paper will be available in the office of the Divisional Forest Officer, Bankura (North) Division from AFR, Bankura (North) Division after depositing cost of Tender Paper within stipulated Date & Time. The Plan and Estimate of the said works may be seen at the office of the undersigned on any working day during office hours. c)emd through DD/Bankers Cheque drawn in favour of Divisional Forest Officer, Bankura (North) Division, payable at Bankura. d)there is no exemption of any kind for any of the eligible contractors towards cost of tender paper fee or EMD. e)payment in any other form e.g. Demand Draft, Cheque, NSC, KVP etc will not be accepted( Vide Memo No. 2365-F(Y) dated 12.04.2018). 5. No tender paper will be accepted without Earnest Money and valid Income Tax, P. Tax &GST clearance Certificate. 6. The Earnest Money deposited shall be forfeited to the Government in case of following a) The tender withdraws tender after opening of acceptance. b) The selected tenderer fails to accept order, refuse either wholly or partly the offer that would be made by the undersigned. c) The selected tenderer fails to supply materials as per specification and within specified period. 7. The Earnest Money deposited by the successful tenderers will be refunded only after completion of the fulfilment if said terms & conditions.

8. Any other information will be available from the office of the undersigned. 9. IT/ ST/ GST will be deducted at source as per Govt. Rule. 10. Considering emergency, work order may be distributed among more than one tenderer at the lowest rate item-wise. 11. This is urgent. Failure in any part of compliance of the order shall attract penal measures as per tender rules. 12. The undersigned shall have the right and discretion to terminate the contract and forfeit the Earnest Money deposited in the event of sort of breach of contract. 13. The time limit for completion of the work may be reduced if emergency situation arises. 14. The undersigned reserves the right to reduce or enhance the quantity of any item of work or omit any item of work completely. 15. The successful tenderer(s) have to undergo an agreement with the respective authority within 48(Forty eight) hours of receiving the work order. 16. The undersigned reserves the right to reject / cancel or accept any tender without assigning any reason thereof. 17. The undersigned also does not bind himself to accept the lowest rate tendered and shall use discretion in accepting higher than the lowest with a view to ensuring standard quality of works. 18. It shall be opened to the authority to impose penalty and take other punitive steps, as deemed fit, for violation of above trams & conditions. 19. Tenderer can drop the tender on any working day during office hours. 20. The Tenderers will have to produce Income Tax, GST and Professional Tax Clearance Certificates. 21. The bidder should have a minimum average turnover of at least 50% of the Project Cost in the last three preceding years (the turnover of the lead member will be considered in case of joint venture) against one project. In case any bidder wants to apply for more than one project, then the requisite amount will increase proportionately. 22. The bidder should have successfully completed at least one similar type of work during last three years for a single contract of value not less than 80% of the estimated amount, for each project. In case any bidder wants to apply for more than one project, then the requisite amount will increase proportionately. 23. Entire Supply of Seedling to be completed within Two (02) Weeks from the date of issue of work order, no delay will be entertained, failure of which work order will be cancelled. 24. The bidder should also have made profits after taxes for each of these last three financial years. 25. The undersigned reserves the right to demand from the Tenderers the classification and justification of their offer. The item wise statement of their proposed expenditure analysis with a view to construct the work mentioned in the schedule of this Tender Notice. On the item wise expenditure proposed labour cost should be specifically mentioned. 26. Tenderers should inspect the works site prior to submission of tenders. 27. The Suppliers / Dealer / Firms/contractor shall have no claim for any payment before completion of work. 28. The successful Tenderer to whom a Letter of Acceptance has been issued shall submit within 10(ten) days from the date of Letter of Acceptance, Security Deposit which is 10% (Ten Percent) of the contracted value of work shall have to be deposited through DD/Bankers Cheque drawn in favour of Divisional Forest Officer,

Bankura (North) Division, payable at Bankura. Failure in depositing this amount shall render the contact liable to termination without reference to the contractor and in such case.the deposited earnest money shall stand forfeited to the Government. 29. Refund of EMD: The EMD of the unsuccessful Tenderers deposited will be refunded without any interest on receipt of application addressed to the Divisional Forest Officer, Bankura (North) Division, from Tenderers as per relevant Govt. Rules. 30. All works are to be carried out as per plan, specification and estimate of works subject to modification made in writing by the undersigned or his authorised officer. 31. The terms and condition mentioned herein shall be deemed to form a part of the agreement. 32. In accordance with the provision of relevant Section of Income Tax 1951. Deduction of Income Tax shall be made from the gross value of the Bill. 33. If any terms and conditions of the tender are altered the same will be notified. 34. The work will be executed under the direct supervision of the concerned Range Officer or Beat Officer. 35. The acceptance of the Tender will be subject to the receipt of fund. 36. Theacceptanceofthetenderincludingtherighttodistributetheworkbetweentwooramongst more thantwotendererswillrestwiththecompetent authoritywithoutassigningreasonthereof.theacceptingauthorityreservesrighttorejectanyoralltenderswithoutassigninga nyreasonthereof. 37. TheTenderershallhavetocomplywiththeprovisionsof(a)Contract labour(regulation&abolition)rules,1970(b) MinimumWagesAct1948orthemodificationthereoforanyother lawsrelatingtheretoaswill be in forcefromtimetotime. 38. Divisional Forest Officer, Bankura (North) Division or hisauthorisedrepresentativeshallnotentertainanyclaimwhatsoeverfromthecontractorfor paymentofcompensationonaccountofidlelabouronanyground. 39. The Tender Inviting Authority shall not be held liable for any compensationdue to machinesbecomingidle for anycircumstancesincludinguntimelyrains,othernaturalcalamities,strikeetc. 40. NoPricepreferencewill beapplicabletow.b.govt.undertaking,as perfinancedeptt.g.o.no. 8648- F(Y),dated12 th October2012. 41. Impositionofanyduty/taxrulesetcwhatsoeverofitsnature(afterworkorder/Commencementandcompletio nof thework)is tobeborne bythetenderer. 42. No mobilization/securedadvancebillwillbeallowed. 43. GST,Cess, TollTax,IncomeTax,FerryChargesandotherLocal Taxesifany aretobepaidbythecontractor.noextrapaymentwillbemadefor these.theratesofsupplyandfinishedworkitemsareinclusiveofthese. 44. Allworkingtoolsandplantswillhavetobearrangedbythecontractorathisowncost. 45. Thefinalacceptanceof thetenderwillbesubjecttothereceiptofapprovalof higherauthorities. 46. Finalpayment willbe madeaftercompletionof allworks in the field&checkingbyauthorisedofficer.theauthorisedofficer maycheckthe qualityof the workatanypointof timebeforesubmittingthereportof completion. 47. Theundersignedreserves therighttocanceltheagreement atanypointoftimeduringtheexecution oftheworkifitnotdoneasperthespecifications or anyterms &conditionsare violatedbythecontractor. 48. TheSecurityDepositwillbereleasedtotheContractorafter1(One)monthfromthedate of finalpayment of the billifnoirregularityis noticed.incaseof anyirregularity,thesecuritydepositwillbeforfeitedinadditiontoanylegalactionasdeemfit &required. 49. Thesuccessfultendererwillnotassignanyorpartof thework(s)toanyothercontractor/agency.

50. The undersigned reserves the right of cancellation of this tender at any time without assigning any reason thereof. 51.
