Hearing none, Mr. Thomas Shepperd Moved to approve the agenda; seconded by Mayor Alan Krasnoff. The Motion Carried. Executive Director Report Mr. Robert Crum, HRTPO Executive Director, directed members towards his report included in the agenda package. He reported that a budget amendment was filed regarding the Richmond to Hampton Roads Passenger Rail Tier II Environmental Impact Statement (EIS) in the 2017 General Assembly session. The amendment would require the Virginia Department of Rail and Public Transportation and the HRTPO to work together to identify a firm cost estimate and a funding source for the Tier II EIS by July 1, Mr. Crum also stated the Board s action in 2016 to add the City of Franklin and Southampton County as official members to the HRTPO included a commitment to conduct a study of the Route 58 corridor. 4 Workshop Agenda Commonwealth Transportation Board Member Comments and Updates There were no representatives present from the Commonwealth Transportation Board (CTB). Virginia Department of Transportation Mr. James Utterback, Virginia Department of Transportation (VDOT) Hampton Roads District Administrator, reported he would brief the HRTPO Board in April 2017 on the status of major transportation projects underway. He noted VDOT has 14 studies moving forward in different stages of progression. Virginia Department of Rail and Public Transportation There were no representatives present from the Virginia Department of Rail and Public Transportation (DRPT). Virginia Port Authority Update Mr. John Reinhart, Virginia Port Authority (VPA) CEO and Executive Director, deferred his update to a status report on VPA scheduled following member comments. HRT and WATA Updates Mr. Ray Amoruso of Hampton Roads Transit (HRT) reported HRT s newest ferry boat will be in operation as of April He noted HRT will acquire two additional boats to serve Hampton Roads. Mr. Joshua Moore of the Williamsburg Area Transit Authority (WATA) had no comments. Citizen Transportation Advisory Committee (CTAC) Update Ms. Terry Danaher, Citizen Transportation Advisory Committee (CTAC) Co-Chair, reported the next CTAC meeting will be in April. She stated CTAC members strongly support mass transit in the region. Military Liaisons Comments and Updates Captain Rick Wester of the U.S. Coast Guard reported that the Coast Guard is working with the Chesapeake Bay Bridge Tunnel (CBBT) Commission regarding the construction of the Thimble Shoals Tunnel. He commented that the Army Corps of Engineers is working to reopen the Dismal Swamp Canal after Hurricane Matthew. Captain Dean VanderLey of the U.S. Navy had no comments. 5 Colonel Herbert Joliat of Langley-Eustis had no comments. Port of Virginia Status Report Mr. John Reinhart, CEO and Executive Director of the Virginia Port Authority, reported the Port of Virginia is growing faster than any port in the United States and briefed the Board on two major projects currently underway: the Norfolk International Terminal (NIT) North and South Expansions, and the Virginia International Gateway Expansion. Mr. Reinhart detailed how the port fits within the region s economy, noting Hampton Roads companies receive more than $2 billion in cargo value. More than 500 national companies are port customers providing an additional $4 billion in cargo value. Mr. Reinhart explained the NIT North Gate Expansion, a $31 million investment, adds 26 new truck gates, ties into a new I-564 Connector, and is slated for completion in June The NIT South Expansion includes a 46 percent increase in capacity (400,000 containers). The South Expansion is a $350 million investment, in which the first stacks are scheduled for completion in 2018 and all stacks are scheduled for completion in Mr. Reinhart also described the Virginia International Gateway Expansion, which increases capacity to 1.2 million containers, as well as including expanded rail operations, expanded berth, and four new ship-to-shore (STS) container cranes. The project commenced on November 17, Regional Proclamation Mr. Robert Crum, HRTPO Executive Director, stated the Hampton Roads region, through a Proclamation of Regional Consensus, would like to request assistance from the state and the federal government to secure funding for the completion of critical infrastructure to support the Hampton Roads economy. He reported several regional organizations have approved or plan to approve the proclamation, including the Hampton Roads Military and Federal Facilities Alliance, Hampton Roads Chamber, Virginia Peninsula Chamber of Commerce, Virginia Shipbuilders Association, Reinvent Hampton Roads, Opportunity, Inc., and the Peninsula Council for Workforce Development. Mr. Crum detailed three projects included in the Proclamation: Completion of improvements to Interstate 64 from Hampton Roads to Richmond Improving passenger rail service from Hampton Roads to Richmond, and the emerging northeast passenger rail corridor Completion of dredging to deepen and widen the region s harbor channel to support post-panamax container ships, while maintaining safe and secure mobility of Navy and Coast Guard assets. Mr. Crum noted the Hampton Roads Planning District Commission (HRPDC) voted to approve the Regional Proclamation at its January 19, 2017 meeting. 6 Hampton Roads Regional Transit Benchmarking Study Mr. John Mihaly, HRTPO Transportation Analyst II, reported on the final draft of the Hampton Roads Regional Transit Benchmarking Study, which compares public transit agencies in Hampton Roads to peer agencies across the nation and provides a baseline against which future performance may be measured. Measures included ridership, riders per revenue hour, riders per revenue mile, operating expenses per rider, fare revenue per rider, and farebox recovery ratios. Mr. Mihaly noted the study focused on bus transit in Hampton Roads and stated a working group has been established to provide guidance on transit topics for follow-up studies. Mr. Mihaly also stated the draft report was presented to TTAC on January 4, 2017 and was made available for public review and comment from December 21, 2016 through January 18, He detailed that comments received, along with HRTPO staff responses addressing the comments, are included in an appendix of the final report. Public Comment Period Meeting Agenda Ms. Donna Sayegh, Portsmouth Citizen, addressed the HRTPO Board regarding her concern about public involvement in the transportation process. A transcription of the public comments made orally during HRTPO Board meetings will be included in the HRTPO Agenda each month. The transcript will also be posted on the HRTPO website when available. Submitted Public Comments Chair Johnson reported there were no submitted comments in the Agenda packet. Authorizing Resolutions for FY 2018 Federal and State Grant Applications Mr. Robert Crum, HRTPO Executive Director, stated that each year, the HRTPO applies for regional planning funds under the Federal Transit Administration (FTA) Section 5303 program and the Federal Highway Administration (FHWA) State Planning and Research (SPR) Funds program. Mr. Crum noted both programs require a resolution by the HRTPO as part of the application process. Specifically, he explained, the resolution authorizes the HRTPO Executive Director to file an application for the funds on behalf of the HRTPO; execute and file all necessary certifications and assurances, as well as any other documents or information required for the application; and execute a grant agreement on behalf of the HRTPO. The resolutions also certify that the local share required to match the federal funds shall be made available from resources available to the HRTPO. 7 Mayor Alan Krasnoff Moved to approve the resolutions and authorize the Executive Director to file applications and execute associated documents for the FY 2018 FTA Section 5303 and SPR funding programs; seconded by Mr. Barry Cheatham. The Motion Carried. FY TIP Amendment: VDOT Mr. James Utterback, VDOT Hampton Roads District Administrator, reported VDOT is requesting to amend the FY Transportation Improvement Program (TIP) to add a new project title HRCS Preferred Alternative Refinement to carry out a geotechnical investigation from I-664 in Hampton to I-564 in Norfolk. He noted the below specifics: Planned allocations FFY 17 PE Phase AC-Other: $25,000,000 PE estimate: $25,000,000 The public review period for the proposed TIP amendment is scheduled from February 9, 2017 through February 23, Mr. Thomas Shepperd Moved to approve the TIP amendment, subject to resolution of the source of funding for allocations and obligations, and receipt of no adverse comments during the public comment period; seconded by Mayor William Sessoms. The Motion Carried. Consent Agenda The Consent Agenda is as follows: Approve the minutes. Accept the HRTPO Financial Statement. Approve the RSTP fund transfer and the associated TIP Revision as an Amendment (Virginia Beach). Approve the Regional Proclamation. Approve the final Hampton Roads Regional Transit Benchmarking Study for public distribution. Approve Ms. Delceno Miles to fill a CTAC vacancy. Mayor William Sessoms Moved to approve the Consent Agenda as written; seconded by Mayor Alan Krasnoff. The Motion Carried. HRTPO Board Three-Month Tentative Schedule Chair Johnson outlined the HRTPO Board three-month tentative schedule in the Agenda Packet. 18 PURPOSE In accordance with Federal regulations (23 CFR ), metropolitan planning areas (MPAs) must certify at least every four years, concurrent with the submittal of the entire proposed Transportation Improvement Program (TIP) as part of the Statewide Transportation Improvement Program, that the metropolitan transportation planning and programming process is being carried out in accordance with applicable requirements. These requirements include highway, transit, and air-quality regulations and laws, as well as Title VI of the Civil Rights Act of 1964 and related nondiscrimination authorities. The questions within this document serve as a guide to issues considered during the selfcertification process. HAMPTON ROADS TRANSPORTATION PLANNING ORGANIZATION The Hampton Roads Transportation Planning Organization (HRTPO) is the metropolitan planning organization (MPO) for the Hampton Roads area. As such, it is a federally mandated transportation policy board comprised of representatives from local, state, and federal governments, transit agencies, and other stakeholders and is responsible for transportation planning and programming for the Hampton Roads MPA. Any highway or transit project or program to be constructed or conducted within the MPA and to be paid for with Federal funds, must receive approval by the HRTPO before any Federal funds can be expended. 19 INTRODUCTION The Hampton Roads Transportation Planning Organization (HRTPO) Self-Certification Procedural Guide was developed to serve as a reference for staff, reviewing agencies, and the public to assure that metropolitan transportation planning and programming processes are being carried out in accordance with applicable requirements. This Guide is organized as follows: Self-Certification Questions This section includes the questions used to ascertain that the HRTPO transportation planning and programming processes comply with pertinent laws and regulations. Appendix A Enumerates and defines applicable requirements. Items 1 and 2 of this section list and briefly explain highway, transit, and air-quality regulations and laws. Items 3 through 10 provide information about Title VI of the Civil Rights Act of 1964 and related nondiscrimination statutes. Appendix B Includes the HRTPO Self-Certification Form. When the Self- Certification Form is submitted, it will be accompanied by an Accomplishments Report highlighting HRTPO initiatives and accomplishments achieved through the regional transportation planning and programming processes since the previous self-certification. The self-certification process takes place at least every four years, concurrent with the submittal of the entire proposed HRTPO Transportation Improvement Program (TIP). The FY TIP is scheduled for approval by the HRTPO Board on April 20, The Self-Certification Form and Accomplishments Report will be included in the appendix of the approved FY TIP. 3 Attachment 19-F

What sources does the HRTPO use to educate and inform the public about plans, programs, and activities (i.e. website, press releases, newspapers, mailers, etc.)? e. Are meetings held at convenient times and at accessible locations? f. Is the public given an opportunity to provide oral and/or written comments on the planning process? g. Does the HRTPO seek out and consider the needs of those traditionally underserved by existing transportation systems, such as low-income and minority households? h. Highway and Public Transportation a. 23 U.S.C. 134 Highways Sec Metropolitan Planning This section describes the legal framework for metropolitan planning areas (MPAs) and the conduct of the metropolitan transportation planning processes, development of transportation plans, programs, and activities to encourage and promote the safe and efficient management, operation and development of transportation systems. b. 49 U.S.C. 53 Public Transportation Sec Metropolitan Transportation Planning This section provides the legal framework to encourage and promote the safe and efficient management, operation, and development of surface transportation systems that will serve the mobility needs of people and freight and foster economic growth and development within and between States and urbanized areas. This section also encourages the continued improvement and evolution of the metropolitan and statewide transportation planning processes. c. 23 CFR part (a) Self certifications and Federal certifications Regulations to ensure the State and MPAs certify at least every four years that the metropolitan planning process is being carried out in accordance with all applicable requirements. 2. Clean Air Act and Related Regulation a. The Clean Air Act (CAA) is the law that defines the Environmental Protection Agency s responsibilities for protecting and improving the nation's air quality and the stratospheric ozone layer. The last major change in the law, the Clean Air Act Amendments of 1990, was enacted by Congress in b. 40 CFR part 93 Determining Conformity of Federal Action State or Federal Implementation Plans This section sets forth policy, criteria, and procedures for demonstrating and assuring conformity of such activities to an applicable implementation plan developed pursuant to the CAA. This section also provide procedures for air quality nonattainment and maintenance to implement requirements with respect to the conformity of transportation plans, programs, and projects which are developed, funded, or approved by the United States Department of Transportation (USDOT), and by MPOs or other recipients of highway or transit funds. 7 Attachment 19-F

Title VI of the Civil Rights Act of 1964 states, "No person in the United States shall, on the ground of race, color, or national origin be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance." Title VI of the Civil Rights Act of 1964 set a standard which authoritatively outlawed discrimination in the conduct of all federal activities. Subsequent laws and Presidential Orders added handicap, sex, age, and income status to the criteria for which discrimination is prohibited. Executive Order directs Federal agencies to make Environmental Justice part of their missions by identifying and addressing disproportionately high and adverse human health or environmental effects of their programs, policies, and activities on minority and low-income populations. Executive Order requires Federal agencies to examine the services they provide, identify any need for services to those with limited English proficiency (LEP), and develop and implement a system to provide those services so LEP persons can have meaningful access to them. This Executive Order also requires that the Federal agencies work to ensure that recipients of Federal financial assistance provide meaningful access to LEP applicants and beneficiaries U.S.C prohibits discrimination on the basis of race, color, creed, national origin, sex, or age in employment or business opportunity. 5. Section 1101(b) of the FAST Act (Pub. L and 49 CFR part 26 provide the legal and regulatory framework regarding the involvement of disadvantaged business enterprises in USDOT funded projects CFR part 230 provides regulatory standards for the implementation of an equal employment opportunity program on federal and federal-aid highway construction contracts. 7. The Americans with Disabilities Act (ADA) prohibits discrimination against people with disabilities in employment, transportation, public accommodation, communications, and governmental activities. It prohibits the discrimination on the basis of disability by public accommodations and in commercial facilities. 8. The Older Americans Act prohibits discrimination on the basis of age in programs or activities receiving federal financial assistance. 9. Section 324 of title 23 U.S.C. prohibits discrimination based on gender. 10. HRTPO FY 2016 CMAQ/RSTP PROJECT SLEECTION PROCESS REPORT As the Metropolitan Planning Organization (MPO) for the Hampton Roads area, the HRTPO is responsible for project selection and allocation of funds under two federal funding programs the Congestion Mitigation and Air Quality Improvement Program (CMAQ) and the Regional Surface Transportation Program (RSTP). RECONCILING FY 2018 CMAQ AND RSTP FUNDING SHORTFALLS HRTPO staff received updated Congestion Mitigation and Air Quality Improvement Program (CMAQ) and Regional Surface Transportation Program (RSTP) preliminary estimates (marks) for fiscal years (FY) from VDOT on March 1, The updated marks resulted in funding shortfalls in FY18 of $250,690 CMAQ and $579,545 RSTP. Since 100% of the previous marks had been allocated for FY18, the only way to reconcile the shortfall is to reduce FY18 allocations on projects. HRTPO staff developed a strategy that addressed the FY18 funding shortfalls by affecting only one CMAQ project and one RSTP project and coordinated with the administrators of those two projects. The strategy (shown in the tables below) includes reducing the FY18 allocation as necessary to resolve the over-allocation in that year and replacing the funding with available funding from later years. FY 2018 TRANSPORTATION ALTERNATIVES SET-ASIDE: PROJECT SELECTION During the March 2017 TTAC meeting, HRTPO staff provided an FY 2018 Transportation Alternatives (TA) Set-Aside update, noting that the Transportation Programming Subcommittee (TPS) would meet on March 17, 2017 to review the scored project proposals and submit a recommended set of TA Set-Aside projects and allocations for consideration by the TTAC in April. Prior to the March TPS meeting, HRTPO staff met with the Commonwealth Transportation Board (CTB) member for the Hampton Roads District to determine the projects on which he intended to allocate the portion of TA Set- Aside funds designated to him. A total of 19 applications were submitted from within the Hampton Roads Metropolitan Planning Area (MPA), but one application was subsequently withdrawn by the applicant. Of the remaining 18 applications, four were for existing projects and 14 were new projects.
