McKinney Street, Denton, Texas at which time the following items will be considered: WORK SESSION 1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials. 2. 3 Agenda Information Sheet DEPARTMENT: CM/ ACM: Finance Bryan Langley Date: June 25, 2014 SUBJECT Receive a report, hold a discussion, and give staff direction regarding project recommendations from the Citizens Bond Advisory Committee for the November 2014 bond election. BACKGROUND On November 19, 2013, the City Council formally created a Citizens Bond Advisory Committee to provide recommendations on projects to be considered in a November 2014 bond election. The Council appointed fifty-one (51) members of the public to serve on the Committee, and Mr. Tim Crouch and Mr. Randy Robinson were appointed as Co-Chairpersons of the Committee. The Council established a formal charge for the Committee, requesting that the Committee focus on existing facilities, infrastructure, drainage improvements, and the downtown area. The Council charged the Committee to specifically consider the reconstruction of Fire Stations No. 3 and No. 4 and $12 million to fund reconstruction of City streets. The Council also asked that the Committee consider including funding for Public Art in accordance with the Public Art Policy approved by the Council in The Committee convened twelve meetings to discuss the various projects under consideration for the 2014 bond program. The Committee created three subcommittees to explore various service areas in more detail: Transportation (including drainage), Leisure Services, and Public Facilities. The Subcommittees conducted tours of various project sites on March 17, 25 and 29. The Committee also solicited public input through a series of four community meetings held throughout the City on January 22, January 25, January 27 and February 1, The Committee published an address and phone number to receive suggestions and comments, and all agendas and minutes were published on the City s website. The Committee finalized its recommendations on May 27, 2014 and made a presentation to the City Council on June 3, In Section of the City Charter, it is stated that the Planning and Zoning Commission may Submit annually to the City Manager prior to the beginning of the budget year, a list of recommended general obligation capital improvements which in the opinion of the Commission ought to be constructed during the forthcoming five (5) year period. (Such list shall be arranged in order of preference, with recommendations as to which projects should be constructed in which year, and the City Manager shall forthwith furnish a copy of such recommendations to each member of the Council.) Due to this provision of the City Charter, the Citizens Bond Advisory Committee would like to present their recommendations for projects in the upcoming bond election. Mr. Tim Crouch and Mr. Randy Robinson will provide a presentation at the meeting to facilitate this conversation with the Planning and Zoning Commission.

Exhibit 2 provides a PowerPoint presentation which summarizes the process and recommendations of the Citizens Bond Advisory Committee. PRIOR ACTION/REVIEW (Council, Boards, Commissions) On October 7, 2013, the City Council discussed the proposed 2014 Bond Program and received a presentation from City staff regarding the initial project list. The City Council recommended a fifty (50) member Citizen Bond Advisory Committee with seven appointments by each council member and a committee chair. On November 5, 2013, the City Council discussed the proposed bond election and appointed members to the Citizen Bond Advisory Committee. On November 19, 2013, the City Council approved a resolution creating a Special Citizen Bond Advisory Committee and appointed members to the Committee. On December 3, 2013, the City Council appointed members to the Citizen Bond Advisory Committee. On December 10, 2013, the City Council appointed members to the Citizen Bond Advisory Committee. The Citizen Bond Advisory Committee met on the following dates to discuss recommendations for the 2014 bond program: December 19, 2013 January 6, 2014 January 21, 2014 February 10, 2014 February 24, 2014 March 3, 2014 March 17, 2014 March 31, 2014 April 14, 2014 April 28, 2014 May 12, 2014 On May 27, 2014, the Citizen Bond Advisory Committee voted to make a formal recommendation to the City Council regarding the 2014 bond program. 8 Exhibit 2 Citizens Bond Advisory Committee In November 2013, the Council formally established a Citizens Bond Advisory Committee and appointed 51 members, including two chairpersons. The Committee met 12 times from December 2013 through May 2014 to discuss the projects proposed by staff and the community. Three subcommittees were formed to discuss specific service areas: Transportation (including drainage), Public Facilities, and Leisure Services.

The property is located within Planned Development District (PD-132). BACKGROUND This plat was considered by the Planning and Zoning Commission during the June 11, 2014 meeting. However, due to unclear notes on the plat, the project was continued to the June 25, 2014 meeting. The applicant will be present at the meeting in order to clarify General Note 11 and General Note 12. The applicant is proposing to replat seven existing lots (The Preserve at Pecan Creek Section N, Phase 3A; The Preserve at Pecan Creek Section N, Phase 3B) into nine lots, two lots being open space to be maintained by the homeowner s association. The property is currently vacant. Per the applicant, the purpose of the replat is to accommodate the location and maintenance of a retention wall that will be located on Lots 90X and 108X. The final plats for this subdivision were first approved in PD-132 permits five units per acre. This replat does not increase the density. The proposed request is in conformance with the approved Planned Development District Ordinances. The Denton Development Code (DDC) defines a replat as a change in a map of an approved or recorded subdivision plat if such change affects any street layout on such map or area reserved thereon for public use or any lot line or if it affects any map or plan legally recorded prior to the adoption of any regulations controlling subdivisions. In addition to the above, Section of the Texas Local Government Code states that a replat of a subdivision or part of a subdivision may be recorded and is controlling over the preceding plat without vacation of that plat if the replat: 1. is signed and acknowledged by only the owners of the property being re-platted;
24 Agenda Information Sheet June 25, 2014 Page 2 2. is approved, after a public hearing on the matter at which parties in interest and citizens have an opportunity to be heard, by the municipal authority responsible for approving plats; and 3. does not attempt to amend or remove a covenants or restrictions. On May 21, 2014, two (2) public notices were sent to property owners within 200 feet of the subject site. One-hundred and three (103) courtesy notices were also sent to residents within 500 feet of this proposal. As of this writing, staff has not received any response. OPTIONS 1. Recommend approval as submitted. 2. Recommend approval subject to conditions. 3. Recommend denial. 4. Postpone consideration. 5. Table the item.
