5 REGULAR CITY COUNCIL MEETING MINUTES APRIL 10, 2017 Call to Order: Mayor Dingler called the Regular City Council Meeting to order at 6:01 p.m., at the Ocean Shores Convention Center. The recorded meeting may be accessed on the City website or viewed on cable Channel 68 Tuesday and Friday at 7:00 p.m. Elected Officials present: Mayor Dingler and Councilmembers Lynn, Plackett, Griebel, Martin, Farra, Peterson, and Broadbent. City Staff present: Police Chief Neccie Logan, Finance Director Angela Folkers, Public Works Director Nick Bird, City Planner Alicia Bridges and City Clerk Rachel Carl. Others present: Cathey Peterson, Planning Commission Chair and Linda Whitcher, Planning Consultant. Roll Call: City Clerk Carl called roll. Pledge of Allegiance: Meeting Agenda Approval: Councilmember Plackett led the Pledge of Allegiance. Melanie Jones commented on events at the Library. Susan Conniry commented on a recent Town Hall Meeting. Diane Beckley commented on the recent Town Hall Meeting and on State funding for public projects. Collette Thomas commented in opposition to adding another retail marijuana store. Mayor Dingler announced that anyone who came prepared to speak on Item No. 10 can have three (3) minutes to address the Council since the item was removed from the agenda after the sign-up sheet was removed. 6 REGULAR CITY COUNCIL MEETING MINUTES APRIL 10, 2017 Public Communication continued: Diane Beckley commented on the need and the downtown vision of Ocean Shores. Lillian Broadbent commented on limiting the location of an additional store and implementing the original rules that the State made the first store follow. Announcements: Mayor Dingler announced that there are five member and two alternate vacancies on the Building Code Board of Appeals, two vacancies on the Park Board, and one vacancy on the Radio Board. Mayor Dingler announced that there will be a public hearing on the Building Moratorium for Block 1 of Divisions 19 and 19A at 6:00 p.m. on Monday, April 24, 2017 at the Ocean Shores Convention Center. Appointments: Mayor Dingler appointed, with Council consensus, Thomas Ferguson to the Radio Board. Mr. Ferguson took his oath of office. Other Reports: Staff Report: Commissioner Vickie Raines gave a report on Grays Harbor County. Planning Commission Chair Cathey Peterson, Planning Consultant Linda Whitcher, and City Planner Alicia Bridges gave a brief report on amendments to the proposed Shoreline Master Program. Mayor Dingler recessed the Regular City Council Meeting at 7:11 p.m. Mayor Dingler reconvened the Regular City Council Meeting at 7:20 p.m. Council Liaison Reports: Councilmember Martin reported on legislative issues. Councilmember Plackett reported attending the Grays Harbor Hospital Board Meeting. Councilmember Farra reported signing warrants and attending the Port. Mayor s Report: Consent Agenda: Mayor Dingler reported that the new Public Records Assistant started this week; property across from Fire Station is available for sale; first City Talk episode was recorded and aired; changes coming to the configuration of tables at the City Council Meeting; Spring Clean-up will be May 2-4; attended Pt. Approval of Treasurer Checks #12797 through #12801 and # through # in the amount of $6,325, dated February 2017 and April Approval of Payroll Warrants # through # plus 83 direct deposit transactions in the amount of $186, dated the 5th day of April A Public Hearing before the City Council of the City of Ocean Shores, Washington, to receive comment for or against any portion of the proposed Shoreline Master Program. Mayor Dingler recessed the Regular City Council Meeting at 7:39 p.m. to convene into a Public Hearing. Planning Consultant Linda Whitcher gave a brief introduction to the proposed Shoreline Master Program and the public hearing. There was Council consensus to receive written public comment for the next twenty (20) days. Comments should be submitted to City Planner Alicia Bridges at abridges@osgov.com. The following public comment was received: Lillian Broadbent expressed concern that the proposed amendments had not been presented to the Citizen Advisory Panel. She asked for more definition in the portion about cutting vegetation on private property for view because trees are important for raptors. She said that she objects strongly to this modification, is okay with the structural setbacks, and thinks it needs to be better thought-out. Diane Beckley asked what will be the notification process for property owners that will be affected by the proposed changes. Mike Valdez commented that deeper setbacks for oceanfront property in the building moratorium area could be considered a taking of land and subject the City to litigation; he asked that the Council not consider allowing deeper setbacks in the building moratorium area. Kyle Dearkopf of Coast Seafoods Company, part of Pacific Seafood Group, commented in favor of the Planning Commission s balancing preservation of industry, recreational interest, and environmental interest; he highlighted the importance of the shellfish industry to Grays Harbor County. Mayor Dingler adjourned the Public Hearing and reconvened the Regular City Council Meeting at 7:56 p.m. Old Council Business: New Council Business: Ordinance No.997: Creation of New LID Funds None. An Ordinance of the City Council of the City of Ocean Shores, Washington, creating a Special Revenue Fund and two Debt Service Funds. Angela Folkers gave the first reading of the Ordinance by title. 8 REGULAR CITY COUNCIL MEETING MINUTES APRIL 10, 2017 New Council Business continued: Ordinance No.997: Creation of New LID Funds Recording #01:49:06 - Councilmember Lynn made a motion that we waive the second reading and approve an Ordinance of the City Council of the City of Ocean Shores, Washington, creating a special revenue fund and two debt service funds and add the five day statement in the wording. Councilmember Griebel seconded the motion. There was a Council question regarding the purpose of the fund creation. The motion passed unanimously. Request: Award of the WWTP Aeration and Building Improvements Project A Request for the City Council of the City of Ocean Shores, Washington to award the WWTP Aeration and Building Improvements Project to the lowest responsive and responsible bidder, Rognlin s, Inc. Nick Bird presented the Request. There was no public comment. There was a Council comment regarding the bidders. Recording #01:54:02 - Councilmember Lynn made a motion that we approve a request of the City Council of the City of Ocean Shores, Washington to award the WWTP Aeration and Building Improvements Project to the lowest responsive and responsible bidder, Rognlin s, Inc. Councilmember Peterson seconded the motion. The motion passed unanimously. Mayor Dingler recessed the Regular City Council Meeting at 8:05 p.m. Mayor Dingler reconvened the Regular City Council Meeting at 8:09 p.m. Discussion: Shoreline Master Plan: Cathey Peterson, Planning Commission Chair, Linda Whitcher, Planning Consultant, and Alicia Bridges, City Planner, discussed comment received during the Public Hearing and asked for Council direction in responding to the comment in the Shoreline Master Program. There was Council discussion regarding Critical Areas regulations; the Shoreline Restoration Plan; pie-shaped lots on the fresh waterways; submitting questions in writing; and conditional use permit. Mayor Dingler recessed the Regular City Council Meeting at 8:40 p.m. Mayor Dingler reconvened the Regular City Council Meeting at 8:47 p.m. Asphalt Repairs: Public Works Director Nick Bird gave a Power Point presentation on asphalt repair options. There was Council discussion regarding paying $15,000 for a pilot project; what work would be done for the $15,000; the number of sites that need repairs; repair timeline; sealing the streets; durability of patching; measuring success of a pilot project; and other areas where this process was used Regular Meeting Page 4 of 5 5. 9 REGULAR CITY COUNCIL MEETING MINUTES APRIL 10, 2017 Discussion continued: Asphalt Repairs Bikini Baristas: Recording #03:02:57 - Councilmember Peterson made a motion that we try whatever you call this process, urethane injection on the five spots, the pilot project, as proposed. Councilmember Plackett seconded the motion. The motion passed with five yes votes and two no votes by Councilmembers Farra and Broadbent. Mayor Dingler stated that the City received an inquiry about requirements for bikini baristas. There were Council questions regarding the current City Code; other bikini barista stands in Grays Harbor County; prohibiting this kind of business; having a special meeting to identify rules and regulations for marijuana and bikini baristas; and establishing a moratorium while working on this issue. Recording #03:12:48 - Councilmember Peterson made a motion to have a moratorium on bikini barista establishments and to have a special meeting as soon as possible. Councilmember Plackett seconded the motion. The motion passed unanimously. Utility Task Vehicles (UTVs): Executive Session: Future Agenda Items: There was a Council concern regarding using this type of vehicle in the dunes. Council will discuss this item the next time. None. Councilmember Martin asked for a Study Session to discuss where marijuana can be sold within the City limits. There was Council consensus to hold a Special Meeting. Recording #03:21:09 - Councilmember Peterson made a motion that we have a Special Meeting regarding the relocation of any current businesses that sell cannabis in our City. Councilmember Plackett seconded the motion. The motion passed with six yes votes and zero no votes, and one abstention by Councilmember Lynn. Pledge of Allegiance: Ordinance No.998: Moratorium on Permits for the Establishment, Operation, Relocation and/or Maintenance of Certain Land Uses within the B-1 and B-2 Zoning Districts Councilmember Plackett led the Pledge of Allegiance. An Ordinance of the City Council of City of Ocean Shores, Washington, adopted pursuant to RCW 35A and RCW 36.70A.390; imposing a temporary moratorium upon the receipt and processing of applications for permits for the establishment, operation, relocation, and/or maintenance of certain land uses within the B-1 and B- 2 zoning districts; setting forth findings of fact in support of said moratorium; stating the effect on vested rights; providing for severability; scheduling a public hearing date; authorizing official interpretations by the City of Ocean Shores Mayor; declaring an emergency and establishing an immediate effective date; and allowing for summary publication by title only. Mayor Dingler gave the first reading of the Ordinance by title. There was public communication regarding the potential for regulations to affect hotel conventions and three comments in opposition to a bikini barista business. There were Council questions and discussion in support of the ordinance; regarding typos; the moratorium length; and regulating these businesses. Mayor s Report: Consent Agenda: Mayor Dingler thanked staff for coming and sitting up front, and she reported that the Grays Harbor Shorebird and Nature Festival is May 5-7; Arbor Day is Friday, April 28; the Arbor Day planting will take place on April 29; the Flag Day Parade is on June 10; asked Councilmembers for suggested topics for City Talk; and attended the Southwest Washington Regional Transportation Planning Organization meeting. 15 REGULAR CITY COUNCIL MEETING MINUTES APRIL 24, 2017 New Council Business: Ordinance No.999: Extension of Development Moratorium in Divisions 19 & 19A An Ordinance of the City Council of the City of Ocean Shores, Grays Harbor County, Washington, adopting the Findings of Fact and recognizing the work plan to support a nine month renewal to Emergency Moratorium 971 passed and effective February 22, 2016, and was renewed for an additional nine months on August 8, 2016 on the acceptance of applications for new development or redevelopment for properties, generally described as Block 1, Division 19 and 19A until the City completes the process of analysis and studies relating beach erosion for the areas subject to this moratorium, and confirming the maintenance of the moratorium for nine months after the end of the initial period, as required by RCS 36.70A.390 and 35A City Attorney Brent Dille gave the first reading of the Ordinance by title. There was public comment regarding the relation between the Shoreline Master Program (SMP) and the moratorium. There were Council questions and discussion regarding allowing non-habitable structures; ending the moratorium; the relation between the moratorium and the SMP; repairs and additions to existing residences; and an appeal process. There were Council questions and discussion regarding LID surplus transfers; creation of the funds; General Fund balance; restrictions; reason for moving funds; using excess LID money for the Street Reserve Fund; and budgeting principles. 16 REGULAR CITY COUNCIL MEETING MINUTES APRIL 24, 2017 Executive Session: Mayor Dingler recessed the Regular City Council Meeting at 7:03 p.m. to convene into Executive Session to consider the selection or the acquisition of real estate by lease or purchase when the public knowledge regarding such consideration would cause a likelihood of increased price, RCW (b). The Executive Session will last approximately fifteen minutes. Mayor Dingler convened the Executive Session at 7:04 p.m. The Executive Session was extended for ten minutes at 7:19 p.m. The Executive Session was extended for ten minutes at 7:29 p.m. Mayor Dingler adjourned the Executive Session at 7:31 p.m. Mayor Dingler reconvened the Regular City Council Meeting at 7:39 p.m. Recording #01:02:14 - Councilmember Lynn made a motion that we authorize the Mayor to move ahead with the acquisition of real property. Councilmember Griebel seconded the motion. There was a Council comment regarding having citizen input before moving ahead. The motion passed with five yes votes and two no votes by Councilmembers Plackett and Farra. Future Agenda Items: Mayor Dingler asked that utility task vehicles (UTVs) be moved forward to the next agenda. There were four Councilmembers in favor of adding that item to the list. Councilmember Peterson asked that the stairs at Bill s Spit be added to the Future Agenda Items List. There were four Councilmembers in favor of adding that item to the list. Councilmember Martin ask that the Council form a Council to look at the issues that go along with the location of retail marijuana stores and bikini baristas. There were four Councilmembers in favor of adding that item to the list. Councilmembers Plackett, Martin, and Farra will be on the committee. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF OCEAN SHORES, WASHINGTON ESTABLISHING A WHEELED ALL-TERRAIN VEHICLE CHAPTER IN THE OCEAN SHORES MUNICIPAL CODE TITLE 10 VEHICLES AND TRAFFIC WHEREAS, the City wishes to allow the limited use of Wheeled All-Terrain Vehicles on the City streets as authorized under RCW ; and WHEREAS, the City of Ocean Shores wishes to limit the definition of Wheeled All- Terrain Vehicles; and. WHEREAS, pursuant to RCW (1)(d)(i) a person may not operate a Wheeled All-Terrain Vehicle on a public roadway within the boundaries of a city or town, unless the city or town by ordinance has approved the operation of wheeled all-terrain vehicles on city or town roadways; and WHEREAS, the Ocean Shores City Council has received input from the City and area citizens as well as City law enforcement and government officials on the use of Wheeled All-Terrain Vehicles on City streets; and WHEREAS, pursuant to RCW 35A , the Ocean Shores City Council has all powers possible under the Washington State Constitution not specifically denied by law which may be exercised for the protection and maintenance of public ways; and WHEREAS, the City recognizes that decisions it makes and actions it takes regarding this issue may affect its citizens as well as citizens located near Ocean Shores; and WHEREAS, it is the duty of the City to protect the health, safety, and welfare of its citizens and to protect the natural environment of the City, including the dunal area of the City. 20 Section 1: Title 10, Vehicles and Traffic, of the Ocean Shores Municipal Code is hereby amended to include a new Chapter 10.32, Wheeled All-Terrain Vehicles, which reads as follows: Ocean Shores Municipal Code Chapter WHEELED ALL-TERRAIN VEHICLES Definitions Use of wheeled all-terrain vehicle on city streets Restrictions on use of wheeled all-terrain vehicle on city streets Equipment requirements of a wheeled all-terrain vehicle Registration and Insurance requirements of a wheeled all-terrain vehicle Duty to obey traffic-control devices and rules of the road Towing Prohibited uses Violation - Penalty Severability Definitions. When used in this chapter, the city defines the words and phrases listed below as follows: "City" means the city of Ocean Shores, its elected officials, its employees, and its agents. "City street" means every way, lane, road, street, boulevard, and every way or place in the city open as a matter of right to public vehicular traffic inside the city limits. "Commercial use" means any vehicle the principal use of which is the furtherance of a company s business purpose but shall not include transportation of commodities, merchandise, produce, freight, animals, or passengers for hire. Emergency management means the carrying out of emergency functions related to responding and recovering from emergencies and disasters, and to aid victims suffering from injury or damage, resulting from disasters caused by all hazards, whether natural, technological, or human caused, and to provide support for search and rescue operations for persons and property in distress. Highway, for the purpose of this chapter only, means the entire width between the boundary lines of every roadway publicly maintained by the state department of transportation or any county or city with funding from the motor vehicle fund. A highway is generally capable of travel by a conventional two-wheel drive passenger automobile during most of the year and in use by such vehicles. Page 2 of 7 Ordinance No. 7. 21 Land owned or controlled by the City means any land owned by the City of Ocean Shores, or any land controlled by easement, lease, license, right-of-entry, or other written agreement giving the City use of the subject property. "Motorcycle helmet" has the same meaning as provided in RCW Non-highway road means any road owned or managed by a public agency, a primitive road, or any private road for which the owner has granted an easement for public use for which appropriations from the motor vehicle fund were not used for (a) original construction or reconstruction in the last twenty-five years; or (b) maintenance in the last four years. "Rules of the road" means all the rules that apply to vehicle or pedestrian traffic as set forth in state statute, rule or regulation. Seashore Conservation Area means all lands now or hereafter under state ownership or control lying between the North Jetty and Damon Road, and occupying the area between the line of ordinary high tide and the line of extreme low tide, as these lines now are or may hereafter be located, and, where applicable, between the Seashore Conservation Line, as established by survey of the Washington state parks and recreation commission and the line of extreme low tide, as these lines now are or may hereafter be located; and shall also include all state-owned nontrust accreted lands along the ocean. "Sidewalk" means that property between the curb lines or the lateral lines of a city street and the adjacent property, set aside and intended for the use of pedestrians or such portion of private property parallel and in proximity to a city street and dedicated to use by pedestrians. Wheeled all-terrain vehicle or WATV means (a) a utility-type vehicle designed for and capable of travel over designated roads that travels on four or more low-pressure tires of twenty psi or less, has a maximum width less than seventy-four inches, has a maximum weight less than two thousand pounds, has a wheelbase of one hundred ten inches or less, and satisfies at least one of the following: (i) Has a minimum width of fifty inches; (ii) has a minimum weight of at least nine hundred pounds; or (iii) has a wheelbase of over sixty-one inches, and (b) where the operator and passenger sit side by side in the vehicle, manufactured primarily for recreational non-highway all-terrain use, as further defined by the State Model Traffic Ordinance Use of wheeled all-terrain vehicle on city streets. Subject to the restrictions and requirements set forth in this chapter, a person with a valid driver's license issued by the state of the person's residence may operate a wheeled all- Page 3 of 7 Ordinance No. 7. 22 terrain vehicle upon a city street having a speed limit of 35 miles per hour or less for commercial use only Restrictions on use of wheeled all-terrain vehicle in the City. A. A person who operates a wheeled all-terrain vehicle must wear a securely fastened motorcycle helmet while the vehicle is in motion; B. A person may not operate a wheeled all-terrain vehicle upon a city street with a speed limit in excess of 35 miles per hour; however, a person may cross a city street with a speed limit in excess of 35 miles per hour at a controlled intersection if the crossing begins and ends on a city street with a speed limit of 35 miles per hour or less and occurs at an intersection of approximately 90 degrees; C. Except as provided in Section D, herein, it is unlawful to operate a wheeled allterrain vehicle, in a park, on the ocean beach within the dunes protection area as defined in Ocean Shores Municipal Code , which prohibits motorized vehicles of all types at all times, except for public vehicles operated in the performance of official duties, utility vehicles when engaged in servicing utility facilities, and vehicles responding to an emergency. D. A person may operate a wheeled all-terrain vehicle upon any city street while being used under the authority or direction of an appropriate agency that engages in emergency management, as defined in RCW , or search and rescue, as defined in RCW , or a law enforcement agency, as defined in RCW , within the scope of the agency's official duties Equipment requirements of a wheeled all-terrain vehicle. A wheeled all-terrain vehicle operated on a city street must comply with the following equipment requirements: A. Headlights meeting the requirements of RCW and and used at all times when the vehicle is in motion; B. One tail lamp meeting the requirements of RCW and used at all times when the vehicle is in motion upon a city street; however, a utility-type vehicle, as described under RCW , must have two tail lamps meeting the requirements of RCW (1) and to be used at all times when the vehicle is in motion upon a city street; C. 23 E. During hours of darkness, as defined in RCW , tum signals meeting the requirements of RCW ; F. Outside of hours of darkness, the operator must comply with RCW or ; G. A mirror attached to either the right or left handlebar, which must be located to give the operator a complete view of the city street for a distance of at least 200 feet to the rear of the vehicle; however, a utility-type vehicle, as described under RCW (19), must have two mirrors meeting the requirements of RCW ; H. A windshield meeting the requirements of RCW , unless the operator wears glasses, goggles, or a face shield while operating the vehicle, of a type conforming to rules adopted by the Washington State Patrol; I. A horn or warning device meeting the requirements of RCW ; J. Brakes in working order; K. A spark arrester and muffling device meeting the requirements of RCW ; and L. For utility-type vehicles, as described under RCW (19), seat belts meeting the requirements of RCW Registration and Insurance requirements of a wheeled all-terrain vehicle. A. A wheeled all-terrain vehicle operated on a city street must comply with all the registration requirements of Chapter RCW. B. Wheeled all-terrain vehicle operators will carry the Washington State minimum required liability insurance as found in RCW for vehicles registered under RCW 46. l 6A Duty to obey traffic-control devices and rules of the road. Unless a police officer directs otherwise, a person operating a wheeled all-terrain vehicle must obey all rules of the road that apply to vehicle or pedestrian traffic and must obey the instructions of official traffic-control signals, signs and other control devices applicable to vehicles. 24 to all of the duties that RCW Chapter et seq. imposes on an operator of a vehicle, except as to those provisions thereof which by their nature can have no application. Wheeled all-terrain vehicles must be operated with all four wheels of the wheeled allterrain vehicle on the roadway; no shoulder driving is permitted, except for slowing to allow vehicle traffic to pass Towing. Wheeled all-terrain vehicle operators shall abide by the manufacturer's guidelines or specifications when towing approved devices. It will be unlawful for any wheeled allterrain vehicle to pull any sled, toboggan, trailer or other device except by means of a rigid tow bar connecting the same to such device. No person shall be pulled in any fashion by a wheeled all-terrain vehicle Prohibited uses. A. Recreational use of wheeled all-terrain vehicles on City streets shall not be permitted. B. No person may operate or ride a wheeled all-terrain vehicle in a negligent or unsafe manner, but must operate it with reasonable regard for his or her own safety and for the safety of others. C. No person may operate a wheeled all-terrain vehicle side-by-side in a single lane of traffic and must have enough space between each wheeled all-terrain vehicle for a fullsized vehicle to pass each wheeled all-terrain vehicle safely. D. No person shall not operate a wheeled all-terrain vehicle for the transportation of commodities, merchandise, produce, freight, animals, or passengers for hire Violation - Penalties Violation of any section of this ordinance by any person shall be punishable by a fine of up to $1,000 per violation. The parent or legal guardian of a minor who knowingly allows the minor to operate a wheeled all-terrain vehicle in violation of this ordinance shall be punished by a fine of up to $1,000 per violation. Violations of this chapter shall be classified as traffic infractions, except as otherwise provided. Traffic infractions are noncriminal offenses Severability Each separate provision of this chapter is independent of all other provisions. Design and permitting activities were completed in We had a little delay in receiving WSDOT authorization to advertise, ultimately receiving authorization to advertise in March. Bid documents were finalized and published for advertisement on March 29, Bid proposals were received on April 20, 2017 and are shown on the attached bid tabulation. Three bid proposals were received ranging from $2,196, to $2,259, for both Schedule A and Schedule B. The apparent low bidder was Cascade Bridge, LLC from Vancouver, Washington. Staff has verified that Cascade Bridge has met the responsibility criteria set forth in RCW and OSMC As a result, the recommendation is to award the project to Cascade Bridge LLC of Vancouver, Washington as the lowest responsive and responsible bidder. In the 2017 budget, $2,700,000 was included for this work. A total of $481,000 has been allocated in construction management services. The award for the work is $2,196,572.70, bringing the total cost for this work to approximately $2,677,573.
