COMMITTEE SECTION (H&FW) 10.1 Functions of the Committee - The Committee Section (H&FW) is entrusted with the task of providing secretarial assistance to the Department-related Parliamentary Standing Committee on Health & Family Welfare. Like other Department-related Parliamentary Standing Committees serviced by Rajya Sabha Secretariat, the Committee on Health & Family Welfare is governed by Rules 268 to 277 of the Rules of Procedure and Conduct of Business in the Council of States. Further, Rules 74 to 92 of the said Rules relating to Select Committees on Bills also apply mutatis mutandis to the Committee. The Committee on Health & Family Welfare deals with Ministry of Health & Family Welfare which consists of four Departments namely: - (i) Department of Health & Family Welfare; (ii) Department of AYUSH; (iii) Department of Health Research; and (iv) Department of AIDS Control The functions assigned to the Committee, as enumerated in Rule 270 of the Rules of Procedure and Conduct of Business in the Council of States are (i) consideration of Demands-for- Grants of the Ministry of Health and Family Welfare, (ii) examination of Bills pertaining to the Ministry when referred to the Committee by the Hon ble Chairman or Speaker, as the case may be, (iii) consideration of Annual Reports of the Ministry, and (iv) consideration of national basic longterm policy documents presented to both the Houses and referred to the Committee by the Hon ble Chairman or the Speaker, as the case may be, and report thereon Tenure of the Committee: The Committee was reconstituted on the 31 st August, 2011 under the chairmanship of Shri Brajesh Pathak, M.P. The tenure of the Committee was one year. The first meeting of the Committee in the year 2012, was held on the 24 th January, After the expiry of the term of the Committee on the 30th August, 2012, it was reconstituted w.e.f. 31 st August, 2012 for another term of one year under the Chairmanship of Shri Brajesh Pathak. The first meeting of the Committee, after its reconstitution, was held on the 12 th October, Consideration of Demands for Grants ( ): The Committee undertook examination of the Demands-for-Grants ( ) of the related Departments during the recess of the Budget Session of In the course of examination of the Demands-for Grants ( ), the Committee heard the Secretary, Department of Health & Family Welfare on 9th April, 2012, Secretaries of Departments of Health Research and AIDS Control on 10 th April, 2012 and Secretary of Department of AYUSH in its meeting held on 11 th April, The Committee considered and adopted four draft Reports on Demands-for-Grants ( ) of the above mentioned four Departments in its meeting held on the 23 rd April, Thereafter, the 54 th, 55 th, 56 th & 57 th Reports on Demand-for-Grants of the Departments of Health & Family Welfare, AYUSH, Health Research and AIDS Control, respectively, were presented to the Rajya Sabha on 26 th April, 2012 and laid on the Table of the Lok Sabha on the 25 th April, Reports on the Action Taken by Government on the Committee s Reports on Demands for Grants ( ): The Action Taken Notes from the Departments of Health and Family Welfare, AYUSH, Health Research and AIDS Control on the recommendations/observations of the Committee as contained in its 54 th, 55 th, 56 th and 57 th Reports on the Demands-for-Grants ( ) were received from the respective Departments and the draft Action Taken Reports prepared thereon are to be adopted by the Committee. 86
2 10.5 Bills: (i) The Bill, namely, the National Commission for Human Resources for Health Bill, 2011 was referred to the Committee on the 26 th December, 2011 for examination and report within a period of three months. The main objective of the Bill was to seek to consolidate the law in certain disciplines of health sector and promote human resources in health sector and provide for mechanism for the determination, maintenance, co-ordination and regulation of standards of health education throughout the country to ensure adequate availability of human resources in all States and for the said purpose to establish the National Commission for Human Resources for Health to supervise and regulate professional Councils in various disciplines of health sector. In this connection, the Committee heard the Secretary, Department of Health and Family Welfare and his team of officers and sought clarifications on various provisions of the Bill. Besides, the Committee also heard the views of Secretaries of Departments of Ayurveda, Yoga & Naturopathy, Unani, Siddha and Homoeopathy (AYUSH) and Health Research and the representatives of Ministry of Law and Justice. Thereafter, the Committee also heard the views of representatives of Pharmacy Council of India; Indian Nursing Council; Central Council of Indian Medicine; Central Council of Homoeopathy; Medical Council of India; Dental Council of India; Indian Medical Association; Delhi Medical Association; Physiotherapy Associations; National Board of Examinations; representatives of Faculty of Dental Science and Vice-Chancellor of Chhatrapati Shahuji Maharaj Medical University, Lucknow; All India Dental Hygienists Association, New Delhi; All India Institute of Medical Sciences, New Delhi; Post Graduate Institute of Medical Education & Research, Chandigarh; Jawaharlal Institute of Post Graudate Medical Education & Research, Puducherry; National Institute of Mental Health and Neuro Sciences (NIMHANS), Bangalore on the Bill. The Committee was also benefitted by the written submissions furnished by the State Governments of Chhattisgarh, Kerala, Tripura, Mizoram, Manipur, West Bengal, Tamil Nadu, Rajasthan, Meghalaya, Andhra Pradesh, Nagaland, Haryana, Uttar Pradesh, Union Territories of Daman & Diu and Dadra & Nagar Haveli and Chandigarh, and oral evidence of representatives of State Governments of West Bengal and Gujarat and its Report was presented/laid in both Houses of Parliament on 23 rd November, Subjects: (a) The Department of Health and Family Welfare had furnished its Action Taken Notes on the recommendations/ observations of the Committee contained in its Forty-fifth Report on Action Taken by the Department of Health and Family Welfare on the recommendations/observations of the Committee contained in its Forty-fifth Report on Issues relating to availability of Generic, Generic-Branded and Branded Medicines, their Formulation and Therapeutic Efficacy And Effectiveness. The Committee scrutinized the Action Taken Notes furnished by the Department and thereafter presented/ laid its 58 th Report on Action taken by the Government on the Recommendations / Observations contained in the Forty Fifth Report on issues relating to availabilty of Generic, Generic-Branded and Branded Medicines, their formulation and Therapeutic efficacy and effectiveness thereon in both the Houses of Parliament on the 4 th May, (c) The Committee had taken up the subject relating to the functioning of the Central Drugs Standard Control Organization (CDSCO) and the 59 th report thereon was presented/laid in both the Houses of Parliament on the 4 th May, Sub-Committees: (a) Sub-Committee-I on the functioning of All India Institute of Medical Sciences (AIIMS) : Sub-Committee heard the views of (i) Sh. K. B. Saxena, Former Secretary, Government of India, (ii) Sh. D. Diptivilasa, Additional Secretary, Ministry of Urban Development alongwith representatives of Department of Health and Family Welfare and All India Institute of Medical Sciences(AIIMS) and (iiii) Dr. M. K. Bhan, Secretary, Department of Biotechnology, Ministry of Science & Technology, on various aspects relating to functioning of AIIMS at its meeting held on 28 th February, The Sub-Committee also heard the views of (i) Shri Manoj Joshi, Joint 87
3 Secretary, Department of Personnel and Training, (ii) Shri Satish Chandra, Joint Secretary and Legal Advisor, Department of Legal Affairs, (iiii) Shri Keshav Desiraju, Special Secretary, Department of Health and Family Welfare along with representatives of AIIMS on the issue of implementation of reservation of SCs, STs and OBCs in the All India Institute of Medical Sciences(AIIMS) at its meeting held on 10 th May, Thereafter,the Sub-Committee also heard the views of Secretaries of Departments of Personnel and Training and Legal Affairs and Joint Secretary of Department of Health and Family Welfare along with Sub-Dean of AIIMS on the issue of implementation of reservation policy in the All India Institute of Medical Sciences (AIIMS) at its meeting held on 21 st May, The Sub-Committee also heard Dr. Seema Rao; Dr. Kameshwar Prasad, HoD, Neurology, AIIMS; Dr. S.K. Sharma, HoD, Medicine, AIIMS; Dr. H.H. Dash, ex- HoD, Neuro-Anaesthesia, AIIMS on the functioning of All India Institute of Medical Sciences (AIIMS) at its meeting held on 31 st May, The Sub-Committee also heard Shri D. Diptivilasa, Additional Secretary, Ministry of Urban Development regarding conversion of land behind AIIIMS from residential to public/hospital and the Secretary, Department of Health and Family Welfare along with Director and Deputy Director(Admn.),AIIMS on various issues concerning the functioning of AIIMS in its meeting held on 8 th June, (b) Sub-Committee-II on the functioning of Central Government Health Scheme (CGHS) Sub-Committee discussed the future course of action on the examination of functioning of Central Government Health Scheme (CGHS) at its meeting held on 6 th June, (c) Sub-Committee-III on Draft Reports The Sub-Committee considered the draft Reports on (i) the Action Taken Note (ATN) furnished by the Department of Health and Family Welfare on the Recommendations/Observations as contained in its 45th Report of the Committee on "Issues relating to availability of generic, generic-branded and branded medicines, their formulation and therapeutic efficacy and effectiveness"; and (ii) the functioning of Central Drugs Standard Control Organisation (CDSCO) at its meeting held on 10 th April, 2012, but, the discussion remained inconclusive. The Sub- Committee, thereafter, considered and adopted the draft Reports on (i) the Action Taken Note (ATN) furnished by the Department of Health and Family Welfare on the Recommendations/Observations as contained in its 45th Report; and (ii) the functioning of Central Drugs Standard Control Organisation (CDSCO) at its meeting held on 11 th April, Visits/Tours: - The Committee undertook one study visit to Leh and Srinagar from 18 th to 21 st June, 2012, in connection with examination of National Commission for Human Resources for Health Bill, 2011 and implementation of National Rural Health Mission (NRHM) and National AIDS Control Programme (NACP). The Committee also interacted with the representatives of State Government of Jammu & Kashmir on the implementation of the National AIDS Control Programme Meetings and Reports: - The Main Committee held, in all, 21 meetings; Sub-Committee- I, 5 meetings; Sub-Committee-II, 1 meeting; Sub-Committee-III, 2 meetings during the year 2012, spreading over 31 hours and 49 (main Committee), 10 and 05 minute (Sub- Committee-I), 30 (Sub-Committee-II) and 1 hour and 50 (Sub-Committee-III), respectively. The details of the meetings are given in Annexures -10.1, 10.2, 10.3 and During the year under review, the Committee presented Seven Reports, details of which are given in Annexure Goals and Analysis: - The main tasks assigned to the Committee, as per rule 270 of the Rules of Procedure and Conduct of Business in the Council of States, are consideration of the Demands for Grants of the Ministry of Health and Family Welfare, examination of Bills referred to it, basic long-term policy documents, if any, referred to the Committee and examination of Annual Reports of the Ministry of Health and Family Welfare. 88
4 10.11 Status of Computerization: - This Section has seven computers which have been provided with network connection. All typing work including typing of Reports, notices, etc., are done on the computers and all the necessary information is fed into the softwares installed for the purpose Inspection of the Section during 2012: - The annual inspection was conducted by Shrimati Sunita Sekaran, Director on the 6 th March, Training: -Shri Dinesh Singh, Deputy Director from this Section attended the Professional Development Programme at the House of Commons, Parliament of UK from 30 th January to 9 th February, Miscellaneous: - Besides rendering secretarial assistance to the Committee in discharge of its functions, this Section also dealt with the following items of work:- (a) Sending the 54 th, 55 th, 56 th, 57 th, 58 th and 59 th (English & Hindi Versions) and 60 th (English version) Reports of the Committee to Printing Section for printing. (b) Circulation of the Printed copies of the 54 th, 55 th, 56 th, 57 th and 58 th Reports (English & Hindi versions) of the Committee to the Members and others as per the official Mailing List. (c) Correspondence with the Ministries/Departments concerned on matters taken up by the Committee and liaising with them; (d) Furnishing of information on the matters relating to the Committee to different Sections/Branches of Rajya Sabha/ Lok Sabha Secretariats and the outside agencies; (e) Processing of bills in respect of Committee s study tours and Refreshment / Lunch served in the meetings of the Committee; and (f) Submitting Quarterly status reports to Co-ordination Section and Review of the Annual Action Plan (2012), Annual Action Plan for 2013 & Annual Report-2011 to the O&M Section. 89

The Committee heard the views of the Secretaries of the Departments of Health Research and AIDS Control in connection with examination of Demands for Grants ( ) of the Ministry of Health and Family Welfare. The Committee heard the views of the Secretary of the Department of AYUSH in connection with examination of Demands for Grants ( ) of the Ministry of Health and Family Welfare The Committee considered and adopted draft 54 th, 55 th,56 th and 57 th Reports on Demands for Grants ( ) pertaining to Departments of Health and Family Welfare, AYUSH, Health Research and AIDS Control, respectively (i)the Committee considered and adopted draft 58 th Report on Action Taken by the Government on the Recommendations / Observations contained in the Forty Fifth Report of the Committee on Issues relating to availability of Generic, Generic-Branded and Branded Medicines, their Formulation and Therapeutic Efficacy And Effectiveness and draft 59 th Report on the functioning of the Central Drugs Standard Control Organisation (CDSCO); (ii) The Chairman apprised the Members of the progress made towards examination of the National Commission for Human Resources for Health Bill, The Committee felt that it would not be possible for it to complete all stages of examination of the Bill and present report thereon by the 31 st May, The Committee, accordingly, decided to seek further extension of time till the last day of the first week of the Monsoon Session 2012 of the Parliament for presenting its Report on the Bill to the Parliament and authorized its Chairman to approach the Hon ble Chairman in this regard; and (iv) The Committee also decided to take up the following four subjects for examination and report viz. (i) Implementation of Universal Immunization Programme (ii) Working of Food Safety and Standards Authority of India (FSSAI), (iii) 90

7 Government of Gujarat on the National Commission for Human Resources for Health (NCHRH)Bill, The Committee heard the views of the Secretary and other officials of the Department of Health and Family Welfare on the National Commission for Human Resources for Health Bill, 2011, to seek clarifications in the light of suggestions/comments received from various stakeholders/experts and evidence tendered by a number of stakeholders on the Bill The Committee considered and adopted draft Report on the National Commission for Human Resources for Health Bill, However, some Members felt that further discussions were needed to be held to have clarity on the Bill in view of the apprehensions expressed by various stakeholders. After some discussion, the Committee deferred the consideration of the Report. The Committee felt that it would not be possible for it to complete all stages of consideration of the Bill and present its Report before 31 st August, 2012 when the extended period of time for presentation of Report was expiring. The Committee therefore, decided to seek further extension of time till the last day of first week of the Winter Session of Parliament 2012, and authorized its Chairman to approach Hon ble Chairman for the purpose (i)the reconstituted Committee discussed its future course of action. (ii) The Committee also directed the Secretariat to call the Secretary, Department of Health and Family Welfare alongwith the Chairperson, Board of Governors, Medical Council of India and the President, National Board of Examinations in its next meeting to hear their views on the National Eligibility- cum- Entrance Test proposed for Under Graduate and Post-Graduate Courses hour hour 25 (i)the Committee considered and adopted its 60 th Report on the National Commission for Human Resources for Health Bill, 2011 and decided to present the same to Hon ble Chairman, Rajya Sabha as the Parliament was not in Session. (ii)the Committee heard the Secretary, Department of Health and Family Welfare along with Chairperson, Board of Governors, Medical Council of India and President, National Board of Examinations on the National Eligibility and Entrance Test (NEET). The Committee heard the Secretary, Department of Health and Family Welfare along with Chairperson, Board of Governors, Medical Council of India on (a) the Bachelor of Science (Community Health)-B.Sc(CH) course and (b) clarification on the matter regarding National Eligibility-cum- Entrance Test (NEET).
