2 ORDER AND NOTICE OF SPECIAL ELECTION TO AUTHORIZE THE CONTINUATION OF EXISTING ADDITIONAL SCHOOL LEVY TO THE VOTERS OF MINGO COUNTY, WEST VIRGINIA Acting on behalf of the Board of Education of the County of Mingo, State of West Virginia, Charles K. Heinlein, State Superintendent of Schools and Designee of the West Virginia Board of Education, pursuant to West Virginia Code Section 18-2E-5(p)(4), on December 21, 2012, approved the following order: After careful study and due deliberation it was determined that the maximum levies for current expenses authorized by Article 8, Chapter 11 of the Code of West Virginia, as amended will not provide sufficient funds for the payment of general current expenses of the schools of Mingo County during the fiscal years beginning July 1, 2014, July 1, 2015, July 1, 2016, July 1, 2017 and July 1, 2018; and it has been determined that the amounts in excess of the amounts raised by the regular levies will be needed by the Board in each of the next five (5) fiscal years, therefore a special election should be held to increase such levies in conformity with West Virginia Code. This special levy has been in effect in Mingo County since The purposes for such levy funds that are needed and the approximate amounts such for each purpose are as follows: a. FREE TEXTBOOKS, SCHOOL EQUIPMENT, INSTRUCTION EQUIPMENT AND INSTRUCTIONAL SUPPLIES FOR ALL STUDENTS To provide free textbooks, maintain instructional equipment and instructional supplies for all pupils pre-kindergarten through grade 12. To maintain and continue the implementation of one-to-one technology for Mingo County students and to upgrade instructional technologies in the classroom, approximately $1,052,576. b. SUPPORT FOR ADDITIONAL EDUCATIONAL OPPORTUNITIES To provide additional educational opportunities for students of Mingo County by offering evening classes, summer school, remedial programs, alternative programs, extra-curricular trips and the Energy Express program, approximately $200,000 annually. c. PROVIDE TECHNOLOGY EQUIPMENT AND SERVICES TO ALL SCHOOLS To provide each school with technology equipment, supplies and technology support services to install and maintain the equipment, approximately $345,414 annually. d. SUPPORT FOR BAND AND CHORAL ACTIVITIES To provide materials and supplies for music, band, choral, and theater arts programs in grades pre-kindergarten through 12, approximately $87,036 annually.

SUPPORT FOR ACADEMIC COMPETITION To enhance the academic achievement for our youth and support curricular events including robotics, spelling bee, social studies fair, math field day, etc., approximately $60,000 annually. f. SUPPORT FOR PUBLIC AND SCHOOL LIBRARIES For supplementing the services provided by school libraries, the public libraries and the mobile library, approximately $200,000 annually as follows: Mingo County Libraries Williamson Public Libraries Mingo County School Libraries $75,000 annually $35,000 annually $90,000 annually g. EXPANDED CAREER & TECHNICAL EDUCATION (VOCATIONAL) PROGRAMS For the improvement and expansion of the Career & Technical Education (vocational) services and instructional programs in the Mingo County School District including ProStart, Health Occupations, Pre-Engineering, Graphic Design, Vocational Agricultural, approximately $138,166 annually. h. INSTRUCTION SUPPLIES AND MATERIALS FOR CLASSROOMS To provide funds for each school in the county in the amount of $10.00 per student to be used at the school's discretion for supplies at the beginning of each school year and to include support for health and wellness, approximately $50,000 annually. i. SUPPORT FOR HEALTH SERVICES For the continuation of providing basic health services to all students and employees in the Mingo County School District including support to the Mingo County Health Department, approximately $92,110 annually. j. SUPPORT FOR COMPLIANCE WITH SAFETY STANDARDS AND SECURITY For compliance with safety standards and the correction of fire hazards, set forth in the inspection report of the West Virginia State Fire Marshal and to provide security of the facilities, creating a healthy environment for staff and students, approximately $345,414 annually. k. SUPPORT FOR SCHOOL REPAIRS AND RENOVATIONS To furnish, equip, repair, renovate and improve any board facility, where necessary, approximately $600,000 annually. 1. SUPPLEMENT EMPLOYEE BENEFITS To provide Optical/Dental coverage for all full-time employees and eligible dependents of the Mingo County School District, approximately $400,000 annually.

SUPPORT FOR PROFESSIONAL PERSONNEL For the continuation of present salary supplements for all supervisory personnel, directors, principals, teaching personnel and the payment of expenses fixed by law and based on the following academic degrees and additional academic hours: Degree and Hours Annual Supplement Bachelor of Arts $1,700 Bachelor of Arts plus 15 hours 1,900 Masters Degree 2,200 Masters Degree plus 15 hours 2,500 Masters Degree plus 30 hours 2,800 Masters Degree plus 45 hours 3,100 Doctorate Degree 3,400 and to provide an annual salary supplement of $500 to all supervisory personnel, directors, principals, teaching personnel, as well as to provide for the payment of salaries and fixed charges not funded by the state basic public education support program, approximately $2,648,211 annually. n. SUPPORT FOR SERVICE PERSONNEL For the continuation of salary supplements of $1,500 to all school service personnel which includes secretaries, aides, bus drivers, truck drivers, mechanics, custodians, cooks and maintenance personnel as well as to provide an annual year-end salary supplement of $375 to all service personnel, including secretaries, aides, bus drivers, truck drivers, mechanics, custodians, cooks and maintenance personnel, as well as the payment of expenses fixed by law, for the payment of salaries and fixed charges not funded by the state basic public education support program, approximately $1,801,910 annually. o. INCENTIVE FOR UNUSED PERSONAL LEAVE For the continuation of the incentive for unused personal leave for professional and service personnel, approximately $200,000 annually. P. SUPPORT FOR ATHLETIC AND EXTRA-CURRICULAR ACTIVITIES To make necessary expenditures to support and maintain all the athletic programs at the middle and senior high level. Expenditures are to be made among the two senior high schools in the fixed amount of $50,000 to be distributed as follows: $12,000 per high school and $26,000 to be distributed between the two high schools based on annual student participation in the school's extra-curricular programs; and $9,000 per middle school. The amount of $30,000 is designated for athletic facility rental fees; the amount of $83,707 is to be used to help defray the cost of adding expanded middle and high school programs including, middle school baseball, softball, soccer and other athletic expenses such as transportation, insurance, equipment and supplies, approximately $217,707 annually. 3

SUPPORT FOR MINGO COUNTY EXTENSION SERVICE To provide funds to the Mingo County Extension Service in the annual amount of $30,000 to provide educational programs such as 4-H, Archery and ATV Safety for the students of Mingo County. r. SALARY SUPPORT FOR SUPPLEMENTAL ASSIGNMENTS Curricular and extra-curricular supplements and support for athletic coaches, athletic trainers, athletic directors, academic department heads, academic sponsors and others with special assignments, approximately $240,350 annually. s. CLASSROOM FURNITURE UPGRADES To provide funds for classroom furniture upgrading, approximately $100,000 annually. t. NATIONAL BOARD CERTIFICATION To provide an annual salary supplement of $1,000 for professional personnel with nationally recognized certification, approximately $35,000 annually. u. SUPPLEMENTATION OF THE BUDGET Authorization for the Board to expend, upon the funding of the above mentioned purposes, and at the end of each fiscal year this levy is in force and effect or at the end of the five-year period this entire levy is in effect or otherwise, at such times as it may desire, for public school purposes, any surplus which may accrue each fiscal year during the term of this levy. 2. Total approximate amount needed to be raised for said purposes after allowance for discounts, delinquencies and exonerations is $8,843,894 and the total amount to be raised during the term of this five year levy is approximately $44,219, That should additional money be obtained by grant or otherwise from the state of federal government or any other source, said additional money may be used either in substitution of or in addition to the amount obtained from this levy. 4. The separate and aggregate assessed valuations and levy rates levied by the Board per $ of assessed valuation for the Board of Education of the County of Mingo for each class of property for the fiscal year ending June 30, 2013 were: Class of Property Assessed Valuation Class I Class ,871,230 Class III 896, Class IV 99,076,287 In the aggregate 1,141,466,235 4

The proposed additional rate of the levy in cents on each Class of property per $ of valuation of such property, is as follows: Class I Class II Class III Class IV cents cents cents cents Provided, however, that the Board of Education of the County of Mingo reserves unto itself as the levying body the right and the authority to reduce the rates of the excess levy if increased assessments would produce funds beyond projected needs in any year specified in the levy call in accordance with the provisions in West Virginia Code g. Note: The above levy rates are now in effect pursuant to past special levy elections. There will not be any increase in the levy rates now in effect, since approval of the current levy will result in a continuation of levy rates stated above and approval of the current levy will not result in the imposition of any new taxes. 6. The proposed number of years, to which the additional levy applies, are the fiscal years beginning July 1, 2014, July 1, 2015, July 1, 2016, July 1, 2017 and July 1, That, upon approval of the proposed additional levy, the Board of Education of the County of Mingo will not issue bonds obligating receipts of the levy. 8. The question of such additional levy shall be submitted to a vote at a Special Election to be held on March 23, That the absentee ballots shall be applied for, obtained from and returned to the Clerk of Mingo County Commission as in the case of general elections, and said Clerk is hereby appointed the Agent of the Board of Education to perform all duties relating to absentee ballots in this election. 10. Notice calling such election shall be given by the publication of this order at least once each week for two successive weeks before said election in The Williamson Daily News and Gilbert Times. All the provisions of the laws concerning general elections shall apply as long as they are practicable, except that a separate ballet shall be used at such election when held in connection with any other election. 5
