1 ASLCC Constitution Approved by ballot May 2017 Article I Name 1.1- Name The name of this organization shall be the Associated Students of Lane Community College (hereafter ASLCC) Name The student government of the ASLCC shall be the Associated Students of Lane Community College Student Government (ASLCCSG). Article II Purpose Purpose The purpose of the ASLCCSG shall be to provide for the social, cultural, educational and physical well-being of the ASLCC; to support and foster rights and responsibilities of students and to ensure the ASLCC is officially represented in college related activities and organizations. Article III Membership Membership The ASLCC shall consist of all credit students currently enrolled at Lane Community College who have paid the Student Activity Fee. Payment of summer term Student Activity Fee or enrollment during summer term is not necessary for a student to maintain membership status Membership The ASLCCSG shall not discriminate against any person based on, but not limited to: race, ethnicity, sexual orientation, marital status, abilities, sex, gender identity, religion, age, socioeconomic background, political view, or national origin in accordance with the college nondiscrimination policy. The ASLCCSG shall also not deny access to any activities financed in whole, or in part through the Student Activity Fee for any reasons as set forth above Membership The ASLCCSG may maintain formal relationships with noncollege organizations subject to annual review. Article IV Organization Organization There shall be two (2) elected ASLCCSG Executive Officers (hereafter Executive Officers): the ASLCCSG President (hereafter President) and ASLCCSG Vice President (hereafter Vice President) Organization There shall be an ASLCCSG Senate (hereafter Senate) composed of: A minimum of six (6) and a maximum of ten (10) ASLCCSG Senators (hereafter Senators) elected by the ASLCC. The President shall be an ex-officio member of the Senate. 1
2 4.3 - Organization All other ASLCCSG positions, unless otherwise specified in this Constitution or the ASLCCSG Bylaws, shall be considered ASLCCSG Regular Staff (hereafter Regular Staff) Organization The President shall appoint and manage Regular Staff and ad-hoc staff positions in accordance with this Constitution, the ASLCCSG Bylaws, and as they see fit. Article V Qualifications for Office Qualifications for Office All members of the ASLCC shall be eligible to hold an ASLCCSG elective or appointive office if they meet established minimum requirements. All students elected or appointed serving in ASLCCSG governance or committees shall be required to enroll in and complete at least four (4) credit hours per term and be in good academic standing as defined by Lane Community College with a minimum cumulative GPA of 2.5 at the time of their election or appointment to office. Enrollment during summer term shall not be necessary to retain an ASLCCSG elective or appointive office Qualifications for Office No ASLCCSG officeholder shall simultaneously hold more than one (1) ASLCCSG office. Article VI Duties of the Officers Duties of the Officers The President shall be the chief executive officer of the ASLCCSG, shall be responsible for the general operations of ASLCCSG, and may be the acting official spokesperson for the ASLCCSG and the ASLCC Duties of the Officers The President shall appoint students for Regular Staff positions. These positions shall be filled within thirty (30) calendar days of taking office. All appointments shall be confirmed by a majority vote of the Senate. All appointments must be confirmed or denied within two (2) weeks of the Senate meeting where the appointment was first introduced. By a majority vote, the Senate may close a vacant Regular Staff position, or reopen a previously closed Regular Staff position. Any closure of a Regular Staff position shall be in effect until May 31 st or until the position is re- opened by the Senate Duties of the Officers The President and ASLCCSG Treasurer (hereafter Treasurer) shall, in consultation with the ASLCCSG Advisor, prepare a budget plan for the subsequent academic year. The budget plan must comply with the expectations of the Student Activity Fee Committee (hereafter SAFC) and be submitted to the Senate for review no later than the 2 nd week of November Duties of the Officers The President may make such rules as are necessary to ensure the fair and efficient operation of the ASLCCSG, and ensure compliance with such budget notes and resolutions as approved by the Senate. Any such rule, once established, shall continue indefinitely, until repealed or 2
3 superseded by subsequent action of the President or the Senate. The President must provide reasonable notice and at least ten (10) working days for comment prior to adoption of any rule Duties of the Officers All elective and appointive staff positions shall serve a term in office of one (1) year commencing on June 1 st and ending on May 31 st of the following year Duties of the Officers The Vice President shall assume the office of the President in the President s absence, removal, or resignation, as well as all other duties as delegated by the President Duties of the Officers During summer term, the Executive Officers shall not authorize total budget expenditures in excess of 10% of the projected fiscal year budget. Payroll and overhead expenses are excluded from these figures and funds. All budget expenditures during summer term shall require approval from the ASLCCSG Advisor. Article VII Senate Senate The Senate shall be comprised as stated in *4.2, and chaired by the Vice President Senate The Senate shall elect by plurality, from the Senate, a President Pro- Tempore who will serve as Chair in the absence or promotion of the Vice President. The position of President Pro-Tempore must be filled within thirty (30) calendar days from the start of fall term and, in the case of a vacancy, within thirty (30) days of the vacancy not to include school breaks. The President Pro- Tempore may be removed from this position by a 2/3 vote of the filled seats of the Senate. Any President Pro-Tempore removed from this position shall retain their Senate seat Senate The Senate shall represent the collective and constituent interest of the ASLCC and shall act on matters relating to the allocation and appropriation of ASLCC funds. The Senate shall be responsible for approving and establishing policies of the ASLCCSG, monitor ASLCCSG programs, and may address any other issues of concern to ASLCC members Senate The President shall have full veto power over any action of the Senate excluding articles of impeachment. The Senate may override with a subsequent 2/3 vote of those seated Senate A quorum shall be required to conduct Senate meetings. A quorum shall consist of 50% plus one (1) of the filled seats of the Senate membership, pursuant to * Senate The Senate shall, when reasonably possible, conduct weekly 3
4 meetings, except anytime when the college is not in session Senate The Chair of the Senate shall, during debate, recognize all members of the Senate listed in *4.2 who wish to speak to the issue at hand Senate The Senate shall vote to approve the ASLCCSG budget for the following fiscal year by November 1 st. The next ASLCCSG administration may modify this budget at any time by a majority vote of the seated members of the Senate Senate The Chair of the Senate shall only vote when that vote breaks a tie Senate All meetings of the Senate shall be in accordance with the Oregon Public Meetings Law. Times and places of such meetings shall be announced to the TORCH and to the ASLCC at least 24 hours in advance of the meeting. Any announcement of Senate meetings shall be posted in the ASLCC Orgsync portal Senate Any funds request for more than $250 shall be submitted in written form and shall be sponsored by a Senator who is not the author of the proposal Senate The terms of all Senators elected during the ASLCCSG General Election shall begin June 1 st and end on May 31 st. The terms of all Senators elected during a special election or appointed shall begin immediately upon certification of the election results or ratification of the appointment, and end on May 31 st Senate If one (1) or more Senator at-large seats are vacant, an ASLCC member may submit a Senate application to the ASLCCSG Advisor. Any Senate application shall contain at least one hundred (100) signatures of current ASLCC members. Once a Senate application is verified, and the applicant has attended two (2) consecutive Senate meetings in their entirety, the applicant shall attend the following meeting for ratification. The Senate shall vote to confirm or deny the immediate ratification of the applicant as a Senator. All Senate ratifications shall be confirmed by a majority vote of the Senate. Article VIII Elections Elections ASLCCSG Elections shall be conducted in a manner consistent with the best interests of the student body. The elections shall be conducted in a fair, orderly and impartial manner. Any member of the ASLCC involved in the electoral process shall not compromise the educational atmosphere of the College Elections In the event that less than six (6) Senator at-large seats are filled on the Monday of the 3 rd week of fall term, a special election shall be held no earlier than October 15 th and no later than November 15 th that year for the 4
5 primary purpose of filling the open Senator-at-large seats. The polling time should last no more than two (2) days for this election Elections The ASLCCSG General Election shall be held no earlier than April 1 st and no later than May 15 th of each year Elections The President and Vice President shall jointly appoint an ASLCC member to be the Elections Committee Chair and shall appoint five (5) ASLCC members to the Elections Committee by the 2nd Senate meeting in March, and ratified by a majority vote by the Senate within two (2) weeks. Serving members of the Elections Committee shall not be eligible to run for ASLCCSG elected office. The Elections Committee shall be responsible for the approval and dispersal of election rules and procedures. The Elections Committee shall hear complaints of violations and have complete authority over any decisions in response to complaints Elections Any member of the ASLCC shall be eligible to vote for candidates seeking elective office. A college official selected by the Elections Committee shall perform verification of eligibility Elections A candidate for President shall run on a ticket with a candidate for Vice President, and vice versa Elections A plurality of votes cast by the ASLCC shall be required to elect ASLCCSG officeholders. Article IX Replacement, Recall, & Impeachment Replacement, Recall, & Impeachment In the event of the vacancy of a Regular Staff position, the President shall fill said vacancy with an appointee within thirty (30) days of the vacancy, and must be confirmed by a majority vote of the Senate. The Senate shall confirm or deny the appointment within two (2) weeks of the Senate meeting where the appointment was first discussed Replacement, Recall, & Impeachment In the event of the vacancy of an elective office, the President shall fill said vacancy with an appointee within thirty (30) days of the vacancy, and shall be confirmed by a majority vote of the Senate. Any appointment to a vacant Senator-at-large seat shall also require the approval of the Vice President. Any appointment of a Senator in this manner shall only be one (1) at a time, and shall only be done when there are five (5) or more vacant Senator-at-large seats. The Senate must confirm or deny the appointment within two (2) weeks of the Senate meeting where the appointment was first discussed Replacement, Recall, & Impeachment Non-fulfillment of duties for three (3) weeks will be considered a vacancy of any office elected or appointed under this Constitution, except in extenuating circumstances and school breaks. 5
6 Requirements for fulfillment of duties are stated in this Constitution, the ASLCCSG Bylaws and signed agreements created by Executive Officers in consultation with the ASLCCSG advisor. The Senate may rule the seat vacant and open for replacement, per procedures set forth for the Regular Staff and Senate, because of a non-fulfillment of duties Replacement, Recall, & Impeachment Should the offices of the President and Vice President become vacant concurrently, the Senate shall choose by a plurality vote an interim President. The interim President shall appoint an ASLCCSG officeholder to serve as an interim Vice President, with the office being offered first to the President Pro-Tempore. The interim President shall hold an election for the office of the President and Vice President within a reasonable time, not to exceed three (3) weeks, excluding finals week and school breaks Replacement, Recall, & Impeachment A petition containing a minimum of 300 signatures of ASLCC members shall be necessary to warrant a recall election Replacement, Recall, & Impeachment A majority vote in a recall election shall remove any ASLCCSG officeholder Replacement, Recall, & Impeachment In the event of a recall, an Elections Committee shall be formed according to the same process as the ASLCCSG General Election (see 8.4). All recall petitions shall be submitted to the ASLCCSG Advisor within two (2) weeks of the initiation of the petition. The advisor shall determine the validity of the signatures on the recall petitions. Upon validation of the signatures and petitions, a special election shall be conducted within five working days by the Elections Committee and the question of recall shall be submitted to the ASLCC Replacement, Recall, & Impeachment Articles of impeachment may be brought against the President, Vice President or any member of the Senate by a 2/3 vote of the filled seats of the Senate. The Senate shall clearly set forth the grounds for removal from office. The grounds for removal from office shall be based on violations of this Constitution, the ASLCCSG Bylaws and/or signed agreements created by Executive Officers in consultation with the ASLCCSG advisor. Article X Initiative, Referendum & Amendment Initiative, Referendum & Amendment A petition containing a minimum of 300 signatures of ASLCC members or a 2/3 vote by the Senate shall be sufficient to warrant a referendum or special election Initiative, Referendum & Amendment A petition containing a minimum of 300 signatures of ASLCC members or a 2/3 vote by the Senate shall be sufficient to place initiative and referendum questions before the students at the ASLCCSG General Election. 6
7 Initiative, Referendum & Amendment An amendment or replacement to this Constitution may be placed on an election ballot by a 2/3 vote of the Senate, or by a petition with the signatures of 100 ASLCC members Initiative, Referendum & Amendment All petitions shall set forth the precise and exact wording of the initiative as it would appear on the ballot, and the petition must be presented to the Senate at least four (4) weeks prior to the ASLCCSG General Election for validation. Validated petitions shall be presented to the Elections Committee within twenty-one (21) calendar days of the ASLCCSG General Election Initiative, Referendum & Amendment Passage of amendments or replacements to this Constitution shall be by a 2/3 vote of those cast by the ASLCC. Passage of an initiative, referendum, or question shall be by a plurality vote of those cast by the ASLCC. Article XI Student Rights and Responsibilities Student Rights and Responsibilities The ASLCCSG shall ensure that there is current institutional protection of Student Rights and Responsibilities as outlined in the College Operating Policies and Procedures Manual (COPPS). Article XII Activation Activation This Constitution shall go into effect immediately upon the validation by the elections officer of the results of the election, if those results show 2/3 of the voters favor adoption of this Constitution on May 12 th, Activation Constitutional amendments and other ballot measures shall go into effect immediately, or as specified by the measure, and upon validation of the election results, if those results show a 2/3 of votes cast favoring the measure or amendment Activation Unless stated in this Constitution, all initiatives, referendums, and amendments that were in effect before the ratification of this constitution on May 12 th, 2017, shall not remain in effect under this constitution Activation Under this Constitution, all ASLCCSG officeholders shall first refer to the ASLCCSG Bylaws for clarification on all aspects of ASLCCSG governance and procedures described in this Constitution. 7
