Yumang (Chairperson - Laws), City Councilor Elizabeth B. Bagonoc (Member City Land Use), City Councilor Lourdes F. Casabuena GUESTS/RESOURCE PERSONS: (See attached attendance sheet.) The chairperson, City Councilor Jose Edmar J. Yumang, called the hearing to order to discuss the following: 1. SPPR NO RESOLUTION AFFIRMING THE VALIDITY OF BARANGAY RESOLUTION NO , PASSED BY THE SANGGUNIANG BARANGAY OF APOPONG, THIS CITY, AUTHORIZING ITS PUNONG BARANGAY, HONORABLE RAMIL G. RABANES, SR., TO ENTER INTO AND SIGN A DEED OF DONATION AND ACCEPTANCE WITH ALFREDO L. CABEROY, ET. AL., AFFECTING 1,000 SQUARE METERS MORE OR LESS, A PORTION OF LOT 473-B-4, PSD , COVERED BY TCT NO. T , LOCATED AT PUROK 4, LANTON, BARANGAY APOPONG, GENERAL SANTOS CITY, INTENDED AS AN AREA FOR THE MULTI-PURPOSE HALL, AND OTHER FACILITIES. (Hon. Jose Edmar J. Yumang Sponsor) Upon learning from Mr. Joselito Panaligan, Purok Chairman of Lanton, Barangay Apopong that there was already a deed of donation for this purpose during the time of former Barangay Captain Delia Rabanes, City Councilor Bagonoc believed that there s no need to execute another deed of donation. Barangay Kagawad Mike Mamacog of Apopong stated that according to the barangay secretary, there s a need to execute a new deed of donation to change the OTC number to TCT. The chair clarified that there s no need to execute another deed of donation considering that there was already a deed of donation executed in year 2000 signed by Alfredo Caberoy and accepted by Barangay Apopong during the time of former Barangay Captain Delia Rabanes. After scrutinizing the pertinent document, the chair ruled to refer the resolution to Barangay Apopong with annotation that the deed of donation executed in 2000 is still effective and enforceable. As to the authority to enter into contract or donation, former JOINT COMMITTEES ON LAWS & CITY LAND USE FEBRUARY 10,

4 Barangay Captain Rabanes had the power to do so considering that the resolution was duly approved by the barangay council but as to the document itself, the committee considered it proper to return the same to the barangay inasmuch as the deed of donation is still enforceable. The committee recommended the transfer of title from Caberoy family to Barangay Apopong so that any infrastructure project will not be hampered. RETURNED TO BARANGAY APOPONG 2. SPPR NO RESOLUTION AFFIRMING THE VALIDITY OF BARANGAY RESOLUTION NO , PASSED BY THE SANGGUNIANG BARANGAY OF APOPONG, THIS CITY, AUTHORIZING ITS PUNONG BARANGAY, HONORABLE RAMIL G. Yumang Sponsor) Mr. Jaime Arana of DARBC informed that there s already deed of donation for this purpose. With this, the chair noted that submitted to the committee is the deed of donation executed last October 22, 2012 between DARBCI represented by Eustaquio Candari, Jr. and Barangay Apopong represented by Barangay Captain Rogelio D. Pacquiao. Thereafter, the chair ruled to refer the said resolution to Barangay Apopong on the ground that there is already an existing deed of donation entered into by and between DARBCI and Barangay Apopong. The chair asked the representative from DARBCI to release the original owner s duplicate copy to the Barangay Council of Apopong for them to issue an acknowledgment receipt of the document. Upon motion of Councilor Bagonoc, duly seconded by Councilor Casabuena, the chair ruled item no. 3 approved on committee level and to be calendared for second reading on February 21 regular session.
