In the 21 July 2005 indictment, Serugendo is charged with five counts including conspiracy to commit genocide, genocide, complicity in genocide, direct and public incitement to commit genocide and persecution as a crime against humanity. From 26 to 30 August 2005, the ICTR Registrar, Mr. Adama Dieng visited Mali where six ICTR convicted persons are serving their sentences. The visit, the second of its kind for the last three years, was aimed at assessing on the spot the conditions in which the sentences handed down by ICTR are being served. During his visit, Mr. Dieng held important meetings with Malian senior officials, including the President of the Republic, Head of State, His According to the indictment, Serugendo, who was Technical Chief of Radio Rwanda and RTLM, acted in concert with others, including Ferdinand Nahimana, Jean-Bosco Barayagwiza, Phocas Habimana and Félicien Kabuga, to organize and conduct the 1994 genocide in Rwanda. He was arrested on 16 September 2005 in Libreville, Gabon, and transferred to the Tribunal's Detention Facility in Arusha on 23 September The arrest brings to 71 the number of accused people who have been arrested by the Tribunal in connection with the 1994 genocide in Rwanda. Registrar s visit to Mali and Senegal Excellency Amadou Toumani Touré, and the Minister of Justice Maître Fanta Sylla. Mr. Dieng seized the opportunity to thank them for their constant commitment to international justice and for the specific support provided to ICTR. The visit was also an occasion to evaluate the suitability and size of the space in the prison of Kulikoro that the Malian authorities graciously allocated to ICTR. Prisoners currently being held in Bamako will be transferred there once it has been refurbished. It was agreed during that meeting that the longstanding draft agreement on enforcement of sentences would be finalized, as accepted in principle by the President of Senegal since July 2003.

2 Registrar meets with the Friends of ICTR On 16, the Registrar met in Dar es Salaam with the group of ambassadors labelled the friends of ICTR, to wit: the representatives of Belgium, Canada, France, Germany, Netherlands, Norway, and the United Kingdom. The UNDP Resident Representative in Dar es Salaam, John Hendra also attended the meeting, which is part of the quarterly rendez-vous agreed upon and held alternatively in Dar and Arusha. The questions tabled on the agenda were mainly a follow up of issues raised in the previous meeting of June in Arusha. As requested by the friends during the June meeting, the Registrar provided them with a list of prioritized projects to be funded outside the regular budget. Several undertakings were made by the friends to help fund specific activities or to provide un-earmarked contributions to the trust fund, leaving it to ICTR to determine its own priorities. Useful exchanges also took place regarding legacy issues and training of the Rwandan judiciary. Some of the friends expressed interest in taking an active part in these activities. The Registrar also received useful advice regarding the next ICTR budgetary discussions to be held in New York. Among other issues discussed were the question of gratis personnel and the new avenues to be explored to find a solution for the longstanding problem of the destination of the persons acquitted by ICTR. Promising headways were made in all these issues. The next meeting will be in Arusha. ICTR Judicial Activities crimes against humanity, and serious violations of the Geneva Conventions. All three accused pleaded not guilty to all charges against them during their 21 March 2005 further initial appearance. Edouard Karemera was former Minister of Interior and Vice-Chairman of the Mouvement Révolutionnaire National pour le Développement et la Démocratie (MRND) party. Mathieu Ngirumpatse was former Director General for Foreign Affairs and Chairman of the MRND party. Joseph Nzirorera was former Minister of Industry, Mines and Handcraft, former Speaker of the Rwandan Parliament, and National Secretary of the MRND party. The Prosecutor s team is headed by Senior Trial Attorney Don Webster who said the prosecution will provide evidence that the accused were directly and personally involved in setting up the genocidal policy and the means to implement it. The Defense team is composed of Dior Diagne and Félix Sow (Senegal), Peter Robinson (United States), Charles C. Roach (Canada) and Frederic Weyl (France). Simultaneously, Trial Chamber I, composed of Judges Jai Ram Reddy, presiding, Sergei A. Egorov and Flavia Lattanzi, opened the trial of Jean Mpambara, the former bourgmestre of Rukara commune in Kibungo prefecture. He is charged with genocide, complicity in genocide, and crimes against humanity (extermination) related to his alleged involvement in the killings in that occurred in Rukara commune between 7 and 16 April On 29 April 2005, he pleaded not guilty to all charges. The Prosecution team is led by Senior Trial Attorney Richard Karegyesa (Uganda). The Defence is headed by Arthur Vercken (France) Prosecution Closes its Case in the Trial of Jean Mpambara Two Trials Commence On 19, three former senior officials from the Interim Government of Rwanda and a former bourgmestre shared the same vehicle from the Detention Facility to the Tribunal headquarters. But as soon as they arrived, they were directed to different Courtrooms for the opening of their respective trials. The three, Edouard Karemera, Mathieu Ngirumpatse, and Joseph Nzirorera, appeared before Trial Chamber III as ICTR Prosecutor Hassan Bubacar Jallow gave his opening statement in the case while Jean Mpambara appeared before Trial Chamber I. The three accused appeared before Judges Dennis C.M. Byron presiding, Emile Francis Short and Gberdao Gustave Kam, and faced seven counts including: conspiracy to commit genocide, direct and public incitement to genocide, genocide, alternatively complicity in genocide, rape and extermination as The Prosecution closed its case on 29 September 2005 in the trial of Jean Mpambara, the former bourgmestre of Rukara commune in Kibungo prefecture. Mpambara is charged with three counts of genocide and crimes against humanity based on his alleged role in April 1994 in organizing and executing the killings which occurred in Rukara commune, including at Gahini Hospital and Rukara Parish. The Accused has pleaded not guilty to these crimes. The trial opened on 19 before Trial Chamber I, composed of Judges Jai Ram Reddy of Fiji (presiding), Sergei Alekseevich Egorov of Russia, and Flavia Lattanzi of Italy. The Chamber heard ten Prosecution witnesses over eight days, making it one of the fastest Prosecution cases in the history of the Tribunal. The Defence will present its case in January Jean Mpambara was arrested at a refugee camp in northern Tanzania on 20 June

3 Appeals Chamber Dismisses Kamuhanda s Appeal be held on 14 and 15 December 2005 in a courtroom to be decided later. The Appeals Chamber of the International Criminal Tribunal for Rwanda on 19 confirmed the conviction of Jean de Dieu Kamuhanda for genocide and extermination and ordered the immediate enforcement of the two concurrent life sentences he received for the crimes committed during the 1994 genocide in Rwanda. The Appeals Chamber dismissed all but one of the 15 grounds of appeal raised by Kamuhanda. The Appeals Chamber vacated the Trial Chamber s finding that Kamuhanda instigated and aided and abetted genocide and extermination. However, the Appeals Chamber found that the Trial Chamber correctly held Kamuhanda responsible for ordering genocide and extermination and ruled that vacating the findings that Kamuhanda instigated and aided and abetted the crimes did not require the imposition of a lesser sentence. On 22 January 2004, Trial Chamber II found Kamuhanda guilty of genocide and extermination as a crime against humanity. The Trial Chamber sentenced him to imprisonment for the remainder of his life. Kamuhanda supervised the killings in Gikomero commune, Kigali-Rural prefecture. He distributed firearms, grenades and machetes to the Interahamwe militia. He also led the attacks at the parish church and adjoining school in Gikomero, where several thousand Tutsi civilians were killed. Kamuhanda was born on 3 March 1953 in Gikomero commune. From late May until mid-july 1994 he was Minister of Higher Education and Scientific Research in the Interim Government. He was also a member of the Mouvement Républican National pour le Développement et la Démocratie (MRND) in Kigali- Rural préfecture. Military I (.) Trial Chamber III: Kamuhanda was arrested in Bourges, France on 26 November On 7 March 2000 he was transferred to the UN Detention Facility in Arusha, Tanzania. The Appeals Chamber was composed of Judge Theodor Meron (United States), presiding, Judge Mohamed Shahabuddeen (Guyana), Judge Florence Mumba (Zambia), Judge Wolfgang Schomburg (Germany), and Judge Inés Mónica Weinberg de Roca (Argentina). On 29, the Prosecution closed its case, subject to cross-examination of one witness to Rwamakuba (Judges Byron, Hökborg, Kam). Cooperation with Rwanda High-profile judges from Rwanda visit the ICTR At the invitation of the Registrar, Hon. Paul Ruyenzi and Fidelite Kanyange, judges at the Supreme Court and Hon. Marie Josee Mukandamage, Charles Gatwaza Gakunde, respectively Vice-President and Judge at the High Court visited the International Criminal Tribunal for Rwanda, from 24 September to 1 October 2005 to get first-hand information on the work of the Tribunal. The four judges visited the Tribunal as part of the effort to strengthen the cooperation between the Rwandan Judicial system and the Tribunal in what is called Appui Judiciaire to the Rwandese judicial bodies. The judges met with Senior Officials of the Tribunal including Messrs. Erik Møse, Hassan Bubacar Jallow and Adama Dieng, respectively President, Prosecutor and Registrar of the ICTR. They discussed a number of issues pertaining to the Completion Strategy and to the current challenges. decision in an interlocutory appeal in the Nsengimana case as well as various pre-appeal decisions and orders. In the 19 Judgement in the Kamuhanda case the Appeals Chamber affirmed, Judge Weinberg de Roca dissenting, the Appellant's convictions for genocide and extermination as a crime against humanity. The Appeals Chamber vacated the Appellant's convictions for instigating genocide and extermination and, Judge Shahabuddeen dissenting, his convictions for aiding and abetting genocide and extermination. The Appeals Chamber, Judge Weinberg de Roca dissenting, dismissed the appeal in all other respects and affirmed the sentences imposed by the Trial Chamber., Presently, the Appeals Chamber is seized of five appeals from Judgement (Media, Cyangugu, Gacumbitsi, Ndindabahizi, Muhimana), four interlocutory appeals and one request for review. The Appeals Chamber is preparing to hear the appeals in the Cyangugu and Gacumbitsi cases and is considering Niyitegeka's request for review as well as the interlocutory appeals and numerous pre-appeal motions. From the beginning of the year, the Appeals Chamber decided appeals from Judgement in three cases (Semanza, Kajelijeli, Kamuhanda). The Appeals Chamber also disposed of three interlocutory appeals and issued seventy-four pre-appeal orders and decisions. H.E Judge Andresia VAZ, ICTR, Sworn-in as Appeals Judge at the ICTR/ITCY Appeals Chamber in The Hague In this regard, ICTR officials informed the delegation that cases are going at a good pace. The judges also attended several Court Hearings and briefed ICTR officials on the restructuring within the judiciary system of Rwanda and on the ongoing legal reform in their country. Rwandan Law Students and Professors Visit the ICTR Rwandan Law students and professors from one of the Private Unviersities in Rwanda visited the ICTR from 3-7 October The purpose of their visit was to get first-hand information about international criminal law and the work of the Tribunal. The visit is part of the capacity-building support that the ICTR provides to Rwandan Academic Institutions under the aeges of the Outreach Programme. News from The Hague Activities of the Appeals Chamber During this period, the Appeals Chamber issued its Judgement in the Kamuhanda case and rendered its Judge Andresia Vaz assumed her duties as a member of the Appeals Chamber on 15 August The solemn Swearing-in Ceremony took place on Tuesday, 16 August 2005 before Judge Theodor Meron, President of the ICTY and the Presiding Judge of the Appeals Chamber and Mr. John Hocking, Deputy Registrar of the ICTY in the presence of the other Judges and Mr. David Tolbert, Deputy Prosecutor of the ICTY. Prior to her assignment to the ICTR/ICTY Appeals Chamber in The Hague, Judge Andrésia Vaz, who joined the ICTR in 2001, served at the ICTR in Arusha, Tanzania, as member of Trial Chamber I and Trial Chamber III ( ), Presiding Judge of Trial Chamber III ( ), and Vice President of the ICTR ( ). As Judge at the ICTR/ICTY Appeals Chamber, Judge Vaz will deal with appeal cases of both International Tribunals for Rwanda and for the Former Yugoslavia. 4

5 New Documents Clerk in the Other Registry Services Sub-Unit (ORSS), ACSU, The Hague Mr. Ramadhani Talib Juma assumed the duties of Documents Clerk within the ICTR Appeals Chamber Support Unit in The Hague on 3 August Before joining the ACSU, The Hague, Mr. Juma worked successively as Document Clerk and Courtroom Assistant at the Court Management Section at ICTR in Arusha. Prior to joining the Tribunal, Mr. Juma worked as an administrator of the SOS Children s Village in Zanzibar. Video-Links/Conferences from The Hague and Brussels to Arusha Following the authorization of the President of the ICTR, pursuant to Rule 4 of the Rules of Procedure and Evidence, the ACSU organised the delivery of the Judgement in the Kamuhanda case on 19 September 2005 away from the Seat of the Tribunal at the ICTY. The Parties as well as the Judges were present for the Judgement delivery which was transmitted by videolink to Arusha and Kigali. Pursuant to the ICTR President's authorization under Rule 4, the ACSU co-ordinated a status conference in the Ndindabahizi case via video-link with Judge Schomburg, the Pre-Appeal Judge, sitting in The Hague, the appellant and OTP in Arusha and a telephone connection to Defence Counsel in Paris. Following the issuance of an Order on 4 July 2005 by Trial Chamber II, composed of Judges W. H. Sekule (Presiding), A. Ramaroson and S. B. Bossa, the Appeals Chamber Support Unit in The Hague, together with the ICTR, CMS in Arusha organised and coordinated a witness testimony by video-conference in the Nyiramasuhuko et al. case from 12 to 16 in Brussels. International Conferences At the invitation of the ARCA-Net, a network on Crisis and Conflicts Management, Koffi Kumelio A. Afande, Legal Officer, OIC, ICTR Appeals Chamber Support Unit in The Hague, participated on Wednesday, 24 August 2005, in a Summer School, which took place in Berlin, Germany from 21 August to 03 on the topic The Prevention of and Resolution of Violent Conflicts Coping Strategies and Natural Resources. During the Summer School which was co-ordinated by the Humboldt University of Berlin in partnership with the Free University and Technical University of Berlin as well as the Max- Planck Institute for Foreign and International criminal Law in Freiburg, Germany, a framework has been designed for further discussions on conflicts in Africa. The Network will hold a conference in December 2005 on the topic Causes and Resolutions Strategies of Conflicts in Africa. Co-operation with the Faculty of Law of the University of Lausanne, Switzerland In a bid to further the awareness of the Tribunal s activities and its jurisprudence in the service of international criminal and humanitarian law as well as to improve its internship and exchange activities, from 22 to 23 the ACSU received a Delegation of two Professors of the Faculty of Law of the University of Lausanne, Switzerland and four of their Research Assistants: - Professor Laurent Moreillon; - Professor André Kuhn; - Ms. Aude Bichovsky, Research Assistant; - Ms. Sandra Blank, Research Assistant; - Ms. Virginie Maire, Research Assistant; - Mr. Baptiste Viredaz, Research Assistant. The Delegation conducted working sessions with Judges of the Appeals Chamber, Mr. Holthuis, Registrar, ICTY, Senior Legal Officers, Legal Officers, Associate Legal Officers and Interns and were briefed on the jurisprudence of the Appeals Chamber, the internship programme of the ACSU as well as the functioning of the Appeals Chamber and the ACSU. As a result of this fruitful exchange, a framework has been defined for internship and exchange programme with the University of Lausanne. ICTR Assists with 60 th World Summit In a spirit of cooperation and mutual support, the Office of the Registrar of the International Criminal Tribunal for Rwanda provided protocol services to UNHQ for the World Summit. Mr. Moustapha El Said Hassouna, Protocol and External Relations Officer, assisted the UNHQ Protocol and Liasion Service in the preparations of the 60 th Session of the General Assembly in New York from 7 to 18. He provided protocol services for the High Level Plenary Meeting which started on 14 September 5

6 followed by the General Debate which opened on 17 September. Working in close association with the supporting delegations of heads of states and governments who participated in the sessions of the General Assembly, Mr. Hassouna assisted the UNHQ Protocol Service with contingency reception planning for world leaders who reached major decisions on ending poverty, promoting human rights, fighting terrorism and helping countries recover from deadly conflict. The 2005 World Summit focused on the overhaul of the UN in order to make it more effective and efficient in its work throughout the world. More than 139 heads of state and government attended the World Summit, making it the largest gathering ever of world leaders. The spotlight was also on reforms to strengthen the United Nations human rights machinery. In addition to a new Human Rights Council that would replace the previous Commission on Human Rights, delegations considered proposals that would bolster the budget and capacity of the Office of the High Commissioner for Human Rights.
