1 1,t" Ontario Ministry of the Environment Ministere de I'Environnement AMENDMENT TO PROVISIONAL CERTIFICATE OF APPROVAL WASTE DISPOSAL SITE NUMBER A Notice No. 15 Issue Date: March 25, 2011 Waste Management of Canada Corporation 2301 Carp Rd Carp, Ontario K0A 1L0 Site Location: 2301 Carp Road Ottawa, Ontario You are hereby notified that I have amended Provisional Certificate of Approval No. A issued on August 17, 1994 and subsequently amended on November 12, 1996, November 1, 2001, November 6, 2001, May 23, 2003, November 10, 2006, December 20, 2006, July 18, 2007, March 7, 2008, March 19, 2008, October 27, 2008, December 10, 2008 and August 9, 2010 for for the use and operation of a 35 hectare landjilling site within a site area of hectares, as follows: The following definitions have been added to the Certificate of Approval: "Site " means the entire waste disposal site, including the buffer lands,and contaminant attenuation zone located at 2301, 2330, 2104, 2326 and 2300 Carp Road, approved by this Certificate. "Contaminant Attenuation Zone " or "CAZ " means the lands known as Part of Lot 4, Concession II, Part of Lot 3, Concession II, Part of Lot 2, Concession II, Geographic Township of Huntley, now in the City of Ottawa consisting of the following properties: former Holcim property, know as 2330 Carp Road, Registered Plan 5R-2401, PIN # ; former Mion property, Registered Plan 5R-5121, PIN# ; former Metcalfe property, should be known as 2104 Carp Road,Registered Plan 4R-24837, Part 2 of PIN# ; former Tomlinson property known as 2326 Carp Road, Registered Plan 5R-9728, PIN # : and, former Karson property known as 2300 Carp Road, Registered Plan 4R-24158, PIN # Condition 1.2 created on November 12, 1996 is hereby revoked and replaced with the following condition. Page 1 - NUMBER A461002
2 Certificate of Requirement 1.2 Pursuant to Section 197 of the EPA, no person having an interest in the Site shall deal with the Site in any way without first giving a copy of this Certificate to each person acquiring an interest in the Site as a result of the dealing. Two copies of a completed Certificate of Requirement, containing a registerable description of the Site, shall be submitted to the Director for the Director's signature within 60 calendar days of the date of this Certificate. The Certificate of Requirement shall be registered in the appropriate land registry office on title to the Site and a duplicate registered copy shall be submitted to the Director within 10 calendar days of receiving the Certificate of Requirement signed by the Director. Condition 3.2 created on November 12, 1996 is hereby revoked and replaced with the following condition. 3.2 Monitoring programs shall be carried out by the Owner for groundwater, surface water, leachate, and landfill gas in accordance with Item 39 attached to this Certificate. Conditions 3.3 and 3.4 are added to this Certificate 3.3 Within sixty (60) days of the date of this Certificate, the Owner shall submit to the District Manager for approval, an updated Environmental Monitoring Plan for the Site. The updated Environmental Monitoring Plan will include proposed new monitoring well(s), and/or surface water locations. 3.4 No alterations to the groundwater or surface water monitoring programs shall be implemented prior to receiving written agreement from the District Manager. Document entitled "Environmental Monitoring Plan WM Ottawa Landfill Ottawa, Ontario" dated October 30, 2008 prepared by WESA Inc.. The reasons for this amendment to the Certificate of Approval are as follows: 1 The reasons for the addition of the definitions are to clarify the Site definition given that additional lands have been added to form a CAZ and to define the CAZ lands. Condition 1.2 has been amended pursuant to subsection 197(1) of the EPA, to provide that any persons having an interest in the Site are aware that the land has been approved and used for the purposes of waste disposal. 3. The reason.* Condition 3.2 is to demonstrate that the landfill site is performing as designed and the impacts on the natural environment are acceptable. Regular monitoring allows for the analysis of trends over time and ensures that there is an early warning of potential problems so that any necessary remedial/contingency action can be taken. 4. Condition 3.3 has been added to ensure that the Owner submits an updated environmental monitoring plan Page 3 - NUMBER A461002
4 to meet the Ministry's requirements. 5. ('ondition 3.4 is needed to clarify the procedures for amending the environmental monitoring plan in the /uture. This Notice shall constitute part of the approval issued under Provisional Certificate of Approval No. A dated August 17, 1994 as amended. In accordance with Section 139 of the Environmental Protection Act, R.S.O. 1990, Chapter E-19, as amended, you may by written notice served upon me and the Environmental Review Tribunal within 15 days alter receipt of this Notice, require a hearing by the Tribunal. Section 142 of the Environmental Protection Act, provides that the Notice requiring the hearing shall state: I. "Ilie portions of the approval or each term or condition in the approval in respect of which the hearing is required, and; 2. The grounds on which you intend to rely at the hearing in relation to each portion appealed. The Notice should also include: 3. The name of the appellant; 4. The address of the appellant; 5. The Certificate of Approval number; 6. The date of the Certificate of Approval; 7. The name of the Director; 8. The municipality within which the waste disposal site is located; And the Notice should be signed and dated by the appellant.
