1 FILLMORE CITY COUNCIL MEETING March 6, 2018 Minutes of the regular meeting of the Fillmore City Council held March 6, 2018 in the Council Chambers of the Fillmore City Building. Notice of the time and place of the meeting was posted on the Utah State Public Notice website, the Fillmore City website, the Council Chambers, the City Office bulletin board, and the President Millard Fillmore Library. Notice was also provided to the Chronicle-Progress, radio station KMTI and each member of the governing body on March 2, Those present were: Mayor: Michael D. By: Councilmember Adams Second: Councilmember Jenson MOTION: To approve the minutes of the meeting held February 20, 2018 as amended. Bills Payroll MOTION: To approve the February 28, 2018 payroll and payment of bills listed on the invoice register dated February 7, 2018 February 20, 2018.

2 Licenses and Permits Building Permit Application #17-45 for Maverik at 965 South Highway 99 for addition to restrooms. Building Permit Application #18-03 for Daniel Wardle at 75 West 300 South for home addition. Building Permit Application #18-09 for Joan Adams at 625 North 100 West for new RV storage shed. Building Permit Application #18-09 for Rodney Buoy at 360 South 200 West for home electrical upgrade. Business License BL-1806, JT Lawn Services at 145 West 300 South. Business description includes lawn care services and sprinkler repair. Business License BL-1805, Clear Choice Professional Services at 135 West Center Street. Business description includes commercial and residential cleaning services. Business License BL-1804, Bake It Up! Bake Shop at 755 East 575 South. Business description includes Cottage foods and made to order baked goods. COMMUNICATIONS AND REQUESTS UAMPS (Utah Association of Municipal Power Systems) Report Eric Larsen UAMPS representative Eric Larsen provided a presentation and the following points were made: All UAMPS project budgets have been set and the council will be receiving a UAMPS budget before the city s annual budget is due. 50% of costs associated with the carbon free project are paid for by the Department of Energy, 25% by NuScale, and 25% by UAMPS and their members. Mr. Larsen encouraged the council to get familiar with the UAMPS and NuScale sites on Facebook and Twitter for updates on lobbying efforts and legislative updates. An early buy-out option for the Horse Butte wind project took place on March 5, This project also offers renewable energy credits, and those will show on the monthly power purchase bill. The San Juan power plant will likely shut down in Intermountain Power Association (IPA) has gone to the bond market for re-financing that will save $10 million by refinancing bonds. The Horse Butte wind project is working out well due to a large number of storms in that area. The Carbon Free Power Project will need to be signed by April 1, It needs to be in place by then so that research funding will continue and that negotiations with the Department of Energy will continue moving forward. Fire Department Report Darren Brunson There was a fire at the TDFI tire shredding plant that was deliberately started with accelerant. This determination was made following an investigation by the State Fire Marshall. The plant is not up to code and there are no plans from the owners to bring it to code in the near future. In response to this, the Fire Department will simply respond to fires at their location to protect outside exposures and then turn it over to them to extinguish the fire. It is nearly impossible to

3 extinguish a fire at their location and the fire department will not spend a week or so and city water to put it out. TDFI understands that there will be serious fines should there be a fire again at their location that would emit smoke into the area over the city. The fire department members will be joining a gym to maintain good health of the crewmembers. This will also reduce insurance premiums. Twenty memberships will be purchased. The fire department also will continue to escort Millard High School sports teams through the city following state championship victories. Abe Johnson Funding for New Stage in Territorial Park This year there is $4 million in grant monies available for outdoor recreation projects. The State cannot use it; however, it can be used for projects that take place on city or private property. The city celebration events continue to grow each year creating a need for a new stage in the Territorial Park to accommodate larger bands and other performers. The grant requires a 50/50 match from the applicant. The applications are due by April 15, Mr. Johnson and Carl Aldrich of the Territorial State House will provide projected costs for such a project to the council. The council directed Mr. Johnson to proceed with filling out the grant application. Dean Heymore Presentation on Planning and Zoning Mr. Heymore provided a lengthy presentation regarding planning and zoning strategies. He is a recently retired Development Director for Storey County in Northern Nevada. He also was the driving force behind the development of what is now the most successful industrial park in the world. During the course of his presentation, the following points were made: Several large companies have built gigafactories, in including Tesla. More than 160 other companies have also located to the Storey County industrial park. Put together a master plan that included a vision of what they wanted their park to include. They used all their resources to put this master plan together. The county would accommodate companies who wanted to locate to the park by having building permits ready for them upon their arrival. The idea was to make it easier for them to get started on construction immediately after their construction plans were submitted. All members of governmental councils, committees and commissions must be have the same objective and be positive about development plans. Sometimes it can take one negative person to derail a whole large project. When setting up an industrial park, zone the land beforehand to not include conditional uses, but rather state what the allowed uses are for the park. Doug Jenkins, DJ Productions Pouring Concrete at Fillmore City North Park DJ Productions does a big show every year in Fillmore City s North Park. Last year the concrete was replaced around the stage. It has since been determined that more concrete needs to be poured. They are seeking permission from the city to pour the needed concrete and asking the city to help with the funding. If 50 feet were to be poured, the estimated cost would be $2, When DJ Productions makes money on their events, they try to put it back into the Fillmore community. This year s show will be Once Upon a Mattress.

4 BUSINESS Alan Roper Conditional Use Permit MOTION: To ratify approval of a conditional use permit for Alan Roper on construction of a new single family dwelling located at 5 North 100 East. Second: Councilmember Jenson Lot Line Adjustement for Gerald Hackwell MOTION: To approve a lot line adjustment for Gerald Hackwell located at 110 East 400 South. By: Councilmember Jenson Conditional Use Permit for a Monopole Tower for Verizon Wireless Fillmore City ordinance has a maximum height requirement of 35 feet for poles within the residential zone. The pole will be 100 feet. State statute requires that school districts be subject to a city s land use ordinances. They can; however, use their own inspectors. Attorney Waddingham recommends to the council to go back to the planning commission to specifically discuss additional height requirements and making exceptions to the height rule. MOTION: To send the conditional use permit back to the planning commission for review of exceptions. Vote: Unanimous. Motion carried PUBLIC COMMENT Brandon Bartholomew asked if the local bidder preference policy was written into the city s policies. That policy has been added. MOTION: To go into a closed executive session to discuss pending litigation at 8:39 p.m. Second: Councilmember Alldredge Vote: Unanimous. Motion carried The council came out the closed executive session at 10:07 p.m.

5 Award BLM Containment Area Project Bid MOTION: To table to allow Attorney Waddingham additional time to research. By: Councilmember Adams Second: Councilmember Jenson Vote: Unanimous. Motion carried COUNCIL REPORTS Councilmember Alldredge No report Councilmember Adams Planning & Zoning The commission tabled the design standards item in the February planning meeting. A lengthy discussion ensued regarding current issues with proposed billboards conflicting with future roadways. Attorney Waddingham advised considering a moratorium on installation of billboards until the matter is researched further. Councilmember Dearden Library Over 200 people attended the recent Dr. Suess event in the library. Celebrations Certain local businesses will be donating eggs for the upcoming Easter celebration. Councilmember Mitchell Electric SunGro will be upgrading a pad mount transformer at their Fillmore Industrial Park location. The council will need to decide how much the city will pay for the upgrade. Mountain View Mushrooms has a large amount of upgrade work that needs to be done. The goal is to end up with one main hookup instead of two at their plant location. Councilmember Jenson No report Mayor Holt Mayor Holt is working with the Territorial Statehouse to get billboards updated north of the city. They are badly faded. UDOT has been contacted about fixing the lights that are out on the on and off ramps to Interstate 15.
