2 Delegates of the Second Assembly of the Trade Union of Media of Montenegro, held on 06 September 2014, adopted the following I GENERAL PROVISIONS STATUTE Of the Trade Union of Media of Montenegro Article 1 Trade Union of Media of Montenegro (hereinafter: Trade Union) is an independent, autonomous, voluntary, interest-based and non-political organization of employees in the media of Montenegro. Article 2 The Trade Union action shall be based on the protection and exercise of the economic and social interests and labor and professional rights of members, on the basis of this Statute and established program acts. In the protection and exercise of interests of its members, the Trade Union shall act in the spirit of the Constitution, laws, international conventions and other documents signed by Montenegro. Article 3 Trade Union shall join forces with trade unions of other branches in the Union of Free Trade Unions of Montenegro (hereinafter: UFTUM) for the purpose of more efficient exercise and protection of common and general interest of employees in the territory of Montenegro. Trade Union shall join the international trade union associations if this collaboration is to contribute to their further development and strengthening. The decision on joining or disassociation with/from other trade union association shall be made by the Main Board. Article 4 Trade Union shall operate on the principles of: 1. Democratic advocacy and representation of its members; 2. Openness to all employees under the same conditions established by this Statute; 3. Voluntariness of joining and withdrawal from the union; 4. Independence of employers and their associations, government, political parties, religious groups and other organizations; 5. Democratic elections and organs responsibility; 6. The Public work; 7. Trade Union solidarity; 8. Respect of the fundamental human and trade union rights and freedoms. Page 2 of 18

3 II NAME, HEADQIARTERS, SCOPE OF ACTIVITY, ORGANIZATION Article 5 Name of Trade Union: Trade Union of Media of Montenegro Abbreviation: SMCG The Trade Union is a legal entity and has its seal and stamp. The headquarters of the Trade Union is: ul. Slobode 74/I, Podgorica. Article 6 The Trade Union has its sign: on the left side is a stylized television and in the right corner there is the text: Trade Union of Media of Montenegro, which is printed in green. The flag of the Trade Union is of a white color with the sign of the Trade Union in the middle and text Trade Union of Media of Montenegro along the bottom, which is printed in green. The stamp of the Trade Union of Media is round in shape and in the centre there is a stylized sign (logo) of the UFTUM and around it the text: Trade Union of Media of Montenegro. III GOALS AND OBJECTIVES OF THE TRADE UNION: Article 7 The main goals and tasks of the Trade Union are: 1. Preparation, negotiation, conclusion and implementation of collective agreements in all areas and action levels; 2. Protection of financial, labor, social interests and status of its members; 3. Improvement of general, living and working conditions of its members; 4. Improvement of the conditions for the payment of salaries and other kinds of earnings (fees), primarily through concluding collective agreements; 5. Ensuring jobs of members; 6. Exercise and improvement of the pension system and other forms of security; 7. Provision of legal protection and counseling on their rights; 8. Union education of members; 9. Representation of special interests of free journalists; 10. Strengthening of the impact to the adoption and implementation of laws and other regulations in the field of media; 11. The implementation and expansion of areas of decision-making process of media workers in accomplishing their interests with the employer; 12. Protection of freedom of the press, electronic media, speech and other forms of expression and information; 13. Obligation of insurance of the journalists and media workers when going to dangerous areas where during the performance of their work they can endanger their life, health, freedom and dignity; Page 3 of 18

4 14. Representation of members' interests in the settlement of collective and individual labor disputes; 15. The exercise of solidarity in interpersonal relations; 16. Protection of professional rights, the integrity of the profession and the integrity of journalists and media workers; 17. Participation in all decisions that affect the working conditions; 18. Cooperation with trade union organizations in Montenegro; 19. Cooperation with international trade union organizations and associations of journalists and media workers in other countries. Article 8 In order to achieve the objectives and purposes of the union establishment, the Trade Union shall: 1. Represent members before the employer, employers' associations, state and other bodies and state institutions; 2. Represent members in the international trade union associations and federations of journalists and media workers; 3. Initiate and conduct negotiations with employers on conclusion collective agreements; 4. Provide free legal counseling and represent them in disputes with the employer; 5. Organize all forms of trade union activities including strikes; 6. Determine the manner of conducting trade union action and adopt rules for the implementation of the strike. Article 9 The Trade Union shall participate in collective bargaining with employers' organizations at branch level and shall support trade union organizations in negotiations with the employer at the level of the media, in accordance with the provisions of this Statute and decisions of the Assembly. Within the Trade Union an advisory committee may be established to monitor the implementation of collective and individual labor relations, whose composition, functioning and jurisdiction is determined by the decision on appointment. Except for the abovementioned, the Trade Union shall carry out other activities of special interest to its members, in accordance with the provisions of this Statute and other acts of the Trade Union. IV MEMBERSHIP Article 10 Media workers may become members of the Trade Union in accordance with the provisions of this Statute and without discrimination on any grounds stemming from fundamental human rights. 5 A worker voluntarily joins the Trade Union by signing a statement of accession that they accept the Statute and objectives and all rights and obligations arising from it. From the legal entity which under the law has the function of employer and where there is no established trade union organization, the employee becomes a member of the Trade Union as an individual member. Individual members of the Trade Union may only be those members in whose media there is no trade union organization. Article 11 Any person whose main profession is in within a media may be a member of the Trade Union: - journalists employed in all types of media; - freelance journalists who the largest part of their revenue they acquired by performing the journalistic profession; - media workers and associates who with journalists participate in the preparation of news articles in the press and on web portals and radio and television shows; - other workers employed in companies whose activities is the media. Employees who have signed the labor contract with the Trade Union may also become members of the Trade Union. In the Trade Union, students of journalism may also be active as associated members, if they respect its principles and rules. MEMBERSHIP CARD Article 12 The Trade Union membership is proved with the membership card. On the front side of the membership card there is a stylized sign of the Trade Union and the text: Trade Union of Media of Montenegro, name and surname of the member and number of the membership cards. Text on the back explains that its holder enjoys rights and fulfills all the obligations of a member in accordance with the Statute, and that the membership card is ownership of the Trade Union and may not be transferable. Records shall be kept on the membership cards that are issued. In case of misuse, the Main Board may make a decision requesting the membership card to be returned temporarily until a decision on the status of the member. RIGHTS OF THE TRADE UNION MEMBER Article 13 On the basis of the commitments provided in the Statute, a member shall exercise the rights arising from this Statute, but particularly: Page 5 of 18

6 - The right to elect and to be elected in the bodies of the Trade Union; - The right to launch initiatives and proposals at all levels of the Trade Union; - The right to be informed about the work of the Trade Union; - The right to control the work of the bodies of the Trade Union in accordance with the provisions of this Statute and other acts; - The right to trade union education; - The right to interest-based representation in collective bargaining; - The right to free of charge legal assistance in the exercise of labor rights and representation in the event of dispute before courts for the protection of labor rights. All statutory rights, a member of the Trade Union shall exercise if they regularly pay the membership fee. If the employee does not receive salary, they shall inform the Main Board of the Trade Union about that, which may remit payment of dues. OBLIGATIONS OF THE TRADE UNION MEMBER Article 14 On the basis of membership a member assumes certain obligations, such as in particular: 1. To comply with the provisions of the Statute, other acts and decisions adopted in accordance with the Statute; 2. To actively participate in all activities of the Trade Union which are organized either within the Trade Union or in cooperation with other trade unions; 3. To defend interests of the Trade Union in solidarity with other members; 4. To regularly pay the membership fee; 5. To promote the objectives of the Trade Union with their activities and to take care not to do no harm to its reputation. V - ORGANIZATION AND MANNER OF OPERATION Article 15 Trade Union members are organized in a trade union organization at the level of media in accordance with the provisions of this Statute. If a trade union organization is not established, employees shall join as individual members of the Trade Union and they shall have the same rights and obligations in accordance with this Statute. TRADE UNION ORGANIZATIONS Article 16 Page 6 of 18

7 Trade union organization is the basic form of organization and work of the Trade Union, consisting of all members employed in a media as well as permanent part-time associates. A trade union organization may be established by at least five employees in any media. The person authorized to represent is the President of the trade union organizations. President of the trade union organizations shall be elected for a term of four years, with the possibility of being re-elected. POWERS OF TRADE UNION ORGANIZATIONS Article 17 The powers of trade union organization are: 1. To initiate and conduct trade union activity aimed at protecting the interests of its members in accordance with the provisions of this Statute and the decisions of the Main Board of the Trade Union; 2. To independently negotiate or participate in negotiations for collective agreements, and conclude collective agreements in the field in which it operates (the Company) in accordance with the provisions of this Statute; 3. To partly dispose of part of union membership fees over its account and perform financial operations in accordance with the provisions of this Statute, decisions of the Main Board and other applicable laws and regulations; 4. Trade union organization for participation in legal matters shall have its own seal, in accordance with the provisions of this Statute. TASKS OF TRADE UNION ORGANIZATION Article 18 The main tasks of trade union organization shall be to take care of all the issues of importance to Trade Union members in accordance with the Statute and the decisions of the bodies of the Union, particularly: - to monitor and supervise the implementation of collective agreements in its field of operation; - to organize new members; - to consider proposals for acts of the media that are of particular interest to members of the Trade Union members and all employees; - to work directly on the improvement of working conditions and humanization of the working environment; - to develop solidarity among its members; - to take care of the calculation and collection of union membership fees; - to implement the decisions of higher bodies of the Trade Union and consider the proposals that submitted to it for discussion; Page 7 of 18

8 Trade Union members who belong to a trade union organization, and who want to achieve or protect some of their rights, including legal protection, shall first report the president thereof. Issues that cannot be resolved within the trade union organization the president shall refer to the Main Board of the Trade Union. In the case of bankruptcy of the media company in which it operates, trade union organization continues to operate, until liquidation or establishing a new form of legal entity. BODIES OF TRADE UNION ORGANIZATIONS Article 19 The bodies of trade union organizations are: 1. Assembly of the trade union organization; 2. The Executive Board of the trade union organization; 3. The President of the trade union organizations; 4. Assembly of the trade union organizations. Article 20 Assembly of the trade union organization is the highest body. Assembly of the trade union organization shall be composed of all its members. Assembly of the trade union organization shall convene every four years as an elective. Assembly of the trade union organizations shall be convened by the president. Assembly can be convened by the majority of members of trade union organizations. Assembly of the trade union organization decisions are made by majority vote of the members present; Elections are conducted by secret ballot of all union members. Article 21 Assembly of the trade union organization shall have the following responsibilities: 1. To review and approve the report on the work of the president and financial reports; 1. To elect president in accordance with the Statute; 2. To decide on the amount of membership fees; 3. To adopt the work plan and program of the trade union organization; 4. To perform other duties arising from the Statute. EXECUTIVE COMMITTEE OF THE TRADE UNION ORGANIZATIONS Article 22 Page 8 of 18

9 The Executive Board of the trade union organization shall consist of 3 or more members of trade union organizations. The number of members shall be odd. The Executive Board of the trade union organization is managed by the trade union organization between two Assemblies. PRESIDENT OF THE TRADE UNION ORGANIZATION Article 23 President of the trade union organization shall be elected by the Assembly of the Trade Union by a majority vote of the members present. President of the Trade Union organization representing trade union organization and is represented by the employer. President of the trade union organization is a member of the Executive Board. VI - MANAGEMENT BODY AND MAKING UNIONS Article 24 The bodies of the Union are: 1. The Assembly of the Trade Union; 2. The Main Board (GO); 3. President; 4. Steering Board; 5. Statutory Board; THE ASSEMBLY OF THE TRADE UNION Article 25 The Assembly is the highest body of the Trade Union of Media of Montenegro. The Assembly of the Trade Union shall be held every four years as an elective. The decision on the date and place of the Ordinary Assembly shall be decided by the Main Board at least 30 days in advance. The Assembly shall consist of all members of the Trade Union. The Assembly may also be composed be of the delegates, that is, authorized representatives of trade union organizations and individual members. Each member of the Assembly shall have one vote, and delegates shall have as many votes as they have the acquired powers of attorney by members of the Trade Union. Article 26 Page 9 of 18

10 The Assembly of the Trade Union may make decisions if it is attended by more than half of the voting members, or more than half of the members representing the delegates, in accordance with the provisions of this Statute. Decisions at the Assembly are made by majority of the voting members and delegates. The Assembly is chaired by the Working Committee elected by the Assembly, in accordance with the Rules of Procedure of the Assembly. Decisions at the Assembly are normally made by public voting, unless this Statute provides otherwise. President of the Trade Union signs the decisions made at the Assembly. If there is no quorum, the Assembly shall be convened again within 30 days, thereby it may be decided even though it is not attended by more than half of the voting members, or more than half of the members representing the delegates, as provided for in paragraph 1 of this Article. COMPETENCIES OF THE ASSEMBLY Article 27 The Assembly of the Trade Union: 1. adopts the Statute and amendments to the Statute; 2. adopts its Rules of Procedure; 3. elects Working Committee and other working bodies of the Assembly; 4. decides on adoption of the Work Report of the Main Board; 5. decides on acceptance of the report of the Steering Board and decides on the dismissal of members of the Steering Board; 1. decides on acceptance of the Work Report of the Statutory Board and decides on the dismissal of members of the Statutory Board; 2. draws and adopts conclusions of the Trade Union on important matters of interest for the Trade Union; 3. discusses and adopts positions on working, material, social status and position of journalists and media workers; 4. appoints and dismisses the President of the Trade Union; 5. elects and dismisses members of the Main Board, who are not automatically members of the Main Board (presidents of trade union organizations), in accordance with this Statute; 6. elects and dismisses members of the Steering Board and Statutory Board; 7. makes decisions on other issues relevant to the work of the Trade Union. THE EXTRAORDINARY ASSEMBLY OF THE TRADE UNION Article 28 The Extraordinary Assembly of the Trade Union is convened by the Main Board of the Trade Union at the request of at least 1/3 of the members or when Page 10 of 18

11 it is required from the Main Board by at least 1/3 of members of the Trade Union. The initiative to convene the Extraordinary Assembly may be submitted by Statutory Board or Steering Board, upon which the Main Board makes final decision by 2/3 majority. In order to convene the Extraordinary Assembly, person who submits the initiative for convening the Extraordinary Assembly has to explain the reason for its convening and propose agenda, before decision on its convening is made. The Main Board has to decide upon the initiative for convening the Extraordinary Assembly within 30 days of the submission of the initiative for its convening, if it is determined that all the requirements for its convocation defined by Statute are met. The Extraordinary Assembly of the Trade Union will be held within a maximum of 60 days from the date of the decision on its convening. THE MAIN BOARD OF THE TRADE UNION Article 29 The Main Board is the highest body of the Trade Union between the two Assemblies and consists of trade union presidents, presidents or elected representatives of 7 trade union organizations and five members elected from among individual members. The Main Board consists of the presidents or, instead of them, elected representatives of 7 trade union organizations. The Main Board may not include more than two members from the same media. When the President of the Trade Union is from a media company, then he/she is counted as on the quota of that media company. If a new trade union organization affiliates to the Trade Union between the two Assemblies, its president or elected representative acquires the right to membership in the Main Board until the expiration of the current mandate. President of the Trade Union is by function president of the Main Board. Two vice-presidents from among the members of the Main Board are elected at the first constitutive session of the Main Board, after the Assembly. The mandate of the members of the Main Board elected at the Assembly is four years, with the possibility of re-election. RIGTHS AND RESPONSIBILITIES OF THE MAIN BOARD OF THE TRADE UNION Article 30 The basic functions of the Main Board are to: 1. manage the work of the Trade Union between the two Assemblies; 2. set and adopt the principles of collective bargaining; Page 11 of 18

12 3. monitor the implementation and require consistent respect for and implementation of collective agreements; 4. organize the work of the Trade Union, direct and coordinate the work of trade union organizations, decide on the membership of new trade union organizations, decide on the exclusion of trade union organizations which do not meet the requirements prescribed by the Statute of the Trade Union; 5. prepare and adopt the financial report and annual accounts; 6. ensure informing of trade union members; 7. decide on the application of the various forms of trade union fight, going on strike, duration and termination of strike in accordance with the provisions of the Labour Law and Trade Union s rules of striking; 8. take over the powers of the strike committee when the Trade Union gets in a strike; 9. announce a vacancy for position of secretary and other positions in accordance with this Statute; 10. define proposal of the Statute of the Trade Union and its amendments; 11. define the documents and decisions to be proposed to the Assembly; 12. decide on the appeals in the cases specified by this Statute, and on proposals submitted by members and bodies of the Trade Union; 13. perform other tasks within its competence, prescribed by this Statute or other decisions and acts of the bodies of the Trade Union; 14. decide on engagement of experts to help members, union organizations, territorial branches and bodies of the Trade Union, which is regulated by special agreements; 15. adopt the Rules of Procedure of the Main Board; The Main Board is responsible for its work to the Assembly and members of the Trade Union. President of the Main Board convenes and manages the sessions of the Main Board. The session is convened at the request of at least 1/3 of the members of the Main Board. The sessions may be convened as reporting ones on which occasion members of the Main Board discuss effects of work of are discussed, if requested by at least 1/3 of the members of the Main Board. The Main Board may make decisions through electronic sessions during which members of the Main Board declare by . Members of the Main Board adopt minute from the electronic session at the first next session of the Main Board. THE PRESIDENT OF THE TRADE UNION Article 31 Page 12 of 18

13 The President of the Trade Union is an authorized person who presents and represents the Trade Union and is responsible for the overall functioning of the material and financial operations of the Trade Union. The President of the Trade Union cooperates in good faith with other trade unions and social partners as well as professional associations at the national and international level. The President of the Trade Union is a member of the Main Board by function. The President of the Trade Union implements decisions of the Assembly, Main Board and coordinates the work of the Trade Union s bodies. The President of the Trade Union signs the acts of the Assembly, contracts and agreements. The President of the Trade Union works on the implementation of objectives and tasks of the Trade Union. The President of the Trade Union is authorized to, on behalf of the Trade Union, act and react independently, verbally or in written form, to the violation of working, material and status rights of journalists and other media workers, as well as to other illegal and illicit practices that members may be exposed to. The President is obliged to comply with the attitude of the Main Board of the Trade Union and to regularly inform the Main Board on the activities undertaken on behalf of the Trade Union. The President of the Trade Union performs other duties assigned to him/her by the Assembly and Main Board. Article 32 The President of the Trade Union is elected by the Assembly. The President is elected for four-year term of office with the possibility of re-election two consecutive times at most. Acting status is calculated within mandate of the President, if it has lasted for more than two years. The President of the Trade Union performs his/her function as a volunteer and, if necessary, he/she may professionally perform the function based on the decision of the Main Board, depending on financial situation of the Trade Union. During incapacity to perform the function, the President of the Trade Union is replaced by vice-presidents, if this body has approved this by a simple majority of votes of its members. Recall procedure of the President of the Trade Union is conducted in a same manner as election procedure. Article 33 The President of the Trade Union has the status and enjoys the protection of a shop steward. Protection of shop stewards and other union activists is defined by the law, collective agreement or agreement with employers. Page 13 of 18

14 THE STEERING BOARD OF THE TRADE UNION Article 34 The Steering Board performs supervision over the property and financial operations of the Trade Union. The Steering Board consists of 3 members, who are elected by secret ballot by the Assembly. If number of the Steering Board members is reduced in a period between the two Assemblies, deputy member is appointed at the vacant position by the decision of the Main Board. The Steering Board of the Trade Union meets when necessary and at least every six months. Elected members hold constitutive session during the same Assembly at which they are elected, if they are all present. Otherwise, the constitutive session of the Steering Board is convened by the President of the Trade Union no later than 30 days after the Assembly. Members and deputy members of the Steering Board are elected for fouryear term of office and may be re-elected after the expiration of the mandate. The Steering Board is responsible for its work to the Assembly of the Trade Union. Article 35 The Steering Board of the Trade Union performs the following tasks: 1. controls the established financial policy of the Trade Union; 2. supervises the total material and financial operations of the Trade Union; 3. submits a report on its work during its mandate to the Assembly of the Trade Union. THE STATUTARY BOARD OF THE TRADE UNION Article 36 The Statutory Board is a body of the Trade Union elected by secret ballot by the Assembly. The Statutory Board consists of 3 members who may not be members of the Main Board or Steering Board. If number of the Statutory Board members is reduced in a period between the two Assemblies, the Main Boards elects new members from among the members of the Trade Union. The mandate of the Statutory Board is four years and members may be re-elected after termination of the mandate. Page 14 of 18

15 Elected members hold constitutive session during the same Assembly at which they are elected, if they are all present. Otherwise, the constitutive session of the Statutory Board is convened by the President of the Trade Union no later than 30 days after the Assembly. The Statutory Board meets as needed, at least once a year. The Statutory Board is responsible for its work to the Assembly of the Trade Union. Article 37 The Statutory Board of the Trade Union has the following responsibilities and tasks: 1. to interpret provisions of the Statute; 2. to deliver opinion on draft amendments to the Statute and forward them to the Main Board and Assembly. THE TRADE UNION ELECTIONS Article 38 Directors, chief editors, technical directors and production directors and members of the Board of Directors of a media may not be elected at the positions of the President and members of the Main Board of trade union organization. ELECTION OF THE TRADE UNION PRESIDENT Article 39 The President of the Trade Union is, as a rule, elected by the Assembly, by secret ballot. If only one candidate is proposed for the position of President, he/she needs to be supported by voting majority of present members and delegates of the Assembly. If several candidates are proposed for the position of President, candidate who is supported by voting majority of present members and delegates of the Assembly is elected for the President. If none of the proposed candidate has received the required majority in the first round, two candidates who received the highest number of votes in the first round will enter in the second round, and candidate who then receives voting majority of the members present and delegates at the Assembly is elected. If both candidates receive an equal number of votes in the second round of elections, a new Assembly will be organized within a period not longer than 30 days. Page 15 of 18

16 ELECTION OF MEMBERS OF THE MAIN, STEERING AND STATUTARY BOARDS Article 40 Members of the Main Board from trade union organizations are not elected, but the Assembly just verifies their membership after they had been selected by their organizations. If the number of proposed candidates for a position is the same as the number of candidates that should be elected, each candidate has to have a voting majority of the present members and delegates at the Assembly in order to be elected. If several candidates have been proposed for a position, those candidates who received the highest number of votes are elected. If two or more candidates receive an equal number of votes for the position, and it cannot be determined who is elected, the election between these candidates are repeated and the candidate who receives the highest number of votes is elected. Elections are conducted by secret ballot. VII TERMINATION OF TRADE UNION MEMEBERSHIP Article 41 Membership in the Trade Union is terminated in the following cases: 1. if the member goes to work in non-media sector; 2. if the member steps out voluntarily; 3. if the member is removed from the list of the Trade Union members; 4. if the member is expelled. By termination of membership in the Trade Union, all mutual rights and obligations of the member based on membership in accordance with the provisions of this Statute are terminated. Upon termination of membership, the member is obliged to return all property owned by Trade Union, including the membership card. Article 42 Member withdraws from membership voluntarily, without any coercion by means of a written statement of resignation from membership surrendered to the trade union president or president of trade union organizations he/she joined to, by submitting the membership card. Deletion of membership is conducted when a member has not paid union fees for 3 consecutive months, and has not sought and gained the right to defer payment of union fees. Page 16 of 18

17 Deleting a member from the previous paragraph is carried out simultaneously in the trade union organization and Trade Union of Media of Montenegro. Procedure of expulsion of a member from membership is conducted in case of violation of membership obligations, when these injuries damage the reputation and interests of the Trade Union, when a member violates the provisions of the Statute, or when it does not carry out and does not respect the decisions of the bodies of the Trade Union. Trade union organization starts and ends expulsion procedure in accordance with the Main Board of the Trade Union, and if it comes to an individual member, the decision is made by the Main Board by a majority vote. Member who is to be expelled is submitted a written decision with an explanation of the reasons for the exclusion. Member may appeal to the Main Board of the Trade Union against the first instance decision, within the next month. Member may appeal to the Assembly of the Trade Union against the Main Board s first-instance decision on the appeal. The Assembly s decision on appeal is final. Article 43 The work of the Trade Union is open to the public. Internal disputes between members of the Trade Union may not be disclosed to the public through press releases and media if it would jeopardize the reputation of the Trade Union. Mutual disputes are discussed at the meetings of the Main Board. The opposite actions of those listed in paragraph 2 of this Article may entail a process of expulsion. VIII PROFESSIONAL AND ADMINISTRATIVE TASKS IN THE TRADE UNION THE TRADE UNION SECRETARIAT Article 44 The Trade Union may establish Secretariat of the Trade Union of Media of Montenegro which would carry out professional and administrative activities for the needs of the Trade Union, keep data and decisions of the bodies of the Trade Union. The decision on the establishment of Secretariat is made by the Main Board. Secretariat office of the Union of Free Trade Unions of Montenegro will perform administrative tasks and provide free legal assistance until the establishment of the Secretariat of the Trade Union of Media of Montenegro. The main source of income and financing of the Trade Union activities is membership fee. Page 17 of 18

18 IX STRIKE AND SOLIDARITY STRIKE Article 45 According to the provisions of the Law on Strike, Trade Union may, as a last measure of the trade union fight, organize a general strike and solidarity strike of its members. A strike may be organized if conciliation procedure or arbitration process prescribed by the Law on Strike fails. Each trade union organization may propose to go on strike, and the Main Board makes final decision about that. When organizing the strike, the Trade Union will comply with the rules of the Labour Law, collective agreement and Statute of the Trade Union. Before initiating the procedure for the strike, procedure of declaration of membership is conducted. ENTRY INTO FORCE OF THE STATUTE Article 46 This Statute enters into force on the day of its adoption. With the entry into force of this Statute, the Statute of the Trade Union of Media of Montenegro dated to 15 April 2013 ceases to exist.
