1 CITY COUNCIL CONFERENCE AND REGULAR MEETING MINUTES December 18, 2008 Trenton Council Chamber 1:00 p.m. A Joint Conference and Regular Public Meeting of the City Council of the City of Trenton, New Jersey, was held on the above date at 1:30 p.m., in the City Council Conference Room, City Hall, 319 East State Street, Trenton, New Jersey. The meeting was called to order by Vice President Cordelia M. Staton, who announced that adequate public notice had been provided to the public specifying the time and place for this meeting in accordance with the Open Public Meetings Act. The FY 2008 annual notice was adopted by Trenton City Council by Resolution No on June 19, The agenda for the said meeting was mailed, posted and filed on December 16, ROLL CALL: Present: Messrs. Bethea and Coston, Ms. Lartigue, Messrs. Melone and Segura, Ms. Staton and Mr. Pintella PUBLIC COMMENT: Charles Owen, 30 Richey Place, spoke regarding his layoff, and is hoping City Council finds a way to prevent the layoffs. A discussion was held concerning the city layoffs in the Recreation Division. Bea Perry, City of Trenton, inquired about having cameras installed at the intersection of New York and Sylvester. Dion Clark, 323 Walnut Avenue, he heard that millions of dollars have been lost due to grants not being properly filed. He also questioned what positions were impacted by grant dollars, and when the budget will be presented to the public. Patricia Stewart, 679 Lamberton Street, feels that when it comes to layoffs, they should start at the top. Mr. Tim Gibson, Recreation Dept., asked for clarity of his position with regards to the layoff notice that he received. City Council Meeting Minutes December 18,

2 Dennis Gonzalez, Acting Business Administrator, informed City Council that the New Jersey Department of Personnel is in the process of evaluating all of the titles that have been proposed for either elimination or demotion, and they will determine person by person what demotional or lateral rights each individual has, and with what title. NJDOP will then send each effected employee a letter describing their determination as to demotional and or lateral title rights. The City of Trenton will receive a copy. Greg Grant, Hillcrest Avenue, feels that the Recreation Department is important to the young children of the City of Trenton. His organization, 94 FT, has worked closely with the Recreation Department. Lonnie McQueen, 1834 Chestnut Avenue, stated he was one of the people that helped the Weed and Seed Program become nationally known., along with the SCOOP Program. Ms. Lartigue requested that in the future, the Department Directors speak with their employees and discuss some of the problems that the city is having. Mr. Gonzalez informed City Council that procedures were followed according to the State Department of Personnel with regards to the layoff notices. EXECUTIVE SESSION: (City Council went into Executive Session at 2:29 p.m.) Adoption of the following resolution to go into Executive Session was read into the record by Acting City Clerk Juanita M. Joyner, moved by Mr. Coston, seconded by Mr. Pintella, and carried by unanimous vote of those Council members present. RESOLUTION AUTHORIZING EXECUTIVE SESSION OF THE CITY COUNCIL TO PERMIT DISCUSSION OF PENDING LITIGATION WHEREAS the City Council deems it necessary and essential to conduct a discussion concerning pending litigation,specifically; 1. In the matter of the Board of Public Utilities (Sale of the outside water infracture and all negotiations related thereto) 2. Cynthia St. John v. City of Trenton Docket Number: CSVLT S 3. Alfred Auletta v. City of Trenton Docket Number: MER-L WHEREAS the public disclosure of such discussion will be contrary to the interest of the City of Trenton and will not permit the fullest view of said matters; now therefore be it RESOLVED by the City Council of the City of Trenton that a discussion be held on December 18, 2008, at or about 1:00 p.m., in the Council Conference Room at which session the public will be excluded pending the discussion of said matters only. The public shall be informed of the determination of the City Council with respect to the final disposition of said pending proceedings, which final disposition shall be memorialized appropriately and adopted at a public meeting as soon as practicable. 3 Mr. Melone left the meeting at 4:00 p.m. City Council reconvened in open session at approximately 3:31 p.m. and then recessed until 4:05 p.m. Council reconvened in open session for docket review. DOCKET REVIEW/ACTION Appearance: Renee Haynes, Chief of Staff Dennis Gonzalez,, Acting Business Administrator Docket items were reviewed and discussed by City Council. City Council recessed at 5:42 p.m., and reconvened in the Council Chambers at 6:15 p.m. City Council members wished Andrew Kitchenman, reporter for the Trenton Times Newspaper, well in the future. Motion was made by Ms. Lartigue, seconded by Mr. Segura, that the minutes of the City Council meetings held on November 25 and December 4, 2008, be approved and the reading thereof dispensed with. Motion carried by unanimous vote of those Council members present. Motion was made by Ms. Lartigue, seconded by Mr. Segura, to accept all communications, petitions, reports, application and bonds. Motion was made by Ms. Lartigue, seconded by Mr. Bethea, to withdraw the following resolutions, which motion was carried by unanimous vote of those Council members present. 5zr - RESOLUTION CONSENTING TO THE APPOINTMENT OF RICHARD LAIRD AS DIRECTOR OF THE DEPARTMENT OF FIRE. 5aar - RESOLUTION CONSENTING TO THE APPOINTMENT OF JEROME HARRIS AS DIRECTOR OF THE DEPARTMENT OF HOUSING AND ECONOMIC DEVELOPMENT. UNFINISHED BUSINESS AND SECOND READING OF THE FOLLOWING ORDINANCES: Council President Pintella declared open a public hearing on an ordinance entitled ORDINANCE TERMINATING CERTAIN LEASES WITH THE NEW JERSEY ECONOMIC DEVELOPMENT AUTHORITY REGARDING CITY-OWNED PROPERTY IN THE MARINE TERMINAL AREA. Jerome Harris, Acting Department of Housing and Development, informed City Council that it is for a portion of property behind Tucker Street to install a handicap ramp for access to the building. 12 RESOLUTION NO RESOLUTION IN SUPPORT OF TRENTON S FEDERAL RECOVERY PLAN. (Sponsored by Mr. Pintella) Ayes: Nays: Messrs. Bethea and Coston, Ms. Lartigue, Mr. Segura, Ms. Staton and Mr. Pintella Mr. Melone Ms. Joyner, Acting City Clerk, informed City Council that she received a petition on behalf of the SCOOP Program. FIRST READING OF THE FOLLOWING ORDINANCE: Mr. Coston introduced, presented and authorized publication of an ordinance entitled ORDINANCE ACCEPTING BIDS AND AUTHORIZING EXECUTION OF DEEDS RELATING TO PUBLIC SALE OF CITY OWNED PROPERTY. The motion was seconded by Mr. Pintella, and carried. Ayes: Nays: Messrs. Bethea and Coston, Ms. Lartigue, Mr. Segura, Ms. Staton and Mr. Pintella Mr. Melone PUBLIC PRESENTATIONS: Patricia Stewart, 679 Lamberton Street, feels that the layoffs should start at the top. She also opposes the cutting of after-school programs for the city youths. Hiram Ortiz, 330 Reservoir Street, spoke against the privatization of the Department of Inspections. He also questioned the status of the Kramer Site. Dion Clark, 323 Walnut Avenue, questioned if the City of Trenton received money from Homeland Security. He also spoke in support of the Department of Recreation and the work that they do with children, and of what had happened to the little girl that died in the fire at 225 Walnut Avenue. Captain Fred Reister, Trenton Police Department, will contact Mr. Clark regarding the status of the report of the fire that claimed the life of a little girl living at 225 Walnut Avenue. Mike Collins, 234 South Cook Avenue, informed City Council that an advertisement was posted in the newspaper requesting proposals for companies to bid on inspection services. He also spoke against the privatization of the Department of Inspections. City Council Meeting Minutes December 18,

13 Ms. Lartigue informed Mr. Collins and the audience that she would not support the privatization of the Department of Inspections, and asked the Administration to pull the advertisement. pay. Mr. Segura questioned why employees were not asked to give back a percentage of their Messrs. Bethea and Coston informed the audience that they would not support the privatization of the Department of Inspections. Ms. Staton echoed the views of her colleagues and also stated that City Council has a fiscal responsibility to balance the budget. Joseph Pratico, 542 Hudson Street, opposed the privatization of the Department of Inspections. Rafael Valentin, 225 Kensington Avenue, opposed the layoff of several people of the Department of Recreation. Samuel Frisby, Director of Recreation, Natural Resources and Culture, informed City Council that they will be sending out an RFP for several organizations. Also, of the eight SCOOP sites, only four are run by the City of Trenton. James Fouse, 18 Covell Avenue, spoke of the budget cuts. Brianna Richardson, 430 S. Logan Avenue, spoke in support of the SCOOP Program. German Ortiz, 539 Emmett Avenue, spoke against privatization of the Department of Inspections. Vertulie Massanet, 1150 E. State Street, spoke against privatization of the Department of Inspections. Hector Tigreros, So. Clinton Avenue, spoke against privatization of the Department of Inspections. Elroy Young, 217 Emory Avenue, supports the SCOOP Program. Lisa Kasabach, and son Kasper, 109 Jackson Street, spoke in support of the SCOOP Program. Michael Smith, 945 W. State Street, spoke of the proposed 40 percent cuts that are to occur in the Department of Recreation. Paul Schorr, Princeton, spoke against the privatization of the Department of Inspections. 14 Daryl Brooks, 118 Rossell Avenue, spoke about a program that he submitted to the Board of Education, which is a free program that would help the children of the City of Trenton. Sandy Durst, 32 Federal City Road, spoke against the cuts that will occur in the Recreation Department. Dan Schwartz, 27 Whittier Avenue, spoke about the layoffs and the budget cuts. Jane Rohlf, 253 Rendover, spoke against the cuts that will occur in the Recreation Department. Mr. Marin, 14 So. Cook Avenue, spoke against the privatization of the Department of Inspections.
