1 LIBERTY TOWNSHIP BOARD OF TRUSTEES MINUTES OF THE ORGANIZATIONAL & REGULAR MEETING TUESDAY JANUARY 2, PRINCETON ROAD LIBERTY TOWNSHIP OH On Tuesday, January 2, 2018 at 6:00 P.M., the Liberty Township Board of Trustees met this day for an Organizational and Regular Meeting. Upon call of the roll, Mrs. Matacic present, Mr. Schramm present, Mr. Farrell present. Boy Scouts Austin Rose, Phillip Corfman, and Graham Allan led the Pledge of Allegiance. ORGANIZATIONAL MEETING 6:00 P.M. Mrs. Quinlisk requested a Resolution to elect Tom Farrell to the position of Board President for Ms. Matacic MOVED TO APPROVE A RESOLUTION TO ELECT TOM FARRELL TO THE POSITION OF BOARD PRESIDENT FOR ( ) Mr. Schramm seconded. The motion passed unanimously. Ms. Matacic requested a Resolution to elect Steve Schramm to the position of Board Vice - President for Ms. Matacic MOVED TO APPROVE A RESOLUTION TO ELECT STEVE SCHRAMM TO THE POSITION OF BOARD VICE - PRESIDENT FOR ( ) Mr. Farrell seconded. The motion passed unanimously. ORGANIZATIONAL MEETING CONSENT AGENDA All matters under the Consent Agenda are considered by the Board of Trustees to be routine and will be enacted by one motion. Any Trustee may remove an item from the Consent Agenda by request. No second is required for removal of an item. Items removed for separate discussion will be considered after the motion to approve the Consent Agenda. Organizational Items: Motion to approve a Resolution to establish the 2018 Meeting Schedules for the Liberty Township Board of Trustees, Board of Zoning Appeals, Finance Committee, JEDD I Board, Parks Committee, Trails Committee, and Zoning Commission, and the 2018 Township Holiday and Event Schedules. ( ) Motion to approve a Resolution to establish the 2018 Zoning Fee Schedule, dispensing with the second reading, and declaring an emergency. ( ) Motion to approve a Resolution to establish the 2018 Medicount Fee Schedule. ( ) Motion to approve a Resolution to establish the 2018 American Heart Association Class Fee Schedule. ( ) Motion to approve a Resolution to establish the 2018 Cemetery Fee Schedule. ( )

( ) Motion to approve a Resolution to allow the Liberty Township Administrator and the Assistant Township Administrator to accept letters of resignations and requests for leaves of absence from Township employees. ( ) Motion to approve a Resolution to set the 2018 Employee Cell Phone Reimbursement Rates. ( ) Motion to approve a Resolution to establish the 2018 Personal Protective Equipment List. ( ) Mr. Schramm MOVED TO APPROVE THE CONSENT AGENDA. Ms. Matacic seconded. The motion passed unanimously. ORGANIZATIONAL BUSINESS Mr. Farrell requested a motion to approve a Resolution to appoint Tom Farrell and Dale Chalk to the Volunteer Fire Fighters Dependents Fund for the 2018 Annual Election of Board Members. Ms. Matacic MOVED TO APPROVE A RESOLUTION TO APPOINT TOM FARRELL AND DALE CHALK TO THE VOLUNTEER FIRE FIGHTERS DEPENDENTS FUND FOR THE 2018 ANNUAL ELECTION OF BOARD MEMBERS. ( ) Mr. Schramm seconded. The motion passed unanimously. Mr. Farrell requested a motion to approve a Resolution to appoint Steve Schramm of the Liberty Township Board of Trustees to the Butler County Emergency Management Agency Advisory Council. Ms. Matacic MOVED TO APPROVE A RESOLUTION TO APPOINT STEVE SCHRAMM OF THE LIBERTY TOWNSHIP BOARD OF TRUSTEES TO THE BUTLER COUNTY EMERGENCY MANAGEMENT AGENCY ADVISORY COUNCIL. ( ) Mr. Schramm seconded. The motion passed unanimously. Mr. Farrell requested a motion to approve a Resolution to authorize the transfer of funds not to exceed $1,300, from medical / hospitalization accounts into the Health Insurance Bank Account with Fifth Third Bank at intervals throughout the year to fund the partially self-funded health insurance program. Mr. Schramm MOVED TO APPROVE A RESOLUTION TO AUTHORIZE THE TRANSFER OF FUNDS NOT TO EXCEED $1,300, FROM MEDICAL / HOSPITALIZATION ACCOUNTS INTO THE HEALTH INSURANCE BANK ACCOUNT WITH FIFTH THIRD BANK AT INTERVALS THROUGHOUT THE YEAR TO FUND THE PARTIALLY SELF-FUNDED HEALTH INSURANCE PROGRAM. ( ) Ms. Matacic seconded. The motion passed unanimously. Mr. Farrell requested a motion to approve a Resolution to authorize the advance of funds in the amount of $50, from the operating bank account into the flex bank account with Fifth Third Bank to be transferred back at the end of the 2018 fiscal year less applicable fees. Mr. Schramm MOVED TO APPROVE A RESOLUTION TO AUTHORIZE THE ADVANCE OF FUNDS IN THE AMOUNT OF $50, FROM THE OPERATING BANK ACCOUNT INTO THE FLEX BANK ACCOUNT WITH FIFTH THIRD BANK TO BE TRANSFERRED BACK AT THE END OF THE 2018 FISCAL YEAR LESS APPLICABLE FEES. ( ) Ms. Matacic seconded. The motion passed unanimously.

3 Minutes Page 3 Mr. Farrell requested a motion to approve a Resolution to amend the Liberty Township Meeting Center Rental Agreement and Regulations with a rental fee of $ for nonresidents and a non-refundable security deposit of $50.00 for residents, non-residents, government entities, and non-profit organizations. Mr. Schramm MOVED TO APPROVE A RESOLUTION TO AMEND THE LIBERTY TOWNSHIP MEETING CENTER RENTAL AGREEMENT AND REGULATIONS WITH A RENTAL FEE OF $ FOR NON-RESIDENTS AND A NON-REFUNDABLE SECURITY DEPOSIT OF $50.00 FOR RESIDENTS, NON-RESIDENTS, GOVERNMENT ENTITIES, AND NON-PROFIT ORGANIZATIONS. Mr. Farrell requested a motion to approve the appointment of Trustee Schramm to the Parks Committee for Mr. Schramm stated he will accept the appointment if the meetings can be held on the Monday before the Trustee Meetings. He stated Mr. Plummer is okay with moving the date of the meetings. Ms. Matacic MOVED TO APPROVE THE APPOINTMENT OF TRUSTEE SCHRAMM TO THE PARKS COMMITTEE FOR Ms. Matacic seconded. The motion passed unanimously. Ms. Matacic requested a motion to approve the appointment of Trustee Farrell to the Finance Committee for Ms. Matacic MOVED TO APPROVE A THE APPOINTMENT OF TRUSTEE FARRELL TO THE FINANCE COMMITTEE FOR Mr. Schramm seconded. The motion passed unanimously. Mr. Farrell requested a motion to approve the appointment of Trustee Matacic to the Trails Committee for Mr. Farrell MOVED TO APPROVE A THE APPOINTMENT OF TRUSTEE MATACIC TO THE TRAILS COMMITTEE FOR Mr. Schramm seconded. The motion passed unanimously. PUBLIC HEARING #1 Street lighting request for Roden Park Drive, St. Andrews Way and Sandhurst Court in Section 6 of the Windsor Estates Subdivision for ten (10) lights. No Comments Fire Department PUBLIC COMMENTS DEPARTMENTAL BUSINESS Chief Klussman requested a Resolution to hire Melissa Steinbrink as the Full-Time Fire Department Administration Assistant at $45, per year with an effective start date of Monday, January 8, Mr. Schramm MOVED TO APPROVE A RESOLUTION TO HIRE MELISSA STEINBRINK AS THE FULL-TIME FIRE DEPARTMENT ADMINISTRATION ASSISTANT AT $45, PER YEAR WITH AN EFFECTIVE START DATE OF MONDAY, JANUARY 8, ( ) Ms. Matacic seconded. The motion passed unanimously.2 Chief Klussman requested a Resolution to hire Josiah Young, Ryan Fogle and Jeremy Crear as Part-Time Fire Fighters / EMTs Basic at $13.00/hour contingent upon successful completion of pre-employment testing. Mr. Schramm MOVED TO APPROVE A RESOLUTION TO HIRE JOSIAH YOUNG, RYAN FOGLE AND JEREMY CREAR AS PART-TIME FIRE FIGHTERS / EMTS BASIC AT $13.00/HOUR CONTINGENT UPON SUCCESSFUL COMPLETION OF PRE-EMPLOYMENT TESTING. Services Department Mr. Plummer requested a Resolution to accept the Parks Committee recommendation for the 2018 officers as President Michel Price, Vice President Laurie Ballenger, Secretary Maureen Mowl, and Treasurer Ron Aylward and to renew terms for members Michel Price, Laurie Ballenger, Ron Aylward, Chuck Holliday, and William Walker for an additional term ending December 31, Mr. Schramm MOVED TO APPROVE A RESOLUTION TO ACCEPT THE PARKS COMMITTEE RECOMMENDATION FOR THE 2018 OFFICERS AS PRESIDENT MICHEL PRICE, VICE PRESIDENT LAURIE BALLENGER, SECRETARY MAUREEN MOWL, AND TREASURER RON AYLWARD AND TO RENEW TERMS FOR

Administration Ms. Bitonte requested a Resolution rescinding previous noise regulations, establishing new noise regulations within Liberty Township, and dispensing with the second reading. Mr. Schramm MOVED TO APPROVE A RESOLUTION RESCINDING PREVIOUS NOISE REGULATIONS, ESTABLISHING NEW NOISE REGULATIONS WITHIN LIBERTY TOWNSHIP, AND DISPENSING WITH THE SECOND READING. ( ) Ms. Matacic seconded. The motion passed unanimously. Ms. Bitonte requested a Resolution to authorize the Township Administrator to submit an application for the Chris Humphreys Impact Grant through The Community Foundation of West Chester / Liberty. Mr. Schramm MOVED TO APPROVE A RESOLUTION TO AUTHORIZE THE TOWNSHIP ADMINISTRATOR TO SUBMIT AN APPLICATION FOR THE CHRIS HUMPHREYS IMPACT GRANT THROUGH THE COMMUNITY FOUNDATION OF WEST CHESTER / LIBERTY. ( ) Ms. Matacic seconded. The motion passed unanimously. Ms. Bitonte presented the following reminder: Holiday Closings: Monday, January 15th TRUSTEE COMMENTS Ms. Matacic noted that the OTA Conference will be held on Jan 31, 2018 February 2, 2018 in Columbus. Mr. Farrell is excited to begin a new year and move forward. He also responded to a statement made by a resident, Ron Alyward (who is not present tonight), at the last meeting regarding transparency. He wanted it noted that he believes the Township is very transparent and has gone beyond to have transparency for its residents. ADJOURNMENT Mr. Schramm MOVED TO ADJOURN. Ms. Matacic seconded. 51 Liberty Township Meeting Center Rental Policies and Regulations The Liberty Township Meeting Center (the Meeting Center ) is located at 6400 Princeton Road, Liberty Township, Ohio The Meeting Center may be reserved seven days per week from 8:00 a.m. until 10:00 p.m. Reservations must be made through the Reserve a Shelter/Facility button at The Liberty Township Board of Trustees ( Liberty Township ) reserves the right to grant or refuse rental of the Meeting Center to anyone, or to terminate a rental at its sole discretion. Liberty Township has first priority in scheduling the Meeting Center for Township meetings and activities. Liberty Township reserves the right to amend rules and fees at any time without advance notice to the public. Rental Fees and Security Deposit Liberty Township residents: o $50 non-refundable security deposit and $0 rental fee Non-residents: o $50 non-refundable security deposit and $100 rental fee Government Entities & Non-Profit Organizations: o $50 non-refundable security deposit and $0 rental fee Reservations: Reservations may be made up to one year in advance. For those organizations that utilize the facility on a regular basis (one (1) time per month and at least six (6) months out of the year), a $100 non-refundable annual use / maintenance fee will be collected at the time the first reservation of the year is requested. This fee will serve as the security deposit for all meetings of that organization for the year. Security Deposit and Damage Policy A non-refundable security deposit is required for ALL reservations. The security deposit will be collected through PayPal at the time the online Rental Application / Agreement is submitted to secure the reservation. The Renter shall be responsible for the facility being clean and in an orderly state after scheduled use. Should the facilities be left in such a condition to require additional cleanup or maintenance, the security deposit will be used and any additional expenses will be invoiced to the Renter. If damage to the Meeting Center occurs or the key is not returned, the cost of the repairs or to replace the lock will be deducted from the security deposit. If any damages, additional cleaning or repair costs exceed the amount of the security deposit, the Renter will be billed and responsible for payment of the balance. Any violation of the rules and regulations set forth in this Rental Agreement may result in the forfeiture of future renting privileges, as determined by the Township Administrator or its designee. Cancellation Policy If cancellation is necessary, Renter must cancel at least fourteen (14) days in advance. Any changes in rental dates and times must be submitted in writing. Rental and Usage Rules and Regulations All functions conducted in the Meeting Center must be in accordance with Township standards and, therefore, not be in violation of any Township regulations or resolutions. All renters are expected to abide by the rules and regulations set forth in this Rental Agreement and to assume responsibility for the appearance and condition of the Meeting Center. Renters must adhere to all occupancy regulations.

52 The Renter may only access the Meeting Center during their designated rental period and must be present at the Meeting Center for the duration of the rental period. The Meeting Center is not rented to minors. If minors are present during the rental period, the Renter shall provide a minimum of one chaperone over the age of 18 be present during all rental period hours. It is agreed that it is the responsibility of the Renter to ensure all chaperones are qualified and properly screened. Businesses may use the facility for training or business related purposes, but may not use the facility for business parties or the sale of any goods or services. (e.g. Mary Kay, Thirty-One, Origami Owl, etcetera). The storage area on the north of the building and the Administration office are non-public areas and are reserved for Township use only. The Renter shall ensure that no one enters these areas. No food and/or beverages are permitted to be brought into the Meeting Center. No alcoholic beverages are to be brought into or consumed at the Meeting Center. No smoking is permitted at the Meeting Center or within 50 feet of any entrance or exit door. No animals or pets are permitted in the Meeting Center, with the exception of service animals for individuals with disabilities. Owners will be fully responsible for his/her service animal. The Renter must leave the Meeting Center clean and in an orderly state after scheduled use. Any area not left in proper order and repair, in as good or better condition as it was found, will be cleaned and repaired by Liberty Township. The Renter agrees to be invoiced and shall be liable for any and all expenses in excess of the security deposit. The Renter is responsible for removing all waste and any personal items from the Meeting Center at the conclusion of the rental period. A dumpster / refuse container is available in the parking area. The Renter may not attach any decorations or fixtures, change, alter, or make additions to the walls, doors, windows, floors, or ceilings of the Meeting Center. The Renter is responsible for ensuring that all doors are closed and locked, all windows are closed and locked, and all lights are turned off at the conclusion of the rental period. Liberty Township makes no warranties as to the fitness of the Meeting Center for a particular purpose. Liberty Township staff will have access to any rented space in the Meeting Center during the rental period and may observe the Renter s use of the Meeting Center at any time without notice. All efforts will be made to be the least disruptive to the Renter and its use of the Meeting Center. All items currently in the Meeting Center are on inventory and must be accounted for when the Renter leaves. If any items are missing, they will be replaced, and the Renter will be responsible for payment for such replacement. The Renter agrees to be fully responsible for all damages, expenses, and losses, including theft and property loss, caused by any person connected with such person s use of the Meeting Center. Any such costs will be assessed and charged to the Renter. Liberty Township is not responsible for loss or damage to personal property. No weapons or firearms are allowed on the Meeting Center premises.

53 It is the responsibility of the Renter to pick up the key prior to the rental period. The key must be returned to the offices no later than 4:30 p.m. on the business day immediately following the rental period. The Renter agrees to indemnify and hold harmless Liberty Township, and its officers, employees, volunteers, agents, affiliates, successors, and permitted assigns (the Indemnified Parties ) from and against any and all liability, claims, demands, and expenses, including court costs, and attorney fees, on account of any injury, loss, or damage of whatever kind, incurred by the Indemnified Parties, which arise out of or are in any manner connected with the use of the Meeting Center under this Rental Agreement. The Renter further waives and releases the Township, and its officers and its employees, from any and all liability, claims, demands, and expenses, including court costs and attorney fees, on account of any injury, loss, or damage, which the Renter may suffer and which arise out of or are in any manner connected with the use of the Meeting Center under this Rental Agreement. The Renter, as an individual, and / or agent for the group or organization designated, does hereby agree to comply with all the rules and regulations provided herein governing the use of the Liberty Township Meeting Center. It is further agreed, that the Renter assumes full responsibility for the payment of the rental fee and security deposit and any costs of damages done to the Meeting Center.
