1 October 9, 2014 The Township Committee met on the above date with Mayor Jeremy Liedtka calling the meeting to order at 7:00 pm. The meeting opened with the flag salute and a moment of silence. Roll call was taken showing present: Mayor Jeremy Liedtka, and Committeeman Alexander Robotin. Also present John Gillespie, Township Attorney; Joseph Hirsh, Township Engineer and Chief of Police Kyle Wilson. The Open Public Meetings Act statement was read and compliance noted. Mayor Liedtka asked if there are any agenda matters requiring recusal. There are none. Mayor Liedtka asked if there were any comments from the public, matters appearing on the agenda only. There were none. Consent Agenda Mr. Robotin made a motion seconded by Mr. Liedtka to approve the September 25, 2014 minutes. All were in favor. Comcast Public Hearing There was a Public Hearing and a Comcast Executive was present and spoke to the Committee. There were no comments/questions from the public or Committee. Mr. Gillespie will work on the ordinance for renewing the franchise agreement. Engineer Report Recreation Building on Fenton Lane is underway. Roof is on and concrete work is out to bid, due on October 21 st. They had two open houses for demo of old school. Mr. Hirsh said he has about a dozen bidders. Playground in Cross Creek 1, ground is ready for delivery. He is submitting for DOT grant for Hogback Road Harker Road with Harker Road being the primary. Pump Station #2 has a lot of scum and it messes with the levels. Mr. Hirsh got an estimate of $5,000 to clean it. Mr. Hirsh is working on RFP for old school/architect. Mayor Liedtka asked Mr. Hirsh to stake out the playground at Fenton Lane Park this week.

2 Public Safety Report Chief Wilson stated that there were a total of 318 (31 property checks) calls for the month of September:19 Alarms, 8 Arrests, 2 CDS, 1 B&E to residence, 19 EMS, 3 Disputes/Domestics, 2 Thefts, 1 B&E to Vehicle, 9 Motor Vehicle Crashes, 1 Domestic Simple Assaults, 1 Hindering, 2 Criminal Mischief Classes: Ptl. Brodowski & Ptl. Semus attended the following classes, Criminal Patrol Drug Interdiction; Ptl. Brodowski attended the Child Safety Seat Inspection Class, Sgt. Stefani attended Alcotest Recert Class; Chief & Sgt. Davison attended IA Seminar; Ptl. Parent attended TAC Class and Sgt. Davison attended an Amber Alert Class. All attended an in house training- range. Ordinance for Public Hearing Mr. Robotin made a motion seconded by Mayor Liedtka to open the public hearing on Ordinance All were in favor. Hearing no public comment the public hearing was closed on a motion by Mayor Liedtka and second by Mr. Robotin. All were in favor. ORDINANCE AN ORDINANCE OF THE TOWNSHIP OF CHESTERFIELD CREATING CHAPTER 78 OF THE CODE OF THE TOWNHSIP OF CHESTERFIELD ENTITLED BINGO AND RAFFLE LICENSES WHEREAS, the Township Committee of the Township of Chesterfield deems it in the best interests of its residents and the public at large to create an ordinance addressing the issuance of bingo and raffle licenses. NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Township Committee of the Township of Chesterfield, County of Burlington, State of New Jersey that the following Chapter 78 entitled Bingo and Raffles is hereby created as follows: Purpose; administration. This chapter is for the purpose of regulating all games of chance held, operated or conducted within the Township, pursuant to Acts of the Legislature of the State of new Jersey known as the Bingo Licensing Law, N.J.S.A. 5:8-24 et seq., and the Raffles Licensing Law, N.J.S.A. 5:8-50 et seq., and in accordance with the rules and regulations issued or to be promulgated by the Legalized Games of Chance Control Commission in the Department of Law and Public Safety of the State of new jersey. All applications, licenses and proceedings in connection therewith shall be subject to the provisions of such Acts and the rules and regulations and nay laws, rules and regulations hereafter enacted and shall be further subject to the provisions of this chapter.

3 78-2. Issuing authority The issuing authority, as the same is defined in N.J.S.A. 5:8-24 et seq. and N.J.S.A. 5:8-50 et seq., responsibility for approving bingo and raffle licenses shall be the Municipal Clerk Conduct of games of chance on Sunday. Licensees authorized by law to conduct any games of chance, including raffles and bingo, shall be permitted to conduct the same on any day of the week, including Sundays, as provided by N.J.S.A. 5:8-31 and N.J.S.A. 5: Application requirements. The issuing authority shall approve or deny all applications for bingo or raffle licenses with due expedition after the filing of the application. Applications must be filed with the Municipal Clerk, together with required fees, pursuant to law. The applicant shall demonstrate, in writing, compliance with the provisions of all applicable laws and regulations Eligibility for license. No license to conduct a game of chance as authorized by law shall be issued to any organization not having a bona fide situs established in good faith within the State of New jersey and actively engaged in serving one or more of the authorized purposes as defined by the rules and regulations of the Legalized Games of Chance Control Commission Suspension or revocation of license. The governing body, pursuant to N.J.S.A. 5:8-30 and N.J.S.A. 5:8-57, may suspend and revoke any issued bingo or raffle license, after a hearing, for any violation of this chapter or state law. The governing body may suspend the operation of a bingo or raffle pending hearing, in which case a hearing must be held within five days after such action. Notice of a hearing shall be served personally upon an officer of the licensee or the member in charge of the conduct of the bingo or raffle or sent by registered mail or certified mail to the licensee at the address shown on the license. All decisions and findings by the governing body regarding the suspension or revocation or a bingo or raffle license shall be in writing Fees. License fees for bingo and raffles shall be in accordance with the provisions of N.J.A. C. 13: Violations and penalties. Any person who violates any of the provisions of this chapter, upon conviction, shall be subject to a fine not exceeding $500 for each violation. 4 TOWNSHIP OF CHESTERFIELD RESOLUTION REQUESTING APPROVAL OF ITEMS OF REVENUE AND APPROPRIATION UNDER NJSA 40A:4-87 FOR DRUNK DRIVING ENFORCEMENT FUND IN THE AMOUNT OF $ 1, IN THE 2014 MUNICIPAL BUDGET WHEREAS, N.J.S.A. 40A: 4-87 (Chapter 159, P.L. 1948) provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget,; and WHEREAS, the said Director may also approve the insertion of an item of appropriation for equal amount; and NOW, THEREFORE, BE IT RESOLVED that the Mayor and Township Committee of the Township of Chesterfield hereby request the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2014 in the sum of $1,937.95, which is now available as revenue from: Miscellaneous Revenues Special Items of General Revenue Anticipated with Prior Written Consent of Director of Local Government Services- Public and Private Revenues Offset with Appropriations: Drunk Driving Enforcement Fund $ 1, BE IT FURTHER RESOLVED that a like sum of $1,937.95; be and the same is hereby appropriated under the caption of: General Appropriations Operations Excluded from Caps Public and Private Programs Offset by Revenues: Drunk Driving Enforcement Fund $ 1, CHESTERFIELD TOWNSHIP COMMITTEE ~~~~~~~~~~ ~~~~~~~~~~ ~~~~~~~~~~

6 AT FENTON LANE PARK WHEREAS, The Township of Chesterfield awarded a contract to RNM Construction, LLC in the amount of $194, for the construction of a recreation building at Fenton Lane Park; and WHEREAS, the Township of Chesterfield intends to initiate a recreation department in 2015 and whereas Chesterfield Township Athletic Association (CTAA) intends to dissolve; thereby creating the need for appropriate facilities for recreation activities; and WHEREAS, the Township has received grant funding and a contribution from the current CTAA to facilitate construction of the awarded 60'x100' structure; and whereas the Township is desirous of a structure capable of supporting a youth basketball program; WHEREAS, the Contractor has provided a change order cost of $33, in order to revised the scope of the project to facilitate construction of a 60'x100' structure in lieu of the 60'x100' structure and related improvements; and WHEREAS, the Township Engineer has reviewed and recommends approval of Change Order Number 1. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Chesterfield that the Township Committee of Chesterfield Township hereby approves Change Order #1 and consequently amends the contract with RNM Construction, LLC to a revised contract amount of $227, CHESTERFIELD TOWNSHIP COMMITTEE ~~~~~~~~~~ ~~~~~~~~~~ ~~~~~~~~~~ RESOLUTION A Resolution providing for guidelines for the annual maintenance of street trees in Chesterfield Township as required by the Complete Streets portion of the Sustainable New Jersey Program under NJDEP.

7 Whereas : The Township of Chesterfield is an active participant in the Sustainable New Program Whereas : All participants in the Sustainable New Jersey Program are required to adopt certain annual practices for the maintenance of municipal street trees Whereas : The Chesterfield Township Environmental Commission has proposed certain standards for the municipality to follow with regard to street tree maintenance. Whereas : The Chesterfield Township Environmental Commission is recommending the performance guidelines as noted below be adopted by the Township Committee. For all street rights of way that are under the jurisdiction of Chesterfield Township TREES All street trees that have had the maintenance responsibility transferred to the Township shall be periodically maintained as follows: In the spring and fall of each year, all street trees shall be inspected by the Environmental Commission to determine the following : Overall health and vigor Improper branching habit Weak or damaged trunks Adequacy of mulch Removal of tree staking and guy wires Presence of insect or disease related damage Removal of tree as last resort replacement within one growing season The Environmental Commission will make recommendations to the Township Committee to remedy any issues. TREE RELATED ITEMS American street tree All mulching shall be performed by the Township following AAN ( Nurseryman Standards) using 3 of shredded hardwood bark mulch. Street tree replacements shall be species chosen from an approved list of varieties in a size and type of root ball required per Township Ordinance.

Committee was given a copy of the Best Practice Survey and notified that we met all standards and received 100% for State Aide. Recreation Committee Mayor Liedtka said we are planning to merge with the CTAA in the new year. We will set up a meeting with them to discuss. Replacement of Fountains Mayor Liedtka told Mr. Hirsh that we will give him the names of (2) local Plumbers so that we can have the fountains fixed instead of replaced. Comments from the Public and Committee: Amy Coover Bordentown-Georgetown Road asked how much State Aid we are currently getting. Ms. Hoyer said it is on our website. Ron Kolczynski - 15 Greenview Drive asked if the $900,000 demotion have to go to vote? Mr. Gillespie said it does not. Mrs. Herdt - Shanahan Lane asked the Committee if Shanahan Lane is scheduled to be re-paved. She said it is in very bad shape mostly to do with the Turnpike work.

12 Mayor Liedtka said that we will try to re-pave that road next year. Mrs. Herdt said that there is a very bad drainage problem on Shanahan as well. Mayor Liedtka asked Mr. Hirsh to go out and take a look at the problem. The meeting was adjourned at 8:30 pm on a motion by Mayor Liedtka and second by Mr. Robotin. All were in favor.
