1 BY-LAWS Of the FIREFIGHTER S MUTUAL BENEVOLENT ASSOCIATION Of JACKSON, NEW JERSEY LOCAL NO. 86 INC. ARTICLE I - NAME This Association shall be known as the Firefighter s Mutual Benevolent Association Jackson Twp. N.J. Local 86 ARTICLE II Section 1. The purpose for which this Association shall be formed is to provide greater awareness and education to the general public in connection with the area of emergency including, but not limited to, encouraging greater public understanding of fire safety and fit instruct the youth of the community- in fire safety and prevention; and to sponsor programs which encourage involvement in fire prevention Section 2.To unite fraternally and to give all moral support in its power to the members composing it. ARTICLE III MEMBERSHIP Section I- Full time sworn members of Jackson Fire District No.3 of the Township of Jackson, New Jersey,, shall be eligible for membership in this Association as stated in Article III, Section 2. Section 2. Application for membership shall be presented in writing at a regular meeting, stating the applicant's name, age and residence. The application shall be referred to an investigating committee who shall make diligent inquire into the character of the applicant and report at the first regular meeting, using the word favorable, as the case may be, when lie shall be balloted for, majority of votes cast will decide whether he be accepted. If rejected, it will not be proposed again within two months next succeeding. Section 3 The local union dues are $20.00 per pay period for members who have not reached top step salary. Members reaching top step salary shall pay $25.00 per pay period. Members shall pay dues by automatic payroll deductions, set up through the Local Treasurer. Section 4. All applicants for membership, upon being elected a member of this Association, shall be supplied with a copy of the Local and State Association By-Laws, roster and committees list. Section 5. A new applicant shall join the Association within 30-days of employment. Previous employed members shall join the Association with 10 days of employment. New members may attend the regular meetings upon their appointment, but will have no vote in any matter until requirements of Section 3 are fulfilled. Section 6 Local union members shall not serve or respond as volunteer firefighters in a jurisdiction where career firefighters are employed. Section 7. Any change in the amount of dues shall be by a majority of the membership after a motion is made and seconded.
2 ARTICLE IV - UNION RIGHTS AND THE EMPLOYER SECTION 1. The Employer hereby recognizes the New Jersey State FMBA Local 86 as the sole and exclusive representative of the full-time employees for the purpose of collective bargaining. These activities shall include the presentation of grievances and proposals relating to the violations of this Agreement, and with the reference to all terms and conditions of employment. SECTION 2. Any Employee or member of the Union, acting in any official capacity whatsoever, shall not be discriminated against for their acts as such officials of the Union. There shall not be any discrimination against any Employee because of Union membership or activities. SECTION 3. The President, Vice President or designee shall be excused from his/her work assignment and shall be granted time off to attend any Union business that requires Union representation. It shall be agreed that the President, Vice President or designee, shall not deduct time while on duty to attend any hearings, interrogations or interviews that require Union representation, or when the Board or its representatives request a meeting with the Union. SECTION 4. The Board agrees to grant necessary time off without loss of pay or compensatory time a maximum of one union representative to attend any state or national convention N.J.S.A.11A:6-10 and a maximum of one representative to attend regularly monthly state union meetings. Non-Union fire service related information attained at a meeting or convention shall be submitted in writing to the Deputy Chief. ARTICLE V- AGENCY SHOP SECTION 1 Upon receiving the written voluntary authorization and assignment of an employee covered by this Agreement the Employer agrees to deduct membership dues (and initiation fees where applicable), in such amounts as shall be fixed pursuant to the By-Laws and Constitution of the FMBA during the full term of this Agreement and any extension or renewal thereof. The Employer shall promptly remit each pay period any and all amounts so deducted with a list of such deductions to the Secretary-Treasurer of the FMBA. SECTION 2 If, during the life of this Agreement, there shall be any change in the rate of membership dues, the FMBA shall furnish to the Employer written notice thirty (30) days prior to the effective date of such change. SECTION 3 The FMBA will provide the necessary "check-off authorization" form to its new members and the FMBA will secure the signatures of its members on the forms and deliver the signed forms to the Employer The Employer will notify the Secretary-Treasurer of the FMBA of the hiring of all employees, their addresses, birth date, classification, rate of pay and social security number; and of all removals of employees from the Employer's payroll. SECTION 4 Any employee in the bargaining unit on the effective date of this Agreement who within thirty (30) days of initial employment within the unit, and any employee previously employed within the unit who does not join within ten (10) days of reentry into employment within the unit shall pay a representation fee to the Union by automatic payroll deduction. The representation fee shall be in an amount up to eighty-five (85%) percent of the regular FMBA membership dues, fees and assessments as certified to the Employer by the FMBA. The FMBA may revise its certification of the amount of the representation fee at any time to reflect changes in the FMBA membership dues, fees and assessments. The FMBA's entitlement to the representation fee shall continue beyond the termination date of this Agreement so long as the FMBA remains the majority representative of the employees in the unit, provided that no modification is made in this provision by a successor agreement by the FMBA and the Employer. SECTION 5 The FMBA hereby certifies that it has established a demand and return system which provides pro rata returns and which otherwise meets the requirements of N.J.S.A. 34:13a-5.5 et seq.
3 ARTICLE VI - MEETINGS Section 1. Regular meetings will take place monthly the 1 st Monday after the State meeting except when the date conflicts with holidays or other activities with sufficient notice of meetings beforehand. Meetings dates will be posted by the secretary as well as notifying the members in writing 2 weeks prior to the meeting. Elections of Officers shall take place at the December meeting. Additional meetings shall be posted. Section 2. Special meetings may be called by a majority of members in good standing, stating their object to the President. He/she shall notify the Secretary to call meetings subject to the order of the President. Section 3. All members are entitled to attend and take an active part in all meetings, and are earnestly urged to do so. ARTICLE VII- PARLIAMENTARY LAW "Roberts Rules of Order" shall be the guide in debates, when it does not conflict with any law or rule of this Association. ARTICLE VIII ELECTION OF OFFICERS Section 1. The elective officers governing this Association shall consist of a President, Vice President, Secretary, Treasurer, Executive Delegate, and Trustees, who shall, with the exception of the Trustees, serve for the term of two years. The term of office to commence on January 1st of each election year. The Trustees will serve for one, two and three and four years, respectfully, electing one each year, to serve a term of three years. Section 2. All officers of this Association shall be from the members of the Department and shall be elected by a motion and seconded and approved by the majority of membership in good standing. Written ballots can be used if the majority of membership approves. Section 3. Any officer may be removed for incompetence or inattention to his duties by a two-thirds vote of all members present, and in case of any vacancies occurring from any cause, they shall be filled in the original manner, to serve for the remainder of the term.
4 ARTICLE IX - DUTIES OF OFFICERS Section 1. Duties of President. It shall be the duty of the President to preside at all meetings, and enforce all the laws, rules and usages of the Association; decide all points of order; act as judge and declare the results of all elections; appoint all committees, unless otherwise ordered; sign all checks for money ordered paid by the Association; declare in open meeting the name of the members more than three months in arrears; call a meeting when necessary. He shall not be entitled to vote except when the members are equally divided upon any question; see that all officers properly perform such other duties of their positions and perform such other duties as the laws and rules of the Association may direct. He is also an official member of all committees and will serve as Alternate Executive Delegate. Section 2. Duties of the Vice President. The Vice-President shall assist the President in the performance of his/her duties. He/she shall also perform such duties as may be required of them by the Local. The Vice-President shall assume the duties of the President in event of death, disability, or other inability of the President to serve. Section 3. Duties of the Secretary. It shall be the duty of the Secretary to keep a roll of membership; an accurate record of the proceedings of all meetings; read all communications, reports, bills, etc.; conduct all correspondence and such other duties as the Association may direct. He shall be custodian of the By-Laws. Section 4. Duties of the Treasurer. It shall be the duty of the Treasurer to receive all monies paid into the Association, and to give receipt for same upon request, and to at once deposit same in bank designated; to notify all members who are in arrears for two months or more; to prepare and procure the necessary signatures to all checks. He shall make a monthly report with the following items: monies received, monies paid out, balance on hand. When term of office expires shall turn over all monies, vouchers, etc., to his successor in office. His books shall be open for inspection by the Board of Trustees at any time. He shall also perform such other duties as the Association may direct. Section 5. Duties of Trustees. 1. It shall be the duty of the members of the Board of Trustees to keep a general supervision over the financial affairs of the Association; to present a preliminary budget at the January meeting; to audit all bills or claims that may be presented; to designate a good bank in which to deposit the funds of the Association; and to perform such other duties as the Association may direct. The Board of Trustees shall have the power to veto all expenditures of $50 or more. A two-thirds majority vote of the Association shall be required to override such veto. 2. It shall be the duty of the Board of Trustees to have the office of President, Treasurer and Secretary bonded for suitable amounts each year. 3. It shall be the duty of the Board of Trustees to keep an up-to-date copy of the Association's Constitution and By-Laws. 4. The Chairman of the Board of Trustees may invite any person he deems appropriate or necessary to attend the meetings of the Board of Trustees to help conduct the business thereof.
5 Section 6. Duties of Execute Delegate. It shall be the duty of the Executive Delegate to represent this Association at all State meetings called by the State President; to attend all legislative business sessions to the good and welfare of this Association and its members at large; and to report orally on said State meetings to the Association. He shall perform such other duties as the Association may direct. Section 7. Duties of the Alternate Executive Delegate. It shall be the duty of Alternate Executive Delegate to perform all duties of the Executive Delegate in absence. ARTICLE X - ASSOCIATION BUSINESS All members are in honor bound to keep to themselves anything that may transpire in regard to any business that may come up before the Association and try to induce by all honorable means all members of the Fire Department to join the Association who may not already have done so. ARTICLE XI - DUES ARREARAGE Any member who may become in arrears for more than 3 months shall be dropped from the rolls and his membership shall cease. Should he at anytime wish to regain his membership, he must make application, pay all back dues and assessments, and be voted on at a regular meeting to be accepted back into the Association. His seniority as a member of the Association shall start with the time of said member being accepted back into the Association. ARTICLE XII - MEMBERSHIP SUSPENSION Section 1. All members of the Association who violate any of its obligations other than being in arrears, or make known any of the arrears to others than those entitled to know, shall be expelled and shall not be reinstated. Section 2. Any member who may become two months in arrears for dues shall be notified by the Treasurer of same. Any member in arrears for three months shall be suspended from benefits and shall not be entitled to vote. ARTICLE XIII - MONIES OF THE ASSOCIATION Section 1. All monies received by the Association from the "general public" and from the membership in the form of dues or other contributions shall go into the general fund of the association to be used for the general purpose for which the association was formed. ARTICLE XIV - DISSOLUTION Section 1. Upon dissolution of the Association, assets remaining on hand shall be distributed as follows: (1) In satisfaction of any and all debts and obligations owing of the Association; and (2) The remainder, if any, to make contributions to charitable organizations for their general purposes. Section 2. The Board of Trustees shall vote upon dissolution as to which charitable organizations shall receive the funds. In the event no vote is conducted, the assets shall be distributed to the St. Barnabas Burn Foundation, or its successor organization. ARTICLE XV - QUORUM Members who are in good standing shall constitute a quorum for the transaction of general business.
6 The Order of Business shall be: I. Calling of meeting to order. 2. Pledge of Allegiance to the Flag. 3. Calling the roll. 4. Reading of the Minutes. 5. Reading Communications, Bills, etc. 6. Reports of Officers. 7. Reports of Trustees. 8. Reports of Committees. 9. Report of Delegate. 10. Unfinished Business. 11. New Business. 12. Adjournment. ARTICLE XVI - ORDER OF BUSINESS ARTICLE XVII - AMENDMENT TO BY-LAWS Section 1. Whenever an amendment to these By-Laws is proposed, one month's notice shall be given before putting the question to a vote, when a majority vote of the members present is necessary for its passage. ARTICLE XVIII -BALLOT VOTING Section 1. Ballot boxes will be made available to each Station, two (2) weeks prior to the meeting at which the vote will be counted. Each member is to be issued an individual ballot, at which time he will sign a roster for receipt of same. The ballot boxes are to be collected by a courier or couriers designated by the President. A majority of the vote will then be binding on all members of the Association. ARTICLE XX EXPENDITURES and REIMBURSEMENTS Section 1 The President shall approve any expenditures and reimbursements that are related to Union Business. Section 2. Upon approval of the President any supplies needed to perform the duties of a position or committee will be reimbursed. Section 3. The President and/or designee shall receive $20.00 per Board Meeting attendance. Section 4. The Executive Delegate and/or designee shall receive $20.00 per State Union meeting and Convention attendance.
7 Section 1 ARTICLE XXI GOOD AND WELFARE The Good and Welfare Committee shall comfort members and their families when there is an illness, injury or bereavement; congratulate members who retire, get married or add to their family; and promote the good of the Local Union. Section2 The Good & Welfare chairperson shall coordinate sending the suggested gifts or donation and maintain the Good & Welfare account. The Chairperson shall act immediately to a good and welfare request and make reasonable expenditures of the suggested gift or donation outlined in section 3. The Chairperson shall maintain a good and welfare checking account with a maximum balance of $ and minimum of $ Transfer request shall be made at the monthly meeting to maintain the minimum balance. A monthly report shall be recorded in the monthly meeting minutes. Section3 Suggested gifts: Illness/Injury- flowers, fruit basket, or dish garden to be sent if the sick person is a member of the local. Maternity-flowers, fruit basket, or dish garden to be sent if the parent is a member of the local. Bereavement - A sympathy card in addition to flowers or a donation to a specific charity in memory of the deceased member's spouse, child, brother, grandchildren, sister, aunt, uncle or members parents.
