1 STAFF REPORT ACTION REQUIRED Business Improvement Area (BIA) Board of Management Deletion and Nominees Date: Tuesday March 29, 2011 To: From: Etobicoke York Community Council Director, Business Services, Economic Development and Culture Wards: 5 and 7 Reference Number: SUMMARY The purpose of this report is to recommend Etobicoke York Community Council appoint members to the Emery Village Business Improvement Area (BIA) Board of Management for the new term of City Council, and approve a deletion to The Kingsway Business Improvement Area (BIA) Board of Management. The Etobicoke York Community Council has delegated authority to make final decisions regarding Business Improvement Area (BIA) appointments. RECOMMENDATIONS The Director, Business Services, Economic Development and Culture, recommends that Etobicoke York Community Council: 1. Appoint the nominees listed in Attachment No. 1 to the report dated March 29, 2011 from the Director, Business Services, Economic Development and Culture, to the Board of Management for the Emery Village Business Improvement Area (BIA) for a term expiring at the end of the term of City Council, or as soon thereafter as successors are appointed. 2. Approve the deletion to The Kingsway Business Area (BIA) Board of Management as set out in Attachment No. 2 to the report dated March 29, 2011 from the Director, Business Services, Economic Development and Culture. 3. Confirm that under City Council's Public Appointments Policy, these Board members are appointed at the pleasure of Community Council, and Community Council retains the right to replace any appointed member at any time and for any reason. Direct that Schedule A of the Municipal Code Chapter 19, Business Improvement Areas, be amended to reflect the changes in the number of members and the number of members required for quorum of each of the Business Improvement Area (BIA) Boards of Management. Financial Impact There are no financial implications resulting from the adoption of this report. DECISION HISTORY Municipal Code Chapter 19 establishes that the term of Business Improvement Area (BIA) Boards of Management appointments expires with the term of City Council. In an election year, BIAs are required to elect nominees for appointment to the next Board of Management at an Annual General Meeting (AGM). Etobicoke York Community Council has the authority to appoint these nominees. To date all sixteen BIAs within the Etobicoke York Community Council area have held Annual General Meetings (AGMs) and elected Boards of Management for the City Council term. Thirteen BIAs were included in the report to January 18, 2011, one BIA was included in the February 16, 2011 and one in the March 22, 2011 report to the Etobicoke York Community Council: and This report recommends the appointment of those persons set out in Attachment No. 1 to the Board of Management for the Emery Village BIA. From time to time, it is also necessary to replace those who are no longer able to serve on the Board. Attachment No. 2 lists the name of an individual to be deleted from The Kingsway BIA Board of Management. Amendments are required to Schedule A of Municipal Code Chapter 19, which prescribes the number of members of each BIA Board of Management and number of members required for quorum. ISSUE BACKGROUND There are sixteen BIAs within the Etobicoke York Community Council boundaries, and all have held their 2010 Annual General Meetings (AGM) to elect members to their Boards of Management. City Council members are appointed to BIA Boards by the Striking Committee. BIA Board Deletion and Nominations 2

3 COMMENTS The resignation of one member from The Kingsway BIA Board of Management will require a change to the number of Board members from 10 to 9 (including one Councillor). Quorum will be unchanged. It is recommended that the Etobicoke York Community Council appoint the nominees listed in Attachment No. 1 to the Emery Village BIA Board of Management, approve the deletion to The Kingsway BIA Board listed in Attachment No. 2, and approve the appropriate amendments to Schedule A of the Municipal Code Chapter 19 concerning the number of members of each Board of Management and quorum.
