1 Cape May Court House, NJ June 5, 2017 REGULAR MEETING FLAG SALUTE THIS MEETING IS BEING RECORDED: I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law). The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building. Members present were Mayor Clark, Deputy Mayor DeVico, Committeemember Donohue, Business Administrator Elizabeth Terenik, Township Clerk Kimberly Krauss and Municipal Solicitor Frank Corrado. Township Engineer Marc DeBlasio was absent. 1. PRESENTATION BY MAYOR AND COMMITTEE MIDDLE MATTERS AWARD JOHN MAHER - Provided background on what Mr. Maher has done for the Township youth soccer program. - Nominated by Committeemember Donohue. - Thanked Mr. Maher for what he has done for the Township. Committeemember Donohue: - Proud to nominate Mr. Maher for award. - Great man and great member of the community. - Provided brief background of Mr. Maher s public service background. Committeemember DeVico: - Spoke to his own children s experiences playing under Mr. Maher. - Instilled character into those he coached. - Thanked Mr. Maher. 3. ORDINANCE NO BOND ORDINANCE AMENDING AND SUPPLEMENTING BOND ORDINANCE NUMBER (WHICH PROVIDES FOR IMPROVEMENTS TO THE SEWER UTILITY) HERETOFORE FINALLY ADOPTED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MIDDLE, IN THE COUNTY OF CAPE MAY, STATE OF NEW JERSEY, ON AUGUST 20, 2012, TO INCREASE THE APPROPRIATION BY $2,095,000 (INCLUDING A GRANT FROM THE UNITED STATES DEPARTMENT OF AGRICULTURE EXPECTED TO BE RECEIVED BY THE TOWNSHIP IN THE AMOUNT OF $649,000) AND TO INCREASE THE AUTHORIZATION OF BONDS OR NOTES BY $2,095,000 Following second reading, hearing, and consideration for adoption, Ordinance was adopted on motion by Committeeman Donohue seconded by Committeeman DeVico and passed on roll call. Complete Ordinance is on file in the Clerk s Office. BE IT ORDAINED AND ENACTED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MIDDLE, IN THE COUNTY OF CAPE MAY, STATE OF NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring), AS FOLLOWS: SECTION 1. The bond ordinance of the Township of Middle, in the County of Cape May, State of New Jersey (the "Township"), heretofore finally adopted by the Township Committee thereof on August 20, 2012, numbered and entitled, BOND ORDINANCE PROVIDING FOR IMPROVEMENTS TO THE SEWER UTILITY IN AND BY THE TOWNSHIP OF MIDDLE, IN THE COUNTY OF CAPE MAY, NEW JERSEY, APPROPRIATING $1,705,150 THEREFOR AND AUTHORIZING THE ISSUANCE OF $1,705,150 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING THE COST THEREOF (the "Original Ordinance"), which Original Ordinance is hereby amended and supplemented, as follows: SECTION 2. For the improvement or purpose set forth in Section 3(a) of the Original Ordinance, as amended and supplemented hereby, there is hereby appropriated the additional sum of $2,095,000 (which is inclusive of a grant from the United States Department of Agriculture expected to be received in the amount of $649,000) (the Grant ). The total appropriation of the Original Ordinance, as amended and supplemented hereby, is equal to $3,800,150. SECTION 3. (a) In order to finance the cost of the improvement or purpose set forth in Section 3 of the Original Ordinance, as amended and supplemented hereby, and until the Grant has been received, additional negotiable bonds or notes of the Township in the amount of $2,095,000 are hereby authorized to be issued by the Township in accordance with the Local Bond Law, N.J.S.A. 40A:2-1 et seq., as amended and supplemented (the Local Bond Law ), such that the total authorization of negotiable bonds or notes to be issued by the Township for the improvement or purpose set forth in Section 3 of the Original Ordinance, as amended and supplemented hereby, is equal to $3,800,150. (b) Until the Grant is received, the estimated maximum amount of bonds or notes to be issued for the improvement or purpose set forth in Section 3 the Original Ordinance, as amended and supplemented hereby, is equal to $3,800,150. (c) The estimated cost of the improvement or purpose set forth in Section 3 of the Original Ordinance, as amended and supplemented hereby, is equal to $3,800,150. SECTION 4. The Capital Budget of the Township is hereby amended, as necessary, to conform with the provisions of this amendatory and supplemental bond ordinance and to the extent of any inconsistency herewith, a resolution in the form promulgated by the Local Finance Board showing full detail of the amended Capital Budget and Capital Program as approved by the Director of the Division of Local Government Services, New Jersey Department of Community Affairs (the Director of the Division of Local Government Services ), will be on file in the office of the Clerk and will be available for public inspection. SECTION 5. The Supplemental Debt Statement required by the Local Bond Law has been duly made and filed in the Office of the Clerk of the Township and a complete executed duplicate thereof has been filed in the Office of the Director of the Division of Local Government Services, and such statement shows that the gross debt of the Township as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided for in this amendatory and supplemental bond ordinance by $2,095,000 and the said obligations authorized herein will be within all debt limitations prescribed by law. SECTION 6. For the improvements or purposes set forth in the Original Ordinance, as amended and supplemented hereby, the additional sum of $419,000 is hereby included for the items of expense listed in and permitted under N.J.S.A. 40A:2-20, making the total amount for such items of expense $819,000, such total amount being included in the estimated cost indicated herein for the improvements or purposes set forth in the Original Ordinance, as amended and supplemented hereby.

3 SECTION 7. The full faith and credit of the Township are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by the Original Ordinance, as amended and supplemented hereby. The obligations shall be direct, unlimited obligations of the Township, and the Township shall be obligated to levy ad valorem taxes upon all the taxable property within the Township for the payment of the obligations and the interest thereon without limitation as to rate or amount. SECTION 8. The Township hereby declares the intent of the Township to issue the bonds or bond anticipation notes in the amount authorized in Section 3 of this bond ordinance and to use proceeds to pay or reimburse expenditures for the costs of the purposes described in Section 3 of the Original Ordinance, as amended and supplemented hereby. This Section 8 is a declaration of intent within the meaning and for purposes of Treasury Regulations or any successor provisions of federal income tax law. SECTION 9. The Township Chief Financial Officer is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Township and to execute such disclosure document on behalf of the Township. The Township Chief Financial Officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the Township pursuant to Rule 15c2-12 of the Securities and Exchange Commission (the Rule ) for the benefit of holders and beneficial owners of obligations of the Township and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized bond counsel, consistent with the requirements of the Rule. In the event that the Township fails to comply with its undertaking, the Township shall not be liable for any monetary damages, and the remedy shall be limited to specific performance of the undertaking. SECTION 10. The Township covenants to maintain the exclusion from gross income under section 103(a) of the Code, of the interest on all bonds and notes issued under the Original Ordinance, as amended and supplemented hereby. SECTION 11. Except as expressly amended and supplemented hereby, the Original Ordinance shall remain in full force and effect. SECTION 12. This bond ordinance shall take effect twenty (20) days after the first publication thereof after final adoption and approval by the Mayor, as provided by the Local Bond Law. 8. RESOLUTION AUTHORIZING CREATION OF LIEN ON PROPERTY On motion by Committeeman Donohue seconded by Committeeman DeVico and passed on roll call, the WHEREAS, N.J.S.A. 40: authorizes the governing body of every municipality the power to make, enforce, amend and repeal ordinances requiring the owner or tenant of a dwelling or of lands lying within the municipality to provide for the removal or destruction of brush, weeds, debris, etc. constituting fire hazard or injurious to public health or safety and to provide for the imposition of penalties for the violation of any such ordinance; and WHEREAS, N.J.S.A. 40: authorizes the municipality the right to place a lien against such dwelling or lands to provide for the cost of removing brush, weeds, debris, etc.; and WHEREAS, the Township of Middle has adopted Ordinance No known as Article I of Chapter 193 of the Code of the Township of Middle Property Maintenance; and WHEREAS, the Township of Middle has noticed the following property owners as indicated below and furthermore these violations had not been remedied; and WHEREAS, in absence of compliance by said owners, the Township of Middle commenced and completed abatement of these violations; and WHEREAS, the Code Enforcement Officer of the Township of Middle has certified the following cost as listed. the governing body thereof, that it hereby imposes a lien on the properties listed below as indicated. RESOLUTION AUTHORIZING ACH PAYMENTS On motion by Committeeman DeVico seconded by Committeeman Donohue and passed on roll call, the following resolution was adopted. WHEREAS, the Department of Community Affairs, Division of Local Government Services has promulgated regulations authorizing municipalities to accept electronic receipt payments in accordance with N.J.A.C. 5: et seq.; and WHEREAS, for a municipality to accept electronic payments, the governing body must adopt a resolution authorizing acceptance and stating the type of obligations that can be paid by electronic receipt and the types of electronic receipt that will be permitted; and WHEREAS, the Middle Township Committee wishes to authorize the payment of property taxes and fees through use of debit/credit cards and ACH debits in accordance with N.J.A.C. 5: et seq.; and WHEREAS, the Township Committee wishes to authorize the Municipal Tax Collector to accept property tax payments through debit/credit cards and ACH debits for property taxes, interest or other payments associated with the tax office as set forth above; and WHEREAS, the utilization of debit/credit cards and ACH debits for payment of taxes, interest and other payments must be in accordance with the provisions of N.J.A.C. 5: et seq.; NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, Cape May County, as follows: 1. The Township Committee authorizes the Tax Collector to accept debit/credit card payment and ACH debit payment of property taxes, interest and other costs associated with the Tax Collector s office. 2. The debit/credit card payment of delinquent property taxes, interest and other costs associated with the accelerated tax sale will be accepted until November 10 th of each year. 3. The use of debit/credit cards and ACH debits for payment are subject to the provisions of N.J.A.C. 5: et seq. 4. Contracts for acquisition of equipment and services to handle electronic payments shall be governed by the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. and by the provisions of N.J.A.C. 5: et seq. 5. The Township shall impose a fee of $20.00 against individuals who issue a payment which is subsequently dishonored by the individual s bank for insufficient funds or any other cause. 6. This Resolution shall take effect immediately, according to law. 14. RESOLUTION APPROVE TEMPORARY TRAILER HRUSKA On motion by Committeeman DeVico seconded by Committeeman Donohue and passed on roll call, the

5 Dustin Kelly WHEREAS, the home of John Hruska, located at 138 Reeds Beach Road (Block 34, Lot 3), sustained damage rendering it uninhabitable, and WHEREAS, the homeowner is requesting the placement of a temporary trailer to be located on the property while the home is repaired. NOW THEREFORE BE IT RESOLVED, that authorization for placement of a temporary trailer is hereby granted by the Township Committee, the governing body of the Township of Middle, at the location of Block 34, Lot 3, otherwise known as 138 Reeds Beach Road. BE IT FURTHER RESOLVED, that a copy of this resolution shall be given to the Middle Township Construction, Zoning, and Code Enforcement offices for notification. FURTHER RESOLVED, that said authorization shall be for a period not to exceed six (6) months from the date of this resolution. FURTHER RESOLVED, that this approval is pending placement of said trailer in a location that is acceptable to the Zoning Officer and Construction Official, as outlined on the attached sketch. 15. RESOLUTION INSERTION OF A SPECIAL ITEM OF REVENUE CAPE MAY COUNTY OPEN SPACE AND FARMLAND PRESERVATION PROGRAM; MIDDLE TOWNSHIP BIKE PATH NORTHERN EXTENSION On motion by Committeeman Donohue seconded by Committeeman DeVico and passed on roll call, the WHEREAS, R.S. 40A: 4-87 provides the Director of the Division of Local Government Services to approve the insertion of any Special Item of Revenue in the budget of any Municipality when such item shall have been made available by law and the amount whereof was not determined at the time of adoption of budget, and WHEREAS, said Director may also approve the insertion of an appropriation for an equal amount. NOW THEREFORE BE IT RESOLVED, that the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, hereby requests the director of Local Government Services to approve the insertion of additional items of revenue in the budget of the year 2017 in the sum of: Cape May County Open Space Middle Twp. Bike Path Northern Extension $1,626, RESOLUTION PLEDGING MUNICIPAL SUPPORT FOR RESPONSIBLE PET OWNERSHIP PROGRAMS IN THE COMMUNITY On motion by Committeeman DeVico seconded by Committeeman Donohue and passed on roll call, the following resolution was adopted. WHEREAS, The Township of Middle recognizes that cats and dogs are an integral and valuable part of all communities, and contribute to the well-being of humans, whether as companions, service animals, or therapy pets, and WHEREAS, the governing body understands that municipalities have an important role in ensuring the well-being of animals while balancing the needs of pet owners and non-pet owners, and WHEREAS, legislators and municipal officials report that the number of calls from citizens about animal related issues rival any other issue(s), and WHEREAS, there are approximately 2.2 million owned dogs and 2.5 million owned cats in New Jersey, and WHEREAS, New Jersey was the first state in the nation to develop an innovative state-wide spay/neuter program and all proceeds from the sale of Animal Friendly License Plates are used to reimburse participating veterinarians for spaying and neutering surgeries, and WHEREAS, State responsibility for promoting responsible pet care and ensuring that pets do not suffer due to abuse, neglect, or lack of proper care in kennels, pet shops, shelters, and pounds

6 (animal facilities) is vested in the Office of Animal Welfare within the New Jersey Department of Health and Senior Services, and WHEREAS, The New Jersey Society to Prevent Cruelty to Animals (NJSPCA) and municipal Animal Cruelty Investigators (ACIs) are responsible for investigating and acting as officers for the detection, apprehension, and arrest of offenders against the animal cruelty laws, and WHEREAS, New Jersey mandates training requirements for animal control officers and Animal Cruelty Investigators, and WHEREAS, New Jersey impounds over 100,000 animals per year in animal shelters and impoundment facilities, and WHEREAS, approximately 37% of the animals that enter New Jersey s impoundment facilities are euthanized, at a rate of around 3000 every month, and WHEREAS, free-roaming unvaccinated cats and dogs present a potential health threat to humans through the spread of such zoonotic diseases as rabies, leptospirosis, toxoplasmosis, roundworms, animal bites, and environmental contamination from animal feces, and WHEREAS, stray and unwanted pets place an enormous financial burden on municipalities and non-profit humane agencies organized to care for these animals, and WHEREAS, it is more humane and cost-effective to reduce the number of unwanted animals than it is to impound and euthanize unwanted or unclaimed dogs and cats, and WHEREAS, all dogs are required to be licensed in the municipality where they are housed and the majority of municipalities also require licensure of cats, and WHEREAS all municipalities are required to canvass their residents to locate unlicensed dogs. NOW, THEREFORE BE IT RESOLVED, that the Township Committee of the Township of Middle, County of Cape May, State of New Jersey does hereby resolve to take the following steps with regard to our municipal responsibilities with the intent of making Middle Township a truly sustainable community: 1. It is our intent to do our utmost, within the bounds of our jurisdiction, to ensure that companion animals are treated humanely, respectfully, and responsibly through public education and through exercise of powers vested within New Jersey municipalities as follows: 2. Authority of municipalities: Pursuant to New Jersey Statutes, all municipalities must appoint a certified animal control officer who shall be responsible for animal control within the jurisdiction of the municipality, including providing emergency veterinary care for injured stray animals and coverage outside of normal working hours; 3. The municipality in which an animal facility is located is responsible for issuing the license for that facility to operate. 4. The NJ Vicious Dog Law establishes a state-wide standard for municipalities to effectively address situations of vicious or potentially dangerous dogs, regardless of breed; 5. The Animal Population Control Program provides for low-cost spaying and neutering for pet owners adopting dogs and cats from New Jersey shelters, pounds, and animal adoption referral agencies and pet owners participating in one of several Public Assistance Programs. BE IT FURTHER RESOLVED that the Municipality does hereby also pledge to: Enforce all animal and rabies control statutes and regulations, including the requirement to pick up and impound all stray dogs and cats, excepting stray and feral cats in managed TNR programs. Work to improve the enforcement of animal cruelty statutes. Educate our community, including school children, about their responsibilities towards the pet animals they chose to keep. Institute, as appropriate, cat licensing ordinances and increase the percentage of licensed dogs and cats through ease of licensing and licensing enforcement measures. Identify and work to implement best practices to prevent unwanted breeding through effective animal control, availability of low-cost pet spaying and neutering services, public education, and pet-friendly rental and senior housing. Identify alternatives to euthanasia of adoptable companion animals, including utilizing foster homes, adoption networks and providing remedial behavior training services to existing and future owners. Assist in identifying resources to improve the conditions and increase the capacity of animal shelters and impoundment facilities and animal control services. 19. RESOLUTION PLEDGING MUNICIPAL SUPPORT OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION, DIVISION OF FISH AND WILDLIFE, STATE-LEVEL PRIORITY CONSERVATION GOALS AND STRATEGIES On motion by Committeeman DeVico seconded by Committeeman Donohue and passed on roll call, the WHEREAS, the Township of Middle recognizes that animals are an integral and valuable part of all communities and believing concern for the wellbeing of wild animals and wild species is a hallmark of a sustainable natural community, and WHEREAS, New Jersey is home to a rich diversity of wildlife and ecologically significant natural communities, and WHEREAS, New Jersey s wildlife and wild places are under threat from development, fragmentation, invasive species and the impacts of people, and WHEREAS, the populations of mammals, birds, invertebrates, fish, reptiles and amphibians that live in and migrate through New Jersey find themselves clinging to smaller and smaller pieces of wild clean lands and aquatic habitats, and WHEREAS, it is more cost-effective to prevent species from becoming imperiled than it is to recover them once their populations have declined, and WHEREAS, a naturally functioning and healthy ecosystem represents a healthy environment for NJ wildlife and our citizens, and WHEREAS, the NJ Division of Fish and Wildlife, other state and federal agencies, and many partners in conservation have worked together to develop a state Wildlife Action Plan for the

7 benefit of biologists, wildlife experts, municipal leaders, land stewards, non-profit organizations, educators, planners, researchers, outdoor recreation enthusiasts, landowners and all the people who know the wild places of New Jersey State, and WHEREAS, the New Jersey Wildlife Action plan is a comprehensive action agenda for the conservation of native wildlife, the restoration of important lands and water, and public education targeting the needs of rare wildlife in New Jersey, and WHEREAS, the residents of, and visitors to, New Jersey also enjoy and benefit from New Jersey s wildlife and wild spaces. NOW, THEREFORE BE IT RESOLVED, that the Township Committee of the Township of Middle, County of Cape May, State of New Jersey does hereby resolve to take the following steps with regard to our municipal land-use decisions with the intent of making Middle Township an ecologically sustainable community: It is our intent to include these principles in our public lands management, our environmental resources inventory and to inform the next master plan revision and update our zoning accordingly We will identify imperiled species, critical habitat and unique ecosystems in our Environmental Resource Inventory. Acknowledging that it is more cost-effective to protect species than recover species, we will protect populations of rare and imperiled species that live and breed in, and migrate through, the municipality and the habitats they depend upon. Because habitat integrity is critical to healthy biodiversity we will manage publicly owned lands in accordance with wildlife management actions laid out in the New Jersey Wildlife Action Plan and will promote the management of all protected lands to promote biodiversity. We will protect wildlife habitats and maintain connectivity of habitat when formulating an open space acquisition strategy, open space stewardship plans and through the municipal master plan including planning and zoning ordinances. We will seek to minimize disturbance of critical wildlife populations and their habitats from human activities, subsidized predators and invasive species. When possible and appropriate, we will work with neighboring municipalities to implement the aforementioned principles across municipal boundaries. When possible and appropriate, we will strive to monitor and implement appropriate management of municipal easements to ensure native vegetation and wildlife takes precedence over invasive and/or exotic species. 20. Stan Donegar, Rio Grande: - Asked for background on the replacement of equipment for Public Works. - Stated that he sees a lot of bills going out; would like to see where we stand on the purchase of new equipment. Thomas Campbell, Wahl Avenue: - Has been in and out of Township court system a total of sixteen times; officers have found nothing illegal. - Further explained that he is a disabled veteran and he purchased his child a 4-wheeler due to not being able to run. - Spoke to his neighbor s chickens and dog that run wild; concerns with wood pile and children that run through the neighborhood without parental supervision. - Expressed his displeasure with having to keep going through the court system; feels as though it is harassment but has been told it is not. Captain Bill Adams: - Discussed law that allows residents to file complaints against one another. - Reiterated that Mr. Campbell has the same right. Thomas Campbell, Wahl Avenue: - Spoke to a conversation that he had with the Chief of police where he was told it was believed that he was being brought into court on an ordinance violation. - Stated that he was informed by the Zoning Department that there is no Ordinance. - Noise Ordinance states that you can make as much noise under a certain decibel from 8:00am 10:00pm; child riding at 3:00pm. - Further explained other incidents he has experienced with his neighbors; nothing being done.
