2 THE DU PAGE COUNTY ELECTION COMMISSION BOARD MEETING April 04, 2016 The proceedings of the DuPage County Election Commission at a regular meeting held in Room 3-500A of the Jack T. Knuepfer Building, DuPage Center, 421 North County Farm Road, Wheaton, Illinois, on Monday, April 04, 2016, at 9:00 a.m. Commissioner Terrill called the meeting to order. On roll call, Commissioners Terrill, Boske and Lowe were present. Commissioner Terrill led the pledge of allegiance. Also present were Joseph Sobecki, Assistant Executive Director, and Mary Dickson, Legal Counsel. --oo00oo-- Commissioner Terrill opened the floor for public comment. There were six (6) comments presented to the Board. The first comment was in regards to lengthy lines and address verification at Wheaton College and concern for lack of transparency in the voting process. The second comment was an update from the Citizen Participation Institute indicating that they now have a website where interested candidates can view areas they can run for. The third, fourth and fifth comments were in regards to attestation to the signing sections of the official canvass that pertained to the precincts in question due to irregularities in the counting of ballots submitted. The sixth comment was in regards to the observation of a pollwatcher at a site on Election Day where he observed the judges working diligently and indicated that due to exhaustion, it is possible that they may have missed noticing write-in votes.
3 As previously indicated by counsel, in order for the Election Commission to have any authority to conduct any recount, a court order must be received. Assistant Executive Director Sobecki advised that judges are agents of the court. In following the chain of custody, staff does not break seals beyond the reconciliation period after an election. On paper ballots, what is tallied and what the results show are what is submitted to the judges on a write-in tally sheet. In regards to the touchscreen, the information is directly selected on the machine by the voter and is easier to determine the voter s intention. Commissioner Terrill requested approval to certify and make official the Canvass for the March 15, 2016 General Primary Election. Commissioner Boske moved, seconded by Commissioner Lowe, to certify and make official the Canvass for the March 15, 2016 General Primary Election. Commissioners Boske, Lowe and Terrill voted aye. Motion carried. At Commissioner Terrill s request, Assistant Executive Director Sobecki provided a response to the registration concern for college students as follows; statute requires that voters provide the address as to where the voter is residing when registering. In most cases, college residence halls are located in different precincts, as is the case with Wheaton College. If the address where a college receives mail is used, this could result in students/voters voting for incorrect precinct committeemen. Staff is currently drafting a letter and working with colleges around the county to compare student lists and determine their correct address. This will allow the commission to correctly code them in the system for the precinct in which they live in. The commission will also work closely with schools to provide students with better awareness as to where they should go to register.

Despite the challenges faced at polling places, judges did a great job. A meeting will be scheduled in the near future with judges and the DuPage Democratic organization to discuss feedback on same day registration and how the technology worked at the polling places. The Voter Participation Center will be sending out a mass mailing the 3 rd week of June to anyone who is not registered and is eligible to register to vote. This was supposed to be a part of ERIC, Senate Bill 172, however the state did not have funding to send out the mass mailing. The hopes is that this will alleviate some of the registrations necessary on Election Day. Staff is in the process of reviewing data submitted by judges and field representatives, pollwatchers and via the phone system based on their observations and any
11 issues that occurred on Election Day. Post-election meetings will take place to determine best solutions for any issues which may have occurred. --oo00oo-- Counsel Dickson Bond provided the following updates and legal report to the Board as follows; other than statement made earlier pertaining to the conversation which took place with the precinct committeemen, there is nothing further to report at this time. --oo00oo-- In regards to speeding up the posting process of election day results and posting of precinct level results prior to counting of ballots, Assistant Executive Director advised the Board as follows; the commission currently does not send results over a telephone line. There has been inquiries about speeding up the process and posting results earlier. Other jurisdictions send their results via airwaves or dedicated lines, this is something the commission will need to look into and conduct a cost analysis to determine if it would be feasible with the system we currently have in place now. If not, we will need to look into an alternative method for sending results. In order to maintain the privacy of the voters, precinct level results are not posted prior to counting of ballots. Further discussion and explanation to be provided at the next board meeting.

13 2016 ORGANIZATIONAL ORDINANCE AUTHORIZING THE ORGANIZATION OF THE DU PAGE COUNTY ELECTION COMMISSION May 11, 2016 Ordinance No WHEREAS, the DuPage County Election Commission (hereinafter referred to as the COMMISSION ) is created pursuant to the Election Code, 10 ILCS 5/1-1, et seq.; and WHEREAS, the COMMISSION is empowered by statute to discharge certain duties and responsibilities; and WHEREAS, the governing board of the COMMISSION is the DuPage County Board of Election Commissioners (hereinafter referred to as the COMMISSIONERS ), who are appointed pursuant to statute, 10 ILCS 5/6A-3; and WHEREAS, in order to efficiently and effectively administer the business of the COMMISSION, it has been deemed necessary and advisable that the duly appointed COMMISSIONERS elect, from among their members, a Chair, to preside over the meetings of the COMMISSION and to exercise those powers so directed by the COMMISSION; and WHEREAS, to further aid in the efficient and effective administration of the COMMISSION, it has been deemed necessary and advisable that the duly appointed COMMISSIONERS elect, from among their members, a Vice Chair, to preside over the meetings of the COMMISSION in the absence of, or at the direction of the Chair and to exercise those powers so directed, from time to time, by the COMMISSION; and WHEREAS, to further aid in the efficient and effective administration of the COMMISSION, it has been deemed necessary and advisable that the duly appointed Commissioners elect, from among its members, a Secretary, to attest to the signature of the Chair, to maintain the records of resolutions passed, ordinances enacted and other actions taken by the COMMISSION, to certify said records, where required, and to exercise those powers so directed, from time to time, by the COMMISSION; and 1
14 NOW, THEREFORE, BE IT ORDAINED by the DuPage County Board of Election Commissioners, DuPage County, Illinois, as follows: Section I: Recitals Incorporated. The foregoing recitals shall be, and they are, hereby incorporated herein as fully set forth within this Section I. Section II: Annual Reorganization. The COMMISSION shall reorganize, on an annual basis, which organization shall take place at the first regularly scheduled COMMISSION meeting following any Commissioner appointment, or as soon thereafter as practicable. In the event of a vacancy on the COMMISSION, the COMMISSION shall reorganize within thirty (30) days of the swearing in of a new Commissioner, or soon thereafter as practicable. Section III: Reorganization Procedures. a. The Current Chair, or in the absence of a Chair, the Vice Chair, shall serve as the temporary presiding officer until the election of a Chair. 2 b. The reorganization meeting shall be called to order by the Current Chair. c. The Current Chair shall call the roll. d. The Current Chair shall entertain a motion for approval of the Organization Ordinance. e. The Current Chair shall call for nominations of officers. Section IV: Nomination Procedures. a. Nominations for the offices provided for herein, shall be made from the floor. b. Two affirmative votes are necessary to be elected to office. c. The roll call vote shall be conducted in alphabetical order. d. The rules contained in the most recent edition of Robert s Rules of Order
15 shall govern the election of officers, to the extent said Rules are not in conflict with the Organization Ordinance. e. The offices shall be nominated in the following order: Chair, Vice Chair, and Secretary. f. The officers shall have those powers and duties afforded them by statute, those set forth herein, and such other and further duties as the COMMISSION deems appropriate. g. The term of office for the officers shall be one (1) year, except any Commissioner appointed to fill a vacancy shall serve for the duration of the vacated term, until the Successor Officer is elected following the reorganization of the Board. h. Upon election, the officers shall hold office for the duration of their term and shall hold office until such time as they are reappointed or a duly appointed replacement takes the oath of office. Section V: Term Commencement/ Appointed Positions: a. Upon receiving the requisite number of votes, as provided for herein and upon the completion of election of all officers, the Current Chair shall tender the gavel and control of the meeting to the newly elected Chair. Section VI: Transmission of Ordinance: The Executive Director is hereby directed to transmit certified copies of this Resolution to the Chief Judge for the Eighteenth Judicial Circuit at 505 South County Farm Road, Wheaton, Illinois 60187, and to the Attorney for the Election Commission at 400 S. Knoll Street, Suite C, Wheaton, Illinois
