2 SELAH PARK AND RECREATION SERVICE AREA RESOLUTION NO A RESOLUTION of the Selah Park and Recreation Service Area Board providing for the submission to the voters of the Service Area at a special election to be held on August I, 2017, in conjunction with the State Primary election to be held on the same date, of a proposition authorizing a one-year excess tax levy commencing in 2017 for collection in 2018 on all of the taxable property within the Service Area of $300,000, the estimated dollar rate of tax levy required to produce such an amount being $0.20 per $ I,000 of assessed value (such assessed value representing 100% of true and fair value unless specifically provided otherwise by law), all in excess of the maximum tax levy specified by law for park and recreation service areas without voter approval, the proceeds of such levy to be used for operating funds; designating the persons to receive notice of the ballot title from the Auditor of Yakima County; and providing for other properly related matters. BE IT RESOLVED BY THE SELAH PARK AND RECREATION SERVICE AREA BOARD as follows: Section I. Findings and Determinations. The Selah Park and Recreation Service Area Board (the "Board") takes note of the following facts and hereby makes the following findings and determinations: (a) By Resolution No , the Board of County Commissioners of Yakima COWlty (the "County") initiated the formation of the Selah Park and Recreation Service Area (the "Service Area") and, at an election held on November 6, 2001, the establishment of Service Area was approved by the voters. The Service Area is a quasi-municipal corporation, a body corporate, an independent taxing "authority" within the meaning of Section I, Article 7 of the Washington Constitution and a "taxing district" within the meaning of Section 2, Article 7 of the Washington Constitution. (b) The area within the boundaries of the Service Area includes certain unincorporated areas of Yakima County as well as the City of Selall (the "City"). Pursuant to RCW and chapter RCW, the County and the City entered into an interlocal agreement in December 200 I providing for the governance of the Service Area. (c) The Service Area is authorized to: "purchase athletic equipment and supplies, and provide for the upkeep of park buildings, grounds and facilities, and provide custodial, recreational and park program personnel at any park or recreational facility owned or leased by tlle service area or a county, city, or town" (RCW ); "acting independently or in conjunction with... any... city,... acquire... land... and... build, construct, care for, control, supervise, improve, operate and maintain... swimming pools... and other recreational facilities... upon any such land" (RCW and ); "levy annual excess levies upon the property included within the service area if authorized at a special election called for the purpose in the marmer prescribed by section 2, Article VII of the Constitution and by RCW for operating funds, capital outlay funds, and cumulative reserve funds" _. _ CRCW ); and "levy taxes at a rate in excess of the rate specified in RCW tlrrough and , or through , when authorized so to do by )

3 the voters of such taxing district in the manner set forth in Article VII, section 2(a) of the Constitution of this state at a special or general election to be held in the year in which the levy is made" (RCW ). (d) The Service Area, in conjunction with and on land owned by the City, currently provides for the operation and maintenance of swimming pool facilities at Wixson Park. The Service Area currently levies regular property taxes pursuant to a six-year operations levy authorized under RCW To provide for anticipated increases in operating expenses during 2018, the Board has determined (i) it is necessary for an excess property tax levy to be made in 2017 for collection in 2018 to provide operating funds, and (ii) to seek voter approval for such one-year excess levy. (e) RCW 29A provides that the Yakima County Auditor (the "Auditor"), as ex officio supervisor of elections within Yakima County, upon request in the form of a resolution of the Board, presented to the Auditor prior to the proposed election date, may call a special election within the Service Area on one of the authorized special election dates, as decided by the Board. Provided this resolution is presented to the Auditor no later than May 12, 2017, the Service Area can call a special election on August 1, (f) The best interests of the Service Area's residents require that (i) the Service Area make a one-year excess levy for operating funds, subject to the approval of the Service Area's voters, and (ii) the Service Area submit a proposition to its voters as soon as possible to authorize the one-year excess levy. Section 2. Calling of Election. The Auditor is requested to call and conduct a special election in the Service Area in the manner provided by law to be held therein on August 1,2017, in conjunction with the State Primary election to be held on the same date, for the purpose of submitting to the Service Area's voters, for their approval or rejection, the proposition of whether a one-year excess levy to provide operating funds for the Service Area shall be made annually for one year commencing in 2017 for collection in 2018 on all of the taxable property within the Service Area of $300,000, the estimated dollar rate of tax levy required to produce such an amount being $0.20 per $1,000 of assessed value (such assessed value representing 100% of true and fair value unless specifically provided otherwise by law), all in excess of the maximum tax levy specified by law for park and recreation service areas without voter approval. The exact tax levy rate may be adjusted based upon the actual assessed value of the taxable property within the Service Area at the time of the levy. The proposed excess property tax levy would be in addition to (and not in lieu of) the Service Area's other levies that have been approved by the voters. Section 3. Use of Levy Proceeds. If the proposition authorized by this resolution is approved by the requisite number of voters, the Service Area will be authorized to levy excess property taxes and use the proceeds of such levy to meet the Service Area's operating expenses in 2018, and in future years if collections are not fully expended in 2018, all as may be authorized by law and deemed necessary by the Board. 4 Section 4. Forn1 of Ballot Title. Pursuant to RCW 29A , the Yakima County Prosecuting Attorney is requested to prepare the concise description of the aforesaid proposition for the ballot title in substantially the following form: PROPOSITION I SELAH PARK AND RECREATION SERVICE AREA ONE-YEAR OPERATING LEVY The Selah Park and Recreation Service Area Board adopted Resolution No concerning a proposition to finance swin1ming pool operations. This proposition would authorize the Service Area to levy a one-year levy in excess of regular property tax levies for operating funds, at the estimated rate of $0.20 per $1,000 of assessed value on all taxable property within the Service Area for collection in 2018 to provide a total of $300,000, all as provided in Resolution No Should this proposition be approved? LEVY... YES D LEVY... NOD Section 5. Authorization to Deliver Resolution to Auditor and Perform Other Necessary Duties. The Chairperson of the Service Area, Kelliann Ergeson (the "Chairperson") or his or her designee is directed to (a) present a certified copy of this resolution to the Auditor no later than May 12,2017, and (b) perform such other duties as are necessary or required by law to submit to the Service Area's voters at the aforesaid special election, for their approval or rejection, the proposition of whether the Service Area shall levy excess property taxes for operating funds. Section 6. Notices Relating to Ballot Title. For purposes of receiving notice of the exact language of the ballot title required by RCW 29A , the Board hereby designates the (a) the Chairperson (Kelliann Ergeson), (telephone), sorsainfo@grnail.com ( ), and (b) special counsel, Foster Pepper PLLC (Jeff Nave), (telephone), jeff.nave@foster.com ( ), as the individuals to whom the Auditor shall provide such notice. The Chairperson is authorized to approve changes to the ballot title, if any, deemed necessary by the Auditor or the Yakima County Prosecuting Attorney. Section 7. Authorization of Local Voters' Pamphlet. To the extent a local voters' pamphlet and/or online voters' guide (the "Pamphlet") will be produced for the August 1,2017 State Primary election, the preparation and distribution of information on the ballot title for inclusion in the Pamphlet is hereby authorized; provided that, the Service Area reserves the right not to participate in the preparation and distribution of the Pamphlet if such participation would create undue fmancial hardship for the Service Area or would otherwise not be in the best interests of the Service Area. The Chairperson is authorized to exercise the Service Area's right not to participate in the preparation and distribution of the Pamphlet. The Pamphlet shall include, if applicable, an explanatory statement and statements in favor of and in opposition to the ballot title. The preparation of the explanatory statement, the appointment of pro/con committees and the preparation of statements in favor and in opposition to the ballot title shall be in accordance with chapter 29A.32 RCW and the rules and guidelines of the Auditor

5 Section 8. General Authorization and Ratification. The Chairperson, other appropriate officers of the Service Area and special counsel, Foster Pepper PLLC, are severally authorized and directed to take such actions and to execute such documents as in their judgment may be necessary or desirable to effectuate the provisions of this resolution. All actions taken prior to the effective date of this resolution in furtherance of and not inconsistent with the provisions of this resolution are hereby ratified and confirmed in all respects. Section 9. Severability. If any provision of this resolution shall be declared by any court of competent jurisdiction to be invalid, then such provision shall be null and void and shall be separable from the remaining provisions of this resolution and shall in no way affect the validity of the other provisions ofthis resolution or of the levy or collection of excess property taxes authorized herein. Section 10. adoption. Effective Date. Tllis resolution shall become effective immediately upon its ADOPTED by the Selah Park and Recreation Service Area Board at a special open public meeting thereof, of which due notice was given as required by law, held on May 8, 2017, the following Members being present and voting in favor of the resolution. 6 CERTIFICATION J, the undersigned, the Secretary of the Selah Park and Recreation Service Area Board (the "Board"), hereby certify as follows: 1. The foregoing Resolution No (the "Resolution") is a full, true and correct copy of the Resolution duly adopted at a special meeting of the Board held at the regular meeting place thereof on May 8, 2017, as that Resol ution appears on the minute book of the Service Area, and the Resolution is now in full force and effect; 2. Written notice specifying the time and place of the special meeting and noting the business to be transacted was given to all members of the Board by mail, fax, electronic mail or by personal delivery at least 24 hours prior to the special meeting (the "Notice"), a true and complete copy of the Notice is attached hereto as Appendix 1; 3. At least 24 hours prior to the special meeting, notice was also posted on the Service Area's web site and prominently displayed at the main entrance of the Service Area's Administrative Office and at the special meeting site; 4. The Notice was also given by mail, fax, electronic mail or by personal delivery at least 24 hours prior to the special meeting to each local radio or television station and to each newspaper of general circulation that has on file with the Service Area a written request to be notified of special meetings and to any others to which such notices are customarily given by the Service Area; and 5. A quorum of the members of the Board was present throughout the meeting and a sufficient number of members of the Board present voted in the proper manner for the adoption of the Resolution.
