PUBLIC HEARING PUBLIC HEARING REGARDING THE POSSIBLE ACQUISITION AND USE OF GRANT FUNDS FOR CERTAIN RECREATION AND CONSERVATION PROJECTS AT SCOTLAND RUN PARK, CLAYTON, PURSUANT TO GREEN ACRES LAND STEWARDSHIP PROGRAM. Per state regulations, a Resolution setting a public hearing date of February 15, 2017 as to the possible acquisition and use of a Green Acres matching funds grant at Scotland Run Park was approved at the Freeholder meeting of February 1, That Resolution requested public comments pertaining to the proposed projects at the Park to be submitted to the Board of Chosen Freeholders on or before February 14, 2017; and that any requests for information concerning the proposed projects be directed to Chuck Rose, Department of Parks & Recreation at the Shady Lane Complex. The County is considering the acquisition and use of matching funds from the State Green Acres Program for recreation and conservation projects at Scotland Run Park. The projects under consideration include an ADA compliant EZ Launch system to allow disabled and non-disabled individuals to access canoes and kayaks at Park s Wilson Lake more easily and safely. The project also include an ADA compliant fishing pier which can accommodate more residents; interpretive signage to facilitate self-guided ecological and nature tours, as well as signage describing marine life at the lake. The total cost to the County is estimated to be $50, (one half of the total project cost of $100,380.49). INTRODUCTION RESOLUTION TO EXCEED THE COUNTY BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK. Introduction of this Resolution will allow the County to use 3.5% vs..5% in calculating its budget CAP and allow the County to bank or use in future years any amounts not needed in The public hearing will be held March 15, Public portion on agenda items only (time limit of five (5) minutes per person, per public portion). DEPARTMENT OF ADMINISTRATION DIRECTOR DAMMINGER FREEHOLDER CHILA A-1 RESOLUTION AUTHORIZING A CLOSED SESSION TO DISCUSS THE STATUS OF AND POSSIBLE SETTLEMENT OF NJ DEP V. GLOUCESTER COUNTY; BENNY A. SORBELLO FAMILY, LLC; TIMOTHY AVSEC; AND DIANNE AVSEC (BASGALORE LAKE DAM). The general nature of the subject to be discussed at the closed meeting of February 15, 2017, shall be the status and possible settlement of litigation matter captioned NJ DEP v. County of Gloucester, et als. The Plaintiff, NJDEP is represented by Daniel Greenhouse and Susan Savoca of the DAG s office; Gloucester County is represented by Michael E. Sullivan of Parker McCay; The Sorbello Family is represented by Anne Krell, Esquire, and the Avsecs are represented by William Ziegler, Esquire. A-2 RESOLUTION AUTHORIZING APPROVAL OF THE BILL LISTS FOR THE MONTH OF FEBRUARY, The Treasurer of Gloucester County submits the bill list for February for Freeholder approval, including ratification of payments made to cover emergency payments made by the Division of Social Services. Upon approval, the Treasurer is the authorized to render payments to vendors appearing on the list.

2 February 15, 2017 Page 2 A-3 RESOLUTION DETERMINING THE ANNUAL APPROPRIATION FOR THE ESTABLISHMENT AND MAINTENANCE OF THE COUNTY LIBRARY FOR THE YEAR In accordance with N.J.S.A.40:33-9, annual appropriations are made for the establishment and maintenance of a Library with the Board of Chosen Freeholders determining a sufficient sum to be raised; and thereafter, certified by the Board of Chosen Freeholders to the County Board of Taxation. A tax amount is then apportioned and assessed against all the municipalities receiving the benefits, and levied and collected in the manner provided by law for the maintenance of the Library. As per N.J.S.A. 40:33-9, this Resolution will set forth the annual appropriation necessary for the maintenance and upkeep of the County Library for the year A-4 RESOLUTION AUTHORIZING EMERGENCY TEMPORARY APPROPRIATIONS. This Resolution is needed to fund the Drunk Driving Enforcement Fund, National Emergency Food & Shelter Program and Electronic Crimes Task Force grants. A-5 RESOLUTION AUTHORIZING THE COUNTY PROSECUTOR TO EXCEED THE 2.0% BUDGET CAP (PL 2015, c.249) FOR THE 2017 COUNTY BUDGET. This Resolution will allow the County Prosecutor to increase its appropriations beyond the 2% maximum permitted to comply with the mandated costs related to Criminal Justice Reform. A-6 RESOLUTION RESCINDING PETTY CASH FUND. These petty cash funds are no longer needed. A-7 RESOLUTION AUTHORIZING A CONTRACT WITH PINO CONSULTING GROUP, INC. FROM FEBRUARY 4, 2017 TO FEBRUARY 3, 2018 FOR $25, This Resolution authorizes a contract with Pino Consulting Group, Inc., for the provision of a county-wide Central Service Indirect Cost Plan from February 4, 2017 to February 3, 2018 for $25, as per RFP This plan identifies Indirect Costs, commonly called overhead costs, so that we may charge them to, and get reimbursed from, grants. CAF # has been obtained to certify funds. A-8 RESOLUTION AUTHORIZING AND CONFIRMING SETTLEMENT OF STATE TAX COURT TAX APPEALS. The Plaintiff, Brightview Woodbury Lake, LLC (tax year 2014) and SHP IV Woodbury Lake, LLC (tax years 2015 & 2016) v. Deptford Township, Docket Numbers , , , represented by Jeffrey D. Gordon, Esquire, of Archer &Greiner, P.C. filed state tax appeals contesting the assessment on the subject property known as Block 82.11, Lot 39.02; and the parties through legal counsel and assessors and/or certified real estate appraisers engaged by the tax payer and County have reached a resolution of the complaints, settling outstanding claims pursuant to N.J.S.A. 54:1-99, N.J.A.C. 18:17A-8.1. A-9 RESOLUTION IN SUPPORT OF RESTRICTING THE SALE OF DOGS AND CATS AT PET SHOPS AND ENCOURAGING MUNICIPALITIES TO ADOPT ORDINANCES ENFORCING REGULATIONS. The U.S. Department of Health has found that due to the significant pet over-population, more than 20,000 dogs and cats are euthanized in New Jersey shelters annually. Restricting the retail sale of puppies and kittens to only those sourced from animal shelters and rescue organizations could effectively reduce this serious issue of pet overpopulation, as well as the burden on agencies and the financial costs to local taxpayers. Current federal and state regulations do not properly address the sale of puppy and kitten mill dogs and cats in local pet shops. This Resolution will support restricting the sale of dogs and cats in pet stores which are not sourced from animal shelters and rescue organizations, and encourage Gloucester County municipalities to adopt ordinances to enforce regulations as to local shops. DEPARTMENT OF PUBLIC SAFETY, VETERANS AFFAIRS & ELECTIONS FREEHOLDER CHILA FREEHOLDER SIMMONS B-1 RESOLUTION AUTHORIZING A CONTRACT WITH PAULSBORO PRINTERS, INC. FOR SERVICES IN CREATING AND PRINTING VOTING AUTHORITY TICKETS FOR THE GLOUCESTER COUNTY SUPERINTENDENT OF ELECTIONS, FROM MARCH 13, 2017 TO MARCH 12, 2019, IN AN AMOUNT NOT TO EXCEED $50, FOR THE TERM OF THE CONTRACT. This Resolution authorizes the execution of a contract with Paulsboro Printers, Inc. for services to create and print voter authority tickets for each election, from March 13, 2017 to March 12, 2019, in an amount not to exceed $50, for the term of the contract. The County of Gloucester has a need for voting machine services for the Gloucester County Superintendent of Elections, said services to include, but not be limited to, the printing of all Voter Authority Tickets.

3 February 15, 2017 Page 3 DEPARTMENT OF ECONOMIC DEVELOPMENT & PUBLIC WORKS FREEHOLDER SIMMONS FREEHOLDER CHRISTY C-1 RESOLUTION REVISING THE PY2015 COMMUNITY DEVELOPMENT ANNUAL ACTION PLAN TO INCLUDE A PUBLIC FACILITIES PROJECT WITH THE BOROUGH OF GLASSBORO FOR $40, The Department of Public Works Planning Division is requesting a Resolution to revise the Community Development PY2015 Annual Action Plan and to approve reallocating $40, unused funds from the Owner Occupied Housing Rehabilitation Program for the demolition of the Ellis Manor Public Housing Site at 737 Lincoln Boulevard in Glassboro. This project promotes public safety in a designated low moderate income area and thereby qualifies under the CDBG regulations. C-2 RESOLUTION AUTHORIZING CHANGE ORDER DECREASE #02-FINAL WITH ARAWAK PAVING COMPANY, INC. FOR ENGINEERING PROJECT #15-02FA. This Resolution will authorize a Contract Change Order Decrease #02-Final by $7, to contract with Arawak Paving Co., Inc. of 7503 Weymouth Road, Hammonton, NJ for the project Proposed Resurfacing and Safety Improvements to East Holly Avenue, County Route 624 from Broadway, CR553A to Delsea Drive, Route 47 in the Borough of Pitman, Gloucester County, New Jersey, Engineering Project #15-02FA, based on increases and decreases for final as-built quantities, resulting in a new total contract amount of $531, C-3 RESOLUTION AUTHORIZING CHANGE ORDER DECREASE #03 WITH ZONE STRIPING, INC. FOR ENGINEERING PROJECT #16-03SA. This Resolution authorizes a Contract Change Order Decrease #03 by $ to contract with Zone Striping, Inc. of 501 New Jersey Avenue, PO Box 568, Glassboro, NJ for the project Countywide State Aid Roadway Safety Project throughout Gloucester County, Engineering Project #16-03SA, necessitated by a reduction of majority of the remaining guiderail items to offset the additional items, resulting in a new total contract amount of $460, C-4 RESOLUTION AUTHORIZING CHANGE ORDER INCREASE #01 WITH SOUTH STATE, INC. FOR ENGINEERING PROJECT # This Resolution will authorize a Contract Change Order Increase #01 for $51, to contract with South State Inc. of 202 Reeves Road, Bridgeton, NJ 08302, for the project Intersection Improvements to Ellis Mill Road (County Route 641) with Richwood Road (County Route 609) and Clems Run Road (County Route 623) in the Township of Harrison, Gloucester County, New Jersey, Engineering Project # This increase is necessary to pay for two items not included in the contract pay items and balance the change order, resulting in a new total contract amount of $926, CAF # has been obtained to certify funds. C-5 RESOLUTION AUTHORIZING CONSENT TO THE PROPOSED WATER QUALITY MANAGEMENT (WQM) PLAN AMENDMENT ENTITLED RIVERWINDS. The Resolution consents to the proposal submitted for West Deptford on behalf of RiverWinds as an amendment to the Tri-County Water Quality Management Plan. The amendment request expansion of the Gloucester County Utility Authority sewer area to include Block 328, Lots 3.01, 7.01, 7.04 (portion), 7.06 (portion), 7.071, & 7.08, located in the Township of West Deptford. The expansion is in accordance with N.J.A.C. 7:15. The amendment was prepared and submitted for West Deptford on behalf of RiverWinds by T&M Associates. This amendment proposal would update the Gloucester County Utilities Authority Wastewater Management Plan, the Gloucester County Utilities Authority (GCUA) sewage treatment plant (STP) sewer service area (SSA), as well as the Tri-County Water Quality Management Plan (WQMP). DEPARTMENT OF EDUCATION FREEHOLDER BARNES FREEHOLDER JEFFERSON DEPARTMENT OF PARKS & LAND PRESERVATION FREEHOLDER DIMARCO FREEHOLDER CHILA E-1 RESOLUTION AUTHORIZING APPLICATION FOR A MATCHING FUNDS GRANT FROM NEW JERSEY GREEN ACRES PROGRAM IN THE AMOUNT OF $50, FOR PROJECTS AT SCOTLAND RUN PARK. As required by the State, the County has also conducted a public hearing to discuss the projects and to

Further, the Resolution authorizes the Freeholder Director to execute an agreement with the State for implementation of projects; that the County has its matching funds share of the project; that in the event the State s funds are less than the total project cost specified above, the County has the balance of funding necessary to complete the project; and, that the County agrees to comply with all applicable federal, state and local laws, rules and regulations in its performance of the projects. DEPARTMENT OF BUILDINGS & GOVERNMENT SERVICES FREEHOLDER CHRISTY FREEHOLDER DIMARCO F-1 RESOLUTION AUTHORIZING A GRANT APPLICATION TO THE NEW JERSEY DIVISION OF HIGHWAY TRAFFIC SAFETY, DRUNK DRIVING ENFORCEMENT FUND FROM JANUARY 1, 2017 TO DECEMBER 31, 2017 FOR $20, This Resolution will authorize the County Prosecutor s Office to apply for a grant in the amount of $20, with the NJ Division of Highway Traffic Safety, Drunk Driving Enforcement Fund. These grant funds are generated by surcharges collected as a result of drunk driving convictions in municipal police departments. A portion of the funds are given to the County Agency (Prosecutor s Office) to use in combating drunk driving. The requested grant funds will be utilized, among other things, to purchase software updates to Crash Investigation Programs, the Crash Data Retrieval (black box) used in the reconstruction of drunken driving crashes, portable variable message boards for use in DWI checkpoints and saturation patrol mobilizations, etc. F-2 RESOLUTION AUTHORIZING AMENDMENT TO THE VICTIMS OF CRIME ACT GRANT TO INCREASE THE IN-KIND MATCH BY $60, By Resolution adopted on November 24, 2015 an application on behalf of the County Prosecutor s Office was authorized for the Victims of Crime Act (VOCA) Grant from the NJ Division of Criminal Justice for the amount of $191,448.00, with an in-kind match of $47, (funds from the Prosecutor s budget), for a total amount of $239, An increase in the in-kind match of $60, is now necessary due to a change in VOCA program guidelines and regulations to include increase in pensions and other related costs. This resolution will authorize an amendment to the grant amount to increase the in-kind match to $107,938.00, for a total grant amount of $299, F-3 RESOLUTION AUTHORIZING PURCHASE AND DELIVERY OF AMMUNITION FROM EAGLE POINT GUN/TJ MORRIS & SON THROUGH STATE CONTRACT FROM MARCH 1, 2017 TO FEBRUARY 28, 2018 IN AN AMOUNT NOT TO EXCEED $125, This Resolution authorizes Gloucester County Prosecutor s Office, The Sheriff s Department and the Department of Correctional Services to purchase ammunition from Eagle Point Gun/TJ Morris & Son, with an address of 1707 Third Street, Thorofare, NJ, through State Contract #A81296, in an amount not to exceed $125, from March 1, 2017 to February 28, F-4 RESOLUTION AUTHORIZING A CONTRACT WITH JOSEPH PORRETTA BUILDERS, INC., FOR $368, This Resolution awards a negotiated contract with Joseph Porretta Builders, Inc., 551 Anderson Avenue, Hammonton, NJ for the supply and delivery of all labor and materials to install a pole barn at the Gloucester County Public Works yard in Mantua. At bid opening on January 5, 2017, it was determined all bids received were over-budget; necessitating a negotiated agreement with Contractor for services described in specification PD , for $368, F-5 RESOLUTION AUTHORIZING A CONTRACT WITH TRI-M GROUP, LLC FROM FEBRUARY 18, 2017 TO FEBRUARY 17, 2018 IN AN AMOUNT NOT TO EXCEED $75, This Resolution awards a contract to Tri-M Group LLC, with offices at Gale Lane, Kennett Square, PA for the provision of on-call maintenance, service and repairs to Andover HVAC Control Systems in various County Buildings in an amount not to exceed $75, from February 18, 2017 to February 17, This Contract is awarded without public advertising for bids pursuant to N.J.S. 40A:11-5(1)(dd), as the service provided by Contractor is for support and maintenance of proprietary hardware and software systems related to existing HVAC control systems installed in the County and as such is an exception to the Local Public Contracts Law. Further, this Contract is awarded consistent with the fair and open provisions of the Gloucester County Administrative Code and with N.J.S.A. 19:44A-20.4 et seq., which exempts this Contract from competition because Vendor has certified that it has not previously made and will not make a disqualifying contribution during the term of the Contract. Finally, this Contract is for estimated units of service in accord with hourly rates identified in Vendor s proposal. F-6 RESOLUTION AUTHORIZING A CONTRACT WITH HARRING FIRE PROTECTION, LLC, FROM FEBRUARY 18, 2017 TO FEBRUARY 17, 2019 IN AN AMOUNT NOT TO EXCEED $40, PER YEAR. This Resolution awards a Contract to Harring Fire Protection, LLC with offices at 748 Cains Mill Road, Williamstown, NJ for annual inspections and maintenance of water/sprinkler systems in various County buildings. County buildings containing Ansul Fire Suppression Systems will also be maintained and inspected as part of this Agreement. This Contract extends from February 18, 2017 to February 17,

5 February 15, 2017 Page in an amount not to exceed $40, per year with the County having the option to extend the Contract for one (1) two (2) year period or two (2) one (1) year periods as per PD F-7 DEPOSIT RESOLUTION PROVIDING FOR THE TRANSFER OF PHYSICAL CUSTODY, BUT NOT LEGAL CUSTODY OF CERTAIN PUBLIC RECORDS TO THE GLOUCESTER COUNTY HISTORICAL SOCIETY. The intent of this agenda request is to renew a Deposit Agreement with the Gloucester County Historical Society, as the current agreement expires in March of The purpose of this agreement is to clarify that Gloucester County has legal custodianship (ownership) of the historical records, while the historical society is the holding agency only, entrusted with the physical custody of the records. A deposit agreement is mandatory per State Administrative Code. DEPARTMENT OF HEALTH & HUMAN SERVICES FREEHOLDER JEFFERSON FREEHOLDER BARNES G-1 RESOLUTION AUTHORIZING SIX (6) GRANT AGREEMENTS TO PROVIDE PROGRAMS AND SERVICES FROM JANUARY 1, 2017 TO DECEMBER 31, This Resolution authorizes the execution of six (6) Grant Agreements, awarded by RFP , for the provision of various programs and services, from January 1, 2017 to December 31, 2017, as follows: (1) Gloucester County Division of Transportation Services, for provision of Non-Emergency Medical Transportation (Agreement No. 003) in an amount not to exceed $40,940.00; (2) Gloucester County Division of Transportation Services, for provision of Blind/Visually Impaired Transportation (Agreement No. 035) in an amount not to exceed $11,600.00; (3) Gloucester County Division of Transportation Services, for provision of Escorted Transportation (Agreement No. 060) in an amount not to exceed $30,326.00; (4) Gloucester County Division of Health, for provision of the Physical Activity, Walking Exercise Program (Agreement No. 008) in an amount not to exceed $4,220.00; (5) Gloucester County Department of Health and Human Services, for provision of the Senior Health Connection Program (Agreement No. 009) in an amount not to exceed $12, and (6) Evergreen Court Adult Day Services, for provision of Adult Day Care (Agreement No. 007) in an amount not to exceed $28, G-2 RESOLUTION AUTHORIZING PUBLIC DONOR AGREEMENT WITH THE ARC GLOUCESTER FROM JANUARY 1, 2017 TO DECEMBER 31, 2017 FOR $22, This Resolution authorizes a Public Donor Agreement with The Arc Gloucester from January 1, 2017 to December 31, 2017 in the amount of $22, This County donation will support social services, specifically, Protective Services for The Arc Gloucester Family Intervention Program. G-3 RESOLUTION AUTHORIZING VARIOUS AMENDMENTS TO INCREASE AND DECREASE CONTRACTS FOR HUMAN SERVICES FROM JANUARY 1, 2017 TO DECEMBER 31, This Resolution authorizes an increase to the contract with Maryville, Inc. by $40, for a maximum contract amount of $243, from January 1, 2017 to December 31, 2017; authorizes a decrease to the contract with SODAT of NJ, Inc. by $10, in an amount not to exceed $18, from January 1, 2017 to December 31, 2017; authorizes a decrease to the contract with Center for Family Services, Inc. by $8, in an amount not to exceed $39, from January 1, 2017 to December 31, 2017; authorizes an increase to the contract with Legacy Treatment Services by $6, in an amount not to exceed $14, from January 1, 2017 to December 31, 2017; and authorizes an increase to the contract with New Hope Foundation, Inc. by $3, in an amount not to exceed $31, from January 1, 2017 to December 31, Old Business New Business Public Portion (time limit of five (5) minutes per person) Adjournment

101 RESOLUTION AUTHORIZING APPLICATION FOR A MATCHING FUNDS GRANT FROM NEW JERSEY GREEN ACRES PROGRAM IN THE AMOUNT OF $50, FOR PROJECTS AT SCOTLAND RUN PARK WHEREAS, the New Jersey Department of Environmental Protection Green Acres Program ( State ), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition, development, and stewardship of lands for outdoor recreation and conservation purposes; and WHEREAS, the County of Gloucester desires to further the public interest by obtaining funding in the amount of $100,380.49, in the form of $50, matching grant and, if available, a $0 loan, from the State to fund the following project(s): Scotland Run Passive Recreation which will expand recreational and educational opportunities at Scotland Run Park to County residents at a cost of $100,380.49; NOW, THEREFORE, the Gloucester County Board of Chosen Freeholders resolves that Robert M. Damminger or the successor to the office of Freeholder Director is hereby authorized to: a) Make application for such a loan and/or such a grant, b) Provide additional application information and furnish such documents as may be required, and c) Act as the authorized correspondent of the above named application; and WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; WHEREAS, the applicant is willing to use the State s funds in accordance with such rules, regulations and applicable statutes, and is willing to enter into an agreement with the State for the above named project; NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE Gloucester County Board of Chosen Freeholders 1. That the Freeholder Director of the Gloucester County Board of Chosen Freeholders is hereby authorized to execute an agreement and any amendment thereto with the State known as Scotland Run Passive Recreation; 2. That the applicant has its matching share of the project, if a match is required, in the amount of $50,190.25; 3. That, in the event the State s funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project; 4. That the applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project; and 5. That this resolution shall take effect immediately.
