This information can be accessed at http ://montgomerycountymd. grani cus.com/generatedagenda Vi ewer. php?view id =169&event id= State legislation introduced through February 1, 2018 related to H.R. 1 (Tax Cuts and Jobs Act of 2017), see page numbers Statewide bills for discussion: HB Traffic Control Signal Monitoring Systems - Duration of Yellow Signal (4-Second Act) (Delegate Korman) The bill requires that traffic control signals display a yellow light that is at least 4 seconds in duration before turning to a red signal. 2 Montgomery County Council Re: Third Winter Update February 5, 2018 Page 2 HB Department of Agriculture - Agritourism (Chair, Environment and Transportation Committee (By Request - Departmental - Agriculture) This bill defines agritourism as an activity conducted on a farm that is offered to a member of the general public or invited guests for the purpose of education, recreation or involvement in farm operation. The bill enumerates 10 activities as examples of agritourism. The list includes farm tours, hayrides, pick your own produce, and classes related to agricultural products or skills. House Bill 252 enables a local jurisdiction to adopt the definition by local ordinance, resolution, law, or rule. HB 326 / SB Public Health - Overdose and Infectious Disease Prevention Supervised Drug Consumption Facility Program (Delegates Morhaim, Anderson, Angel, Barron, Barve, Brooks, Cullison, Dumais, Fraser Hidalgo, Frick, Frush, Gibson, Gutierrez, Hayes, Hettleman, Hill, C. Howard, Korman, Lafferty, Lam, J. Lewis, Lierman, A. Miller, Moon, Morales, Queen, Robinson, Stein, Tarlau, Turner, and K. Young; Senators Feldman, Manno, and Mathias) This bill would allow for a community-based organization to establish a drug consumption facility after approval from the Maryland Department of Health and the local health department. The drug consumption facilities would allow drug users to consume pre-obtained drugs at their locations, as well as monitor for overdoes and administer rescue medications such as naloxone, provide needle exchange services, and provide services or referrals to services for substance abuse counseling, HIV testing, and other relevant overdose and infectious disease prevention strategies. HB 396 I SB Local Government - Agricultural Land Preservation Fee (Delegate Luedtke; Senator Middleton) This is a statewide bill that authorizes a county to impose an "agricultural land preservation fee." This bill was requested by the Montgomery County Agricultural Land Preservation Board. The Board would like the County to impose a $5-10 tax on all property owners in the County and dedicate the revenues to agricultural land preservation. The County Attorney believes that Montgomery County already has legal authority to impose this kind of tax. The issue of whether to create such a tax is a policy question at the local level for Montgomery County and not a taxing authority issue at the State level. However, many other counties do not have the same broad taxing authority as Montgomery County and would need new authority before imposing such a tax.

Local bill for discussion: MC Montgomerv County-Residential Leases-Just Cause Eviction (Delegate Wilkins) This bill would require landlords in Montgomery County to renew residential leases on substantially similar terms, unless the landlord has just cause to not renew a lease. The bill enumerates 11 just causes for eviction. Renewal of substantially similar terms would include, for example, rental rate and lease duration. 5. H.R. 1 did not repeal the personal exemption but did set it at zero. HB 365 has a hearing scheduled for February 7, 2018, in the Ways and Means Committee. SB 184 was voted out of the Budget and Taxation Committee and is pending before the full Senate. HB 587 / SB 194- Calculation of Taxable Income - Itemized Deductions -Property Taxes (Delegates Krebs, Afzali, Arentz, Aumann, Carozza, Ciliberti, Corderman, Hornberger, Jacobs, Kipke, Kittleman, Long, Malone, Mautz, McComas, McConkey, W. Miller, Rose, Saab, Shoemaker, Szeliga, and West; Senators Serafini, Bates, Cassilly, Eckardt, Edwards, Hershey, Hough, Jennings, Norman, Reilly, Salling, Simonaire, and Waugh) The bill allows an individual to increase the amount of itemized deductions used to determine Maryland taxable income by the amount of certain real or personal property taxes paid by that individual and not allowed as part of the individual's itemized deductions. HB Individual Income Ten: - Itemized Deductions on State Income Tax Returns (Delegate Afzali) The bill allows an individual to itemize deductions to compute Maryland taxable income whether or not the individual itemizes deduction on the individual's federal income tax return. For single and joint filers, the filer may itemize on the Maryland return if the filer was eligible to itemize on a federal return at least $6,300 (single) and $12,600 (joint). HB 697 has a hearing scheduled for February 21, 2018, in the Ways and Means Committee. HB 644 -State Income Ta.Y: - Subtraction Modification - Elementary and Secondary Education Expenses (Delegates Lam, Ebersole, and Turner) The bill disallows a subtraction modification for purposes of calculating Maryland adjusted gross income for elementary or secondary education expenses as described in Section 529(c) of the Internal Revenue Code. HB 644 has a hearing scheduled for February 21, 2018, in the Ways and Means Committee. HB 131 I SB 650-Income Tax Subtraction Modification - College Savings Plan Accounts - Contributions (Delegate Korman; Senators King, Feldman, Guzzone, Kagan, Lee, Manno, Peters, Robinson, Young, and Zucker) The bill increases from $2,500 to $5,000 the amount of the Maryland subtraction modification allowed for contributions to certain college savings plan accounts, subject to federal adjusted gross income limitations. HB 131 had a hearing in the Ways and Means Committee on January 31,

6 SB Income Ta.,\: - Standard Deduction - Alteration (Senators Serafini, Bates, Eckardt, Edwards, Hershey, Hough, Jennings, Norman, Ready, Reilly, Salling, Simonaire, and Waugh) The bill increases the maximum standard deduction allowed in order to compute Maryland taxable income to $7,500 for an individual and $10,000 each for a head of household and a spouse on a joint return. SB 318 has a hearing scheduled for February 21, 2018, in the Budget and Taxation Committee. HB Income Ta.,\: - Standard Deductions (Delegates Gilchrist, Barve, Beidle, Lafferty, Lisanti, Luedtke, Mosby, and Stein) The bill alters the value of the standard deduction allowed in order to compute Maryland taxable income to $2,000 for an individual and $4,000 each for a head of household and a spouse on a joint return. HB 570 has a hearing scheduled for February 14, 2018, in the Ways and Means Committee. SB Income Ta.,\: Rates - Reductions (Senator Serafini) The bill reduces State income tax rates for Maryland taxable income between $3,000 and $150,000 for single filers and between $3,000 and $225,000 for joint filers. 7 SB 561 -Maryland Estate Tax- Unifled Credit (Senators Manno, Madalena, Pinsky, Ramirez, Smith, and Young) The bill limits the value of the federal unified credit used to calculate the Maryland estate tax to $1,000,000. This credit amount was due to be tied to the same amount excluded for purposes of the federal estate tax by January 1, 2019, which under H.R. 1 will be $11,200,000. 4

8 2018 General Assembly Session Montgomery County Local and Bi-County Legislation Status as of February 2, 2018 Number/Sponsor/Title MC 1-18 (Luedtke) Montgomery County Board of Education Compensation Commission Positions CE: Support CC: Support Description This bill sets up a Montgomery County Board of Education Compensation Commission consisting of five residents appointed by the County Executive and confirmed by the County Council. Under current law, the Board President receives a salary of $29,000. The remaining elected Board members receive a salary of $25,000. The student member receives a $5,000 scholarship. The new Commission is required to study the salaries of all Board members and issue a report to the State delegation every four years, beginning on September 1, The report must include recommendations for appropriate compensation and scholarship levels. The bill requires that the County provide staff support for the Commission. To be eligible to sign this type of agreement, a golf course must be open to the public and located on at least 50 acres of land on which is maintained a regular or championship golf course of at least nine holes. A country club must have at least 100 members who pay annual dues averaging $50 or more, restrict use primarily to members, families and guests, and be located on at least 50 acres of land on which is maintained a regular or championship golf course of at least nine holes and a club house. If the Constitutional Amendment is passed, these types of entities would be assessed at market value.
