1 Minutes of the meeting of the North Lafourche Conservation, Levee & Drainage District, Wednesday, November 19, 2014 A regular monthly meeting of the North Lafourche Conservation, Levee and Drainage District was called to order by Board Vice President George Broussard, Sr., in the absence of Board President Cory Kief, at 5:00 PM. The meeting was held at the District s Office at 627 Jackson Street, Suite A in Thibodaux. Broussard led the assembly in the Pledge and Rev Nolan Smith led in the Invocation. The Vice President called roll. Commissioners present were: Timothy Allen, Louis Andolsek, George Broussard Sr., J. Daniel Clement, Kenney Matherne and Rev Nolan Smith. Cory Kief was absent and two (2) seats are vacant. Others present were NLLD Executive Director Dwayne Bourgeois; NLLD Administrative Assistant Madonna Viguerie; NLLD Field Coordinator Glenn Bourgeois; Attorney Pat Amedee; and Consultant Lori LeBlanc; various engineering professionals and public. Motion was made by T. Allen, seconded by L. Andolsek, to approve the Minutes of the following meetings of October 22, 2014 Lockport to Larose/Valentine E/Gheens Committee, October 22, 2014 Finance & Priority Committee, October 22, 2014 Regular Board, and November 3, 2014 Lockport to Larose/Valentine E/Gheens Committee. No discussion or public comment. Motion passed unanimously. The meeting was then turned over to the Director to address regular session items. A. Thibodaux West Project Area: St. Louis Canal Improvements: The Director reported that T. Baker Smith has been looking into a CEA with Terrebonne Parish and working on scheduling meetings with land owners for land rights. Acadia Woods Drainage: The Director reported that T. Baker Smith has completed the definitive report on Acadia Woods Drainage and is moving forward with preparing the bid package for the cleaning of the ditch between Plater and Hale Drive which was determined to be the only practical project to benefit the area. Andree, from T. Baker Smith, reported that they are looking for the drainage servitude. B. Thibodaux Lockport Bayou Blue Project Area: Bayou Blue Hollywood Backwater Flood Protection Project: The Director reported that this large project will prevent high storm water elevations in the Hollywood Canal from backing into the subdivisions on the Lafourche side of LA316 from the intersection of LA 316 and Prospect Extension northwest to the intersection of the Bayou Blue By Pass Road and the Hollywood Canal. Land along the Burma Road and the land west of the Grand Coteau Ridge will also be protected as will subdivisions that cross the Hollywood Canal to the east (Over 1,800 residences, numerous businesses, and nearly 7,000 citizens.) This project was selected for this year s Capital Outlay request because of its high ranking in the NOPET evaluation. Discussions with the District s legislative delegates took place prior to submittal of the Capital Outlay request, and communications continue with the legislative delegation to get this funded. St. Charles By Pass Backwater Flood Protection: The District is working with Duplantis Design Group on formulating a project to prevent repeated backwater flooding into this community. David Boudreaux, from DDG, reported that the surveys were delayed. Contact has been made with two of the major land owners of this project area. He added that brief packets were provided to the land owners with general information. After reviewing, they should call to setup meetings. Thibodaux, Culvert Extensions West of Bayou Lane: The Director reported that the Certificate of Substantial Completion was accepted at the August meeting and the Clear Lien Certificate was provided to Leonard Chauvin Inc. Leonard Chauvin, from Leonard Chauvin, P.E. Inc., reported that all of the punch list items were taken care of and all looks good. He recommended payment of the final invoice from KCR Contractors in the amount of $36, Motion was

2 Page 2 of 7 made by K. Matherne, seconded by L. Andolsek, to approve payment of the final invoice from KCR Contractors, Inc. as recommended by the project engineer. Commissioner Matherne inquired if the city officials has inspected. Chauvin stated that the city has been maintaining the area and the NLLD Director added that they haven t heard anything negative on the project. No public comment. Motion passed unanimously. Thibodaux, Culvert Installations along Bayou Lane: Reported above. Thibodaux, Culvert Installation within Peltier Park: Reported above. Thibodaux, Audubon Avenue Drainage Improvements: The Director stated that as a result of the Thibodaux, East 7th Street Drainage study, Leonard Chauvin, P.E. Inc. determined that there is a need for the replacement of some miss matched culverts and catch basins (about 600') along Audubon Avenue from Menard to near Babbington Hall on NSU. A final report will be provided prior to execution of the work. Chauvin reported that the plans are 99% complete and they are waiting to hear back from the city on sewer conflicts. C. Lockport Larose Project Area Lockport Larose Valentine Area Reach C Levee Project: John Plaisance, from J. Wayne Plaisance, Inc., reported that the Parish continues to work on the tie in at the back of the Plaisance property. Lockport Larose Valentine Area Levee Project, Reaches C4, C5, and D1: The Director explained that this project would strive to develop a stable levee with a 7.5 foot finished elevation that can be maintained for the next years. The public informational meetings were held in Lockport and Larose on October 8 th and 9 th and since then, an additional mail piece went to all physical addresses in the project area to provide some clarifying information and another information packet was mailed to all of the impacted land owners that were identified in the project area with considerably more information as requested during the presentations. The LtoL/ValE/Gheens and Legal/Development committees each met before this meeting to review a drafted right of way document for this project area. They will be reporting on that during the committee reports. Edna Barrios Pump Consolidation Project: The Director reported that this project is awaiting approval from the State, then the Lafourche Parish Council. Continuity of Levee at Allied Shipyard (Reach D4): The Director reported that the Certificate of Substantial Completion was accepted at this Board s August meeting and the Clear Lien Certificate was provided to J. Wayne Plaisance, Inc. John Plaisance, from J. Wayne Plaisance, Inc., reported that all of the punch list items were taken care of and he is recommending the acceptance of a balancing change order in the amount of $19, to match the material used and the added time for weather. He also recommended the board approve payment on the final invoice in the amount of $42, to close the books on this project. Motion was made by K. Matherne, seconded by T. Allen, to approve a change order to Sealevel Construction, Inc. as recommended by the project engineer. No discussion or public comment. Motion passed unanimously. 3 Page 3 of 7 Weak / Low Levee Sections Valentine to Larose: The Director reported that CPRA is in receipt of the copies of the invoices needed to issue reimbursement; however, there is a paperwork issue on CPRA s end and communications continue with Jerome Zeringue. Company Canal South Bank, Second Lift & Armoring Project: Andree Cortez, from T. Baker Smith, reported that the contract document with Beverly Construction Co., LLC is in the Parish s hands and a pre construction meeting will be scheduled upon execution of the contract. Lockport to Larose Levee Project Reach D2 Project: Private Arceneaux Pump Station east to Larose Pump Station at GIWW. The Director reported that the preliminary report to resection the levee to 6.5 was received from Picciola and Associates and he is in discussion with CPRA for funding assistance. Lockport Church Street Ditch Clearing Project: The Director reported that LPDD#1 agreed to extend their engagement with J. Wayne Plaisance, Inc. to develop the project to bid for segments A B and B C. He added that the bids were opened on November 6, The low bid was submitted by Beverly Construction Co. LLC of Bridge City in the amount of $209, The LPDD#1 would like to have a CEA in place between them, our District for our $200K commitment, and the town of Lockport for their commitment of $15K before issuing the notice to proceed. The Legal/Development Committee reviewed the CEA and they will report on their findings during their committee report later on tonight s agenda. D. Choupic Project Area: West Choupic Storm Water Protection Project: The Director reported that Leonard Chauvin, Inc. is working to determine a proposed levee alignment. Leonard Chauvin reported that they have the elevation data, maps prepared and options sketched for review by the NLLD Director. Bayou Onion Maintenance Dredging Project: The Director reported that the Certificate of Substantial Completion was accepted at this Board s August meeting and the Clear Lien Certificate was provided to Leonard Chauvin, Inc. He added that the maintenance dredging work is still scheduled to begin after the Volvo buggy completes the work at Little Clotilda. Leonard Chauvin, from Leonard Chauvin, P.E. Inc., reported that there were no punch list items and everything is in order on this project. He recommended payment of the final invoice from Sealevel Construction, Inc. in the amount of $20, Motion was made by J. Clement, seconded by L. Andolsek, to approve payment of the final invoice from Sealevel Construction, Inc. as recommended by the project engineer. No discussion or public comment. Motion passed unanimously. 80 Arpent Canal Clearing, Caldwell to Laurel Valley Project: Leonard Chauvin, from Leonard Chauvin, Inc., reported that the Permit application is in the final stages and will be submitted to the permit chief for signatures. Chauvin added that any conditions would be added to the plans and then submitted to the state for approval, as is required with the $1.1M state appropriation. North Thibodaux Drainage Improvements, Phase A: The Director stated that this drainage project, requested by the City of Thibodaux, seeks to eliminate recurring drainage issues in North Thibodaux. After meeting with Mayor Eschete, David Waitz Engineering will work on redefining the scope of the project to avoid the relocation of the ditch that caused the unresolved servitude issue with the landowner. There was no one present from David Waitz Engineering to provide an update.

4 Page 4 of 7 E. St. James Project Area: 80 Arpent Canal Project: Previously reported with the same project in the Choupic Project Area. Thibodaux, Rienzi Canal Maintenance Dredging Project and Thibodaux, Rosedown Canal Maintenance Dredging Project: The Director reported that these projects were requested by the City of Thibodaux to make drainage improvements in the adjacent areas. He added that after this board s approval of the revised 2014 Budget last month, the district moved forward with contracting Byron E. Talbot Contractor, Inc. for the work. David Boudreaux, from Duplantis Design Group, reported that the Rienzi portion is complete, and the Rosedown portion is probably three (3) days from completion. He added that the contractor is taking half the time estimated and there have been no complaints from the land owners. F. Lake Bouef Watershed Project Area: Bayou Bouef School Forced Drainage Project: The Director reported that this project received an appropriation of $105K in HB No. 2; however, it did not make it to the Bond Commission and must be resubmitted as a Capital Outlay Request. Zeller/Larousse Forced Drainage Area Systems Improvement: The Director reported that the District was unsuccessful in the request for the balance of the funds through this year s Capital Outlay Request; therefore it was submitted again. The District is coordinating with CPRA on an agreement for the $1M received from CPRA to work on Phase 1A (clearing encroachments and dredging the reservoir) of this project. Leonard Chauvin, PE, reported that his office is working on the permits. G. Gheens Project Area: Company Canal Project: The Director reported that the maintenance dredging portion of this project was completed in May. Mathews Canal Project: The Director reported that the CAT buggy is nearing the Gheens Road in the maintenance dredging of the Mathews Canal. Little Clotilda Pump & Levee Project: The Director reported this small project is to address the backwater in this area that threatens the Gheens Road from time to time. After meeting with the landowner and John Plaisance, PE, the Volvo buggy is working to make some repairs to the existing levee so the area can be de watered. Glenn Bourgeois, NLLD Field Coordinator, added that the pump should be there soon and the landowner will dewater the area. Des Allemands Bulkhead Project and Des Allemands Breakwater Project: The Director reported that All South Consulting Engineers, LLC had provided reports on these projects and it is likely that the project area committee will consider these projects for recommendation to the Board. H. Valentine East Project Area: Rita Pump District: The Director stated that the District framed up a small clearing and levee rehabilitation project along the Company Canal south bank to improve backwater flood protection for the community within the budgeted amount for the area. The Director added that the District is looking at the bulkhead at the pump station. When the levee height is increased, this bulkhead, which is already bowing under stress, will be the weak spot. A meeting took place with the Parish to discuss the intentions of the District and the Parish granted clearance to move forward. I. Equipment: Glenn Bourgeois, NLLD Field Coordinator, reported that the CAT buggy had an issue with the bucket ram. A part broke and scarred the cylinder. It is non repairable. A barrel

5 Page 5 of 7 was ordered and the machine should be running for half the cost of new cylinder at $9, The Volvo buggy is completing the reroute ditch from dredging Mathews Canal. After completion, service is needed with coolant, oil sensor and relay on A/C before moving it to Bayou Onion. J. General Items Photo Presentation: The Director presented photos taken by Glenn B., NLLD Field Coordinator, of various projects in the District, including the following: pump canal at Mathews Canal; LtoL Reach C at Edna end of borrow canal, the Director reported that the Parish is digging outside of the servitude by their own doing and there will be a discussion on that; Mathews Canal; Rienzi project, the Field Coordinator reported that the contractor just took out a little bit of the muck in the grass and hauled it off; Rosedown project. Facility for NLLD: The Director reported that the purchase closing for the building located at 3862 Highway 1 in Raceland was transacted on October 28th. A Locksmith has already going in and rekeyed the locks. Things will be moving on this as quickly as possible. Lafourche Parish Government: The Parish has provided NLLD with a draft of a proposed Cooperative Endeavor Agreement intended to replace the three Cooperative Endeavor Agreements that are in place with the Parish for the District s Equipment. This document has been directed to the Legal/Development Committee for their review and consideration. DoA Corps Permit for reaches K&L of Morganza to the Gulf: The District was asked to compile a letter to the South Lafourche Levee District (identical to one the Terrebonne Levee District prepared) in support of the permit, and more specifically the mitigation for Reaches K&L. The NLLD is looking to provide resources (equipment) for in kind work on the proposed mitigation for the project. In the past, a lot of self mitigation has been done and there was never a need to provide an assurance that the work would get done. The Corps wants the assurance this time and the SLLD agreed to do the assurance of the $470K. The letter to the SLLD is to not committing funds; only the District s equipment for in kind work. Other Meetings this Month: The Director stated that besides the regular monthly meeting circuit, NLLD was represented at the following significant meetings since the last board meeting: LAMP LLPT Meetings 11/19: FEMA LAMP meeting process. WOTUS Meetings 10/31 & 11/17: Meeting with staff from Senator Landrieu s office concerning specific action on WOTUS. Testified at a special meeting of the LA Senate Natural Resources Committee in Baton Rouge, explaining how the WOTUS rule could negatively impact the district and residents of our parish. The NLLD signed a resolution on this last month and the NLLD was thanked for the work on these issues. The Director expressed thanks to LA Senators Bret Allain, Norby Chabert, and Gary Smith who represent the District and are members of the Senate Natural Resources Committee for bringing State attention to this issue. The NLLD will continue working with federal and state leaders, and other agencies like LA CPRA, Lafourche Parish, and the Association of Levee Boards of LA to oppose the proposed WOTUS rule. Committee Reports: Executive Committee: Vice Chairman G. Broussard stated that this committee did not meet this past month and had nothing new to report.

6 Page 6 of 7 Finance & Priority Committee: Chairman K. Matherne reported that the F&P Committee met on October 22, During that meeting, the Payables report was reviewed for recommendation of acceptance to the full board during the Regular Board meeting that followed. Lockport to Larose/Valentine East/Gheens Project Areas Committee: Chairman G. Broussard reported that this committee met on October 22, 2014 and November 3, These meetings were to review the additional information mail pieces and packets that have since been mailed to landowners in the LtoL Reaches C4, C5, and D1 project area. The committee also met prior to this Board meeting to review the right of way agreement. That resulted in the marked up copy being sent to Legal/Development for review and recommendation to the Board. Legal / Development Committee: Chairman L. Andolsek reported that the Legal/Development Committee met before this Board meeting to consider several items and the two time sensitive items are being addressed. The first was a draft of the right of way agreement received from the LtoL/ValE/Gheens PA s Committee for the impacted landowners in the area of the Lockport to Larose Project, Reaches C4, C5, and D1. The recommendation by the Legal/Development Committee is to approve the agreement as presented and amended, and to instruct the Engineer to begin contacting landowners in pursuit of the Rights of Way. Motion was made by J. Clement, seconded by Rev. N. Smith, to approve the right of way agreement as recommended by the Legal/Development Committee. No discussion or public comment. Motion passed unanimously. The Legal/Development Committee also reviewed a Cooperative Endeavor Agreement concerning the Lockport Church Street Ditch Clearing Project committing up to $200K for the project and it is the committee s recommendation that the Board approve the agreement as presented in the Board s meeting packets as amended in the committee meeting. Motion was made by K. Matherne, seconded by T. Allen, to approve the CEA as recommended by the Legal/Development Committee. No discussion or public comment. Motion passed unanimously. Chairman Andolsek added that other items discussed at that meeting are not as time sensitive and will be addressed in the regular committee report at the next meeting. Fed Hurricane Protection Levee Committee: Chairman T. Allen stated that this committee did not meet this past month and had nothing new to report. Thibodaux Lockport Bayou Blue/Thibodaux West Project Areas Committee: Chairman K. Matherne stated that this committee did not meet this past month and had nothing new to report. Revenue/Audit Committee: Chairman J. Clement stated that this committee did not meet this past month and had nothing new to report. Choupic/St.James/Lake Bouef WS PA Committee: Chairman J. Clement stated that this committee did not meet this past month and had nothing new to report. The Vice President called for any other engineering reports; there were none. The Vice President then called for other Public Comments; there were none. The Vice President announced that the next Regular Board Meeting was re scheduled to Tuesday, December 16, 2014 at the NLLD office at 627 Jackson Street, Suite A in Thibodaux. A motion was made by J. Clement, seconded by K. Matherne, to adjourn the meeting. Motion passed unanimously and the meeting was adjourned at 5:42 PM.
