3 ORDINANCE O2010 OCTOBER 13,2010 AN ORDINANCE AMENDING THE PERMANENT ANNUAL APPROPRIATIONS ORDINANCE (ORDINANCE 52010) FOR THE VILLAGE OF BOSTON HEIGHTS FOR THE YEAR 2010 AND DECLARING AN EMERGENCY BE IT ORDAINED by the Council of the Village of Boston Heights, Summit County, State of Ohio: SECTION 1: The Permanent Annual Appropriations for the Village of Boston Heights (Ordinance 52010) for the year 2010 are hereby amended to reflect any and all changes necessary to balance the account within each fund as needed. There is no exhibit presented due to the undetermined amount of the changes needed. SECTION 2: That the ClerkTreasurer of the Village of Boston Heights is approved to make any changes necessary to comply with the regulations of the Auditor of the State of Ohio. The ClerkTreasurer is also authorized to recertify any excess revenues with the Summit County Auditor's office for the above mentioned amendments to the appropriation Ordinance SECTION 3: That the ClerkTreasurer of the Village of Boston Heights is approved to transfer $5, from the General Fund to the Park Fund for the payment of the necessary expenditures through the rest of the year. SECTION 4: That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section of the Ohio Revised Code. SECTION 5: That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and the daily operations of the municipal departments and shall take effect and be in force from and after its passage. 8 ORDINANCE P2010 OCTOBER 13, 2010 AN ORDINANCE AMENDING CHAPTER OF THE CODIFIED ORDINANCE TO PROVIDE FOR THE APPOINTMENT TO THE POSITION OF OFFICE CLERK, REDEFINING THE POSITION, AND DECLARING AN EMERGENCY BE IT ORDAINED by the Council of the Village of Boston Heights, County of Summit and State of Ohio: Section 1: That Title Five Administrative, Chapter 131, Section of the Codified Ordinances of the Village of Boston Heights is hereby amended to provide as follows: Office Clerk (c) Were the position of the Office Clerk to become vacant, for any reason, during the oneyear term of appointment, the Mayor may appoint a person to serve as Office Clerk for the remainder of the current oneyear term. At the option of the Mayor, and if such a vacancy occurs after the second Wednesday of July, the term can include both the remainder of the current oneyear term and the following year's oneyear term. Any of the aforementioned appointment options chosen by the Mayor must be confirmed by Council for the term of that appointment. If for any reason the Mayor does not act to appoint an Office Clerk to fill such vacancy within thirty (30) days, or if for good reason Council does not confirm the Mayor's appointee, Council may appoint an interim clerk to fill the office of Office Clerk and to perform all the duties of such office until such time as the Mayor makes an appointment, which is confirmed by Council for the term of that appointment The present Section (c) shall become Section (d). The present Section (d) shall become Section (e) Section 2: That this Council hereby finds and determines that all formal actions relative to the adoption of this Resolution were taken in an open meeting of this Council and that all deliberations of this Council which resulted in formal action were taken in meetings open to the public, in full compliance with the applicable legal requirements including Section of the Ohio Revised Code. Section 3: That this Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare of the Village of Boston Heights, and for the further reason that the daily business of the Village needs to continue on as usual. WHEREAS, the Village of Boston Heights is in need of a replacement for the position of the fulltime Office Clerk, and WHEREAS, the Mayor's recommendation is to move to fulltime the existing Assistant Clerk of Courts, Kathleen Cole. NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Boston Heights, County of Summit and State of Ohio: Section I: That Mayor's recommendation to appoint Kathleen Cole, as a Level (1) one Office Clerk for the Village of Boston Heights is hereby accepted, effective on October 13, 2010 and shall continue until December 31, Section 2: That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section of the Ohio Revised Code. 11 RESOLUTION FF 2010 OCTOBER A RESOLUTION ACCEPTING THE AMOUNTS AND RATES AS DETERMINED BY THE BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX LEVIES AND CERTIFYING THEM TO THE COUNTY FISCAL OFFICER AND DECLARING AN EMERGENCY The Council of the Village of Boston Heights, Summit County, Ohio, met in regular session on the 13th day of October, 2010 at the office of Council with the following members present: Janet Miller, Ron Fenn,, Scott Foss, Dawn Blakeney, Frank Baxter, Don Polyak, Carol Zeman and Mayor Bill Goncy. 14 Ohio Department of TAXATION JOURNAL The Honorable John Donofrio Summit County Fiscal Officer Ohio Building 175 South Main Street, Suite 400 Akron, Ohio Date: AUG Entry Number: Re: Approval of Extension for the Summit County Budget Commission to Complete its Work The Tax Commissioner, upon consideration of the application filed by the County Auditor, as secretary of the county budget commission, on August 25, 2010, for an extension of time beyond the statutory date of September first to complete its work, as provided by Revised Code section , finds that the extension of time is necessary and approves October 8, 2010, as the dale within which such work shall be completed, pursuant to Ohio Revised Code section (last para.). The Tax Commissioner also extends the October first deadline contained in Ohio Revised Code section for the political subdivision to authorize the necessary tax levies to the auditor by the same number of days that the extension to certify rates is granted by this entry. Accordingly, the political subdivision must authorize the necessary tax levies to the auditor by November 8, 2010, since November 7, 2010 is a Sunday. 15 SUMMIT COUNTY BUDGET COMMISSION CERTIFICATION OF TAX LEVY (O.R.C. Sections & ) Please use the information provided on the front page to adopt a resolution accepting the amounts and rates as determined by the Budget Commission and authorizing the necessary tax levies and certifying them to the Summit County Fiscal Officer. Estimated yields on the front page are AD Valorem Property Taxes (based upon value). Included are the following State of Ohio tax relief programs because they are based upon value, 10% reduction in all real property that is not used in a business activity, 2.5% reduction in the homeowner's real property, and the homestead exemption reduction. Starting July 2, 2007, the Homestead Exemption became available to all Ohio homeowners regardless of income, who are either age 65 or older or permanently and totally disabled. The homestead exemption change is the result of House Bill 119, which was signed into law by Governor Ted Strickland on June 30, 2007 Therefore, for your information an estimate of your rollback and homestead payment from the State of Ohio is 12% to 18% of your Res/Ag real estate yield. House Bill 66 passed by the 126th General Assembly of the Slate of Ohio phases out the lax on tangible personal property of general businesses, telephone and telecommunications companies The tax revenue from general businesses was phased out at the end of collection year 2008 The tax on telephone and telecommunication companies, which were reclassified to tangible personal property rather than public utility property have a unique phase out schedule The remaining assessment percentage on telephone company property was 5% in 2010 and 0% in The bill also introduced a mechanism lo reimburse local governments for the property tax losses incurred by directing a portion of the revenues from the newly created Commercial Activities Tax to the Local Government Property Tax Replacement Fund During the hold harmless period ( ), all taxing authorities will be fully reimbursed relative to prior law for revenue lost due to the taxable value reductions. During the years , reimbursements for qualifying levies will be phased out. The information on the front page does not include the following State of Ohio property tax replacement reimbursement money, which is not based upon current assessed values, and is being phased out based upon varying schedules; public utility electric and gas deregulation reimbursement money, and tangible personal property tax elimination reimbursement money. 18 RESOLUTION HH2010 October 13,2010 A RESOLUTION AUTHORIZING THE CHIEF OF POLICE OF THE VILLAGE OF BOSTON HEIGHTS TO ENTER INTO AN AGREEMENT WITH THE SUMMIT COUNTY OVI TASK FORCE FOR 2010/2011 TO REDUCE THE NUMBER OF ALCOHOL AND DRUG RELATED CRASHES AND DECLARING AN EMERGENCY. BE IT RESOLVED by the Council of the Village of Boston Heights, County of Summit and State of Ohio: Section 1: That the Chief of Police of the Village of Boston Heights is here by authorized to enter into an agreement with the Summit County OVI Task Force for a period beginning October 1, 2010 through September 30, 2011 to reduce the number of alcohol and drug related crashes, said agreement is attached hereto as Exhibit "A" and incorporated herein by reference.
