4 5. MOTION: Authorize $100 for Stern/Fazio Senate District 27 Debate and Ballot Measures Discussion to be held on Thursday, October 26, 2016 at the Rose Goldwater Community Center in Canoga Park. To be cohosted with SW Valley NCs, League of Women Voters, NOW, and American Association of University Women. Pooled funds will pay for room rental, refreshments, and outreach. Each NC will receive table space and logo placement on outreach materials. Vendor is American Association of University Women Pulled by Wayne from Encino, asked ENC to request LWV ask question about business experience of candidates. MOTION: Authorize up to $750 payable to Music Theatre International to secure for the Encino Community Center theatre program the rights to produce Beauty and the Beast. Bailey wanted to know if it's for a class and if the tickets will be free George indicated she understands that the class will have a fee and the tickets will have a $10 fee Bailey said in that case, this violates the funding rules and doesn't think the Council should support this because it'll end up looking foolish if they commit to the Community Center that the ENC will cover this, and then have to apologize and walk that commitment back when the Department [of Neighborhood Empowerment] doesn't let the payment go through. If the class and or the event were free we could do this, but since there's a fee both to participate in and attend this play it's not going to work. Cohen: I feel this is a waste of money, while he thinks it'll draw people to our table, he doesn't think it'll bring people to the auditorium George: Photos will have info on the photos they'll be taken home Shovlowsky: as chair of outreach committee let me tee this up a bit, a lot of people don't know we even exist, as Eliot mentioned, it will draw people to our booth, we'll follow up on the photos with hand-delivered motions Eshelman: What else is our presence for Taste of Encino? Shovlowsky: we bought a booth, we'll be next to CM Koretz, volunteers staffing, and we ll have a new flier Rosen: do we have bags to hand out? Esterle: this is an opportunity for us to capture s because we'll be ing the photos to the people Levinson: did you apply for a booth with electricity? Shovlowsky: yes we did Cohen: $1500 is a waste of money with all the interesting NPGs we could Eshelman: I think it's a good idea, we have no visibility Kelson: have you heard of Party Print? A booth is very Rosen: if we are capturing contact info, that's worth a fortune Silver: does anyone know how many people attend TOE, of those how many visit our booth? Levinson: 10,000 attend, I'm not sure how many people visit the booth George: if there are 10,000 people a lot more people will Wayne From Encino: what about Starbucks giftcards? Guest Speaker - Shawn Bayliss, CD 5 Director of Planning Shawn will speak on the Home Sharing Ordinance, Second Dwelling Unit Ordinance, and other recent Planning and Land use items of interest. -BMO/BHO Bayliss : number of policies going on with regards to housing, we have the Baseline Mansionization Ordinance (BMO), throughout the city the typical lot is R-1, say about 2,700 Sqft but there were all there exemptions that allowed people to max out lot uses and creating this box like effect where people were overlooking their neighbors' Currently the Encino ICO is in progress, for a while we didn't hear until March about McMansions from Encino, Encino is currently not covered by the BMO or BHO You can build 45% of your lot, except for garages, if the garage is in the rear of the lot you get 400 sqft but if it's in front you only get 200 Sqft The goal for all these issues will be something out of PLUM and planning Silver: this group voted for an ICO a BMO and a BHO, that went to your office, but you're telling us that never got to your boss, and the protection Sherman Oaks has doesn't cross Sepulveda? Bayliss: I m not sure, I wasn t in the office at the time. Billik: as a follow-up to silver's Question, what happened to that effort out of the ENC? Bayliss: I'm not sure, I wasn't in the office at the time. But we only have 4 planning staff, any staff we put on the Encino ICO is a person we take away from the BMO and BHO regulations we're trying to finish. SO was just ahead of Encino in that process of applying for an ICO -SDUs (granny flats) Second Dwelling Units All computer files were wiped when Koretz took Office Bayliss: state said we need more affordable housing or at least more housing and they said all jurisdictions need to allow SDUs, local jurisdictions and restrict them, but they can't make them discretionary, SDUs used to require CUPs, but the new laws made that impossible, must be outside the hills. -Currently there have only been 300 permits since we took office in various staging of getting a C of O. CM Koretz, Ryu and Martinez are opposing the ordinance, they're saying that if the discretionary portion is the problem, let's strip that, and leave the rest in place, just get rid of the CUP Process Bailey: this item was it in council yesterday, but it got kicked to August 31st, why is that? Bayliss, I'm not sure about that, probably they felt more adjustments were needed. -Home sharing New ordinance allows for 180 days, we're pushing back against half the year or allowing a second home as well Bailey: the difference between a residential zone and a hotel is that you are under 30 days, I don't have a problem with people renting out rooms in houses for long term rentals, but the short term uses pose a problem, also people sometimes use houses for party houses Bayliss: you didn't ask if I knew about party houses, we are party house central in this district, that's why we pushed for the ACE program
7 Silver: let's talk about the taxes, what benefit is there in legalizing and taxing Home Sharing? Bayliss: there's definitely a school pushing permission, and charging transit occupancy tax and such Eshelman: if we don't adopt this, what is the fallback position? Bayliss: the fallback position is defaulting to state which is basically nothing. Henry: so, isn't something better than nothing, can't we fix it later? Bayliss: something is definitely better than nothing, but it takes a while to fix these things, as you have all felt. George: If we vote FOR the motion we are voting AGAINST the regulations being proposed Eshelman: Substitute Motion: This Council supports the Home Sharing ordinance as written, and request that AIRBnB and other companies assist with enforcement. Silver: I'd like to submit another substitute motion that rejects city-wide adoption, but allows it as based on planning areas Bailey: the point of a substitute motion is not to override the motion put forth by committee. These such rentals under 30 days are NOT legal currently, and if you don't want to support the position taken by the motion, don t vote for it. MOTION: The Encino Neighborhood Council urges the City Council to not adopt the Home Sharing Ordinance (CPC CA) proposal and consider the following general comments: The Home Sharing Ordinance does not include enforcement and cooperation of AirBnB and other similar companies.
