With what shall I come before the Lord and bow myself before God, our highest. He has showed you, immortal, what is good and what does the Lord require of you, but to do justice, to love kindness and walk in company with your God. Render true judgments, show kindness and mercy to one another. Do not oppress the widow, the orphan, the alien or the poor, and do not devise evil in your hearts against one another. Let us pray. We pray You so to guide and bless the members of the New York State Assembly now gathered that they may enact such laws as shall please You, and further the dignity and welfare of all the peoples of this State. Grant, Oh God, that Your holy and life-giving spirit may so move every human heart, and especially the hearts of this Assembly. That barriers which divide us may crumble, suspicions disappear, and hatred cease; that our divisions may be healed and that we may live in justice and peace. We pray this through God, our creator. MORELLE: Good morning, Mr. Speaker, colleagues. Thank you so much for your cooperation yesterday. I'm looking forward to a great day and a productive day today. I would encourage members who are still sort of making their way over to the Chamber to do that so that we can begin our deliberations. And while we're waiting, Mr. Speaker, let me perhaps regale you with a couple of notes from history on this day. For instance, on this day in 1972, five men were arrested for breaking into the Democratic National Committee headquarters at the Watergate Hotel in Washington. Investigators tied the men to individuals connected to the White House, and two enterprising Washington Post 2

3 reporters, Bob Woodward and Carl Bernstein, uncovered evidence of illegal political espionage. Although President Nixon won a landslide reelection in November, public support for him quickly faded as more details emerged regarding the scandal. Facing near certain impeachment by the House, President Nixon became the first and only American President to resign from office on August 9th, On this day in 1856, the Republican National Convention was held for the first time in Philadelphia, Pennsylvania. The Convention shows John Fremont of California as the Presidential nominee of the party, and a former U.S. Senator named William Dayton as the party's first candidate for vice-president. The election marked the end of the Whig Party, replaced by the Republicans, as one of the two major political parties in American politics. One other sidenote, the candidate who came in second in balloting for the vice presidential nomination, Abraham Lincoln of Illinois, who, four years later, would become the first Republican ever elected to the White House. And finally, in 1885, the Statute of Liberty, a gift of friendship from the people of France to the people of America, arrived in New York Harbor after being shipped across the Atlantic in 350 individual pieces, packed in more than 200 cases. Reassembled, Lady Liberty stands 305 feet tall, weighs 450,000 pounds, and though originally copper-colored, is now adorned in the very familiar greenish-blue hue. In 1892, Ellis Island, located next to Liberty Island, opened as America's chief immigration station, and for the next 3

4 62 years, Lady Liberty stood watch as more than 12 million immigrants sailed into New York Harbor. Inscribed inside the wall of the pedestal are poet Emma Lazarus' now-famous words: "Give me your tired, your poor, your huddled masses yearning to breathe free." The Statute of Liberty remains one of New York's and one of America's most famous and enduring landmarks, a symbol of freedom and democracy. That should inspire each of us as we continue our work before us in the final week of the 2014 Legislative Session. Let me describe a little bit of how Tuesday, at least, will work relative to that schedule. Members have on their desks a main Calendar and a debate list. We will begin our work today by continuing to consent bills on the main Calendar, starting on page 12, Rules Report Nos. 236 through 239. We will continue then to page 16, Rules Report Nos. 283 through 344, and we will continue to work off the debate list. Members should note we will be calling a number of committees. And again, members, those members who serve on these committees should pay particular attention to them as they're called off the floor. We will begin in a short while with the Rules Committee. We will then, at various points, call the Veterans' Affairs, Real Property Taxation, Election Law, Transportation, Codes and Ways and Means. These committees will produce additional calendars, which we will also take up today. Majority members should note that there will be the need for a Conference at some point during our work this afternoon. 4

5 So, with that as a general outline, Mr. Speaker, I note that there are introductions. We could take that up. And as soon as we dispense, we can do whatever housekeeping you may have as well. Good morning. It is my pleasure to introduce today the priest who gave the invocation, Father Howard K. Williams, who is the Rector of St. Augustine Episcopal Church, which is in my district in Brooklyn, East Flatbush, Brooklyn, New York. Father Howard has been a priest for quite sometime. Although I'm not a member of the church, he does treat me as a member. I guess I'm still owing my tithes, Father. St. Augustine is a very important religious institution and part of the foundation of the community. At St. Augustine, we 5

6 have a Boy and Girl Scout program, which has generated 15 Eagle Scouts in four years and five leaders who have received the Wood Badge. This church has been doing well enough to also be able to fund several community programs, including senior citizens programs and after-school homework help centers. Father Williams has been a priest since 1999, when he was first appointed by Bishop Walker as an interim priest. Accompanying Father Williams this morning are three members of the congregation: Rita Fray, who is a lay Eucharist Minister; Claudia Titus, who is a member of the Willing Hands Special Project in the Church; and Marc Anthony Schuyler -- I don't know if I said that wrong -- but he is a Eucharist designer and a member of the Property Committee. And by the way, the Property Committee seems to be doing quite well. The Church's assets have been growing, and I know that's good for the community. Mr. Speaker, I ask that you welcome these visitors to our Chamber today, and that you offer to them all of the cordialities of the House on our behalf. And we thank you, Father Williams, for your very inspiring invocation. ACTING SPEAKER AUBRY: Thank you, Mr. Perry. Ms. Weinstein on the same subject. MS. WEINSTEIN: Yes, Mr. Speaker. I would like to join with Mr. Perry in welcoming Father Williams here to the Chamber. As you heard, St. Augustine is an integral part of the East 6

7 Flatbush community, and I particularly have enjoyed the services where the community takes time out to, in a packed church, to honor the first responders, the police officers who serve our community. It's a very joyful occasion and one that's much appreciated by both the community and the police. It's just one indication of some of the good work that happens and generates from St. Augustine. I'm pleased to join in welcoming you here today. ACTING SPEAKER AUBRY: Certainly. On behalf of Mr. Perry, Ms. Weinstein, the Speaker and all the members, Father Williams, we welcome you here to the New York State Assembly. And to your guests, we also welcome you. And congratulations on having such a vibrant church in these communities. Thank you for the service that you provide. (Applause) Mr. Goodell for the purpose of an introduction. MR. GOODELL: Thank you very much, Mr. Speaker, for allowing me to interrupt our proceedings. We have a couple of very special guests today. Jeffrey Hoffman is joining us. Mr. Hoffman is one of our nation's top new baseball pitchers. He easily pitches in the 90-mile-plus range, with a wicked curve ball. He's ranked nationally and just went through the draft, where he was selected ninth in the nation. He was the first-round draft pick for the Toronto Blue Jays, which gives me special pleasure since Toronto is 7

8 one of the nine capitals that's closer to my house than Albany. Accompanying Mr. Hoffman is another special guest, Marissa Reinhart. She is a senior at South Carolina, where Mr. Hoffman was a student before being drafted by the Toronto Blue Jays. I have been following Mr. Hoffman's career very closely, because his mother is my Chief of Staff here in Albany. So, as a result, whenever there's a big game at South Carolina, not only was I obligated to wear purple, but all the Assemblymen on that half of the floor were required to wear purple. So, on behalf of Assemblyman Tom McKevitt, myself, Assemblyman Ed Ra, Assemblyman Dave DiPietro, Assemblyman Ray Walter and Assemblyman Mark Johns, all the Assemblymen who were required to wear appropriate colors whenever Mr. Hoffman pitched, I would ask that you extend the cordialities of the House. And if we are back next year, I suspect we'll be wearing Toronto Blue Jay colors, whenever they pitch as well. Thank you, Mr. Speaker. ACTING SPEAKER AUBRY: Certainly. WHEREAS, Recovery Month promotes the societal benefits of prevention, treatment, and recovery for mental and substance use disorders, celebrates people in recovery, lauds the contributions of treatment and service providers, and promotes the message that recovery in all its forms is possible; Recovery Month spreads the positive message that behavioral health is essential to overall health, that prevention works, treatment is effective and people can and do recover; and WHEREAS, September 2014 marks the 25th observance of National Recovery Month and the third observance of Recovery Month in the State of New York; and WHEREAS, The observance celebrates people in recovery and lauds the work of treatment providers, while emphasizing that behavioral health is an essential part of health and one's overall wellness; additionally, Recovery Month exemplifies that all individuals have the fundamental and inherent value to be accepted and treated with respect, dignity, and worth and is designed to help people understand that treatment for mental and substance use disorders is effective and people do recover; and WHEREAS, According to the 2011 National Survey on Drug Use and Health (NSDUH), published by the U.S. Department of Health and Human Services, Substance Abuse and Mental Health Services Administration (SAMHSA), in 2011, an estimated 22.5 million Americans aged 12 or older were current (past month) illicit 10

11 drug users, meaning they have used an illicit drug during the month prior to the survey interview; and WHEREAS, This estimate represents 8.7 percent of the population aged 12 or older; and WHEREAS, Illicit drugs include marijuana/hashish, cocaine (including crack), heroin, hallucinogens, inhalants, or prescriptive-type psychotherapeutics (pain relievers, tranquilizers, stimulants, and sedatives) used nonmedically; and WHEREAS, Recovery Month helps to highlight the numerous paths to recovery and the wide range of services available to people living with mental and substance use disorders; and WHEREAS, Recovery Month supports many of SAMHSA's Strategic Initiatives, particularly the goals of increasing public awareness of mental and substance use disorders, health reform implementation, and offering recovery support through an individual, program, and system approach; and WHEREAS, Coordinated by SAMHSA, the 2014 Recovery Month observance emphasizes the many ways that people can prevent behavioral health issues, seek treatment, and sustain recovery as part of a commitment to living a mentally, physically, emotionally, and spiritually healthy life; and WHEREAS, Each event seeks to unite a range of stakeholders in taking action, including individuals in the recovery community and their families and friends; policymakers and community leaders; judges; insurers; health professionals; treatment 11

12 providers; educators/schools; community-based and faith-based organizations; the criminal justice system; diverse racial, ethnic and cultural groups; and members of the media; and WHEREAS, Recovery from substance abuse and mental disorders touches nearly everyone and every community; and WHEREAS, Sponsored by the Substance Abuse and Mental Health Services Administration (SAMHSA) within the U.S. Department of Health and Human Services, Recovery Month inspires millions of people to become better educated about recovery; it also encourages individuals to share their stories of recovery and assist others who are struggling with substance use and mental disorders; and WHEREAS, The observance of Recovery Month helps to emphasize the importance of educating policymakers, health care providers, employers, and the general public about the role of treatment and recovery support services; and WHEREAS, Recovery Month is also a reason for people to celebrate; it honors the millions of people who have sought or are currently seeking treatment and recovery services for substance use and mental disorders for themselves or a loved one; and WHEREAS, Recovery Month educates New Yorkers about the fact that addiction treatment and mental health services can enable those with a mental and/or substance use disorder to live a healthy and rewarding life and lauds the gains made by those in recovery from these conditions, just as we would commend those who 12

13 are managing other health conditions such as hypertension, diabetes, asthma, and heart disease; and WHEREAS, Recovery Month, in addition, spreads the positive message that behavioral health is essential to overall health, prevention works, treatment is effective, and people can and do recover; and WHEREAS, Recovery Month highlights individuals who have reclaimed their lives and are living happy and healthy lives in long-term recovery and also honors the prevention, treatment, and recovery service providers who make recovery possible; and WHEREAS, Recovery Month promotes the message that recovery in all its forms is possible and also encourages citizens to take action to help expand and improve the availability of effective prevention, treatment, and recovery services for those in need; and WHEREAS, The observance of Recovery Month emphasizes that while the road to recovery may be difficult, the benefits of preventing and overcoming behavioral health conditions are significant and valuable to individuals, families, and communities; it has become a year-round initiative which supports educational outreach and celebratory events throughout the year; and WHEREAS, Recovery Month promotes the societal benefits of prevention, treatment, and recovery for substance use and mental disorders, celebrates people in recovery, lauds the contributions of treatment and service providers, and promotes the message that recovery in all its forms is possible and spreads the positive message 13

Cuomo to proclaim September 27, 2014 as Family Health & Fitness Day in the State of New York. WHEREAS, Saturday, September 27, 2014 has been declared National Family Health & Fitness Day; and WHEREAS, Family Health and Fitness Day USA is a nationwide health and fitness event for families with the purpose of increasing good health awareness and promoting family involvement in physical activity; family related health and fitness events will be held at local organizations such as health clubs, schools, houses of 14

15 worship, park districts, hospitals, YMCAs/YWCAs, malls and other community locations; and WHEREAS, The United States Surgeon General has determined that regular physical activity results in significant health benefits and improved quality of life; and WHEREAS, Thirty-seven percent of adults report they are not physically active; only three in 10 adults get the recommended amount of physical activity and only one in 10 women get the recommended amount of physical activity prescribed by the Surgeon General; and WHEREAS, Moderate daily physical activity can substantially reduce the risk of developing or dying from cardiovascular disease, type 2 diabetes, and certain cancers, such as colon cancer; daily physical activity helps to lower blood pressure and cholesterol, helps prevent or retard osteoporosis, and helps reduce obesity, symptoms of anxiety and depression, and symptoms of arthritis; and WHEREAS, Physical activity among children and adolescents is vitally important because of the related health benefits, including cardio respiratory function, blood pressure control, weight management and cognitive and emotional benefits; and WHEREAS, The New York State Legislature affirms its commitment to take a leadership role in urging all its citizens to support the efforts of local organizations that encourage families to enhance their lives through physical activity; and 15

16 WHEREAS, It is most appropriate that this great Empire State recognize Family Health & Fitness Day in the State of New York; now, therefore, be it RESOLVED, That this legislative Body pause in its deliberations to memorialize Governor Andrew M. Cuomo to proclaim October 11, 2014 as Pulmonary Fibrosis Day in the State of New York. WHEREAS, Pulmonary Fibrosis is a disease of the lungs which occurs when lung tissue becomes damaged and scarred; when the tissue around the air sacs in the lungs thickens, it is more difficult for oxygen to pass into the bloodstream, causing those with pulmonary fibrosis to become progressively more short of breath; and WHEREAS, Scarring associated with pulmonary fibrosis can be caused by many factors making it difficult for doctors 16

17 to pinpoint the specific cause of the problem, and in most cases the cause is never found; when a definite cause cannot be found, the condition is termed Idiopathic Pulmonary Fibrosis (IPF); and WHEREAS, A lack of clinical understanding of IPF often leads to misdiagnosis, and it is estimated more than 50 percent of IPF patients may be initially misdiagnosed delaying treatment and the ability to perform adequate clinical trials; and WHEREAS, It is estimated approximately 130,000 Americans have IPF although there are published estimates suggesting the number may be as high as 200,000; and WHEREAS, IPF is found in equal proportions in urban and rural environments but affects more men than women; the median age at time of diagnosis is approximately 63 years old; and WHEREAS, Researchers have several theories on the causes of IPF including viruses; exposure to tobacco smoke; airborne toxins in the workplace such as silica dust, asbestos fibers, grain dust, bird and animal droppings; certain lung diseases; and even some types of medical treatments; since IPF often runs in families, heredity is also believed to play a role; and WHEREAS, The lung scarring that occurs in pulmonary fibrosis cannot be reversed and no current treatment has proved effective in stopping the progression of the disease although some treatments may improve symptoms temporarily or slow the disease's progress; and WHEREAS, Lung transplantation may be the option 17

18 of last resort for patients with severe IPF; and WHEREAS, Robert "Chip" Hamilton, a distinguished and profoundly loved civic leader in the Town of Peru, Clinton County, died on January 27, 2011, following a valiant battle with IPF including a right lung transplant performed in October of 2010; and WHEREAS, Chip's family is sponsoring a half-marathon and a 10K in his honor to be held on October 11, 2014, to raise money for research to assist in the diagnosis and treatment of IPF; and WHEREAS, It is imperative there be greater public awareness of this serious health condition, and more must be done to encourage research and activity at the State, local and national levels to support the patients as well as their families; now, therefore, be it RESOLVED, This this legislative Body pause in its deliberations to memorialize Governor Andrew M. Cuomo to proclaim October 11, 2014, as Pulmonary Fibrosis Day in the State of New York; and be it further RESOLVED, That copies of this Resolution, suitably engrossed, be transmitted to The Honorable Andrew M. Cuomo, Governor of the State of New York, and to the family of Robert "Chip" Hamilton. ACTING SPEAKER AUBRY: On the resolution, all those in favor signify by saying aye; opposed, no. 19 request of Ms. Rosenthal. Legislative Resolution memorializing Governor Andrew M. Cuomo to proclaim November 2014 as Pancreatic Cancer Awareness Month in the State of New York. WHEREAS, The State of New York takes great pride in participating in months designated to raise awareness of important issues; and WHEREAS, November 2014 will be observed as Pancreatic Cancer Awareness Month to create awareness of pancreatic cancer, the fourth-leading cause of cancer death among men and women in the United States; and WHEREAS, Pancreatic cancer has the lowest relative survival rate of all the cancers tracked by both the American Cancer Society and the National Cancer Institute; and WHEREAS, 74 percent of pancreatic cancer patients die within the first year of their diagnosis and only 6 percent survive more than five years; and WHEREAS, Every year over 46,000 people will be diagnosed and over 39,000 people will die of pancreatic cancer in the United States; that means approximately one in every 72 men and women born today will be diagnosed with pancreatic cancer in their lifetime and over 2,000 New York residents yearly will die from the disease; and WHEREAS, There has been no significant improvement in survival rates in the last 40 years and pancreatic 19

20 cancer research is still in the earliest scientific stages; and WHEREAS, The number of new pancreatic cancer cases and the number of deaths caused by the disease are increasing; the expected number of new pancreatic cancer cases is projected to increase by 55 percent between the years 2010 and 2030; and WHEREAS, When symptoms of pancreatic cancer generally present themselves, it is often too late for an optimistic prognosis, and the average survival rate is only five to seven months; and WHEREAS, People of Eastern European Jewish and African-American descent are diagnosed at a higher frequency than the rest of the population; and WHEREAS, Additional risk factors include, but are not limited to: Smoking, obesity, recent on-set diabetes, family history of pancreatic cancer and pancreatitis; and WHEREAS, Pancreatic cancer research is currently severely underfunded as compared to other cancers with similar mortality; it is urgent that we focus on this matter; now, therefore, be it RESOLVED, That this legislative Body pause in its deliberations to memorialize Governor Andrew M. Cuomo to proclaim November 2014 as Pancreatic Cancer Awareness Month in the State of New York, and to urge its citizens to educate themselves about pancreatic cancer and the need for research funding, early detection methods, effective treatments, and prevention programs; and be it further 20

21 RESOLVED, That a copy of this Resolution, suitably engrossed, be transmitted to The Honorable Andrew M. Cuomo, Governor of the State of New York. He also happens to be the head of the New York State Brewers Association. He is joined in the Chamber by Nick Irvine, who is the facilities manager at Empire Brewing here at Armory Square in Syracuse. We are delighted to have them in the Chamber. I know they're interested in observing the proceedings and are guests of Mr. Magee, and I wanted to make sure we extended the cordialities of the House and the greetings, and thank them for being here this morning.
