1 March 19 & 20, 2012, Emmett, Idaho Pursuant to a recess taken on March 13, 2012, the Board of Commissioners of Gem County, Idaho, met in regular session this 19th day of February, 2012, at 8:00 a.m. Present: Sharon Pratt Lan Smith Michele Sherrer Leandra Rountree Chairman Commissioner Commissioner Deputy Clerk Whereupon the following proceedings were had, to-wit: March 19, 2012 The Pledge of Allegiance was said. INDIGENT HEARING : At 10:00 a.m. a motion was made by Commissioner Smith, seconded by Commissioner Sherrer and carried unanimously to go into executive session under Idaho Code (1)(d) for indigent matters with a roll call vote as follows: Commissioner Sherrer, aye, Commissioner Pratt, aye, and Commissioner Smith, aye. The applicant and Deputy Clerk Diane Wright were sworn in. Regular session reconvened at 10:19 a.m. A motion was made by Commissioner Smith to suspend the application until we get all the information needed and place it on the weekly Indigent updates. It was seconded by Commissioner Sherrer and carried unanimously. INDIGENT APPLICATIONS: At 11:14 a.m. a motion was made by Commissioner Smith, seconded by Commissioner Sherrer and carried unanimously to go into executive session under Idaho Code (1)(d) for indigent matters with a roll call vote as follows: Commissioner Pratt, aye, Commissioner Sherrer, aye, and Commissioner Smith, aye Medical Application Non-Medical Application Notices of Liens Notices of Liens

2 After reconvening in regular session at 11:28 a.m. a motion was made by Commissioner Smith to deny not medically indigent; not medically necessary; and not the last resource, deny no emergency exists; non-medical employment requirement not met; and failure to cooperate, and sign statutory and N1 liens as applicable on and It was seconded by Commissioner Sherrer and carried unanimously. The Commissioners recessed at 12:00 p.m. for lunch to reconvene at 1:15 p.m. CONSENT AGENDA: Items on the consent agenda included A. Adopted Budget and Resolutions pertaining to the collections for Water District 65-A, B. Appointment of Tim Vickery to the Zoning Commission, C. Appointment of Michell Schneider to the Planning Commission, D. Property Tax Cancellations on Parcel Numbers RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , RP , and RP , and E. Certificate of Residency for Casey Barton, Caden Banister, Jennifer Downen, Tana Fraser, Kira Hunter, Nicole Welch, and Calli Webb for Junior College Tuition. A motion was made by Commissioner Sherrer to approve items A., B, C., and E. and remove item D. for discussion. It was seconded by Commissioner Smith and carried unanimously. The Commissioners stated that although there is a list of parcel numbers to cancel, they have not received the tax cancellation book and would like to have that information before they approve item D. MINUTES: There were no minutes to review. UNITED STATES BUREAU OF RECLAMATION PARK ALCOHOL ORDINANCE: Doug Goff, Jeff Reavis, and Krystal Clair with the Bureau of Reclamation met with the Commissioners to discuss making changes to the current Black Canyon Park Alcohol Ordinance as well as the Dog Ordinance. They would like to have the ordinance changed to include Wild Rose Park, Cobblestone Park, and Triangle Park. The Commissioners stated that they have not spoken to the Sheriff s Department in regards to enforcement of the ordinance. They stated that they will talk to the Sheriff

3 as well as the Prosecuting Attorney tomorrow and work on getting some additional language added to the proposed Ordinance. JUVENILE DETENTION CENTER YEARLY UPDATE WITH STEVE JETT: Steve Jett and Juvenile Probation Director Janelle Schneider met with the Commissioners to discuss the Juvenile Detention Center. Steve stated that due to the fact that numbers are down, outside counties rates would be raised to $140 per day. This will be starting next fiscal year. At 4:01 p.m. a motion was made by Commissioner Smith, seconded by Commissioner Sherrer and carried unanimously to go into executive session under Idaho Code (1)(d) for indigent matters with a roll call vote as follows: Commissioner Pratt, aye, Commissioner Sherrer, aye, and Commissioner Smith, aye Non-Medical Application After reconvening in regular session at 4:04 p.m. a motion was made by Commissioner Sherrer to deny due to the fact it was a self-created emergency, lack of cooperation, exceeds the allowable rate, and non-medical employment requirements were not met. It was seconded by Commissioner Smith and carried unanimously. The Board recessed at 5:00 p.m. to 8:00 a.m. on March 20, March 20, 2012 The Commissioners attended the Local Emergency Planning Council Meeting at the EMS Building. PUBLIC WALK IN: Tyson Gardner met with the Commissioners in regards to the Island path. He has concerns regarding the condition of the path. He has fallen several times and feels that it is a hazard to people and would like to see it repaired. Commissioner Pratt suggested walking on the pathway on the south side of the river because it is gravel. PROSECUTING ATTORNEY MATTERS: Prosecuting Attorney Dick Linville and Deputy Prosecuting Attorney Tim McNeese met

4 with the Commissioners. At 11:09 a.m. a motion was made by Commissioner Smith, seconded by Commissioner Sherrer and carried unanimously to go into executive session under Idaho Code (1)(b) personnel and (f) potential litigation with a roll call vote as follows: Commissioner Pratt, aye, Commissioner Sherrer, aye, and Commissioner Smith, aye. Regular session reconvened at 11:17 a.m. Commissioners Sherrer and Pratt attended the Annual Farm Bureau Lunch at Toadstools. Commissioner Smith attended the Gem County Community Health Connection Lunch at Walter Knox Memorial Hospital. Chris Williams with the Emmett Little League met with the Commissioners to provide an update on little league. ADULT PROBATION ANNUAL UPDATE DISHION ENTERPRISES: Wade Dishion met with the Commissioners to provide an annual update for Adult Probation. Case load, case closures, probation violations, community service, SILD, and absconded cases were reviewed. He also reviewed the County treatment programs as well as fine payments. Wade questioned if Gem County would have available room in the Juvenile Probation facility to allow them some office space. The Commissioners stated they would like to accommodate in any way possible. Arrangements were made with Sheriff Rolland for space in the jail office. HAWK HUSTLE FUN RUN/WALK REQUEST FOR MAY 5, 2012: Joanne Webb, Margaret Castle, and Teresa Dean met with the Commissioners to discuss the Hawk Hustle scheduled for May 5, Joanne explained that it is a fundraiser for Shadow Butte Elementary. Commissioner Smith questioned if there will be people directing traffic at the corners. The race is scheduled for May 5, 2012 to begin at 10:00 a.m. Commissioner Smith made a motion to approve the use of county roads pending approval from the Sheriff s office and the Road Department. It was seconded by Commissioner Sherrer and carried unanimously. Approved: Chairman
