Oral Communications A number of the public requested time to speak on Item 22, Los Banos Bypass and Future Funding, when that item was presented. Chair O Banion stated that all who would like to speak would be given an opportunity. Les Palocsay stated that the Los Banos City Council meetings are held at night and he would like MCAG to have their Governing Board meetings at night around 7:00 p.m. 4. Oral Report Citizens Advisory Committee Christiane Traub gave the Citizens Advisory Committee report. 5. Consent Agenda a. Minutes of the February 20, 2014 Regional Waste Management Authority Board meeting b. Agreement with Tuolumne County for the Disposal of Solid Waste at the Highway 59 Landfill Director Davis moved to approve the Consent Agenda. Seconded by Director Oliveira. Ayes Directors Davis, Walsh, O Banion, Oliveira, Espinoza, Villalta, Thurston, Antonetti 6. Oral Report Monthly Update Brooks Stayer gave the monthly update report for Merced County Regional Waste Management Authority. 7. Approval of Capital Project #80019 to Implement Groundwater Corrective Action Plan Brooks Stayer gave a review of the request for approval of the Capital Project to implement groundwater correction action at the Hwy 59 landfill. Brooks stated that there were minimal amounts of volatile organic compounds and that a corrective action plan was necessary. Director Espinoza moved to authorize: a. Allocation of an additional $537,000 from the Capital Project Fund to Capital Project #80019; b. The Executive Director to sign Amendment #15 to SCS Contract # which will: 1: Increase the contract amount by $316,500; 2. Amend the scope of work as
3 detailed in Attachment #1 to Amendment #15; and 3. Extend the term of the Contract to June 30, 2015; c. SCS Engineers to prepare Drilling and Well Construction Request for Bid and obtain a qualified well drilling company and construct the extraction wells; and d. Authority staff to obtain bids for the electrical, piping and GAC treatment system components from local contractors and return to the Authority Board for authorization to enter into an agreement with local contractors(s). Draft Fiscal Year 2014/15 Operating Budget, Draft Fiscal Year 2014/15 Fleet Budget, and Draft Capital Project Status as of Fiscal Year 2013/14 9. Transit Joint Powers Authority for Merced County Title VI Plan, Public Participation Plan, and Limited English Proficiency Plan Update Director Oliveira moved to approve the final Title VI Plan, final Public Participation Plan and the final Limited English Proficiency Plan. Seconded by Director Espinoza. 7 Marjie Kirn, Executive Director Robin Lamas, Administrative Assistant II Brooks Stayer, Director, Merced County Regional Waste Management Authority At this time Chair O Banion requested hearing Items 22 and 19 out of order. 22. Los Banos Bypass and Future Funding Matt Fell stated that Director Thurston had requested this item be placed on the agenda to discuss the Los Banos Bypass and future funding for the Bypass. Director Thurston stated that with all the changes to the Regional Transportation Impact Fee Program that it may be time to examine how the RTIF is collected and dispersed. Les Palocsay stated he felt the Los Banos Bypass would benefit all of Merced County and it should be called the Merced County Bypass around Los Banos. Adam Cox spoke on funding and stated that now is the time to look for projects that can move forward with any available funding dollars. Gerry Stamback, Los Banos, stated that the Los Banos Bypass was necessary for safety reasons. Kathy Ballod spoke in support of any available funding to go to the Los Banos Bypass. Tom Faria stated that he believed Director Thurston was calling for a re-evaluation of the Regional Transportation Impact Fee Program. Tom stated that Los Banos was not currently collecting full RTIF fees; they are only collecting fees on new housing. The reason they are not collecting fees on new business is because the additional fees discourage new businesses from coming to Los Banos. Robert Sherwood, Los Banos, stated he was opposed to all RTIF fees. Director Villalta spoke on the history of the Los Banos Bypass and funding and the need to keep all dollars promised to the Los Bans Bypass reserved for it. 19. Federal Tiger Grants Funding Availability Matt Fell gave an in depth review of the federal Tiger Grants funding availability. Matt stated that this year s applications are due by April 28, After discussion by the Directors a motion was made and seconded but then rescinded after additional discussion. Director Walsh moved to direct staff to work with the City and County of Merced on an application for Tiger grant funding for Phase II of the Campus Parkway with funding mechanisms stated and to bring this item back to the Board for final approval. Minutes of the February 20, 2014 MCAG Governing Board meeting Director Antonetti moved to approve the minutes of the February 20, 2014 MCAG Governing Board meeting. Seconded by Director Thurston.
