1 Township of Bloomfield Zoning Board Minutes Regular Meeting May 17, 2018 The fifth regular meeting of the Zoning Board of Adjustment of the Township of Bloomfield was held on Thursday, May 17, 2018 with a start time of 7:08 p.m. Chairman Michalski read the following statement: Notice of the time, date, location and agenda of this meeting, to the extent then known, was provided at least forty-eight (48) hours prior to the commencement of this meeting, in the following manner, pursuant to the provisions of Chapter 231 of the Law of 1975 (The Open Public Meetings Act) : 1.) By posting such notice on the bulletin board of the municipal building and 2.) By mailing such notice to the office of the Independent Press, Bloomfield Life, Herald News and the Star Ledger. Roll call showed the following members present: Mr. Moormann, Mr. Sceurman, Ms. Brown, Mr. Balnicki, Ms. Alfreds, Mr. Prince and Chairman Michalski. Also present was the Board Secretary Nicole Cosenza, the Board Engineer Anthony Marucci and the Board Attorney Michael Rubin. Roll call showed the following members absent: The Nishuane Group, Mr. Puno, Mr. Munson and Mr. Debold. Any and all discussion was recorded on audio tapes through the municipality and also through the Bloomfield Township Public Access TV Channel 35. A memorializing resolution was adopted for 62 Main Street, moved by Mr. Sceurman, seconded by Mr. Prince. Minutes of 3/15/18 were approved, moved by Mr. Balnicki, seconded by Mr. Sceurman. Minutes of 3/29/18 were approved, moved by Balnicki, seconded by Mr. Prince. Minutes of 4/12/18 were approved, moved by Mr. Sceurman, seconded by Mr. Prince. A special meeting was scheduled for 6/21/18 at 7 pm, moved by Mr. Prince, seconded by Mr. Sceurman
2 CASE A Application of Ashley Carespodi as Applicant & Owner for bulk variances and any such other relief as may be required from the Zoning Ordinance of the Township of Bloomfield to construct a four foot fence in a front yard on a corner property in a residential one (1)-family R-1A zone on premises known as Map 22, Block 574, Lot 2 better known as 39 Benson Street. + Ashley Carespodi-Owner/Applicant and Anthony Marucci-Board Engineer. A motion was made by Mr. Sceurman to approve this application, seconded by Mr. Moormann. All voting members voted yes on the motion and this application was approved. CASE B Application of Arc Treatment Center as Applicant & Robert Maturo as Owner for an interpretation and/or use variance and any such other relief as may be required from the Zoning Ordinance of the Township of Bloomfield to open a drug treatment and psychological counseling center in a Neighborhood Business B-2 zone on premises known as Map 6, Block 98, Lot 18 better known as Watsessing Avenue. Remaining testimony and discussion regarding the interpretation followed. Brian Aloia-Applicant s Attorney, Michael Pessolano-Applicant s Planner, Michael Rubin- Board s Attorney and Anthony Marucci-in the capacity of Zoning Official. A motion was made by Mr. Prince: 1.) to uphold the interpretation of the Zoning Ordinance from Anthony Marucci as Zoning Official and 2.) to adjourn the use portion of this bifurcated application to the special meeting of 6/21/18, seconded by Mr. Sceurman. All voting members voted yes on the 2 part motion and the Zoning Official s original interpretation was upheld and the use portion was adjourned. CASE C Application of Exclusive Holdings, Inc. as Applicant & Owner for a use variance and any such other relief as may be required from the Zoning Ordinance of the Township of Bloomfield to convert an existing office use into a two (2)-family residential dwelling in a Neighborhood Business B-2 zone on premises known as Map 8, Block 156, Lot 42 better known as 122 Orange Street. A motion was made by Mr. Balnicki to adjourn this application, seconded by Ms. Brown. All voting members voted yes on the motion and this application was adjourned until
3 the next regular meeting of June 14, 2018 at 7:00 p.m. CASE D Application of Broad Street, LLC. as Applicant & Adriana Madrid as Owner for bulk variances, a use variance and any such other relief as may be required from the Zoning Ordinance of the Township of Bloomfield to renovate and construct an addition to the existing structure in a Professional Office/Residential POR zone on premises known as Map 20, block 511, Lots 12 & 20 better known as Broad Street. Some testimony and discussion followed. Robert Gaccione-Applicant s Attorney, Adrianna Madrid-Applicant/Owner, James Kokkalis-Applicant s Architect and Anthony Marucci-Board s Engineer. A motion was made by Mr. Sceurman to adjourn the remainder of this application, seconded by Mr. Balnicki. All voting members voted yes on the motion and this application was adjourned until the next regular meeting of June 14, 2018 at 7:00 p.m. CASE E Application of Happle Children s Fund as applicant & Owner for a use Variance and any such other relief as may be required from the Zoning Ordinance of the Township of Bloomfield to change the use of the first floor from commercial to a residential unit in a residential one (1)- family R-1A zone on premises known as Map 11, Block 252, Lot 19 better known as 328 Belleville Avenue. A motion was made by Mr. Sceurman to adjourn this application, seconded by Mr. Balnicki. All voting members voted yes on the motion and this application was adjourned until the next regular meeting of June 14, 2018 at 7:00 p.m. CASE F Application of Charles Housing, LLC. as Applicant & Owner for bulk variances, a use variance and any such other relief as may be required from the Zoning Ordinance of the Township of Bloomfield to expand the garage and convert a one (1)-family dwelling to a two (2)-family dwelling, in a residential one (1)-family R-1A zone on premises known as Map 37, Block 1021, Lot 2 better known as 387 Broughton Avenue A motion was made by Ms. Brown to adjourn this application, seconded by Mr. Prince. All voting members voted yes on the motion and this application was adjourned until the next regular meeting of June 14, 2018 at 7:00 p.m.
4 CASE G Application of Gary & Pauline Amitrano as Applicants & Owners for bulk variances, a use variance regarding floor area ratio and any such other relief as may be required from the Zoning Ordinance of the Township of Bloomfield to construct a one (1)-story addition in a residential one (1)-family R-1B zone on premises known as Map 29, Block 792, Lot 109 better known as 66 Clark Avenue. Gary Amitrano-Applicant/Owner, Wayne Guskind-Applicant s Architect and Anthony Marucci-Board s Engineer. A motion was made by Mr. Balnicki to approve this application, seconded by Ms. Alfreds. All voting members voted yes on the motion and this application was approved. CASE H Application of Rachel C. Wyatt as Applicant & Owner for bulk variances, a use variance regarding floor area ration and any such other relief as may be required from the Zoning Ordinance of the Township of Bloomfield to construct an attic addition in a residential one (1)- family R-1A zone on premises known as Map 37, Block 1021, Lot 12 better known as 15 Gracel Street. Rachel Wyatt-Applicant/Owner, Robert Forbes-Applicant s Architect and Anthony Marucci-Board Engineer. A motion was made by Mr. Moormann to approve this application, seconded by Mr. Balnicki. All voting members voted yes on the motion and this application was approved. CASE I Application of Cathy Realty, LLC. as Applicant & Owner for bulk variances, a use variance regarding floor area ration and any such other relief as may be required from the Zoning Ordinance of the Township of Bloomfield to construct a front and rear yard addition in a residential two (2)-family zone on premises known as Map 6, Block 101, Lot 4 better known as 63 Charles Street. A motion was made by Mr. Balnicki to adjourn this application, seconded by Mr. Sceurman.
