In an effort to keep the School Board Policy Books updated, members of the administration and the Southeast Tech policy review committee will continually review the policies and regulations for items that need to be added, deleted, revised, or in some cases, to update the language. These policies have been reviewed by administration and the Southeast Tech Policy Review Committee. The following policies are updating language to current practice. Instead, STI shall encourage all students and staff members to appreciate and be tolerant of each other's religious views. STI shall utilize educational opportunities to foster understanding and mutual respect among students and parents, whether it involves race, culture, economic background, or religious beliefs. In that spirit of tolerance, students and staff members shall be excused from participating in practices that are contrary to their religious beliefs unless there are clear issues of overriding concern that would prevent it. Furthermore, STI believes that students are capable of successful learning experiences when instruction is designed to address the full range of their abilities. 4 School Board Governance and Operations School Board Operational Functions The School Board, functioning within the framework of laws, court decisions, attorney general's opinions, and similar mandates from the state and federal levels of government and recognizing the authority of the state, fulfills its mission as the governing body of a political subdivision by acting as follows in the execution of its duties: Enacts policy and shall concern itself primarily with broad questions of policy, rather than with administrative details. The application of policies is an administrative task to be performed by the Superintendent Southeast Technical Institute President and his/her staff, who shall be held responsible for the effective administration and supervision of the entire School District.Southeast Tech. Provides for the planning, expansion, improvement, financing, construction, and maintenance of the physical plant of the DistrictSoutheast Tech. Prescribes the minimum standards needed for the efficient operation and improvement of the DistrictSoutheast Tech. Requires the establishment and maintenance of records, accounts, archives, management methods and procedures incidental to the conduct of school Southeast Tech business. Approves the budget, financial reports, audits, major expenditures, payment of obligations, and policies whereby the administration may formulate procedures, regulations and other guides for the orderly accomplishment of business. Estimates and levies taxes for the operation, support, maintenance, improvement and expansion of the District. Adopts courses programs of study. Provides staff and instructional aids. Evaluates the education program to determine the effectiveness with which Southeast Tech isthe schools are achieving the its educational purpose of the District. Provides for the dissemination of information relating to the schoolssoutheast Tech necessary for creating a well informed public. 6 School Board Governance and Operations School Board Authority and Responsibilities By statute definition the School Board is an elected body created according to the laws of the state to serve as the governing board of a school districtsoutheast Technical Institute for the purpose of organizing, maintaining, and locating schools and for providing educational opportunities and services for all district residents. The chief function of the Sioux Falls School Board is to provide for the progress and welfare of all of the schools under its controlsoutheast Tech, and to establish and maintain the policies which govern its organization and operation. The Board functions only when it is convened in regular or special meeting which has been legally called. An individual Board member has no authority to speak for the Board unless such authority is delegated by the Board. The Board is responsible for formulating policies for the general management of the schools in the DistrictSoutheast Tech. It shall delegate administrative authority to the Superintendent of schoolssoutheast Tech President, but shall be responsible to the people for the results produced. The Board acts as an appraisal body rendering judgment upon recommendations that may come to it through its executive officers, its own members, or the public which concern the progress and improvement of the schools. The Board shall sit as a judicial body when the Superintendent Southeast Tech President requests a hearing or on an appeal for any school Southeast Tech employee, group of employees, or student.

7 NEPN Code: BBAA Page of The Board shall: Select a Superintendent Southeast Tech President of schools who is the chief executive officer of the DistrictSoutheast Tech. Adopt the annual budget for the support of education Southeast Techin the District. Carefully deliberate on all issues to be considered. The majority action of the Board on a given issue should become the policy of the entire Board until such time as the question is again raised for consideration. Act upon recommendations of the Superintendent Southeast Tech President regarding o matters of policy; o appointment, transfer, and dismissal of all personnel.; o selection of courses programs of study; o adoption of salary schedules for all employees of the DistrictSoutheast Tech; o passing upon accounts and audits of the business control of the school; o studying and passing upon the reports of the Superintendent Southeast Tech President and his/her staff; o interpreting the program and representing the needs of the schools institute before the public; and o all other matters pertaining to the welfare of the schoolssoutheast Tech. Individual Members Board members have authority only when acting as a Board legally in session. The Board shall not be bound in any way by any statement or action on the part of any individual Board member except when such statement or action is in pursuance of specific instruction by the Board. The officers shall serve for a one year term. President The president of the Board shall: preside at all meetings of the Board; countersign all checks or warrants drawn by the Sioux Falls School District Business Manager which have been authorized for payment by the Board; sign all contracts or agreements governed by Policy DJ/STI/DJ-R/STI approved by the Board; confer with the Superintendent Southeast Tech President as may be necessary and desirable regarding school institute and related matters; call special meetings of the Board; be entitled to discuss and vote on all matters coming before the Board unless Policy BCB applies; be the primary spokesperson for the Board; and appoint all committees requiring School Board participation. Vice President The vice president of the Board shall assume the duties and responsibilities of the president in his/her absence. 10 SIOUX FALLS SCHOOL DISTRICT SOUTHEAST TECHNICAL INSTITUTE Policies and Regulations School Board Governance and Operations NEPN Code: BDD Board-Superintendent Southeast Technical Institute President Relationship It is the primary responsibility of the School Board to formalize the educational ideals, values, and goals of the community into concepts of policy and to see that these are translated into actual practice by the Superintendent Southeast Tech President and his/her staff. The Board believes that the most effective way of fulfilling its responsibilities to the patrons of a dynamic, growing District technical institute is through close cooperation and teamwork between the Board and SuperintendentPresident. The roles of the Board- Superintendent President leadership team are essential to the success of the entire DistrictSoutheast Tech. The Board-Superintendent President team has an obligation to provide educational leadership within the DistrictSoutheast Tech. The Board-Superintendent President team must always function at a high professional and ethical level focusing on the goals to be achieved and the policies to be implemented by the Superintendent President and/or his/her designee. As the legally designated governing body, the Board retains final authority. within the District. Yet, the Superintendent President is the Board's professional advisor to whom the Board delegates executive responsibility. It is essential that each recognizes, respects and supports each other's area of responsibility. To help clarify this shared responsibility, the following operating principles are adopted: The Superintendent President shall be the chief administrator of the DistrictSoutheast Tech and be directly responsible to the Board for the total administration of the DistrictSoutheast Tech. The Board will not assume the administrative function, but will vest in the Superintendent President executive authority to carry out these administrative responsibilities. Important school institute matters requiring Board action will be presented by the Superintendent President to the Board in a responsible manner. The Superintendent President is expected to inform the Board of important District Southeast Tech related matters in a timely fashion. The Board expects the Superintendent President to bring important items requiring Board action to the Board as well as other items that are properly within its legislative function, or those that are required by law. Board members will inform the Superintendent President about any schoolinstituterelated questions or concerns that have potential implication for Board deliberation or action which may arise between Board meetings. The Board president and the Superintendent Southeast Tech President will discuss any such question or

11 NEPN Code: BDD Page of concern to determine if the items should be placed on the agenda of a future Board meeting. Board members and the Superintendent President will communicate such matters to each other prior to the meeting to prevent misunderstandings and to promote more efficient, businesslike meetings. Individual Board members, in the normal course of interacting with the schools institute and community, may seek information on non-personnel matters or receive information from employees, parents/guardians, students or community members about District Southeast Tech related matters. If the information raises questions or concerns requiring a response from administration, the Board member shall discuss the information directly with the SuperintendentPresident. The SuperintendentPresident/designee is responsible for responding directly to the constituent. The responsibility for selection, placement, suspension, or dismissal of District Southeast Tech personnel is vested in the Superintendent President subject to approval by the Board as required by law. All Board decisions and communications affecting employees will be issued by the Superintendent President through regular administrative channels. The Superintendent, as the executive officer and professional advisor to the Board, will endeavor to develop ways of serving the community and of keeping parents/guardians, patrons, and taxpayers informed of school programs through activities based on a continuing information policy. The Board will take action on items and issues properly before the Board only after consultation and upon recommendation by the SuperintendentPresident. However, the Board recognizes its legal responsibilities for the operation of the District, and may revise or reject the Superintendent's President s recommendations on any item or issue. The President of the School Board shall authorize payment to the Superintendent President for reimbursement of expenses of the Superintendent President while conducting school business as submitted to the Finance Office in accordance with Finance Office practices and procedures. Board members and the Superintendent President will take a positive approach based on cooperation and support in resolving problems and issues which will arise from time to time.

13 School Board Governance and Operations School District Attorney/Legal Services The services of the attorney of the School District shall be available to the School Board and Superintendent Southeast Tech President for legal advice and representation on school institute matters. When specifically requested to do so, the attorney shall attend Board meetings and provide legal advice. 14 School Board Governance and Operations School Board Meetings SIOUX FALLS SCHOOL DISTRICT SOUTHEAST TECHNICAL INSTITUTE Policies and Regulations NEPN Code: BE/STI An official meeting is any meeting of a quorum of the Board Members at which official business of that public body is discussed or decided, or public policy is formulated. The annual meeting of the School Board shall be the organizational meeting of the Board and will be held on the second Monday of July, unless otherwise designated by the Board at the prior regular meeting. Regular meetings are scheduled to occur on the second and fourth Mondayfirst Wednesday of each month unless changed by an action of the Board. The time of the regular meetings will be designated by the Board. Special meetings may be called by the Board president or by the Board vice president in the president's absence or a majority of the Board members. Recessed meetings shall serve as a continuation of a regular or special meeting. Executive or closed meetings shall be held only upon a majority vote of the members of such body present and voting, and discussion during the closed meeting is restricted to the legal basis specified in the closure motion. Executive meetings may be held for the sole purpose of: (1) Discussing the qualifications, competence, performance, character or fitness of any public officer or employee or prospective public officer or employee. The term "employee" does not include any independent contractor: () Discussing the expulsion, suspension, discipline, assignment of or the educational program of a student; () Consulting with legal counsel or reviewing communications from legal counsel about proposed or pending litigation or contractual matters; () Preparing for contract negotiations or negotiating with employees or employee representatives; () Discussing marketing or pricing strategies by a board or commission of a business owned by the state or any of its political subdivisions, when public discussion may be harmful to the competitive position of the business. However, any official action concerning such matters discussed in an executive meeting shall be made at an open official meeting.

16 School Board Governance and Operations Public Participation at School Board Meetings Members of the publicresidents and parents/guardians of students enrolled in the School District have the expressed right and are encouraged to attend meetings of the School Board to listen and observe the deliberations of its members. A Board meeting is a legislative session, a public input session, or a work session. Legislative Session The purpose of a legislative session is to discuss, deliberate and, when appropriate, take action on issues presented to the Board by the Superintendent Southeast Tech President or other Board members. In general, a Board meeting for legislative purposes is not an open hearing on a topic or issue. At a legislative session of the Board there are generally two opportunities to address the Board. The first opportunity is at the agenda item entitled Persons Wishing to Address the School Board and the second opportunity is for Public Input on Agenda Items, which occurs after an action has been presented to the Board but prior to Board discussion of an action or a first or second reading of a policy item listed on the Board agenda. Some legislative sessions include a Public Hearing. This allows a third opportunity to address the Board. Persons Wishing to Address the School Board Non-Agenda Items SIOUX FALLS SCHOOL DISTRICT SOUTHEAST TECHNICAL INSTITUTE Policies and Regulations NEPN Code: BEDH/STI This portion of the agenda is available for individuals wishing to address the Board about a District-Southeast Tech related subject that is not listed on the Board agenda of the meeting at which the person is addressing the Board. An individual wishing to address the Board on a DistrictSoutheast Techrelated issue which is not on the agenda must sign up prior to the start of the meeting with the Business Manager Southeast Tech President or designee and give his/her name, address, and topic about which the person wishes to speak. The speaker is limited to five minutes regardless of the number of subjects the person wishes to cover. If multiple individuals sign up to speak on the same topic that is not an agenda item, total testimony on the topic shall be limited to 1 minutes per side of the issue as determined by the Board President.

17 NEPN Code: BEDH Page of Public Input on Agenda Items Individuals wishing to address the Board regarding an item on the agenda will have an opportunity to do so after the administration has presented the item to the Board but prior to the Board addressing the agenda item. Individuals wishing to address the Board on an agenda item must sign up with the Business ManagerSoutheast Tech President or designee prior to the beginning of the meeting. Each person wishing to speak must give his/her name, address, identify the agenda item and whether he or she will be speaking for or against the item. The Board President may waive the requirement that a speaker must sign up to address an agenda item prior to the beginning of the meeting. However, if the waiver is granted, the speaker must sign up with the Business Manager Southeast Tech President or designee prior to leaving the meeting. Individuals may address the Board for a maximum of five minutes on an individual agenda item. A maximum of fifteen minutes per side of testimony will be permitted per agenda item. If more speakers sign up to speak to an issue than time is available, the Board President may request that each side of the issue select a person or two to speak to each side of the issue. Public Hearing Public hearings are required by State law and Board policy prior to certain actions (e.g. approval of the budget). Individual testimony shall be limited to three () minutes. At the discretion of the Board President, this limit can be extended. The public may address the Board without signing up prior to speaking. Each speaker must state his/her position in a clear, concise manner. The person may ask for clarification on an item. As appropriate, the Board President may authorize a Board member or the administration to clarify the issue. Public Input Session Public input sessions are scheduled by the Board exclusively to receive information on a particular topic in an informal setting. Public input sessions are generally governed by the following guidelines:

18 NEPN Code: BEDH Page of Individual testimony for all persons may be limited at the discretion of the Board President. The public may address the Board without signing up prior to speaking. Individuals are encouraged to ask questions and give suggestions during a public input session. These guidelines may be revised by the Board President to best fit the topic or purpose of the input session. The expectations of the public shall be explained at the beginning of each public input session. Work Session Work sessions are public meetings at which the Board receives detailed information from the administration, other Board members, and invited guests. An opportunity for public input shall be provided under the following guidelines: The opportunity to provide input shall be limited to addressing the Board regarding an item on the work session agenda, excluding committee reports; The public input period shall occur after the Administration has presented its report on the agenda item; Individuals wishing to address the Board must sign up with the Business Manager Southeast Tech President or designee prior to the beginning of the meeting. Each person wishing to speak must give his/her name, address, identify the work session agenda item and whether he or she will be speaking for or against the work session agenda item. Individual testimony shall be limited to three () minutes. At the discretion of the Board President, this limit can be extended. A maximum of six () minutes will be permitted per work session agenda topic. If more speakers sign up to speak to an issue than time is available, the Board President may prorate time accordingly or request the group to select two individuals to speak on the group s behalf. General Decorum for All Types of Meetings * Anyone addressing the Board must give his/her name and address. * The speaker may not give oral complaints regarding District Southeast Tech personnel or personnel actions. 19 NEPN Code: BEDH Page of personnel are to be addressed to the Superintendent Southeast Tech President in private or in writing to the Superintendent Southeast Tech President and Board members in accordance with Policy KEB/STI KEB- R/STI. * The speaker may not offer personal attacks against any individual. * The speaker may not give oral complaints identifying individual students. Complaints regarding individual students are to be addressed to the Superintendent Southeast Tech in private or in writing to the Superintendent Southeast Tech President and Board members in accordance with Policy KE/STI. * The Board President, at his/her discretion, may request the administration or another Board member to respond to a person addressing the Board immediately following the input or may direct the administration to respond in writing. If an individual does not follow the appropriate guidelines for speakers, he or she may be denied the privilege of speaking before the Board. Upon the first violation of the guidelines by an individual, such person s privilege of speaking may be suspended for the remainder of the Board meeting at which the violation occurs. If an individual violates the guidelines a second time, the person s privilege of speaking before the Board may be suspended for the remainder of that meeting and for the next Board meeting. If an individual violates the guidelines a third time, the length of the suspension may be at the discretion of the Board President, but may not exceed one year. Notwithstanding the ability of the Board to suspend an individual s privilege to speak before the Board, that person may always communicate with the Board in writing. 21 SIOUX FALLS SCHOOL DISTRICT SOUTHEAST TECHNICAL INSTITUTE School Board Governance and Operations School Board Policy Process Policies and Regulations NEPN Code: BG The School Board is the legislative body which determines policy for the School District.Southeast Technical Institute. Policies are written statements which express the will and intent of the Board with regard to the operation of the DistrictSoutheast Tech. and the schools therein. These policies guide the Superintendent Southeast Tech President and all District Southeast Tech employees in the day-to-day administration of the DistrictSoutheast Tech. The Board directs the Superintendent Southeast Tech President to establish a schedule to systematically review each Board policy through his/her Policy Review Committee. Proposals regarding District Southeast Tech policies may originate from any member of the public. from several sources: a parent, a taxpayer, an employee, a member of the Board, the Superintendent, a professional consultant, or a civic group. Proposed policy statements, ideas or complaints must be submitted in writing to the Superintendent Southeast Tech President in accordance with Policy KEA/STI Public Concerns/Complaints about Policies. Prior to presenting proposed policy changes to the Board for first reading, the Superintendent Southeast Tech President will research the issues involved, seeking guidance and assistance from staff members and his/her Policy Review Committee. Policy Adoption and Amendment In accordance with Policy KEA/STI, proposals for new policies and suggested amendments to existing policies shall be submitted to the Superintendent Southeast Tech President in writing to be reviewed by the Policy Review Committee and recommended to the Board if applicable. Proposed policies or amendments shall be discussed at a Board meeting under the heading First Reading of School DistrictSoutheast Tech Policies/Regulations. To allow for public input, after the first reading, the suggested policy or amendment will be posted on the District and Southeast Tech websites. Members of the publicdistrict residents or parents/guardians of enrolled students are welcome to make public comment at a Board meeting in accordance with policy BEDH/STI and/or submit a written comment to the Superintendent Southeast Tech President for submission to the Board. In order to be considered by the Board, written comments must contain the name and address of the person or persons submitting them. All comments, either oral or written, will be confined to the contents of the policy or regulation.. One regularly scheduled Board meeting will come between the first reading and the second reading.

22 NEPN Code: BG Page of The nexttwo meetings after the first reading, a second reading and a vote shall take place unless the Board suspends its usual procedure and extends the time for input. If time is extended, the Board must set a specific date at which it will take action. The Board may also choose not to approve new policy or revisions to existing policy. Once policies are adopted or amended the policies shall be placed on the District and Southeast Tech website. Policies and regulations are public documents and are accessible to staff, students, parents, and community members upon request. If a policy inadvertently contains provisions that are in conflict with another policy, the provisions in the policy most recently adopted or amended will govern. If a policy inadvertently contains provisions that are in conflict with a state or federal law, the state or federal law shall govern the District s actions. Reviewed Policies When a proposed revision is not acceptable to the Board, the date on the present language will be changed to reflect the date that the Board reviewed the policy. The Southeast Tech Policy Review Committee may also submit policies to the Board that they have reviewed and feel are still applicable and need no change. Such policies would also indicate the date on which they were reviewed at Board level. This action shows that the District s Southeast Tech s policies are being kept current. Withdrawal of Policy Policies and regulations may be withdrawn by Board action when the policy or regulation is no longer necessary due to changes in statute, when it has become obsolete, or when another policy or regulation covers the material. Recommendations for withdrawal are placed on the consent agenda of one meeting only. Emergency Action upon a Policy In an emergency situation, the Board may suspend the requirement of two readings in order to adopt a new policy, amend a policy, or suspend a policy immediately. Upon written notification of an emergency situation prior to the Board meeting at which the action will take place, a majority of the Board is required to suspend the two reading requirement. If written notice is not given prior to the Board meeting, the two reading requirement may be suspended only by a unanimous vote of all five members of the Board. If the Board exercises this prerogative and the Board adopts a policy or amends a policy, the Board shall direct the Superintendent Southeast Tech President to conduct a detailed review of the adopted or amended policy that was implemented under emergency conditions and to bring an analysis of the policy and appropriate amendments, if necessary, to the Board at the next regularly scheduled Board meeting or as soon as possible thereafter.

23 NEPN Code: BG Page of Regulation Approval and Revision Administrative regulations arise from Board policies and are the more detailed directions that are developed by staff to put policies into practice. The regulations specify how, by whom, where, and when things are to be done. If the Superintendent Southeast Tech President or the Board feels that a a regulation is needed to accompany the policy in order to provide better guidelines for the public or staff, the regulation shall, if possible, be presented at the same time the new or amended policy is being presented for first reading. This should be done in order to provide all parties with a full understanding of the policy and how it will be implemented. No regulation shall exist without an attendant Board policy. On the recommendation of the Southeast Tech Policy Review Committee, proposed or revised regulations shall be placed on a regularly scheduled Board meeting agenda for consideration. A motion acknowledging proposal or revision of a regulation shall be acted on. 24 KE/STI School/Community/ Relations Public Concerns and Complaints Persons wishing to submit official complaints or concerns relating to Southeast Technical Institute, its policies, personnel, programs, or instructional materials should begin at the level closest to the source of the complaint. If a complaint or concern is not resolved initially, it may be referred to the next level in accordance with the appropriate STI Southeast Tech policy (See Related Policies/Regulations listed below). If applicable, appeals to the Southeast Tech President must be presented in writing within ten () calendar days of the lower level decision. After receiving an appeal, the Southeast Tech President will investigate the matter and respond in writing to the complainant within fourteen (1) calendar days. If the Southeast Tech President is unable to satisfy the complainant, the case may be appealed to the School Board. Any appeal of the Southeast Tech President s ruling must be presented in writing to the Southeast Tech President within seven () calendar days of his/her decision. 25 KEA/STI School/Community/ Relations Concerns/Complaints about Policies Southeast Technical Institute recognizes that, from time to time, concerns regarding the development and implementation of STI Southeast Tech policies and regulations may arise. STI Southeast Tech further believes that constructive criticism can assist in improving the quality of the program, and in meeting individual student needs more effectively. STI Southeast Tech also places trust in its employees, and desires to support their actions in a manner that frees them from unnecessary or unwarranted criticism and complaints. The following procedures for dealing with complaints about the content or implementation of STI Southeast Tech policies/regulations shall apply: Public concerns/comments about an STI Southeast Tech policy or regulation that is before the Sioux Falls School Board for review, revision, deletion, or adoption may be expressed orally in accordance with policy BEDH/STI. Written comments or should be addressed to the Superintendent Southeast Tech President for submission to the Board. In order to be considered by the Board, written comments must contain the name and address of the person or persons submitting them. All comments, either oral or written, will be confined to the contents of the policy or regulation. Concerns about a policy or regulation that is not before the Board, or ideas for a new policy/regulation shall be submitted in writing to the Southeast Tech President for submission to the STI Southeast Tech Policy Review Committee in accordance with Policy BG/STI. Within calendar days of the original submission, the Southeast Tech President shall provide the individual(s) submitting the concern/idea with the administrative decision. This decision may or may not result in either creation of a new policy or change to the existing policy/regulation. Any proposed change must be submitted to the Board in accordance with Policy BG/STI. Concerns about the implementation of a policy or regulation should be dealt with by first discussing the concern with the staff person involved. If, for some reason, the concerned individual is not satisfied, he/she should discuss the matter with the following persons in the following order: Program/department supervisor, then the Southeast Tech President s designee. 31 School Board Governance and Operations School Board Authority and Responsibilities By statute definition the School Board is an elected body created according to the laws of the state to serve as the governing board of a school districtsoutheast Technical Institute for the purpose of organizing, maintaining, and locating schools and for providing educational opportunities and services for all district residents. The chief function of the Sioux Falls School Board is to provide for the progress and welfare of all of the schools under its controlsoutheast Tech, and to establish and maintain the policies which govern its organization and operation. The Board functions only when it is convened in regular or special meeting which has been legally called. An individual Board member has no authority to speak for the Board unless such authority is delegated by the Board. The Board is responsible for formulating policies for the general management of the schools in the DistrictSoutheast Tech. It shall delegate administrative authority to the Superintendent of schoolssoutheast Tech President, but shall be responsible to the people for the results produced.
