1 Page 1 of 6 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF LOS ALTOS, HELD ON TUESDAY, AUGUST 23, 2011, AT 7:00 P.M. AT LOS ALTOS CITY HALL, ONE NORTH SAN ANTONIO ROAD, LOS ALTOS, CALIFORNIA ROLL CALL PRESENT: ABSENT: Mayor Packard, Councilmembers Carpenter, Casas, Fishpaw and Satterlee None PLEDGE OF ALLEGIANCE Mayor Packard led the pledge of allegiance to the flag. CLOSED SESSION ANNOUNCEMENT Mayor Packard reported that no action was taken in the closed session meeting. SPECIAL PRESENTATIONS Human Resources/Risk Manager Horta presented the Annual Risk Management Report. Mayor Packard presented a proclamation to John and Jackie Moss recognizing them for their numerous contributions to the City and Community of Los Altos. PUBLIC COMMENTS Marge Suozzo requested funding on behalf of GreenTown Los Altos in the amount of $20,000 for bicycle education programs at Los Altos schools. Los Altos resident Kelly Cook requested removal of No Stopping/No Parking signs located on Carmel Terrace and Altamead Drive near Blach Intermediate School. Los Altos resident Willem De Lange spoke against the installation of a traffic light at Miramonte Avenue and Covington Road, requested removal of No Stopping/No Parking signs located on Carmel Terrace and Altamead Drive near Blach Intermediate School and favored removal of No Through Traffic signs on Gest and Madison Drives in Mountain View. Los Altos resident Robert Otillar raised concerns about removal of trees at 960 North San Antonio Road. CONSENT CALENDAR Councilmember Satterlee pulled item number 9 and clarified item number 13. A member of the public pulled item number 11.
2 Page 2 of 6 Action: Upon a motion by Councilmember Fishpaw, seconded by Mayor Pro Tem Carpenter, the Council unanimously approved the Consent Calendar, with the exception of items 9 and 11, as follows: 1. Council Minutes Approved the revised minutes of the July 26, 2011 regular and August 3, 2011 special meetings. 2. Chapter 6.28 of Los Altos Municipal Code Smoke Free Recreation Areas Adopted Ordinance No repealing Chapter 6.28 of the Los Altos Municipal Code and replacing it with a new Chapter Downtown Opportunity Study Final Environmental Impact Report Affirmed the adoption of Resolution No , as modified and adopted on July 26, 2011, certifying an Environmental Impact Report with a Statement of Overriding Considerations as revised. 4. South Plaza Parking Lots Rezoning Adopted Ordinance No amending Chapter of Title 14 pertaining to rezoning the South Plaza parking lots to Commercial Downtown. 5. Sewer Master Plan Repair, Projects 09-26, and Adopted Resolution No accepting the completion of the Sewer Master Plan Repair, Projects 09-26, and and authorized the Engineering Services Manager to record a Notice of Completion as required by law. 6. Biennial Street Slurry Seal, Project Adopted Resolution No accepting the completion of the Biennial Street Slurry Seal, Project and authorized the Engineering Services Manager to record a Notice of Completion as required by law. 7. Amendments to Chapter 2.08 of the Los Altos Municipal Code Pertaining to City Commissions Generally Adopted Ordinance No amending Chapter 2.08 of the Los Altos Municipal Code to establish the Senior Commission and make other amendments, as necessary, with minor clerical revisions. 8. South San Antonio Road Resurfacing, Project Adopted Resolution No authorizing the City Manager to execute Program Supplement No. N008 to the Master Agreement No R for the South San Antonio Road Resurfacing Project, awarded the Base Bid and Add Alternative Bid Item No. 1 for the South San Antonio Road
3 Page 3 of 6 Resurfacing, Project to Bond Blacktop in the amount of $196, and authorized the City Manager to execute the contract on behalf of the City. 9. Community Center Master Plan Update Pulled for discussion (see page 5). 10. Traffic Signal Controller and Cabinet Replacement, Project and El Monte Avenue Bicycle Lane, Project Adopted Resolution No accepting the completion of the Traffic Signal Controller and Cabinet Replacement, Project and El Monte Avenue Bicycle Lane, Project and authorized the Engineering Services Manager to record a Notice of Completion as required by law. 11. Collector Street Traffic Calming (Fremont Avenue), Project Pulled for discussion (see page 6). 12. City of Los Altos Response to Three Civil Grand Jury Reports Received three Memorandums in Response to Findings and Recommendations to three reports by the Santa Clara County Civil Grand Jury and authorized staff to send said Memorandums in Response to Findings and Recommendations to the Presiding Judge of the Santa Clara County Superior Court. 13. Disposal and Management of Expanded Polystyrene Received a letter from Recycling and Waste Reduction Commission of Santa Clara County (RWRC) and referred the letter with RWRC recommendations for expanded polystyrene (EPS) disposal and management to the Environmental Commission to consider adding to their work plan. PUBLIC HEARING 14. Reconsideration of Large Family Daycare at 1250 Heritage Court City Attorney Houston framed the proceedings for the item. Mayor Packard opened the Public Hearing. Public Comments: John Hickey, attorney for applicant Greg Vaisberg, spoke in favor of granting the Use Permit application. The following Los Altos residents spoke in favor of upholding the denial of the Use Permit: Brad Martin, John Boniface, Kim Boniface, Fred Geier, Sylvia Dahlgren, Djuki Muliawau, Alberta Lemson, Jie Chu and Ulf Stauber.
4 Page 4 of 6 John Hickey provided rebuttal remarks. Mayor Packard closed the Public Hearing. Mayor Packard presented supplemental findings for Council consideration (on file in the Office of the City Clerk). Action: Motion by Mayor Packard, seconded by Councilmember Casas to uphold denial of Use Permit Application subject to findings including supplemental findings provided by Mayor Packard. Councilmember Satterlee and City Attorney Houston offered minor ministerial amendments to the supplemental findings. The amendments were accepted by Mayor Packard and Councilmember Casas. The motion, as amended passed unanimously. Mayor Packard called a recess at 8:45 p.m. The meeting resumed at 8:59 p.m. Action: Upon a motion by Mayor Packard, seconded by Councilmember Casas, the Council unanimously clarified that the applicant has until September 30, 2011 to comply with zoning regulations. 15. Senior Scholarship Fund DISCUSSION ITEMS Karen Jenney, Senior Commission Chair, presented the report and responded to Council questions. Mayor Pro Tem Carpenter proposed amendments to the draft application for Senior Scholarship, to include changing the annual aggregate household income to $38,500 and adding the following provisions: 1) Scholarships shall be limited to a maximum of $200 per year per household; 2) Scholarship are first come, first served ; and 3) Scholarships are limited to Los Altos residents. Action: Upon a motion by Mayor Pro Tem Carpenter, seconded by Councilmember Casas, the Council unanimously authorized implementation of a Scholarship Program for Senior Center membership and activities, directed the Finance Department to vet applications under the current North County Library Authority tax exemption process, approved the application for Senior Scholarships, as amended, allocated $1,600 in Fiscal Year for the program, and directed the Senior Commission to report back on the program at the end of the fiscal year. Council agreed to encourage the Town Council of Los Altos Hills to provide scholarship funding for Los Altos Hills residents. 16. Public Sculpture Committee Organizational Structure Mayor Pro Tem Carpenter presented the report.
5 Page 5 of 6 Public Comment: Los Altos resident Penny Lave expressed support for re-establishing an Arts Committee. Action: Upon a motion by Mayor Pro Tem Carpenter, seconded by Councilmember Casas, the Council unanimously changed the organizational and reporting structure of the Public Sculpture Committee from reporting to the Parks, Arts and Recreation Commission to reporting directly to Council, referred to the Public Sculpture Committee consideration of expanding their responsibilities and directed that they report to Council their findings and recommendations. 17. Appointment to Los Altos School District (LASD) Citizens Advisory Committee on Finance (CACF) Councilmember Casas presented the report and options for Council consideration. Councilmember Satterlee expressed a desire to take no action because the Council is already represented on the Joint City-Schools Sub-Committee. Action: Motion by Mayor Pro Tem Carpenter, seconded by Mayor Packard, to authorize appointment of a resident to the LASD CACF in place of a Councilmember and delegate selection to the Council Personnel Committee with a preference to appoint a current City of Los Altos Financial Commissioner. The motion passed 4-1 with Councilmember Satterlee dissenting. 18. VTA Board s Adopted Regional Transportation Plan/Sustainable Communities Strategies Engineering Services Manager Gustafson presented the report on VTA s proposed federal funding criteria. Action: Upon a motion by Mayor Pro Tem Carpenter, seconded by Councilmember Satterlee, the Council unanimously directed staff to send a letter in opposition to the proposed funding criteria particularly calling out the Safe Routes to School funding. 19. Amendment to Public Employees Retirement System (PERS) Contract Public Safety and Miscellaneous Employees Assistant City Manager Logan presented the report. Action: Upon a motion by Councilmember Satterlee, seconded by Councilmember Casas, the Council unanimously adopted Ordinance No authorizing an amendment to the contract between the City and PERS. ITEMS PULLED FROM CONSENT CALENDAR 9. Community Center Master Plan Update Mayor Packard recused himself due to a financial conflict of interest, stepped down and left the Chamber. Councilmembers Satterlee and Fishpaw offered suggestions for changes to the brochure and presentation.
6 Page 6 of 6 Mayor Packard reentered the Chamber and returned to the dais. 11. Collector Street Traffic Calming (Fremont Avenue), Project Public Comment: Los Altos resident Jeannie Bruins requested that Council rethink placing a roundabout at Fremont Avenue and Fallen Leaf Lane and conduct public outreach as a first step. Action: Upon a motion by Councilmember Satterlee, seconded by Councilmember Casas, the Council unanimously approved release of the Request for Proposal for design of a roundabout at Fremont Avenue and Fallen Leaf Lane with the understanding that the City will conduct public outreach to seek input on the final design. COUNCIL REPORTS AND DIRECTIONS ON FUTURE AGENDA ITEMS Council Reports: Councilmember Casas reported that Santa Clara County is preparing an Environmental Impact Report for Permanente Quarry and that a meeting will be held on August 30, 2011 at the City of Cupertino Quinlan Center. He also reported he recently completed a term as chair of the Silicon Valley Regional Interoperability Authority. Councilmember Fishpaw reported that the Los Altos Community Foundation 20 th Anniversary Gala will be held on August 27, Mayor Pro Tem Carpenter reported that the Personnel Committee met on August 3, 2011 and held a Study Session with the Parks, Arts and Recreation Commission on August 10, She also announced that the 60 th Anniversary Committee met August 18, 2011, will meet again on September 22, 2011 at 9:00 a.m. in the Neutra House, and that she attended a Local Government Commission dinner on August 18, Directions on Future Agenda Items: At the suggestion of Councilmember Casas, the Council requested a future agenda item to discuss the GreenTown Los Altos request for funding for Bicycle Education and directed staff to review it and bring back a recommendation for or against it. At the suggestion of Mayor Pro Tem Carpenter, the Council requested a future agenda item to discuss the No Stopping/No Parking signs on Carmel Terrace and Altamead Drive and directed staff to provide a history of the signage.
