1 MINUTES OF A REGULAR MEETING OF COUNCIL OF THE BOROUGH OF SOUTH TOMS RIVER A Regular Meeting of Council of the Borough of South Toms River was held at the Borough Hall on Monday, May 20, 2013 at 7:00 pm. Notice of this meeting was given to the Asbury Park Press on December 6, 2012 and notices were posted on the bulletin boards in the Clerk s Office and Meeting Room on said date. The following roll call was taken: FOR: Councilman, Reevey,, Williams, Cradle, Murray Mayor Champagne stated Jennifer Carr was filling in for Municipal Clerk Elizabeth Silvestri A motion was made by Councilman Murray seconded by Councilman Williams to approve the April 8 Caucus and Closed Session Minutes The following roll call was taken: FOR: Councilman, Reevey,, Williams, Cradle, Murray A motion was made by Councilman seconded by Councilman Williams to approve the April 15, 2013 Regular Meeting and Closed Session Minutes. The following roll call was taken: Councilman, Reevey,, Williams, Cradle, Murray A motion was made by Councilman Cradle seconded by Councilman Williams to approve the April 26 Special Meeting Caucus and Closed Session Minutes The following roll call was taken: Councilman, Reevey,, Williams, Cradle, ABSTAIN: Murray and Mayor Champagne introduced Bond Ordinance 6 13 for Introduction After the Mayor read the title of Ordinance #6 13, BOND ORDINANCE PROVIDING FOR VARIOUS GENERAL IMPROVEMENTS, APPROPRIATING $972,500 THEREFORE AND AUTHORIZING THE ISSUANCE OF $710,125 BONDS OR NOTES OF THE BOROUGH FOR FINANCING THE COSTS FOR SAID IMPROVEMENTS AUTHORIZED TO BE UNDERTAKEN IN AND BY THE BOROUGH OF SOUTH TOMS RIVER, IN THE COUNTY OF OCEAN, NEW JERSEY, he then opened the floor to the public. As there were no comments, the Mayor then closed the floor to the public. 1

2 A motion was made by Councilman Cradle seconded by Councilman Williams to approve the Introduction of Ordinance #6 13 The following roll call was taken: FOR: Councilman, Reevey,, Williams, Cradle, Murray: After the Mayor read the title of Ordinance #7 13, title: BOND ORDINANCE AMENDING THE TITLE AND SECTION 3 BOND ORDINANCE ADOPTED JUNE 18, 2012 OF THE BOROUGH OF SOUTH TOMS RIVER, IN THE COUNTY OF OCEAN, NEW JERSEY, he opened up for public comment. As there were no comments, the Mayor then closed the floor to the public. A motion was made by Councilman Cradle seconded by Councilman Williams to approve the Introduction of Ordinance #7 13 The following roll call was taken: FOR: Councilman, Reevey,, Williams, Cradle, Murray: After the Mayor read the title of Ordinance #8 13, title: AN ORDINANCE OF THE BOROUGH OF SOUTH TOMS RIVER AMENDING AND SUPPLEMENTING CHAPTER 26 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF SOUTH TOMS RIVER, ENTITLED LAND DEVELOPMENT, CONSISTENT WITH THE 2012 MASTER PLAN, he opened it up for public comment. As there were no comments, the Mayor then closed the floor to the public. A motion was made by Councilman Cradle seconded by Councilman Williams to approve the Introduction of Ordinance #8 13 The following roll call was taken: FOR: Councilman, Reevey,, Williams, Cradle, Murray: The Municipal Clerk announced the Resolution for the insertion for a special item of revenue in the budget for OEM 966 grant Resolution Authorizing the Insertion of a Special Item of Revenue in the 2013 Budget for Office of Emergency Management 966 Grant RESOLUTION BOROUGH OF SOUTH TOMS RIVER, COUNTY OF OCEAN OEM 966 REIMBURSEMENT PROGRAM GRANT RESOLUTION PROVIDING FOR THE INSERTION OF A SPECIAL ITEM OF REVENUE IN THE 2013 BUDGET PURSUANT TO N.J.S.A 40A:4 87 (CHAPTER 159, P.L

3 WHEREAS, N.J.S.A 40A:4 87 provides that the Director of the Division of Local Government services may approve the inertion of any special item of revenue in the budget of any county or municipality when such shall have been made by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for any equal amount; and WHEREAS, teh Borough of South Toms River has received from the New Jersey Department of Law and Public Safety, Division of State Police for an entitlement of $12, for the Fiscal Year 2013 OEM 966 Reimbursement PRogram Gran, a copy of which is attached; and NOW, THEREFORE BE IT RESOLVED that the Borough of South Toms River, County of Ocean hereby requests the Director of the Division of Local Government Services to approve th insertion of items of revenue from the New JErsey Department of Law and PUblic Safety, Division of STate Police. of: BE IT FURTHER RESOLVED that a like sum is hereby appropriated under the caption OEM 966 Reimbursement Program Grant 2013 BE IT FURTHER RESOLVED that copies of this resolution be forwarded to the following 1. 6 Murray X X Reevey X Williams The Municipal Clerk announced Resolution RESOLUTION BOROUGH OF SOUTH TOMS RIVER, COUNTY OF OCEAN, STATE OF NEW JERSEY RESOLUTION PROVIDING FOR THE ADOPTION OF A CORRECTIVE ACTION PLAY FOR RECOMMENDATIONS STATED IN THE REPORT OF THE AUDIT YEAR ENDED DECEMBER 31, 2011 WHEREAS, The Division of Local Government Services promulgates that a corrective action plan be formulated to address recommendations reported in the annual report of the audit on the financial statements; and WHEREAS, the Chief Financial Officer has prepared this plan for the Borough of South Toms River, County of Ocean, State of New Jersey, that the corrective action plan prepared by the Chief Financial Officer be and is hereby accepted. Pursuant to N.J.S.A 40A:2 8, the following amounts of General Obligation General Improvement Bond Anticipation Notes (the Notes) shall be issued at such dates and in such amounts as is determined by the Chief Financial Officer and/or acting Chief Financial Officer in accordance with this resolution: A. Pursuant to the provisions of Section 40A:2 26 of the Local Bond Law of New Jersey, particularly paragraph (f) thereof, and in lieu of the sale of more than one (1) issue of bonds or notes as provided for in said Local Bond Law, the issues of bonds and notes of the Borough authorized pursuant to the Bond ORdinances of the Borough hereinabove set forth shall be combined into one (1) issue of Notes to be sold in the aggregate amount of not to 8

9 eceed $1,404,675. Section 3. determined: The following matters in connection with said Notes are hereby A. All notes issued hereunder and any renewal thereof, shall mature at such times as may be determined by the Chief Financial Officer and/or acting Chief Financial Officer of the Borough, provided that any note issued pursuant hereto shall be issued for a period not to eceed one (1) year, but all such notes, including renewals, shall mature and be paid in accordance with the Local Bond Law. B. All notes issued hereunder shall bear interest at such rate or rates as may be determined by the Chief Financial Officer and/or acting Chief Financial Officer of the Borough. C. The notes shall be in a form as permitted by law and approved by Bond Counsel, and issued pursuant to the Local Bond Law, and any such notes or any renewal thereof, may be signed or sealed by officers of the Borough in any manner permitted by Section 40A:2 25 of said Law notwithstanding what is otherwise set forth herein. Section 4. The Chief Financial Officer and/or acting Chief Financial Officer of the Borough is hereby authorized and directed to determine all matters in connection with said Notes or any renewal thereof, not determined by this or a subsequent resolution and his/her signature upon said Notes shall be conclusive as to such determinations. Section 5. The Chief Financial Officer and/or acting Chief Financial Officer of the Borough is hereby authorized to sell said Notes or any renewal thereof, from time to time at public or private sale in such amounts as he/she may determine at not less than par value and to deliver the same from time to time to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from the dated date of the Notes to the date of delivery thereof and payment therefor. Section 6. Any instrument issued pursuant to the resolution shall be a general obligation of the Borough, and the Borough s faith and credit are hereby pledged to the punctual payment of the principal of and interest on said obligation and, unless otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the budget and a ta sufficient to provide for the payment thereof shall be levied and collected. Section 7. The governing body of the Borough hereby covenants on behalf of the Borough to take any action necessary or refrain from taking any action in order to preserve the ta eempt status of the debt obligations authorized hereunder as is required under the Internal Revenue Code of 1986, as amended, including compliance with said Code with regard to the use, ependiture, investment, timely reporting and rebate of investment earnings as may be 9

10 required thereunder. Section 8. This resolution shall take effect immediately. APPROVED AS TO SUFFICIENCY AND FORM BOROUGH ATTORNEY RESOLUTION OFFERED BY WHEREAS, the Borough of South Toms River is in need of paving services for the Recreation Center Pavement Reconstruction Project ( project ) in the Borough of South Toms River; and WHEREAS, the Borough of South Toms River solicited bids pursuant to an in compliance with the New Jersey Local Public Contracts Law; and 10

11 WHEREAS, the Bid submitted by All Surface Asphalt Paving, Inc., was the lowest bid at $58, and is within the Engineer s Estimate for this project; and WHEREAS, the bid process has been reviewed by the Municipal Attorney and found to be in compliance in form and substance with Local Public Contracts Law and accepted practice; and WHEREAS, the Borough Chief Financial Officer has certified to the availability of funds for this project; NOW THEREFORE BE IT HEREBY RESOLVED that teh Borough Council of the Borough of South Toms River hereby awards the contract for Recreation Center Pavement Reconstruction to All Surface Asphalt Paving, Inc. in the amount of $58,085.00, in subject to the eecution of required documents. 12 AGREEMENT WITH THE COUNTY OF OCEAN FOR 2013 WHEREAS, the Interlocal Services Act, N.J.S.A 40:8a 1 et seq. authorized the Borough of South Toms River to enter into a contract for the provision of certain governmental services with the County of Ocean; and WHEREAS, N.J.S.A. 40:8 requires such a contract to be authorized by resolution or ordinance; and WHEREAS, it is the desire of the governing Body to authorize the eecution of a contract with the County of Ocean for the provision of services, materials and equipment as set forth in Schedule C attached hereto. NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of South Toms River, County of Ocean, State of New Jersey as follows: 1. That the Mayor and Municipal Clerk are hereby authorized to eecute a Schedule C agreement with the County of Ocean in accordance with the provisions of the law to include $20, for the Road Department and $5, for the Engineering Department for a sum total and not to eceed $25, A copy of the said agreement is attached hereto and made part hereof as Schedule C. 2. This agreement is for the period January 1, 2013 to December 31, That a copy of this agreement referenced herein shall be kept on file and made available for public inspection in the Municipal Clerk s office during normal business hours. 13 Murray X Reevey Williams The Municipal Clerk announced Resolution RESOLUTION A RESOLUTION APPROVING PARTICIPATION WITH THE STATE OF NEW JERSEY SAFE AND SECURE COMMUNITIES PROGRAM ADMINISTERED BY THE DIVISION OF CRIMINAL JUSTICE, DEPARTMENT OF LAW AND PUBLIC SAFETY WHEREAS, the Borough of South Toms River/South Toms River Police Department wishes to apply for funding for a project under the Safe and Secure Communities PRogram, and WHEREAS, the project is a joint effort between the Department of Law and Public Safety and Mayor and Council of South Toms River for the purpose described in the application; THEREFORE, BE IT RESOLVED by the Mayor and Council of South Toms River that 1. As a matter of public policy South Toms River PD wishes to participate to the fullest etent possible with the Department of Law and PUblic Safety. 2. The Attorney General will receive funds on behalf of the applicant 3. The Division of Criminal Justice shall be responsible for the receipt and review of the application for said funds 4. 14 X Cradle Murray Reevey X Williams The Municipal Clerk announced Resolution RESOLUTION RESOLUTION AUTHORIZING THE BOROUGH ENGINEER TO PROCEED TO OBTAIN A NEW WATERFRONT DEVELOPMENT PERMIT WHEREAS, the Bureau of Tidelands Management reviewed aerial photography and a personal inspection on April 26, 2013 to proceed with a license renewal; and WHEREAS, the Borough of South Toms River is applying for a license renewal for Lots 1 through 4, in Block 3, in South Toms River Borough, County of Ocean. NOW, THEREFORE BE IT RESOLVED, the Governing Body of South Toms River Borough authorizes the Borough Engineer to proceed to obtain a new waterfront development permit. 15 Reevey X Williams The Municipal Clerk announced Resolution RESOLUTION BOROUGH OF SOUTH TOMS RIVER WHEREAS, the redemption of Ta Sale Certificate # on Block Lot 4 assessed to Hill, William C., III has been made in the office of the TA Collector and it is necessary to reimburse the lienholder. NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of South Toms River that a check in the amount of $14, to be issued to US Bank Custodial for Pro Capital I, 50 South 16th Street, Suite 1950, Philadelphia which represents the Redemption in the amount of $11, and Premium in the amount of $3, Barbara Herr, CTC Cradle X Murray Reevey Williams Mayor Champagne announced permission request for the Manitou Park Fire Company to hold a Coin Toss at the intersection of Double Trouble and Rt 530, on June 8 with an alternate rain date of June 15 and October 26, 2013 from 8am to 6pm. 16 Betty Silvestri, RMC Cradle Murray Reevey Williams Mayor Champagne opened up for Public Comments. CFO, Steve Gallagher stated the Governing Body may want to increase the dollar per hour salary offer for Court Administrator to entertain quality candidates. Mayor Champagne asked for a motion to increase Debbie Martucci, the current Court Administrator s hours from 20 to 30 hours temporarily RESOLUTION Increasing the Deputy Court Administrator s Hours from 20 hours/week to 30 hours/week temporarily WHEREAS, the municipal court of the borough to south toms river, uses the services of municipal court services; WHEREAS, the municipality is currently engaged in the identifying candidates to fill the position of municipal court administrator WHEREAS, the Deputy Municipal Court Clerk has served on a parttime time basis works to assist the Municipal Court Administrator until the municipal court administrator is filled; and WHEREAS, the Dept Municipal Court Clerk has served on a limited basis at 20 hours a week; and WHEREAS, the official operations of the municipal clerk be employed at 30 hours a week. THEREFORE, BE IT RESOLVED, the dep municipal court clerk be employed to 30 16

17 hours a week on a temporary basis until until such time that the Municipal Court Administrator is fill, and at a period no longer than 45 days after the resolution is passed. Betty Silvestri, RMC Cradle Murray Reevey Williams Mayor Champagne confirmed with Mr. Gallagher that hourly salary was lower than many other Court Administrators. Mayor Champagne stated they are considering a fourth of July event at Mathis Plaza. Mayor Champagne submitted a letter Tri State Recycling they are responding to noise complaints and are doing everything they can to reduce the noise. Councilman Murray asked if they are within the decimals allowed by the borough noise ordinance, and the Mayor directed the code enforcer to obtain the decimal level. Councilman Cradle stated that the yearly statement for recycling will have a new form. Councilman stated he was appointed Stormwater Management Coordinator. The buildings and grounds, was able to remove the $2,000 fine. He stated borough hall and they will go out to bid. Councilman wishes thoughts and prayers for Betti, as she has surgery. Mayor Champagne praised Councilman for taking care and having the State remove the fine. The Submarine Veterans would like to thank the governing body for supporting their organization.
