3 THE SHASTA SELPA GOVERNING BOARD WELCOMES AND ENCOURAGES YOUR PARTICIPATION. HOWEVER, TO INSURE AN ORDERLY MEETING, ALL PARTICIPANTS WILL BE ASKED TO OBSERVE THE FOLLOWING PROCEDURES. Procedures for placing an item on the SELPA Governing Board agenda, making a presentation, or speaking of some issue on the agenda shall be as follows. 1. Arrangements to plan an item on the agenda and make a presentation concerning said item must be established with the SELPA Governing Board at least eight calendar days in advance of the meeting. The request to address the SELPA Governing Board about the item shall be submitted in writing and shall contain questions, problems, or positions to be presented with the name, address, and phone number of the person who will address the Commission and the group represented, if applicable. 2. At all regular meetings of the SELPA Governing Board, the presiding officer shall ask if there are members of the audience who wish to address the SELPA Governing Board on any item listed on the published agenda. They should stand, state their name, what group they represent, if any, and the item number to which they wish to speak. At the appropriate time, the presiding officer will call upon those parties who have been recognized to speak. 3. If it is approved by a majority of the SELPA Governing Board members present at the meeting, testimony may be taken at regularly scheduled meetings on matters not on the agenda provided that no action is taken by the SELPA Governing Board on such matters at the same meeting at which such testimony is taken (EC 35145). Persons addressing the SELPA Governing Board shall be guided by the following conditions: 1. The person addressing the SELPA Governing Board may be required to show a reasonable basis of interest in the affairs of the SELPA Governing Board, such as legal resident of the county, parent, guardian of children in Special Education programs or a representative of an organization having legitimate concern within the scope of the SELPA Governing Board or other bona fide individual interest in the proceedings of the SELPA Governing Board. 2. Remarks or charges by any person addressing the SELPA Governing Board which reflect adversely upon the character or motives of any person are out of order. 3. Five minutes may be allotted to each person addressing the SELPA Governing Board and a maximum of twenty minutes to any subject. The presiding officer of the SELPA Governing Board shall endeavor to allot equal time to persons having opposing views on a subject, at his/her discretion these general time limits may be altered. 4. It shall be in order for the members of the SELPA Governing Board, or the SELPA Governing Board chairperson, to interrupt the speaker at any time to ask questions or to make comments as frequently as necessary to clarify the discussion. 5. During the time when the SELPA Governing Board is holding official meetings, only those persons recognized by the presiding officer of the SELPA Governing Board shall be permitted to participate in the discussion. Any attempt by any person not so recognized to discuss issues of business before the SELPA Governing Board is out of order. 6. Conduct by a participant declared out of order by the presiding officer for violations of the above rules shall be grounds for summary termination by the presiding officer of that person s privilege of addressing the SELPA Governing Board for that scheduled meeting. 4 SELPA Governing Board Meeting Minutes August 22, Call to Order Brian Winstead, SELPA Chairperson, called the meeting to order at 8:01 a.m. Brian welcomed new representatives Rob Adams, Redding School District replacing Rick Fauss for Region 3 and Clay Ross from Columbia School District replacing Tom Armelino for Region Additions or Corrections to Agenda None. 3. Public Forum/Hearing of Persons Wishing to Address the Shasta Governing Board None. 4. Announcements Conde announced that CDE adopted Dyslexia Guidelines and are on the SELPA website on the district only tab. The PECS I training was held August 10 and 11. Approximately 40 participants attended and have requested the PECS II training for next school year. Behavior Support trainings are available for paraprofessionals through the on-line Relias Trainings. There are two strands of trainings available - one version is 40 hours for more severe behaviors and the second module is 17 hours for low/moderate behaviors. Please contact Cari Stilwell if you are interested in attending. Also, Cari is offering monthly two hour trainings for paraprofessionals and staff. The first training is August 28 and will be focused on how to write a behavior plan. 5. Approval of Regular Agenda These items will be given individual consideration by the Board. The motion passed by majority vote as follows: AYES: Jim Cloney, Jim Harrell, Rob Adams, Greg Hawkins, Clay Ross, Brian Winstead, Tim Azevedo NOES: None ABSTENTIONS: None ABSENT: None 9.4 Compliance Access to Records for Desk Audit ACTION Timeline for CDE audit is August 28, October 27, 2017 CDE will review up to 10 files per LEA for each non-compliance finding "Therefore, the CDE and LEAs will need to establish a process to gain required electronic access to student records. The most practical way would be to permit electronic access to the LEAs computer-based IEP system (e.g., Special Education Information System), is for the LEA to authorize the CDE to have temporary, limited read-only access to the LEA s IEP system" Kristin Wright, CDE Director Options: District allows read only access to all students 6

7 SELPA Governing Board Meeting Minutes August 22, 2017 District allows read only access to students selected by CDE for a file review District makes copes of files, and meets face to face with CDE representative for review Twenty districts in Shasta County received disproportionate letters. Conde reviewed the rubrics with indicators for districts who are disproportionate. An was sent asking all Superintendents if they received an back in June with a subject of Reconsideration Notice. Please look for the notice and let Conde know whether or not you received it. CDE will supply names needing to be submitted by September 28. CDE is hoping to complete the review by October 27. Conde will get more clarification of the review and ask that CDE come to Shasta County for the meetings. The motion passed by majority vote as follows: AYES: Jim Cloney, Jim Harrell, Rob Adams, Greg Hawkins, Clay Ross, Brian Winstead, Tim Azevedo NOES: None ABSTENTIONS: None ABSENT: None 9.5 ERICS MOU and Criteria for High School and K-8 INFORMATION Conde distributed the amended version of the ERICS MOU with the addition of the financial aspect - $63,000 for the classroom and $5000 for the database. 9.6 AB 403 Continuum of Care Realignment Update INFORMATION Update related to proposed funding model Conde and Cindy Ostrander have been participating with statewide group Shasta County has received duplicate funding from the home and brought to their attention. The funding for the current year of 1.9 million will remain in place. Conde met with Remi Vista and they will be rolling up two homes to a STRP and two and half homes vetted for the regional center bringing in intensive kids. There is an increase of foster students - currently 500 foster youth students in Shasta County who will be impacted. We are watching this closely. Conde will be meeting with the statewide group to finalize the final model with the Department of Finance. 9.7 Allocation Model Review INFORMATION The continuum of Care Realignment has significant implications for the SELPA related funding and service delivery models. 7

8 SELPA Governing Board Meeting Minutes August 22, 2017 The SELPA Office is forming an Allocation Review Workgroup to study SELPA revenues and allocations in order to provide stability over time. The group will be looking at all subsidies and off-the top programs. In addition to the standing members of Finance Advisory Committee, additional members may include Superintendents, CBO s, or Special Education Directors. 12 LEASED SITE MAINTENANCE AND JANITORIAL SERVICES AGREEMENT (SELPA Medical Therapy Unit) This LEASED SITE MAINTENANCE AND JANITORIAL AGREEMENT ( Agreement ) is made and entered into as of July 1, 2018 (the Effective Date ), by and between the Shasta County Office of Education ( SCOE ), on behalf of the Shasta County Special Education Local Plan Area ( SELPA ) and Redding School District ( District ). 1. District Services. District agrees to provide the following services to SCOE (collectively, the Services ): At the site attached to this Agreement as Exhibit A and incorporated herein by reference ( Site ), for those maintenance and/or janitorial services, methods of performance, and other standards more specifically described in the Specifications attached as Exhibit B and incorporated herein by reference. 2. District Qualifications. District represents and warrants to SCOE that District, and all of District s employees, agents or volunteers (the District Parties ), have in effect and shall maintain in full force, throughout the Term, all licenses, credentials, permits and any other qualifications required by law to perform the Services and to fully and faithfully satisfy all of the terms set forth in this Agreement. District and any District Parties performing Services shall be competent to perform those Services. 3. District Responsibilities. District shall perform all Services on and at the Site in a safe and professional manner. District shall have adequate office and personnel resources for responding to SCOE s needs at the Site, including telephone coverage weekdays during the hours of 7:30 a.m. through 4:30 p.m. 4. Term. This Agreement shall begin on the Effective Date and shall terminate on June 30, 2019 ( Initial Term ), except as otherwise stated in Paragraph 5 below, and shall automatically renew for one-year extensions thereafter (each renewal, together with the Initial Term, the Term ). In the event of early termination, District shall be paid for satisfactory Services performed to the date of termination. Upon payment by SCOE, SCOE shall be under no further obligation to District, monetarily or otherwise, hereunder. 5. Termination. Either party may terminate this Agreement at any time by giving thirty (30) days advance written notice to the other party, however the parties may agree in writing to a shorter notice period. Written notice by the SCOE Superintendent of Schools ( Superintendent ) or designee shall be sufficient to stop further performance of the Services by District or the District Parties. Notwithstanding the foregoing, SCOE may terminate this Agreement at any time by giving written notice to District if District materially breaches any of the terms of this Agreement, or if any act or omission of District or the District Parties exposes SCOE to potential liability or may cause an increase in SCOE s insurance premiums. Such termination shall be effective immediately upon District's receipt of the notice. 6. Payment of Fees for Services. SCOE agrees to pay District fees for Services satisfactorily performed based at the Schedule of Rates for the Site, attached as Exhibit C and incorporated herein by reference. Such rates shall be subject to an annual 3% adjustment. District shall prepare an invoice for the Services, and deliver annual invoices in person or by mail to the SCOE contact person at the address shown for SCOE Notices and Invoices on the signature page SC

13 to this Agreement. SCOE agrees to pay the fee for the Services, up to the maximum amount provided herein, within fortyfive (45) days of receipt of an invoice from District, including any additional supporting documentation SCOE reasonably requests. 7. Indemnity. District shall defend, indemnify, and hold harmless SCOE and its agents, representatives, officers, consultants, employees, Board of Education, members of the Board of Education (collectively, the SCOE Parties ), from and against any and all claims, demands, liabilities, damages, losses, suits and actions, and expenses (including, but not limited to attorney fees and costs including fees of consultants) of any kind, nature and description (collectively, the Claims ) directly or indirectly arising out of, connected with, or resulting from any act, error, omission, negligence, or willful misconduct of District, the District Parties or their respective agents, employees, material or equipment suppliers, invitees, or licensees in the performance of or failure to perform District s obligations under this Agreement, including, but not limited to District's or the District Parties use of the site, District's or the District Parties performance of the Services, District s or the District Parties breach of any of the representations or warranties contained in this Agreement, or for injury to or death of persons or damage to property or delay or damage to the SCOE or the SCOE Parties. Such obligation shall not be construed to negate, abridge, or reduce other rights or obligations of indemnity, which would otherwise exist as to a party, person, or entity described in this paragraph. 8. Equipment and Materials. District at its sole cost and expense shall provide and furnish all tools, labor, materials, equipment, transportation services and any other items (collectively, Equipment ) which are required or necessary to perform the Services in a manner which is consistent with generally accepted standards of the profession for similar services. District s equipment shall be compatible with the Site and be in good working order. All personnel shall be trained in safety measures to preclude accidents and endangering SCOE s personnel or property. Notwithstanding the foregoing, SCOE shall not be responsible for any damages to persons or property as a result of the use, misuse or failure of any Equipment used by District or the District Parties, even if such Equipment is furnished, rented or loaned to District or the District Parties by SCOE. Furthermore, SCOE may reject any Equipment or workmanship that does not conform to the requirements of this Agreement and District must then promptly remedy or replace it at no additional cost to SCOE and subject to SCOE s reasonable satisfaction. 9. Insurance. Without in any way limiting District's liability, or indemnification obligations set forth in Paragraph 7 above, District shall secure and maintain at its own expense throughout the Term of this Agreement the following insurance: (i) comprehensive general liability and casualty insurance with limits of not less than $1,000,000 each occurrence and $2,000,000 in the aggregate; (ii) commercial automobile liability insurance with limits not less than $1,000,000 each occurrence, if applicable; and (iii) worker s compensation insurance as required by Labor Code section 3200, et seq., if applicable. Neither District nor any of the District Parties shall commence performing any portion of the Services until all required insurance has been obtained and certificates indicating the required coverages have been delivered to and approved by SCOE. All insurance policies shall include an endorsement stating that SCOE and SCOE Parties are named additional insureds. All of the policies shall be amended to provide that the insurance shall not be suspended, voided, canceled, reduced in coverage or in limits except after thirty (30) days prior written notice has been given to SCOE. If such a notice is not given or even if SCOE receives a notice, SC

14 SCOE may, at its sole option, terminate this Agreement. All insurance policies shall include an endorsement stating that it is primary to any insurance or self-insurance maintained by SCOE and shall waive all rights of subrogation against SCOE and/or the SCOE Parties. A copy of the declarations page of District s insurance policies shall be attached to this Agreement as proof of insurance. 10. Independent Contractor Status. District Parties, in the performance of this Agreement, shall be and act as an independent contractor. District understands and agrees that District and the District Parties shall not be considered officers, employees, agents, partners, or joint ventures of SCOE, and are not entitled to benefits of any kind or nature normally provided to employees of SCOE and/or to which SCOE s employees are normally entitled. 11. Assignment; Successors and Assigns. District shall not assign or transfer by operation of law or otherwise any or all of its rights, burdens, duties or obligations under this Agreement without the prior written consent of SCOE. Subject to the foregoing, this Agreement shall be binding on the heirs, executors, administrators, successors, and assigns of the respective parties. 12. Severability. If any provision of this Agreement shall be held invalid or unenforceable by a court of competent jurisdiction, such holding shall not invalidate or render unenforceable any other provision of this Agreement. 13. Modifications and Amendments. All terms of this Agreement may be modified, waived, altered, supplemented or amended in whole or in part upon mutual consent of both parties. Such modification, waiver, alteration, supplement or amendment shall be in writing, signed and dated by authorized representatives of each party. 14. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of California, excluding its choice of law rules. Any action or proceeding seeking any relief under or with respect to this Agreement shall be brought solely in the Superior Court of the State of California for the County of Shasta, subject to transfer of venue under applicable State law, provided that nothing in this Agreement shall constitute a waiver of immunity to suit by either party. 15. Written Notice. Written notice shall be deemed to have been duly served to a party if delivered in person to such party at the address located next to the party signatures below, or if delivered at or sent by registered or certified or overnight mail to the last business address known to the person who sends the notice. 16. Waiver. No delay or omission by a party in exercising any right under this Agreement shall operate as a waiver of that or any other right and no single or partial exercise of any right shall preclude a party from any or further exercise of any right or remedy. 17. Entire Agreement. This Agreement is intended by the parties as the final expression of their agreement with respect to such terms as are included herein and as the complete and exclusive statement of its terms and may not be contradicted by evidence of any prior agreement or of a contemporaneous oral agreement, nor explained or supplemented by evidence of consistent additional terms. 18. Ambiguity. The parties to this Agreement, and each of them, hereby represent that the language contained herein is to be construed as jointly proposed and jointly accepted, and in the event of any subsequent SC

15 determination of ambiguity, all parties shall be treated as equally responsible for such ambiguity. 19. Execution of Other Documents. The parties to this Agreement shall cooperate fully in the execution of any and all other documents and in the completion of any additional actions that may be necessary or appropriate to give full force and effect to the terms and intent of this Agreement. 20. Execution in Counterparts. This Agreement may be executed in counterparts such that the signatures may appear on separate signature pages. A copy, facsimile, or an original, with all signatures appended together, shall be deemed a fully executed agreement. 21. Warranty of Authority. 26 POLICY 1 SHASTA COUNTY SELPA CHARTER SCHOOL PROCEDURE TO BECOME LEA Any public school district or county office of education, hereinafter referred to as a local education agency (LEA), located in an area contiguous to Shasta County, or any charter school already deemed to be an LEA, may apply to the SELPA Superintendents' Council to become a member of the SELPA. Application must be made to the SELPA on or before February 1 of the school year preceding the school year in which the LEA anticipates operating as a member within the SELPA. LEA member status will not become effective prior to July 1 of the year in which final approval was granted. Once granted membership, the LEA will participate in the governance of the SELPA in the same manner as all other LEA members in the SELPA. The applicant LEA will be deemed a member of the SELPA if the SELPA Governing Board determines that the LEA has met all requirements to be included as a member LEA as specified in this policy and the Local Plan. The applicant LEA will meet all other requirements, if any, from the California Department of Education and the current SELPA to which the LEA belongs. The SELPA requirements include an agreement to: Provide assurances that all eligible individuals with disabilities (ages birth to 22) shall have access to appropriate special education programs and services Provide assurances of its knowledge and understanding of applicable special education laws Provide assurances that each certificated employee is appropriately credentialed to serve in his/her assignment Provide necessary staff as required to meet federal mandates Follow all requirements of the SELPA Local Plan Utilize SELPA approved forms FIRST READ Provide transportation as indicated in the student's IEP Provide assurances that the LEA understands its sole legal and financial responsibility to provide appropriate services to eligible students, and that the LEA shall not seek defense or indemnification from the SELPA or SELPA SHASTA COUNTY SELPA ADMISSION OF LOCAL EDUCATION AGENCIES TO THE SHASTA COUNTY SELPA Adopted (DATE) PAGE 1 OF 3 26

27 POLICY 1 members unless liability is the result of acts or omissions of other agencies, their agents or employees, while performing services under an agreement To initiate an application, the interested LEA must submit a letter of intent to the Shasta County SELPA Director. Included in that letter or by way of attachment, the applicant must provide the following information: Specify the current services and those reasonably anticipated to be provided by or through the applicant's IEPs Specify the amount of excess costs associated with special education if any for the applicant over the immediate past three year period Specify the reason for the application Identify what if any services or support systems the applicant will need from the Shasta County SELPA and or neighboring school districts The Shasta County SELPA Director may review budget documents or any other related public records of the applicant in conjunction with this application. Upon conclusion of this review, the Director shall submit his/her recommendations regarding the application to the respective committees for consideration of a final recommendation to the SELPA Governing Board. Once deemed a member of the SELPA, a LEA shall: Participate in the governance of the SELPA in the same manner as all other LEAs in the SELPA Contribute to, participate in, and receive the benefits of reimbursement from all SELPA fiscal pools, and participate in any chargebacks in the same manner as other members Receive state and federal funding for special education in accordance with the SELPA Special Education Funding Allocation Plan Be responsible for all costs incurred in the provision of special education services to students enrolled in the LEA. These costs may include, but are not limited to, instruction, related services, transportation, nonpublic school/agency placements, inter/intra SELPA placements, due process proceedings, complaints, and attorney fees FIRST READ Document that all state and federal special education funds apportioned to the LEA are used for the sole purpose of providing special education instruction and/or services to identified students with disabilities SHASTA COUNTY SELPA ADMISSION OF LOCAL EDUCATION AGENCIES TO THE SHASTA COUNTY SELPA Adopted (DATE) PAGE 2 OF 3 27

28 POLICY 1 Membership may be initially granted for a period not to exceed five years and may be granted one or more renewals by the SELPA Governing Board. Each renewal shall be for a period of five years. Membership may be revoked by the SELPA Governing Board if it finds that the LEA did any of the following: Committed a material violation of any of the conditions, standards, or procedures set forth in this policy or the Local Plan Failed to meet generally accepted accounting principles, or engaged in fiscal mismanagement of special education funds Violated any provision of law applicable to the LEA relating to special education The SELPA Governing Board shall examine the pattern of conduct by the LEA in implementing special education laws. The decision to revoke may be based on the ability of the LEA to cure and correct violations and/or the LEA's ability to ensure ongoing, consistent compliance with all applicable special education laws. Prior to revocation, the SELPA Governing Board shall notify the LEA of any violation of this policy and give the LEA a reasonable opportunity to cure the violation, unless the SELPA Governing Board determines, in writing, that the violation constitutes a severe and imminent threat to the health or safety of the pupils. Upon revocation of membership, the LEA shall take immediate steps to comply with Education Code and any other requirements of the California Department of Education.
