3 ORDINANCE Intro O -1 presented the following Ordinance and moved for its adoption: ORDINANCE REPEALING CHAPTER 111 OF THE GLOVERESVILLE CITY CODE WHEREAS, in October 2015 the Common Council having legislated an Ordinance pertaining to Cat Rescue Sanctuaries; and WHEREAS, in 2016 the City has been in the process of accomplishing a comprehensive update of the zoning laws of the City Gloversville; and WHEREAS, the Zoning update to be passed by the City contains policies and procedures relating to Cat Rescue Sanctuaries that will allow the same to exist in C and M zones in the City, subject to a special permit with site plan approval; and WHEREAS, the passage of the zoning update will supplant and replace the procedure and application criteria required by Chapter 111; and WHEREAS, a Public Hearing on this issue having been held on June 28, NOW, THEREFORE, BE IT ENACTED, that Chapter 111 of the Gloversville City Code is hereby repealed. This Ordinance shall become effective upon ratification by the Common Council following a Public Hearing on June 28,

4 Local Law # of 2016 Intro LL-1 presented the following Local Law and moved its adoption: LOCAL LAW MODIFYING CHAPTER 300 OF THE GLOVERSVILLE CITY CODE IN CONNECTION WITH A COMPREHENSIVE ZONING UPDATE WHEREAS, the City having previously retained the services of Greenman-Pedersen, Inc. (GPI) for a comprehensive review and updating of the zoning laws within the City of Gloversville; and WHEREAS, a presentation having been made by GPI regarding the zoning update at the Common Council meeting held on March 22, 2016; and WHEREAS, a Public Hearing having been held regarding the zoning update on April 12, 2016; and WHEREAS, following said public hearing, further substantive modifications pertaining to Cat Rescue Sanctuaries and Kennels were made requiring a further Public Hearing that was held on June 28, 2016; and WHEREAS, referrals having been made by the City to the Fulton County Planning Board and Gloversville Planning Board pursuant to General Municipal Law 239-m, with the City having received responsive communications from each planning board, with there being no identified reason to delay the passing of the instant local law; and WHEREAS, the Common Council having held a public hearing regarding SEQR on June 28, 2016 and having passed a Resolution adopting a negative declaration following said public hearing. NOW, THEREFORE, BE IT ENACTED by the Common Council of the City of Gloversville as follows: That Chapter 300 of the Gloversville City Code is modified to read as set forth in the annexed document. This Local Law shall take effect upon ratification by the Common Council following a Public Hearing held on June 28,

5 Intro LL-2 Local Law # of 2016 presented the following Local Law and moved its adoption: LOCAL LAW MODIFYING CHAPTER 166 OF THE GLOVERSVILLE CITY CODE IN CONNECTION WITH A COMPREHENSIVE ZONING UPDATE WHEREAS, the City having previously retained the services of Greenman-Pedersen, Inc. (GPI) for a comprehensive review and updating of the zoning laws within the City of Gloversville; and WHEREAS, a presentation having been made by GPI regarding the zoning update at the Common Council meeting held on March 22, 2016; and WHEREAS, as part of the overall zoning update, modifications are required to the Chapter 166 Historic Districts as set forth in the annexed modified version of Chapter 166; and WHEREAS, a Public Hearing having been held in regard to the proposed modifications outlined herein, said public hearing having been held on June 28, NOW, THEREFORE, BE IT ENACTED by the Common Council of the City of Gloversville as follows: That Chapter 166 of the Gloversville City Code is modified to read as set forth in the annexed document. This Local Law shall take effect upon ratification by the Common Council following a Public Hearing held on June 28,

6 Resolution Intro R-1 Simonds presented the following Resolution and moved its adoption: RESOLUTION APPROVING A VACATION INCREASE FOR WILLIAM WALRATH, MOBILITY MANAGER FROM TWO (2) WEEKS TO THREE (3) WEEKS ANNUALLY and and WHEREAS, William Walrath has served as the City s Mobility Manager for five (5) years; WHEREAS, during that time, Mr. Walrath has had two (2) weeks vacation to utilize annually; WHEREAS, the Mayor and Common Council, after discussion with Mr. Walrath, agree that Mr. Walrath, after five (5) years of service with the City, should receive a total of three (3) weeks vacation to utilize annually, a benefit which is enjoyed by other City Department Heads. RESOLVED, that effective June 1, 2016, William Walrath shall have three (3) weeks vacation to utilize annually, defined as the period January 1 through December 31 of each calendar year; and be it further RESOLVED, that this Resolution shall apply to William Walrath so long as he is employed by the City of Gloversville as Mobility Manager; and be it further RESOLVED, that this Resolution shall remain in effect for so long as William Walrath serves as Mobility Manager for the City of Gloversville or until future action by the Common Council, whichever occurs first. 7 Resolution Intro R-2 presented the following Resolution and moved its adoption: RESOLUTION TO AWARD THE PURCHASE OF A SECURITY CAMERA SYSTEM TO BE UTILIZED AT CITY HALL WHEREAS, the Gloversville Police Department held a bid opening on June 09, 2016 and received the following bids regarding the purchase of a security camera system: Adirondack Cabling, Inc. $22, (D/B/A Adirondack Security) Steven Wood Security Consulting LLC $25, SHI International Corp. $40, WHEREAS, Adirondack Cabling, Inc. was determined to be the lowest qualified bidder. RESOLVED, that the purchase of a security camera system is hereby awarded to Adirondack Cabling, Inc. (D/B/A Adirondack Security) for the bid price of $22,958.73; and BE IT FURTHER RESOLVED, the Commissioner of Finance is hereby authorized to execute all necessary purchase documents to effectuate this purchase. 7

8 Resolution Intro R-3 presented the following Resolution and moved its adoption: RESOLUTION TO AUTHORIZE THE COMMISSIONER OF FINANCE TO UTILIZE $9,000 FROM THE HH FUND FOR THE LABOR PORTION OF THE CITY HALL SECURITY CAMERA SYSTEM WHEREAS, the Gloversville Police Department held a bid opening on June 09, 2016 for the City Hall Security Camera System, and WHEREAS, Adirondack Cabling, Inc. (D/B/A Adirondack Security) was determined to be the lowest qualified bidder at $22,958.73, and WHEREAS, the Fulton County Fire Coordinator/Civil Defense will be covering the approximate cost of materials of $14,000, and WHEREAS, the labor for installation and warranty is approximately $9,000 for which the City will be responsible. RESOLVED, that the Common Council approves utilizing up to $9,000 of the HH Fund for the labor portion of the City Hall Security Camera System. 8

9 Resolution Intro R-4 presented the following Resolution and moved its adoption: RESOLUTION AUTHORIZING THE COMMISSIONER OF FINANCE TO EXECUTE A BUDGET MODIFICATION RELATED TO A REIMBURSEMENT CHECK FROM FULTON COUNTY FOR POLICE STOP DWI PATROLS WHEREAS, the Police Department has received a check totaling $3, from Fulton County for reimbursement for Stop DWI Patrols, and WHEREAS, the Commissioner of Finance would like to make budget modifications increasing the following accounts: A2626 Police Revenue $3, A Police-DWI Overtime $3, RESOLVED, that the Common Council authorizes the Commissioner of Finance to make budget modifications in the above referenced accounts. 9

10 Resolution Intro R-5 presented the following Resolution and moved its adoption: RESOLUTION AUTHORIZING THE GLOVERSVILLE POLICE DEPARTMENT TO AUCTION BICYCLES DURING THE NATIONAL NIGHT OUT WHEREAS, the Police Department is hosting National Night Out on August 02, 2016, and WHEREAS, the Police Department would like to auction bicycles held at City Hall, and WHEREAS, all proceeds from the auction will be deposited in the HG Fund Recreation. RESOLVED, that the Common Council hereby authorizes the Gloversville Police Department to auction bicycles held at City Hall during National Night Out. 10

11 Resolution Intro R-6 Simonds presented the following Resolution and moved its adoption: RESOLUTION AUTHORIZING THE POLICE CHIEF TO EXECUTE A PROPOSAL FOR A TRAFFIC SAFETY ASSESSMENT WITH CREIGHTON MANNING ENGINEERING, LLP WHEREAS, the Gloversville Police Department is desirous to have a traffic calming and safety assessment completed for South Kingsboro Avenue, and WHEREAS, the goal of the study is to develop a plan to improve pedestrian access and safety in this area in conformance with current engineering guidelines, and WHEREAS, Creighton Manning Engineering, LLP has submitted the attached proposal. The attached proposal will not exceed $4,900, which includes direct expenses, and WHEREAS, the attached Proposal has been reviewed and approved by the City Attorney. RESOLVED, that the Common Council authorizes the Police Chief to execute the attached proposal with Creighton Manning Engineering, LLP. Smith 11

12 Resolution Intro R-7 presented the following Resolution and moved its adoption: RESOLUTION AUTHORIZING THE COMMISSIONER OF FINANCE TO EXECUTE A BUDGET MODIFICATION RELATED TO AN INSURANCE CHECK FOR POLICE VEHICLE DAMAGE WHEREAS, the Police Department is has received a check totaling $1, from New York Municipal Insurance Reciprocal (NYMIR) for damages to police vehicle #3491 that occurred on February 26, 2016, and WHEREAS, the Commissioner of Finance would like to make budget modifications increasing the following accounts: A2680 Insurance Recovery Our Carrier $1, A Police Repairs Insurance Recovery $1, RESOLVED, that the Common Council authorizes the Commissioner of Finance to make budget modifications in the above referenced accounts. 12

13 Resolution Intro R-8 presented the following Resolution and moved its adoption: RESOLUTION AUTHORIZING THE REMOVAL OF THE ACCOUNTS RECEIVABLES FOR 2016 TAX BILLS AND ACCOUNTS RECEIVABLES CHARGES ON 2016 COUNTY TAX FORECLOSURE/DEMO PROPERTIES WHEREAS, the attached list of properties were foreclosed upon by Fulton County for unpaid taxes, and WHEREAS, the total Account Receivable monies from 2016 City tax bills and open Account Receivables invoices totals $21, for those properties, and WHEREAS, pursuant to the terms of the Agreement between the City of Gloversville and the County of Fulton, the City of Gloversville will not recover the above referenced invoices and should be removed from City of Gloversville s Accounts Receivables. RESOLVED, that the Common Council authorizes the Commissioner of Finance to remove the Accounts Receivables and 2016 tax bills for the attached list of properties. 13

14 Resolution Intro R-9 presented the following Resolution and moved its adoption: RESOLUTION AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF GLOVERSVILLE AND THE FULTON COUNTY PLANNING DEPARTMENT FOR PLANNING SERVICES IN 2017 WHEREAS, the City desires the County to provide services from the County Planning Department during 2017 for the amount of $3,000. RESOLVED, that the Common Council hereby authorizes the Mayor to execute an Agreement with the County Planning Department for year 2017 Planning Services. 14
