1 Ref.: MENDELU 8266/ Faculty of Business and Economics, MENDELU Rules of Election of Academic Senate of Faculty Pursuant to Section 27 (1) (b) of Act no 111/1998 Coll., on Higher Education Institutions, amending other acts (Higher Education Act), as amended, the Academic Senate of the Faculty of Business and Economics, Mendel University in Brno, agreed on the following Rules of Election of the Academic Senate of the Faculty of Business and Economics, MENDELU as its internal bylaw. Art 1 Initial Provisions (1) The document of Rules of Election of the Academic Senate of the Faculty of Business and Economics, Mendel University in Brno (hereinafter Rules of Action ) is issued on the basis of Section 33 (2) (b) of Act no 111/1998 Coll., on Higher Education Institutions, amending other acts (Higher Education Act (hereinafter the Act ). (2) The Academic Senate of the Faculty of Business and Economics of Mendel University in Brno (hereinafter the Senate ) is the self-governing body of the Faculty of Business and Economics of Mendel University in Brno (hereinafter the Faculty ), pursuant to Section 25 (1) (a) of the Act. (3) The basic principles of the Rules of Election are based, inter alia, on Section 26 et seq. of the Act. The number of members and representatives of academic staff and students are specified by the Faculty Statute (hereinafter the Statute ). (4) The elections to the Senate, its establishment and activities are governed by the Law, the Statute and these Rules. Art 2 Election Rules and Progress (1) Election to the Senate is announced by the Senate Chairman at least 60 days before the current Senate term of office ends. Failing to do so the election is announced by the dean. The election announcement must include a framework schedule of the voting process. The election announcement must include accurate specification of the elected Senate term of office. (2) Senate election consists of the proposal round and the election round. (3) Each member of the academic community of the Faculty may vote and be elected within the electorate the member list of which he is entered in. (4) The senate is elected by secret ballot. Academic community members must vote in person and cannot be substituted. (5) The proposal card and the voting list is received by the voters in the place of the election against signature in the attendance sheet and submission of the identity card for proof of identity. (6) The proposal cards and the voting slips may only be edited in the voting rooms specified by the election committee which the votes enter individually and in the manner specified by the election committee to be valid. 2 Rules of Election, Academic Senate, Faculty of Business and Economics, MENDELU 2/5 (7) Pre-election meetings may be held at the Faculty, but only outside the days of the proposal round and the election round. Pre-election campaign may not take place in the lecture time and in the election rooms. (8) Any voter may file a complaint against preparation, progress and results of the vote to the senate with the election committee within three calendar days from the election result publication for the respective round. The complaint must be in writing and must give and document the reason(s) for the complaint. The election committee shall assess validity of the vote in five business days from the complaint receipt. The text of the complaint and the decision with justification must be published. Art 3 Election Committee (1) For the purpose of the election organisation and management an election committee is appointed. The senate meeting elects the election committee and members in a way assuring that each electorate and the senate are represented by at least one election committee member each. The election committee must have at least three members. (2) The election committee must public the accurate schedule of the election at least seven calendar days before commencement of the proposal round, including specification of the voting rooms. (3) The election committee, in cooperation with the Faculty secretary, shall prepare the room for the election, the urn, the screen and the proposal cards and voting lists. (4) The election committee is responsible for due progress of the election. For that purpose the voting urns must be properly sealed and supervised by at least two members of the faculty academic community, or safely stored overnight, the candidate cards and the voting lists must be duly distributed and the act of election must be duly carried out. (5) At the end of the election the election committee shall evaluate the round, compile the election result protocol without undue delay and publish it. (6) After election closing the election committee chairman shall submit complete election documentation including the proposal cards and the voting lists to the senate secretary in sealed envelopes. (7) For the purpose of the election organisation in the electorates further members of the Faculty academic community may be invited to assist. Art 4 Voting Lists (1) For the purpose of election to the Senate there are two electorates at the Faculty, one of the academic staff and the other for the students. (2) On request of the election committee chairman the dean shall prepare the list of the Faculty academic staff and the list of the Faculty students as of the governing date and submit it to the election committee chairman. (3) The lists of members of the electorates are published for the academic community at least seven calendar days before the proposal round of the election is commenced. The chairman of the election committee is responsible for the list publication. (4) The members of the academic community of the Faculty who are at the same time Faculty students shall be asked by the election committee to state in writing which electorate he/she wants to be included in for the purpose of the given election. In the case of failure to submit the written statement within the specified deadline the individual will be included in the academic staff electorate. (5) The lists of electorate members shall be valid throughout the election period for maximum 45 days from their publication by the election committee. Art 5 Proposal Round and Candidate List Compilation (1) Every member of the Faculty academic community with voting right may submit proposed candidates in the number of the electable positions in the electorate he/she is member of.

3 Rules of Election, Academic Senate, Faculty of Business and Economics, MENDELU 3/5 (2) The list of candidates shall include the candidates with the highest numbers of votes in the proposal round for the number of candidates to be double the number of senate seats to be elected. The candidate lists may only include the candidates submitting their written approval with inclusion in the list. In the case of equality of votes for more than one candidate in the proposal round in the lowest eligible rank for inclusion in the list then all such candidates shall be listed. (3) The election committee is responsible for compilation and publication of the candidate lists for both electorates. The candidate lists for both electorates must be published for the academic community at least 5 calendar days before the election round date. Art 6 Election Round and Election Results (1) In the election round the voters may only give their votes to the number of candidates equal to the number of the senate seats to be elected. The election is performed by checking the selected candidates in the voting list which is ordered alphabetically. (2) Elected senate members include: a) Ten members of academic staff with the highest numbers of votes in the election round, b) Five students with the highest numbers of votes in the election round. (3) A draw decides about the order of candidates with the equal numbers of votes. (4) If the needed number of senate members is not elected in either of the electorates then another election, including the proposal round, is held. These Election Rules apply accordingly to the second election. (5) The senate candidates not elected but obtaining valid votes of at least 30% of the attending voters of the respective electorate are entered in the list of substitute senate members in the descending order by their numbers of received votes. In the case of equality of votes a draw shall decide about the order. The substitute lists are part of the published election results. (6) The results of the senate election are announced by the election committee to the chairman of the Senate in three calendar days after the election closing. The Senate chairman shall provide for publication of the election results in three calendar days from their receipt. Art 7 Senate Membership, Its Suspension and Termination (1) Senate membership is incompatible with the positions of rector, deputy rector, bursar, dean, deputy dean, secretary, university institute director and his deputy. (2) Senate membership may be suspended to a member expecting temporary impossibility to duly perform the function of senate member in the length exceeding three months. The membership suspension must be notified to the senate chairman by the suspending senate member in writing. Suspension of the senator function is effective from the date given in the notification and/or from the eighth calendar day after the notification delivery to the chairman, whichever comes earlier. (3) The suspension termination must be notified to the Senate chairman in writing, unless the exact date of the suspension termination has been notified in the suspension notification. The termination of the senator function suspension is effective from the date specified in the notification of the suspension termination and/or from the eighth calendar day after the suspension termination notification delivery to the chairman, whichever comes earlier. (4) Suspension of senate membership does not suspend the senator s term of office. (5) Senate membership shall not be terminated for a student senate member who notifies the senate chairman on or before termination or suspension of the last active course at the faculty that he/she is included in the admission proceeding for study at the Faculty and wants to be enrolled. Senate membership is then just suspended from the date of the last course termination to the date of enrolment of the next course at the Faculty. In the case of non-enrolment within 4 months from termination or suspension f the last course at the Faculty the senate membership of that student shall be terminated as at that date. The senate membership shall also be terminated on vain elapse of the enrolment period as at the last day of the period.

4 Rules of Election, Academic Senate, Faculty of Business and Economics, MENDELU 4/5 (6) If the number of senate members from either electorate drops below the number defined by the Statute then the missing senate seats are filled by the substitutes. In the case of membership suspension the substitute with the lowest sequential number in the current list of substitutes becomes temporary senate member. In the case of senate membership termination the substitute or temporary senate member with the lowest sequential number in the current list of substitutes in the list becomes senate member. (7) The substitute becoming senate member must be informed about this fact by the Senate chairman without undue delay. (8) In the case of the empty list of substitutes additional election must be held. These Rules of Election shall apply accordingly. (9) Senate membership is terminated: a) By elapse of the term of office; b) For the reason of incompatibility with the function pursuant to section 1 on the day of appointment to the incompatible function; c) By loss of membership in the respective electorate except for the situation specified in Art. 7 (5) n the date of termination of membership in the electorate; d) By resignation on the day of delivery of the written resignation to the Senate chairman; e) For the reasons defined in Section 14 (3) (c) and (e) of the Act related to senate members. (10) The term of office of all senate members is terminated if the senate does not act incompliance with the law for six months. In such case the dean announces a new senate election in 30 days from this date, appointing the election committee and its chairman according to these Rules, not considering the condition of senate membership in this case. The obligations of the senate chairman and the senate secretary in connection with the election shall be performed by the dean in this case. (11) Substitute lists are annulled as at the end of the related senate term of office. (12) Any changes in the senate composition shall be announced by the chairman at the beginning of the next senate meeting and entered in the minutes of the meeting. Art 8 Final Provisions (13) As long as these Rules of Election require publication the manner chosen must allow for remote access. (14) As of the effectiveness date hereof the Rules of Election and the Rules of Action of the Faculty senate of 19 April 2010 are hereby cancelled and replaced.
